Angiosarcoma is a rare cancer of blood vessel–forming cells with a high patient mortality and few treatment options. Although chemotherapy often produces initial clinical responses, outcomes remain poor, largely due to the development of drug resistance. We previously identified a subset of doxorubicin-resistant cells in human angiosarcoma and canine hemangiosarcoma cell lines that exhibit high lysosomal accumulation of doxorubicin. Hydrophobic, weak base chemotherapeutics, like doxorubicin, are known to sequester within lysosomes, promoting resistance by limiting drug accessibility to cellular targets. Drug synergy between the beta adrenergic receptor (β-AR) antagonist, propranolol, and multiple chemotherapeutics has been documented in vitro, and …

Hurricane Irma Induces Divergent Behavioral And Hormonal Impacts On An Urban And Forest Population Of Invasive Anolis Lizards: Evidence For An Urban Resilience Hypothesis, Haralambos Fokidis, Taylor Brock

Faculty Publications

Hurricanes can have both profound short-term effects on animal populations and serve as long-term drivers of evolutionary change. Animals inhabiting varying habitats may differ in their response to hurricane impacts. Increasing evidence sug- gests that animals from urban areas exhibit different behavioral and physiological traits compared to rural counterparts, in- cluding attenuated hormonal stress responses and a lowered propensity for flight behavior. A unique opportunity was pre- sented when Hurricane Irma hit Florida on 10 September 2017 and interrupted a study of invasive brown anoles (Anolis sagrei) at an urban and a forest. Using data collected before and after Hurricane …

How Different Esg Factors Across Cultures Affect Financial Performance, Matej Susec, Marc Sardy

Faculty Publications

This paper examines the financial performance of publicly traded companies based on their ESG factors’ specific commitment across different cultures. Using ESG ratings from HIP Investor Inc. on companies the agency evaluates and cultural dimensions as defined by Geert Hofstede, the average stock return of companies was compared to countries’ main stock indexes. The results show that the majority of the analyzed combinations of ESG factors and cultural dimensions outperformed the main stock indexes between the years 2016 and 2020. Moreover, it seems that for ESG committed companies, culture plays a role in ESG practices as well as financial performance.

Faculty Publications

The Taxodium hybrid ‘Zhongshanshan 406’ (T. hybrid ‘Zhongshanshan 406’) [Taxodium mucronatum Tenore × Taxodium distichum (L.). Rich] has an outstanding advantage in flooding tolerance and thus has been widely used in wetland afforestation in China. Alcohol dehydrogenase genes (ADHs) played key roles in ethanol metabolism to maintain energy supply for plants in low-oxygen conditions. Two ADH genes were isolated and characterized—ThADH1 and ThADH4 (GenBank ID: AWL83216 and AWL83217—basing on the transcriptome data of T. hybrid ‘Zhongshanshan 406’ grown under waterlogging stress. Then the functions of these two genes were investigated through transient expression and overexpression. The results showed that the …

Values And Other Decisional Factors Regarding Treatment Of Hypercalcaemia Of Malignancy: A Systematic Review Protocol, Aya Bassatne, Maya Rahme, Thomas Piggott, Hassan Murad, Layal Hneiny, Ghada El-Hajj Fuleihan

Faculty Publications

Introduction Hypercalcaemia of malignancy (HCM) is the second most common cause of hypercalcaemia and is associated with significant morbidity and mortality. Several treatment options are available including pharmacological therapy with bisphosphonates, denosumab, glucocorticoids and calcimimetics, as well as conventional therapy with hydration and possibly calcitonin. While guidelines have previously considered treatment effects, no guideline has yet considered a range of contextual factors impacting recommendations for the management. The aim of this study was to summarise the available evidence on important decisional factors for the development of guidelines for the treatment of HCM. These include patient’s values and preferences, cost, acceptability, …

No More Old Boys’ Club: Institutional Investors’ Fiduciary Duty To Advance Board Gender Diversify, Anat Alon-Beck, Michal Agmon-Gonnen, Darren Rosenblum

Faculty Publications

As the benefits of gender equality for governance become more apparent, boardroom diversity initiatives abound. At the same time, institutional investors play an increasingly central role in the corporate world. This Article takes a novel approach to achieve this necessary change. Institutional investors already oversee firm leadership quite closely. This Article suggests that institutional investors hold a fiduciary duty to ensure there is gender diversity in leadership. As objections to state mandates persist, institutional investors can bring the benefits of private ordering to play a central role in ensuring equality.

Institutional investors play a dominant role over firms as principal …

A Salt Cap Workaround That Works? Notice 2020-75, Erik M. Jensen Jan 2021

A Salt Cap Workaround That Works? Notice 2020-75, Erik M. Jensen

Faculty Publications

In November 2020, after the election was over, in form at least, the Treasury and the IRS issued Notice 2020-75, announcing that proposed regulations will be issued governing the treatment of new state laws that impose income taxes on what are passthrough entities for federal income tax purposes. Those laws are clearly intended to provide a way to circumvent the cap on the deductibility of state and local taxes (SALT) included in the Tax Cuts and Jobs Act of 2017, and the Notice is very taxpayer friendly in its understanding of these arrangements. This article considers the particulars and the …

Free Speech & Abortion: The First Amendment Case Against Compelled Motherhood, Raymond Shih Ray Ku Jan 2021

Free Speech & Abortion: The First Amendment Case Against Compelled Motherhood, Raymond Shih Ray Ku

Faculty Publications

The most important lessons are taught by example. Children learn the fundamental values that guide them throughout their lives from the examples set by their parents, especially their mothers. Even before they understand a language, they learn by observing and imitating the actions of their parents. For almost fifty years Roe v Wade guaranteed pregnant women the freedom to determine whether to carry their pregnancy to term. The right to obtain a safe abortion prior to viability is the most significant and controversial aspect of this freedom. The Supreme Court is now poised to overturn what it previously described as …

Developments Affecting Intercollegiate Athletics And Taxation, Erik M. Jensen

Faculty Publications

Developments affecting whether some college athletic teams will be subject to the unrelated business income tax (UBIT) continue and may be accelerating. This article describes the relevant events over the past decade or so, and focuses on new rules generally permitting college athletes to benefit financially from marketing their names, images, and likenesses (NILs), and on the Supreme Court’s 2021 decision in National Collegiate Athletic Association v. Alston. Alston wasn’t a tax case, but what the Court said about the application of the Sherman Antitrust Act to the NCAA’s limitations on providing college athletes with education-related benefits seems to call …

The Legal And Administrative Risks Of Climate Regulation, Jonathan Adler Jan 2021

The Legal And Administrative Risks Of Climate Regulation, Jonathan Adler

Faculty Publications

Dramatic and rapid reductions in greenhouse gas emissions are necessary to stabilize atmospheric concentrations of greenhouse gases (GHGs) at acceptable levels. Prioritizing federal environmental regulation as the primary means of achieving these goals may be a strategic mistake. Regulatory mandates, particularly if based upon existing statutory authority, will be vulnerable to legal attack, obstruction, and delay. Climate legislation can reduce the legal risks and accelerate the rate of policy implementation, but only on the margin. Adopting regulatory controls, sector-by-sector, technology-by-technology will be immensely resource intensive for the EPA and other federal agencies. Even with authorizing legislation, federal regulatory strategies may …

A Paradigm Shift In Comparative Institutional Governance: The Role Of Contract In Business Relationships And Cost/Benefit Analysis, Juliet P. Kostritsky Jan 2021

A Paradigm Shift In Comparative Institutional Governance: The Role Of Contract In Business Relationships And Cost/Benefit Analysis, Juliet P. Kostritsky

Faculty Publications

Stewart Macaulay’s research on the ways that Wisconsin manufacturers transact debunked the centrality of contract law by revealing a disinclination to consult contract documents or invoke legal sanctions. This research revolutionized contracts scholarship, highlighting that a contract, instead of being viewed as an inevitable necessity of exchange, should be viewed as one of many institutions that might be available to parties as a solution to problems and a method for facilitating exchange. Macaulay’s research further revealed that the cost of legal sanctions, the importance of maintaining business relationships, and the desire for informal solutions actually push parties to conclude that …

When Can Taxpayers Invoke The Substance-Over-Form Doctrine?, Erik M. Jensen Jan 2021

When Can Taxpayers Invoke The Substance-Over-Form Doctrine?, Erik M. Jensen

Faculty Publications

This article considers the circumstances under which taxpayers can disavow the form of a transaction they enter in order to claim better tax consequences based on the substance of the transaction. In some situations, the disavowal is noncontroversial because the Internal Revenue Service has blessed the transactions. In a few situations where the Service resists, however, taxpayers are sometimes successful anyway. The focus of the article is on the Tax Court’s 2021 decision in Complex Media, Inc. v. Commissioner, and substantial discussion is devoted to the Third Circuit’s well-known, and sometimes controversial, 1967 decision in Commissioner v. Danielson.

News Flash: Pay Your Federal Income Taxes; The Sixteenth Amendment Was Properly Ratified, Erik M. Jensen Jan 2021

News Flash: Pay Your Federal Income Taxes; The Sixteenth Amendment Was Properly Ratified, Erik M. Jensen

Faculty Publications

The idea got around years ago—and it’s still around in tax-protester circles—that the Sixteenth Amendment wasn’t properly ratified and therefore that no legal obligation exists to pay federal income taxes. Wrong! The Amendment process was sloppy, but nothing happened that calls the legitimacy of the Amendment into question, particularly since the relevant officials considered the ratification issues in 1913, when the Amendment was formally adopted.

Payment For Ecosystem Services: Rewarding The Landowner Who Conserves The Public Good, Steven H. Bullard, Sarah Fuller

Faculty Publications

It has been said that money doesn’t grow on trees, but any forest landowner or manager will tell you that’s not exactly true— especially when observing a harvesting operation or managing dues from your hunting lease. While timber production and recreation are the most frequently monetized services provided by forests, what about the other goods and services they provide on a continuing basis? Are you or other forest landowners in your area being monetarily rewarded for soil stability, flood control, water filtration, air quality, and the other critical services—known as ecosystem services—provided by forests?

Buddhas And Body Language: The Literary Trope Of The Buddha's Smile, David Fiordalis Jan 2021

Buddhas And Body Language: The Literary Trope Of The Buddha's Smile, David Fiordalis

Faculty Publications

This essay explores how classical Buddhist literature, across a variety of traditional genres, portrays the wondrous smile of the Buddha. Despite its literary register, the Buddha’s smile is first and foremost a nonverbal gesture, and if we are to understand its significance, then we must employ a theoretical approach that treats it as such. Multimodality provides such an approach. While an emergent body of psychological research has argued that the smile is a universal human gesture connected to a rather limited set of emotional states like happiness, the recognition that smiles can be voluntary acts highlights the importance of situational …

Los Budas Y El Lenguaje Corporal: El Tropo Literario De La Sonrisa Del Buda, David Fiordalis Jan 2021

Los Budas Y El Lenguaje Corporal: El Tropo Literario De La Sonrisa Del Buda, David Fiordalis

Faculty Publications

Progress On Research Regarding Ecology And Biodiversity Of Coastal Fisheries And Nektonic Species And Their Habitats Within Coastal Landscapes, Mark S. Peterson, Michael J. Andres Jan 2021

Progress On Research Regarding Ecology And Biodiversity Of Coastal Fisheries And Nektonic Species And Their Habitats Within Coastal Landscapes, Mark S. Peterson, Michael J. Andres

Faculty Publications

This paper aims to highlight the new research and significant advances in our understanding of links between coastal habitat quality/quantity/diversity and the diversity of fisheries species and other mobile aquatic species (hereafter nekton) that use them within coastal landscapes. This topic is quite diverse owing to the myriad of habitat types found in coastal marine waters and the va-riety of life history strategies fisheries species and nekton use in these environments. Thus, we focus our mini-review on five selective but relevant topics, habitat templates, essential fish habitat, habitat mosaics/habitat connectivity, transitory/ephemeral habitat, and the emerging/maturing approaches to the study of …

Estuarine Oiling Increases A Long-Term Decline In Mussel Growth*, R. Eugene Turner, Jennifer S. Spicer Jan 2021

Estuarine Oiling Increases A Long-Term Decline In Mussel Growth*, R. Eugene Turner, Jennifer S. Spicer

Faculty Publications

The ribbed mussel, Geukensia granosissima, cycles nutrients, contributes to soil stability, and can be a major component of predator-prey communities in salt marshes. Mussels were exposed to the 2010 Deepwater Horizon oil spill in the Gulf of Mexico, and salt marshes remain contaminated eight years later. We hypothesized that the oiled mussels had reduced annual growth, altered population size frequency, and perhaps changed valve morphometrics. We sampled 10 marshes near Port Sulphur, LA, to measure the morphometrics of 133 mussels and their age-specific growth rate, and also the marsh oil content and percent vegetative cover. The relationships between valve weight, …

Phosphorus Concentrations Into A Subtropical Lake Strongly Influence Nitrogen Accumulation, Nitrogen Export, And Chl A Concentrations, R. Eugene Turner, J M. Lee, C S. Milan, E M. Swenson Jan 2021

Phosphorus Concentrations Into A Subtropical Lake Strongly Influence Nitrogen Accumulation, Nitrogen Export, And Chl A Concentrations, R. Eugene Turner, J M. Lee, C S. Milan, E M. Swenson

Faculty Publications

We measured water quality monthly for 22 years in water entering, within, and exiting a 65 km(2) shallow polymictic and eutrophic freshwater lake in the northern Gulf of Mexico. Fertilizer use in the watershed is the dominate source of phosphorous (P) going into the lake and controls the lake's P concentrations, but nitrogen (N) fertilizer use was not related to total nitrogen concentration in the lake. Half of the particulate P entering the lake is trapped within it and there is a net accumulation of N that appears to be from the stimulation of nitrogen fixation. The lake's concentration of …

Characterization Of Common Phytoplankton On The Louisiana Shelf, M L. Parsons, A L. Brandt, R. Eugene Turner, W L. Morrison, M L. Parsons

Faculty Publications

Phytoplankton and accompanying environmental data (temperature, salinity, secchi depth, stratification, and inorganic nutrients) were analyzed from 672 surface water samples (0 to 1.5 m depth) collected from 95 stations located on the Louisiana shelf between April 1990 and August 2011. Phytoplankton were identified to the lowest practical taxonomic unit from glutaraldehyde-preserved samples using epifluorescent microscopy and reported as cells L-1. Twenty-six phytoplankton taxa (primarily diatoms) that were 8 mu m in size, identified to genuslevel resolution and ranked in the top 20 in at least one of three separate categories (average abundance; frequency of occurrence; and bloom frequency) were used …

Declining Bacteria, Lead, And Sulphate, And Rising Ph And Oxygen In The Lower Mississippi River, R. Eugene Turner Jan 2021

Declining Bacteria, Lead, And Sulphate, And Rising Ph And Oxygen In The Lower Mississippi River, R. Eugene Turner

Faculty Publications

Various air and water pollution issues in the US were confronted in the last 60 years using national policy legislation, notably the Clean Water Act and the Clean Air Act. I examine changes in the concentrations of bacteria, oxygen, lead, and sulphate at the terminus of the Mississippi River before and after these pollution abatement efforts. Microbial concentrations increased or were stable from 1909 to 1980 but decreased about 3 orders of magnitude after the 1970s, while the average oxygen content increased. A large decline in lead concentration occurred after the 1960s, along with a less dramatic decline in sulphate …

Faculty Publications

Climate change is altering naturally fluctuating environmental conditions in coastal and estuarine ecosystems across the globe. Departures from long-term averages and ranges of environmental variables are increasingly being observed as directional changes [e.g., rising sea levels, sea surface temperatures (SST)] and less predictable periodic cycles (e.g., Atlantic or Pacific decadal oscillations) and extremes (e.g., coastal flooding, marine heatwaves). Quantifying the short- and long-term impacts of climate change on tidal marsh seascape structure and function for nekton is a critical step toward fisheries conservation and management. The multiple stressor framework provides a promising approach for advancing integrative, cross-disciplinary research on tidal …

Salt Marsh Elevation Limit Determined After Subsidence From Hydrologic Change And Hydrocarbon Extraction, R. Eugene Turner, Yu Mo Jan 2021

Salt Marsh Elevation Limit Determined After Subsidence From Hydrologic Change And Hydrocarbon Extraction, R. Eugene Turner, Yu Mo

Faculty Publications

Levee construction aboveground and hydrocarbon removal from belowground in coastal wetlands can create hydrologic changes that increase plant stress through flooding. But the significance of the subsidence they cause individually or in combination is contested. This study untangled them to demonstrate elevational limits of salt marshes by studying dredged and natural waterways in two salt marshes in Louisiana, USA. The areas had a homogenous plant cover before drilling for oil and gas extraction peaked in the 1960s, and now are a mixed network of natural waterways and dredged canals used to drill wells with an average drill date of 1965.8 …

Marginal Warming Associated With A Covid-19 Quarantine And The Implications For Disease Transmission, P. W. Miller, C. Reesman, M. K. Grossman, S. A. Nelson, V. Liu, P. Wang

Faculty Publications

During January-February 2020, parts of China faced restricted mobility under COVID-19 quarantines, which have been associated with improved air quality. Because particulate pollutants scatter, diffuse, and absorb incoming solar radiation, a net negative radiative forcing, decreased air pollution can yield surface warming. As such, this study (1) documents the evolution of China's January-February 2020 air temperature and concurrent particulate changes; (2) determines the temperature response related to reduced particulates during the COVID-19 quarantine (C19Q); and (3) discusses the conceptual implications for temperature-dependent disease transmission. C19Q particulate evolution is monitored using satellite analyses, and concurrent temperature anomalies are diagnosed using surface …
