The COVID-19 pandemic led to unprecedented closures of national borders and the withdrawal of much of the social and cultural activities of society into the walls of the home. For us, educators focused on global engagement and analyzing international law and society, the abrupt retreat into the shelter of domestic walls disrupted the very subjects we were studying-inside and outside the classroom. The U.S. Constitution grants the federal government plenary power over American Indian affairs, yet states are increasingly attempting to assert regulatory and tax jurisdiction over tribal businesses. This overreach threatens tribal sovereignty and contravenes the terms of treaties entered between the United States and American Indian tribes. This Article begins by examining the legal foundations of federal, state, and tribal relations. It then examines recent cases across four business sectors - gaming, tobacco sales, petroleum sales, and online lending - in order to illustrate the pervasive jurisdictional challenges faced by courts in cases involving tribal businesses. Declaring, Exploring, Instructing, And (Wait For It) Joking: Tonal Variation In Majority Opinions, Lisa A. Eichhorn

British literary critic I.A. Richards once defined “tone” as a literary speaker’s attitude toward his or her listener. Borrowing that definition, this article posits that the genre of the majority judicial opinion leaves more room for tonal variation than many scholars have previously theorized. The article first elaborates on the concept of “tone,” distinguishing it from “voice” and “style.” It then reviews the existing scholarship on tone in legal writing and describes the specific dynamics of tone in majority opinions. The Tax Cuts and Jobs Act was the most significant tax law in more than three decades, but the strategy for getting it enacted included a variety of maneuvers to avoid public scrutiny. As a result, many taxpayers did not know how they would be affected until they filed their own tax returns more than a year later. This Article identifies this lack of transparency as part of a persistent pathology of avoiding and constraining democratic inputs and responsiveness in U.S. federal tax lawmaking. Brian Frye's Right of Reattribution proposes a mechanism for loosening the strictures of attribution associated with creative works of authorship and giving the law of attribution a pro-property spin. Authors regularly receive attribution recognizing their authorship role. Frye transforms this norm of attribution into a fully alienable property right. An author would receive original rights of attribution, but those rights could then be sold or transferred to another person seeking accolades. This secondary transfer process is knows as reattribution. The observation of 236 MeV muon neutrinos from kaon-decay-at-rest (KDAR) originating in the core of the Sun would provide a unique signature of dark matter annihilation. Since excellent angle and energy reconstruction are necessary to detect this monoenergetic, directional neutrino flux, DUNE with its vast volume and reconstruction capabilities, is a promising candidate for a KDAR neutrino search. In this work, we evaluate the proposed KDAR neutrino search strategies by realistically modeling both neutrino-nucleus interactions and the response of DUNE. Maternal malnutrition gives rise to both short- and long-term consequences for the survival and health of the offspring. As the intermediary between mother and fetus, the placenta has the potential to interpret environmental signals, such as nutrient availability, and adapt to support fetal growth and development. While this potential is present, it is clear that at times placental adaptation fails to occur resulting in poor pregnancy outcomes. Induced resistance provides protection in plants against insect herbivores. Silicon and mycorrhizae often prime plant defenses and thereby enhance plant resistance against herbivores. In rice, Oryza sativa L., insect injury has been shown to induce resistance against future defoliators. However, it is unknown if silicon and mycorrhizae treatments in combination with insect injury result in greater induced resistance. Members of the insect ATP binding cassette transporter subfamily C2 (ABCC2) in several moth species are known as receptors for the Cry1Ac insecticidal protein from Bacillus thuringiensis (Bt). Mutations that abolish the functional domains of ABCC2 are known to cause resistance to Cry1Ac, although the reported levels of resistance vary widely depending on insect species. In this study, the function of the ABCC2 gene as a putative Cry1Ac receptor in Helicoverpa zea, a major pest of over 300 crops, was evaluated using CRISPR/Cas9 to progressively eliminate different functional ABCC2 domains. We provide a new generalization of a recent trajectory-based approach for proving global asymptotic stability properties, using new sup-delay inequalities. Our generalization eliminates the usual contractivity requirement from previous sup-delay inequality approaches. We show how the requirements of our generalization hold under less restrictive Halanay's conditions than those that were previously reported. While the usual Halanay's inequality requires the decay rate to exceed the gain, our less restrictive conditions allow the gain to exceed the decay rate. We apply our work to systems with switching delays and to a continuous-discrete system.

Rivers and streams play a central role in global carbon budget, but our knowledge is limited on the magnitude and extent of urbanization influence on riverine methane (CH4) dynamics. In this study, we investigated dissolved CH4 (dCH4) concentration and CH4 diffusive fluxes in 27 river segments of two 4th-order and three 3rd-order tributary rivers to the Yangtze River in China, which drained land areas with varied urbanization intensities. We found that urban development was the key factor responsible for high fluvial dCH4 concentration and diffusive flux, exceeding the influence of agricultural farming, and these headwater rivers were over-saturated in CH4 …

In 2010, the Deepwater Horizon oil spill released an estimated 4.9 million barrels of oil into the Gulf of Mexico, damaging coastal ecosystems. Seaside Sparrows (Ammospiza maritima)—a year-round resident of Gulf Coast salt marshes—were exposed to oil, as shown by published isotopic and molecular analyses, but fitness consequences have not been clarified. We monitored nests around two bays in Plaquemines Parish, Louisiana, USA from 2012–2017 to assess possible impacts on the nesting biology of Seaside Sparrows. A majority of nests failed (76% of known-fate nests, N = 252 nests, 3521 exposure-days) during our study, and predation was the main cause …

In this work, we present and analyze a mathematical model for tumor growth incorporating ECM erosion, interstitial flow, and the effect of vascular flow and nutrient transport. The model is of phase-field or diffused-interface type in which multiple phases of cell species and other constituents are separated by smooth evolving interfaces. The model involves a mesoscale version of Darcy's law to capture the flow mechanism in the tissue matrix. In this work, we present a coupled 3D–1D model of solid tumor growth within a dynamically changing vascular network to facilitate realistic simulations of angiogenesis. Additionally, the model includes erosion of the extracellular matrix, interstitial flow, and coupled flow in blood vessels and tissue. We employ continuum mixture theory with stochastic Cahn–Hilliard type phase-field models of tumor growth. The interstitial flow is governed by a mesoscale version of Darcy's law. This study determined the carcass yields of red hartebeest from Namibia and compared the physical-chemical meat quality characteristics of six different muscles (biceps femoris, infraspinatus, longissimus thoracis et lumborum, semimembranosus, semitendinosus, and supraspinatus) for both males and females. Red hartebeest males were heavier (133.92 kg) than females (114.20 kg) but the average dressing percentage did not differ between the two sexes. Muscles from females had a lower mean shear force value of 3.59 kg/1.27 cm ø, compared to males (4.23 kg/1.27 cm ø). The United States is one of the largest catfish producers in the world. Louisiana is the leading producer of wild-caught catfish. Historically, the U.S. Food and Drug Administration inspected all seafood products; however, in 2008, Congress moved the inspection of fish in the order Siluriformes to the U.S. Department of Agriculture (USDA), Food Safety and Inspection Service. Full enforcement of the rule began on 1 September 2017. This paper analyses X-ray observations by the Chandra X-ray Observatory of CXOGBS J174614.3-321949 (CXB3) and CXOGBS J173620.2-293338 (CX332), two symbiotic binary star candidates identified by the Galactic Bulge Survey. Using new Chandra observations, we improved their X-ray positional uncertainties to 0.24 and 0.92 arcsec, respectively, confidently associating them with single optical counterparts. In particular, new observations of symbiotic X-ray candidate CX332 further solidify confidence in its coincidence with a carbon star. We demonstrate X-ray variability in both targets with a more recent observation of CX332 showing a decrease in brightness by a factor of 30, while CXB3 observations show it …

We prove a Roth-type theorem for polynomial corners in the finite field setting. Let ϕ1 and ϕ2 be two polynomials of distinct degree. The nature of the and excited states in is studied using the transfer reaction in inverse kinematics at 10A MeV at TRIUMF ISAC-II, in particular to assess whether either of them can be considered as an excited halo state. The angular distributions for both states are extracted using deuteron- coincidences and analyzed using a transfer model taking into account one-step and two-step processes. A good fit of the angular distributions is obtained considering only the one-step process, whereby an inner neutron of is removed, leaving the halo neutron intact. Random matrix theory (RMT) is used to provide a measure of the chaoticity (q) of calculated results for the spectra for various Cd isotopes. The goal is to gain a better understanding of the internal dynamics in play; namely, whether it tracks with regular or irregular (chaotic) behavior as determined through an RMT analyses of calculated spectra. The basis-state configurations used to determine the spectra includes all positive, negative, natural (J π = 1-, 2+, ...), and unnatural parity configurations (J π = 0-, 1+, 2-, ...), unless suppressed for comparative purposes. Bethe ansatz solution of the two-axis two-spin Hamiltonian is derived based on the Jordan-Schwinger boson realization of the SU(2) algebra. It is shown that the solution of the Bethe ansatz equations can be obtained as zeros of the related extended Heine-Stieltjes polynomials. Symmetry properties of excited levels of the system and zeros of the related extended Heine-Stieltjes polynomials are discussed. Exploring the symbiosis between plants and plant growth-promoting bacteria (PGPB) is a new challenge for sustainable agriculture. Even though many works have reported the beneficial effects of PGPB in increasing plant resilience for several stresses, its potential is not yet widely explored. One of the many reasons is the differential symbiosis performance depending on the host genotype. This opens doors to plant breeding programs to explore the genetic variability and develop new cultivars with higher responses to PGPB interaction and, therefore, have higher resilience to stress. We evaluate competing hypotheses regarding tectonic models of the early Taconic Orogeny in the Southern Appalachians during the Blountian tectophase with new geochemical data obtained from analyses of apatite and zircon phenocrysts, and melt and mineral inclusions therein, from the Ordovician Deicke K-bentonite (453.35 ± 0.10 Ma). Apatite geochemistry confirms that samples from different locations represent the same eruptive event, and zircon geochemistry and U[sbnd]Pb geochronology (including several Grenville-age inherited detrital cores) confirm an evolved magma of continental-arc composition, with the trace-metal geochemistry of magmatic Taconic-age rims on Deicke zircons pointing to a provenance of continental crustal igneous rock melts, …

BACKGROUND: Time to surgery (TTS) has been suggested to have an association with mortality in early-stage breast cancer. OBJECTIVE: This study aims to determine the association between TTS and preoperative disease progression in tumor size or nodal status among women diagnosed with clinical T1N0M0 ductal breast cancer. METHODS: Women diagnosed with clinical T1N0M0 ductal breast cancer who had breast-conserving surgery as their first definitive treatment between 2010 and 2016 (n = 90,405) were analyzed using the National Cancer Database. Automated fiber placement (AFP) is a composite manufacturing technique used to fabricate complex advanced air vehicle structures that are lightweight with superior qualities. The AFP process is intricate and complex with various phases of design, process planning, manufacturing, and inspection. An understanding of each of these phases is necessary to achieve the highest possible manufacturing quality. This work reviews the state-of-the-art methodologies for the deterministic sensitivity analysis of nonlinear systems and deterministic quantification of uncertainties induced in model responses by uncertainties in the model parameters. The need for computing high-order sensitivities is underscored by presenting an analytically solvable model of neutron scattering in a hydrogenous medium, for which all of the response’s relative sensitivities have the same absolute value of unity. It is shown that the wider the distribution of model parameters, the higher the order of sensitivities needed to achieve a desired level of accuracy in representing the response and in computing the response’s expectation, …

Regulation of the mammalian embryo involves cell-signaling molecules produced by the maternal oviduct and endometrium. Here, datasets on the transcriptome of the gestational Days 5 and 6 bovine morula and Day 5 maternal endometrium were examined to identify receptor genes expressed by the morula and expression of the corresponding ligand-related genes in the endometrium. A total of 175 receptor genes were identified in the morula, including 48 encoding for growth factors or WNT signaling molecules, 25 for cytokines and chemokines, 35 involved in juxtacrine and matricellular signaling and 25 encoding for receptors for small molecules. This work introduces a bulk data acquisition method using a hyperspectral imaging system (HIS) to measure chromium (Cr) concentration in the soil samples obtained from tailings of a gold mine considering of the spectral competition between heavy metal elements. The chemical, mineralogical, and spectroscopic analyses in a laboratory environment revealed that heavy metal elements' competitive geochemical behaviors were manifested as spectral competitions between heavy metal elements in tailings. The heavy metal elements can be classified into two groups based on their geochemical behaviors: chromium-nickel (Cr-Ni) and zinc-arsenic-cadmium-lead (Zn-As-Cd-Pb).
