Generic Competition And Pharmaceutical Innovation: The Drug Price Competition And Patent Term Restoration Act Of 1984, James J. Wheaton

This article critiques the Drug Price Competition and Patent Term Restoration Act of 1984. Part I traces the background of the two major sections of the Act by examining the recent trend toward generic competition in the pharmaceutical industry and the need perceived by some industry observers for additional incentives to pharmaceutical research. Part II of the article describes and discusses the sections of the Act designed to benefit the two segments of the pharmaceutical industry. Part III addresses the likely effect of the Act on generic competition, and Part IV provides a parallel analysis for the research-intensive pharmaceutical firms. …

A Policy Analysis Of Fee-Shifting Rules Under The Internal Revenue Code, Gary Myers, Richard L. Schmalbeck

Until recently, the costs of litigating federal tax cases were borne exclusively by the parties who incurred them, regardless of whether the government or the taxpayer prevailed in the litigation. This practice reflects the application to tax disputes of the ‘American rule’ against fee shifting. Although the American rule continues to be predominant in the tax area, it has been modified in important respects. An explicit fee-reimbursement rule, benefiting prevailing taxpayers in cases in which the government is found to have acted unreasonably, was added to the Internal Revenue Code (IRC) by the Tax Equity and Fiscal Responsibility Act of …

Effect Of Adrenalectomy On In Vivo Glucose Metabolism In Insulin Resistant Zucker Obese Rats, Marjorie Freedman, Judith Stern, G. Reaven, C. Mondon

Lean (Fa/?) and obese (fa/fa) Zucker rats were adrenalectomized (ADX) in order to assess the contribution of adrenal hormones to insulin resistance of the obese Zucker rat. Glucose utilization was measured using an insulin suppression test.Sham-operated obese rats gained almost twice as much weight as sham-operated lean littermates. However, body weight gain of ADX animals was comparable in both genotypes. It was significantly less than that of the respective sham-operated controls. Body weight differences can be accounted for almost entirely by a marked loss of adipose tissue.Although insulin resistance may be attributable to obesity in part, steroid hormones are thought …

Le segment phonologique /r/ en position implosive montre une grande variete de manifestations phonetiques dans les differents dialectes hispaniques (v. Navarro Tomas 1972; Alarcos Llorach 1968; Zamora Vicente 1970). Parmi les manifestations les plus connues, on peut citer la variante alveolaire vibrante simple carne 'viande', la fricative carne, l'aspiree cahne, la lateralisee caIne, l'assimilee canne et l'elidee cane. On considere generalement la vibrante comme la realisation standard, mais la norma culta 'la norme cultivee' admet aussi la prononciation fricative. Toutes les autres prononciations, des points de vue academique et normatif, sont jugees vulgaires, populaires ou regionales (Navarro Tomas 1972:119-121).

He smiled and said, "My success can be summed up in two very important words: vacuum sweeper." His approach was to locate as many relevant materials as possible and then to analyze and classify them. As the business environment becomes more complex and more competitive, accountants and other business managers must exploit the advantages of the computer to remain competitive. Even though managers have long used data which was collected, stored, summarized, and reported using computer technology, managers have not traditionally used computers to manage. Interconnected Reproductive And Vegetative Remains Of Populus (Salicaceae) From The Middle Eocene Green River Formation, Northeastern Utah, William D. Tidwell, Steven R. Manchester, David L. Dilcher

A new specimen from the Middle Eocene Evacuation Creek Member of the Green River Formation in northeastern Utah shows a twig with several leaves of Populus wilmattae Crockrell and a fruiting raceme attache. This specimen establishes for the first time the type of fruits borne by P. wilmattae and provides additional characters with which to assess its taxonomic and evolutionary status. An associated seed shows attached placental hairs like those of extant species of Populus. The Green River fossil differs from extant Populus species in having basically palmate leaf venation and in bearing its fruiting axis on a young twig. …

This paper explores the social science concept of conventions as a way of understanding law that would bridge the enduring gap between natural law and legal positivist legal theories. It further finds in the conventionalist approach a promising account of the rule of law—both in how it may be characterized and in how it can be assessed in particular legal systems.

Constitutionalism is the practical science of designing and balancing institutions of public power and authority so as to prevent monopolies of power or the emergence of tyranny. In spite of continuing attempts to ground constitutions in moralistic political theories, they are best understood as formalizations of citizenry agreements to manage their affairs under the rule of law following rules formulated by their legislatures and applied by their judges, all of which are to be selected through established procedures. Historians of the American West have observed that compared with most other mid-19th century American overlanders, whether Oregon-bound farmers or California Agronauts, the Mormons enjoyed a relatively more amicable, more peaceful relationship with the American Indian. Furthermore several contend with cause that Brigham Young was the principal architect of peace with the Ute, Shoshoni, Navaho, Hopi, and other tribes in the deserts and valleys of "Deseret," the Mormon Zion in the Great Basin Kingdom. The sugar cane (a complex hybrid of Saccharum spp.) cultivar improvement program for the irrigated Lower Rio Grande Valley of Texas, initiated in 1961, has expanded greatly over the past 20 years. Initially, only 8 to 12 cultivars, selected from those previously released from commercial production in Louisiana or Florida, were screened annually for their production potential in the Lower Rio Grande Valley. The current introduction and screening program is more comprehensive utilizing 1) all clones advanced from the first to the second line trials at the U. S. This article discusses a production-tested method for determining exposure indexes for video cameras. Also discussed are exposure control methods, camera sensitivity, waveform monitors, lighting, and other factors. The importance of this procedure in practical production situations is described.

When a federal court resolves equipoise in its effort to determine the contours of a litigant class created by an express private cause of action, the court should consider the control that the Federal Rules of Civil Procedure, taken as a whole, exercise on the conduct of litigation. With civil RICO as background, part II presents this thesis and discusses the circumstances in which procedural control would be an element supporting a determination *1481 that Congress created a broad litigant class.
