Restricting Public Employees' Political Activities: Good Government Or Partisan Politics?, Rafael Gely, Timothy D. Chandler

The article starts by reviewing, in Part II, the history of the regulation of political activities by public employees, and in Part III, the regulation of patronage. Part IV develops the argument that both sets of regulations, although justified on different grounds, are better understood as political control mechanisms. Part V provides some empirical evidence for this argument by examining voting patterns on federal legislation restricting public employees' political activities. Part VI discusses the relationship of these laws to public sector unionization. Part VII concludes the article.

Lawyers have garnered a reputation for being unreasonable and excessively contentious. This popular sentiment is embedded in our culture. If lawyers cannot change that perception, a second-best outcome (from the perspective of lawyers) would be the formation of an understanding that there is a reason why they appear to act unreasonably, that it can be desirable for lawyers to act in a way that initially appears to be unreasonable. This Article attempts to build a basis for that understanding in the context of lawyers participating in large commercial transactions.

Bringing Structure To The Law Of Injunctions Against Expression, Christina E. Wells

Part I of this Article reviews the Court's cases regarding injunctions against speech, focusing first on the increasing elevation of rhetoric (as opposed to analysis) in the Court's prior restraint decisions. Part I also reviews the Court's other decisions involving injunctions and demonstrates that they too contain little, if any, analysis concerning the appropriateness of injunctive relief against expression. Part II examines Madsen's interaction with the Court's previous decisions and discusses how Madsen furthers the incoherence of the Court's previous cases. The identification of police officers who have potential problems has emerged as a popular approach for curbing police misconduct and achieving accountability. Early warning (EW) systems are data-driven programs whose purpose is to identify officers whose behavior is problematic and to subject those officers to some kind of intervention, often in the form of counseling or training. Because of their potential for providing timely data on officer performance and giving police managers a framework for correcting unacceptable performance, early warning systems are consistent with the new demands for performance evaluation raised by community policing and the effective strategic management of …

Noskov, Xiaochen Lu, Anne Bergmann, Xiaojia Ren, Tiffany Warth, Paul Richardson, Natalya Kouprina, Lisa Stubbs

Using mouse BAC clones spanning an imprinted interval of proximal mouse chromosome 7 and the genomic sequence of the related interval of human chromosome 19q13.4, we have identified a novel mouse gene, Usp29 (ubiquitin-specific processing protease 29), near two known imprinted genes, Peg3 and Zim1. Gene Usp29 is located directly adjacent to Peg3 in a ″head-to-head″ orientation, and comprises exons distributed over a genomic distance of at least 400 kb. A similar human gene is also found in the homologous location in human chromosome 19q13.4. The mouse Usp29 gene is also imprinted and is transcribed mainly from the paternal allele …

High Phosphorylation Efficiency And Depression Of Uncoupled Respiration In Mitochondria Under Hypoxia, Erich Gnaiger, Gabriela Méndez, Steven C. Hand

Mitochondria are confronted with low oxygen levels in the microenvironment within tissues; yet, isolated mitochondria are routinely studied under air-saturated conditions that are effectively hyperoxic, increase oxidative stress, and may impair mitochondrial function. Under hypoxia, on the other hand, respiration and ATP supply are restricted. Under these conditions of oxygen limitation, any compromise in the coupling of oxidative phosphorylation to oxygen consumption could accentuate ATP depletion, leading to metabolic failure. To address this issue, we have developed the approach of oxygen-injection microcalorimetry and ADP-injection respirometry for evaluating mitochondrial function at limiting oxygen supply. Response Of Atmospheric Methane Consumption By Maine Forest Soils To Exogenous Aluminum Salts, K. Nanba, G. M. King

Atmospheric methane consumption by Maine forest soils was inhibited by additions of environmentally relevant levels of aluminum. Aluminum chloride was more inhibitory than nitrate or sulfate salts, but its effect was comparable to that of a chelated form of aluminum. Inhibition could be explained in part by the lower soil pH values which resulted from aluminum addition. However, significantly greater inhibition by aluminum than by mineral acids at equivalent soil pH values indicated that inhibition also resulted from direct effects of aluminum per se. This paper discusses the realization of a quantum associative memory using linear integrated optics. An associative memory produces a full pattern of bits when presented with only a partial pattern. Quantum computers have the potential to store large numbers of patterns and hence have the ability to far surpass any classical neural network realization of an associative memory. In this work two 3-qubit associative memories will be discussed using linear integrated optics. In addition, corrupted, invented and degenerate memories are discussed.

Collagen molecules in articular cartilage have an exceptionally long lifetime, which makes them susceptible to the accumulation of advanced glycation end products (AGEs). In fact, in comparison to other collagen-rich tissues, articular cartilage contains relatively high amounts of the AGE pentosidine. To test the hypothesis that this higher AGE accumulation is primarily the result of the slow turnover of cartilage collagen, AGE levels in cartilage and skin collagen were compared with the degree of racemization of aspartic acid (% D-Asp, a measure of the residence time of a protein). This paper strengthens the excluded-minor characterization of GF(4)-representable matroids. In particular, it is shown that there are only finitely many 3-connected matroids that are not GF(4)-representable and that have no U2, 6-, U4, 6-, P6-, F-7-, or (F-7)*-minors. Explicitly, these matroids are all minors of S(5, 6, 12) with rank and corank at least 4, and P″8, the matroid that can be obtained from S(5, 6, 12) by deleting two elements, contracting two elements, and then relaxing the only pair of disjoint circuit-hyperplanes. © 2000 Academic Press.

During the course of flower development, floral homeotic genes are expressed in defined concentric regions of floral meristems called whorls. The SUPERMAN ( SUP, also called FLO10 ) gene, which encodes a C2H2-type zinc finger protein, is involved in maintenance of the stamen/carpel whorl boundary (the boundary between whorl 3 and whorl 4) in Arabidopsis. Here, we show that the regulation of SUP expression in floral meristems is complex, consisting of two distinct phases, initiation and maintenance. In a recent experiment, we have for the first time studied near-barrier and sub-barrier fusion of the exotic "Borromean" nucleus 6He with 209Bi and found that the sub-barrier fusion of this system is exceptionally enhanced, implying a 20% reduction in the nominal fusion barrier. It was suggested that this striking effect might he due to coupling to positive Q-value neutron transfer channels, leading to "neutron flow" and consequent neck formation between the projectile and target. The creation of neologisms through linguistic borrowing is a complex process. For donor language models to be transformed into host language replicas, phonological and morphological adaptation must take place. Part and parcel of that adaptation is the assignment of gender to loanwords in a host language like Spanish. The present article examines gender assignment in two corpora of loanwords (New Mexican and Southern Colorado Spanish: N=212 and General Chicano Spanish: N=595). Through the application of variable rule methodology (GoldVarb 2), five factors are posited as significant. To understand marine biogeochemical cycles, it is critical to quantitatively balance organic matter transformations within the euphotic zone. Such an assessment for nitrogen is difficult because of lateral advection, uncertainties in individual measurements, the complexity of elemental transformations (including nitrification and denitrification), and the difficulty of collecting data on appropriate space and time scales. Two cruises were conducted to the southern Ross Sea, Antarctica, to understand the time-varying fluxes of nitrogen into its various pools. From these data a balanced inventory was constructed. Nitrate removal in the upper 200 m was balanced by particulate and dissolved organic nitrogen production, ammonification, …
