Reinforcing The Myth Of The Crazed Rapist: A Feminist Critique Of Recent Rape Legislation, Christina E. Wells, Erin Elliott Jan 2001

Reinforcing The Myth Of The Crazed Rapist: A Feminist Critique Of Recent Rape Legislation, Christina E. Wells, Erin Elliott

Faculty Publications

Part I of this article reviews these new legislative provisions, discussing their requirements as well as the general impetus behind their enactment. Part II discusses both the history of rape prosecution and feminist efforts in the 1970s and 1980s to eliminate barriers to successful rape prosecutions. This part also elaborates upon the myth of the crazed rapist and its relationship to feminist reform efforts. Part III explains how the current legislation is rooted in and reinforces that myth by encouraging unsupportable distinctions among rape defendants. Finally, Part IV discusses the feminist response to such laws and argues for a more …

Fabrication Of Nanometer-Sized Protein Patterns Using Atomic Force Microscopy And Selective Immobilization, Kapila Wadu-Mesthrige, Nabil A. Amro, Jayne C. Garno, Song Xu, Gang Yu Liu

Faculty Publications

A new methodology is introduced to produce nanometer-sized protein patterns. The approach includes two main steps, nanopatterning of self-assembled monolayers using atomic force microscopy (AFM)-based nanolithography and subsequent selective immobilization of proteins on the patterned monolayers. The resulting templates and protein patterns are characterized in situ using AFM. Compared with conventional protein fabrication methods, this approach is able to produce smaller patterns with higher spatial precision. In addition, fabrication and characterization are completed in near physiological conditions. The adsorption configuration and bioreactivity of the proteins within the nanopatterns are also studied in situ.

Faculty Publications

The complete genome sequences are reported here of two field isolates of bovine coronavirus (BCoV), which were isolated from respiratory and intestinal samples of the same animal experiencing fatal pneumonia during a bovine shipping fever epizootic. Both genomes contained 31028 nucleotides and included 13 open reading frames (ORFs) flanked by 5′- and 3′-untranslated regions (UTRs). ORF1a and ORF1b encode replicative polyproteins pp1a and pp1ab, respectively, that contain all of the putative functional domains documented previously for the closest relative, mouse hepatitis virus. The genomes of the BCoV isolates differed in 107 positions, scattered throughout the genome except the 5′-UTR. Differences …

Effect Of Phytase On Production Parameters And Nutrient Availability In Broilers And Laying Hens: A Review, L. F. Hatten, D. R. Ingram, S. T. Pittman

Faculty Publications

An increase in poultry production in recent years has led to greater use of poultry manure as fertilizer, which has, in turn, increased the amount of phosphorus runoff from fields fertilized with poultry manure. Phosphorus excretion in poultry manure can lead to water pollution when the manure is used as fertilizer. The need to maintain sufficient dietary phosphorus levels while reducing phosphorus excretion in poultry manure has led to an increase in the application of phytase to poultry feed in recent years. The use of phytase reduces phosphorus excretion in poultry manure by allowing the birds to utilize more of …

Effects Of Initiation Age Of Skip-A-Day Feed Restriction On Skeletal Development In Broiler Breeder Males, D. R. Ingram, L. F. Hatten, B. N. Mcpherson

Faculty Publications

This experiment was conducted over an 18-week period to determine the effects of initiating a skip-a-day (SAD) feed restriction program at 2, 4, and 6 weeks of age on male broiler breeders. For each of the SAD treatments, feed intake was manipulated so that the breeder's recommended target weight was reached by all groups at 18 weeks of age. Males were evaluated for shank and keel length and head width at 7 and 18 weeks of age. The results of this experiment show that starting a SAD feeding program at 2, 4, or 6 weeks of age will decrease shank …

A Phylogenetic Analysis Of Variation In Reproductive Mode Within An Australian Lizard (Saiphos Equalis, Scincidae), Sarah A. Smith, Christopher C. Austin, Richard Shine Jan 2001

A Phylogenetic Analysis Of Variation In Reproductive Mode Within An Australian Lizard (Saiphos Equalis, Scincidae), Sarah A. Smith, Christopher C. Austin, Richard Shine

Faculty Publications

Saiphos equalis, a semi-fossorial scincid lizard from south-eastern Australia, is one of only three reptile species world-wide that are known to display geographic variation in reproductive mode. Uniquely, Saiphos equalis includes populations with three reproductive modes: oviparous with long (15-day) incubation periods; oviparous with short (5-day) incubation periods; and viviparous (0-day incubation periods). No Saipho populations show 'normal' scincid oviparity (>30-day incubation period). We used mitochondrial nucleotide sequences (ND2 and cytochrome b) to reconstruct relationships among populations from throughout the species' distribution in New South Wales, Australia. Under the phylogenetic species concept, phylogenetic analyses are consistent with the oviparous …

We have analyzed 35 widely distributed, polymorphic Alu loci in 715 individuals from 31 world populations. The average frequency of Alu insertions (the derived state) is lowest in Africa (.42) but is higher and similar in India (.55), Europe (.56), and Asia (.57). A comparison with 30 restriction-site polymorphisms (RSPs) for which the ancestral state has been determined shows that the frequency of derived RSP alleles is also lower in Africa (.35) than it is in Asia (.45) and in Europe (.46). Neighbor-joining networks based on Alu insertions or RSPs are rooted in Africa and show African populations as separate …

Faculty Publications

In this report, placement of Rickettsia felis in the spotted fever group (SFG) rather than the typhus group (TG) of Rickettsia is proposed. The organism, which was first observed in cat fleas (Ctenocephalides felis) by electron microscopy, has not yet been reported to have been cultivated reproducibly, thereby limiting the standard rickettsial typing by serological means. To overcome this challenge, several genes were selected as targets to be utilized for the classification of R. felis. DNA from cat fleas naturally infected with R. felis was amplified by PCR utilizing primer sets specific for the 190 kDa surface antigen (rOmpA) and …

Falling Out Of Love With America: The Clinton Impeachment And The Madisonian Constitution, Frank O. Bowman Iii

Faculty Publications

First, were the Nixon and Clinton affairs truly as different as my memory makes them? Were the villains of Watergate as villainous and the heroes as heroic as I remember them? Were nearly all the players on both sides of l'affaire Lewinsky as shallow and fatuous as they seemed? Or to put the question in broader historical context, was the impeachment of Bill Clinton truly distinct, not only from Watergate, but from all of the other (fortunately few) occasions on which a president was seriously threatened with removal from office? Second, if the Clinton impeachment really was as bizarre, unprecedented, …

The 2001 Federal Economic Crime Sentencing Reforms: An Analysis And Legislative History, Frank O. Bowman Iii

Faculty Publications

This Article has four parts. First, it describes the general structure of the Federal Sentencing Guidelines and the approach to sentencing economic crimes in effect between 1987 and 2001. Second, it outlines the defects in the former economic crime guidelines that led to the call for reform. Third, it describes the process undertaken by the Sentencing Commission that led to the passage of the 2001 economic crime amendments and, in so doing, provides a roadmap to sources of legislative history. Fourth, it explains and analyzes the new guidelines in light of their legislative history, with primary emphasis on the consolidated …

Chinese Mortgage Law: An American Perspective, Dale A. Whitman

Faculty Publications

My objective in this paper is to compare and to evaluate some of the features of the American and Chinese systems. I do so without any preconception that the American system provides better answers, but with the recognition that it is far more mature and provides more answers. Hence it provides a reference point from which the Chinese system can be considered. Perhaps each system has something to teach the other.

'The Question Is Which Is To Be Master - That's All': Cunningham, Claiborne, Rita And The Sixth Amendment Muddle, Frank O. Bowman Iii Jan 2001

'The Question Is Which Is To Be Master - That's All': Cunningham, Claiborne, Rita And The Sixth Amendment Muddle, Frank O. Bowman Iii

Faculty Publications

Three things are clear from the Supreme Court's opinion in Cunningham v. California, in which the Court struck down California's sentencing law as violative of the Sixth Amendment, and from the briefs in the pending cases involving post-Booker federal sentencing, Claiborne v. United States and Rita v. United States. First, the Supreme Court has plunged Sixth Amendment sentencing law deep down the rabbit hole. Second, both the government and petitioners in Claiborne and Rita have adopted indefensible positions. Third, neither the parties nor the amici in Rita and Claiborne have offered the Court any real help in crafting a sensible …

Beyond Campaign Finance: The First Amendment Implications Of Nixon V. Shrink Missouri Pac, Christina E. Wells Jan 2001

Beyond Campaign Finance: The First Amendment Implications Of Nixon V. Shrink Missouri Pac, Christina E. Wells

Faculty Publications

This essay, however, is less concerned with the campaign finance aspects of Shrink than with the decision's broader implications. In the course of its decision, the Shrink Court not only obfuscated the standard of scrutiny applicable to contribution regulations, it effectively ignored the government's lack of factual support for the law, instead accepting the state's assertions at face-value. Consequently, Shrink is far more than a simple application of Buckley. Rather, it reflects fundamental problems with the Court's standards of review in First Amendment cases generally. The more global nature of Shrink's problems suggest that, despite scholarly focus on the Buckley …

Cybergossip Or Securities Fraud? Some First Amendment Guidance In Drawing The Line., Lyrissa Lidsky, Michael Pike Jan 2001

Cybergossip Or Securities Fraud? Some First Amendment Guidance In Drawing The Line., Lyrissa Lidsky, Michael Pike

Faculty Publications

Fifteen-year-old Jonathan Lebed, the youngest person ever pursued by the SEC in an enforcement action, made over $800,000 in six months by promoting stocks on Internet message boards. Using several fictitious screen names, Jonathan posted hundreds of messages on Yahoo! Finance, hyping selected over-the-counter stocks and then promptly selling his pre-purchased shares as soon as the stock prices rose.

Publicly, the SEC painted a picture-perfect case of securities fraud. Yet, the SEC forced disgorgement of only $285,000 of Jonathan's profits, leaving many observers to wonder why the resolution of this supposedly clear-cut case left its teenaged perpetrator with over $500,000. …

Fermi-Surface Measurements On The Low-Carrier Density Ferromagnet (Formula Presented) And (Formula Presented), Donavan Hall, D. P. Young, Z. Fisk, T. P. Murphy, E. C. Palm, A. Teklu, R. G. Goodrich

Faculty Publications

Recently it has been discovered that weak ferromagnetism of a dilute three-dimensional electron gas develops on the energy scale of the Fermi temperature in some of the hexaborides; that is, the Curie temperature approximately equals the Fermi temperature. We report the results of de Haas–van Alphen experiments on two concentrations of La-doped (formula presented) as well as Ca-deficient (formula presented) and Sr-deficient (formula presented) The results show that a Fermi surface exists in each case and that there are significant electron-electron interactions in the low-density electron gas. © 2001 The American Physical Society.

Kondo Effect To Heavy Fermions Studied Using The De Haas-Van Alphen Effect, N. Harrison, R. G. Goodrich, A. Teklu, L. Balicas, J. S. Brooks, D. Young, Z. Fisk, J. C. Cooley, J. L. Smith

Faculty Publications

In this paper, we briefly review some recent de Haas-van Alphen experiments on two contrasting types of heavy fermion/Kondo systems for varying concentrations x of the impurity ion, Ce or U. In both systems the Fermi surface is observed to vary continuously with x: in CexLa1-xB6, the Ce ions behave as Kondo impurities while in UxTh1-xBe13 they do not. In both systems, the f electrons are also found to contribute only partially to the Fermi surface volume, therefore raising questions concerning the applicability of Fermi liquid theory.

We present inelastic light scattering measurements of EuO and (formula presented) (formula presented) 0.005, 0.01, 0.03, and 0.05) as functions of doping, B isotope, magnetic field, and temperature. Our results reveal a variety of distinct regimes as a function of decreasing T: (a) a paramagnetic semimetal regime, which is characterized by a collision-dominated electronic scattering response whose scattering rate (formula presented) decreases with decreasing temperature; (b) a spin-disorder scattering regime, which is characterized by a collision-dominated electronic scattering response whose scattering rate (formula presented) scales with the magnetic susceptibility; (c) a magnetic polaron regime, in which the development of an …

The cross section for the elastic scattering reaction νe+e-→νe+e- was measured by the Liquid Scintillator Neutrino Detector using a μ+ decay-at-rest νe beam at the Los Alamos Neutron Science Center. The standard model of electroweak physics predicts a large destructive interference between the charge current and neutral current channels for this reaction. The measured cross section, σνe+e-= [10.1± 1.1(stat) ±1.0(syst)]×Eνe (MeV)× 10-45 cm2, agrees well with standard model expectations. The measured value of the interference parameter, I= -1.01±0.13(stat)±0.12(syst), is in good agreement with the standard model expectation of ISM= -1.09. Limits are placed on neutrino flavor-changing neutral currents. An upper …

Thermodynamics Of D-Wave Superconductors In A Magnetic Field, I. Vekhter, P. J. Hirschfeld, E. J. Nicol

Faculty Publications

We investigate the thermodynamic properties of a two-dimensional d-wave superconductor in the vortex state using a semiclassical approach, and argue that such an approach is valid for the analysis of the experimental data on high-temperature superconductors. We develop a formalism where the spatial average of a physical quantity is written as an integral over the probability density of the Doppler shift, and evaluate this probability density for several model cases. The approach is then used to analyze the behavior of the specific heat and the nuclear magnetic resonance (NMR) spin-lattice relaxation rate in a magnetic field. We compare our results …
