Energy Trade And The National Security Exception To The Gatt, Donald N. Zillman

Three topics combine in this paper: international trade, national security, and energy. The specific focus of the paper is the General Agreement on Tariffs and Trade (GATT) and the "essential security interests" exception contained in Article XXI. The provisions of the GATT set out the structure of a system to encourage international trade by reducing tariffs and other trade barriers. More broadly, many aspects of international trade in energy have developed outside the structure of GATT or with the implied assumption that Article XXI or another GATT exception would take them out of normal GATT arrangements. 'Death And Taxes' And Hypocrisy, John W. Lee

Professor Lee finds the "death and taxes" poem by Rep. Ewing hypocritical for several reasons. He notes that the poem is derived from a 1920s populist attack on Treasury Secretary Mellon for cutting taxes on the rich in the name of trickle-down economics while relying on regressive excise taxes on the masses -- an attack similar to that waged by then-Governor Clinton during the 1992 presidential campaign. Further, says Lee, the Bush administration displayed more of a preference for regressive excise taxes than the Clinton plan, whose reliance in part on consumption taxes appears a consequence of 25 years of …

Music plays a larger role in the book of Revelation than in any other book of the New Testament, and few books in all of Scripture have spawned more hymns sung in Christian worship today. Attention to how the hymnic material in Revelation would have sounded to the Christians who first heard it, to the place of these hymns in Revelation as a whole, and to their relation to the rest of Scripture can help revitalize the singing of the hymns these passages have inspired.

The Ute Indians of Utah rebelled in 1865 which led to war for the next three years. Throughout the conflict, small numbers of Utah warriors showed great skill in raiding white settlements of central Utah and in keeping their enemies at bay.

This joint memorandum is submitted to the court hearing Dellums v. Bush. This amicus brief advocates that the President may not order American armed forces to make war without consultation with and approval by Congress. The brief also argues that the case is justiciable.

Opportunity, Willingness, And The Diffusion Of War, Randolph M. Siverson, Harvey Starr

Using borders and alliances as indicators of opportunity and willingness, respectively, we test the relationship between the sea and the diffusion of war during the 1816-1965 period. The impact of borders and alliances, individually and in combination, on the growth of ongoing war through "infectious" diffusion is shown through the comparison of baseline cases to cases where states at peace were exposed to various "treatments" comprised of warring border nations or warring alliance partners. The findings indicate that the probability of war diffusion is substantially increased as opportunities and willingness increase, particularly when such geographic and political factors are combined. …

In 1932, Adolf Berle and Gardiner Means published the seminal book, The Modern Corporation and Private Property. This work set forth the thesis that corporate law's central dilemma has been the separation of ownership and control in publicly held corporations. Over the years, the Berle-Means thesis has been tossed aside by critics who argue that economic forces compel managers to act as if the shareholders were in control and by those who welcome the idea that managers are able to exercise their more enlightened business acumen. Stepping Out Of The Morass Of Duress Cases: A Suggested Policy Guide, Juliet P. Kostritsky

Traditional coercion theories and elements are simply inadequate as an exclusive focus of analysis in duress cases. This Article does not propose a new theory of duress. Instead, it suggests a refinement of doctrine in which the courts candidly articulate certain key policy goals and develop elements based on them. These policy goals include efficiency, disclosure of unexpected risks, judicial capability, reliance, and economic incentives. If decisionmakers adopted the policy analyses suggested here, the predictability of judicial decisionmaking would be enhanced and a supplemental analysis would be available when the doctrinal elements become difficult to apply. Regional Security Organizations And National Interests: Analyzing The Nato-Greek Relationship, Constantine P. Danopoulos

This article analyzes the reasons which account for Greece's continuing membership in the Atlantic Alliance, even though NATO has not lived up to expectations and has failed to protect the nation's security against threats from Turkey. Following a brief examination of Greek attitudes toward NATO and the nature of dissatisfaction, the article argues that strategic concerns are, at best, of secondary importance. Instead, Greece's continuing membership in the Alliance is a result of the nation's economic ties to the West and the dependency of its military on NATO and Washington for advanced training, arms, war materiel, and other professional considerations. …

Beginning in the second half of the nineteenth century and extending to the outbreak of the Second World War, Brazil was to receive a stream of Polish immigrants seeking fabled "new lands" in South America. While there is a considerable literature on this subject, the vast majority of the works available are, of course, in Polish and Portuguese with a considerable number in German and Spanish. Very few items are available in English, and most of these works assume a fairly extensive knowledge of Polish history in addition to Latin American history. This paper reviews the historical experience of a new public relations program housed in a speech communication department (rather than in a journalism department; which is traditional); discusses some of the internal and external struggles experienced in the implementation and administration of the program; and reports on the placement of its graduates. The program; at the University of Northern Iowa's (UNI) department of Communication and Theatre Arts; was implemented in 1978 after five years of planning. The program received support from the administration but faced problems because of its phenomenal growth. The paper describes this support and a number of …

There was a strong interest in psychology at Brigham Young University at the turn of the century; the third president was a psychologist and a number of distinguished psychologists regularly visited the campus. An outstanding young scholar who was destined to become the only Mormon president of the American Psychological Association started a vigorous academic psychology program in those early years, but he left the university because of a controversy over his teachings. Psychology at Brigham Young University developed little from that time until the 1940s. The 1950s were a time of rapid growth and development, expansion of the faculty, …

A New Theory Of Assent-Based Liability Emerging Under The Guise Of Promissory Estoppel: An Explanation And Defense, Juliet P. Kostritsky

This Article will demonstrate that these apparently divergent approaches (bargain and promissory estoppel) share unifying elemental criteria that situate them all squarely within an assent-based theory of enforceability. This Article differs from scholarship that depicts promissory estoppel as having a different conceptual or theoretical basis for enforcement. This Article posits that promissory estoppel, together with other orthodox doctrines, are merely substitute doctrinal methods for showing the assent required for an enforceable consensual exchange.
