Cancel culture attempts to silence authors who express “unapproved” opinions by removing access to their works, publicly shaming them, and making attempts to destroy their livelihood. Formally, judicial analysis of a challenged statute's validity should be consistent, regardless of the challenge's pre- or post-enforcement posture. A post-enforcement posture arises when an aggrieved party defensively challenges a purportedly unconstitutional statute being enforced against them. Alternatively, a pre-enforcement posture arises when an impacted party strikes first, attacking the statute by asserting a credible threat that the law will be enforced against them in the future. Either way, judicial evaluation of a statute's validity should turn on its content and effect-not on whether it was challenged before or after enforcement.

The Book of Mormon has been studied for its thematic, literary, and theological content using almost exclusively qualitative methods (e.g., Turley, 2019; Morrill, 2017). However, scholars have conducted little analysis comparing it to the Bible, even though those who view it as scripture consider it directly comparable in purpose. (e.g., The Book of Mormon, 2015; McConkie, 1985). The present study applies quantitative linguistic analysis to statistically derive the distinctive language from the two volumes of scripture and identifies the key themes and language from the two books. This Essay contends that data infrastructure, when implemented on a national scale, can transform the way we conceptualize artificial intelligence (AI) governance. AI governance is often viewed as necessary for a wide range of strategic goals, including national security. It is widely understood that allowing AI and generative AI to remain self-regulated by the U.S. AI industry poses significant national security risks. Data infrastructure and AI oversight can assist in multiple goals, including: maintaining data privacy and data integrity; increasing cybersecurity; and guarding against information warfare threats. The laws of war apply equally to all parties to a conflict; thus, a party that violates international law by launching a war is granted the same international humanitarian law rights as a party that is required to defend against the illegal war. This doctrine—known as the equal application doctrine—has been sharply critiqued, particularly by philosophers, who claim the doctrine to be morally indefensible. Lawyers and legal academics, by contrast, defend the equal application doctrine because they reasonably fear that applying different rules to different warring parties will sharply reduce states’ willingness to comply with the international humanitarian law system …

Shock-Wave Tolerant Phase Reconstruction Algorithm For Shack–Hartmann Wavefront Sensor Data, Thomas E. Defoor, Matthew Kalensky, Matthew R. Kemnetz, Timothy J. Bukowski, Mark F. Spencer

We develop a phase reconstruction algorithm for the Shack–Hartmann wavefront sensor (SHWFS) that is tolerant to phase discontinuities, such as the ones imposed by shock waves. In practice, this algorithm identifies SHWFS locations where the resultant tilt information is affected by the shock and improves the tilt information in these locations using the local SHWFS observation-plane irradiance patterns. The algorithm was shown to work well over the range of conditions tested with both simulated and experimental data. In turn, the reconstruction algorithm will enable robust wavefront sensing in transonic, supersonic, and hypersonic environments.

The Aramaic book commonly known as First Enoch is among the most important of all the compositions found in the Dead Sea Scrolls. The fragments of this pseudepigraphal work and related documents provide new information about the use and growth of the Enochic traditions, as well as how their contents influenced the community that collected and placed the Dead Sea Scrolls in the caves in the vicinity of Khirbet Qumran. Research on the Enochic literature in this corpus of documents is important for Jewish studies and for understanding the history of Christianity since the New Testament cites from and alludes …

Separation Distances are used throughout the world to protect people and assets from the potential hazardous effects from propellants, explosives, and pyrotechnics. The current separation distances for Hazard Division (HD) 1.3 substances and articles used in the United States, in some cases, may not adequately protect against the effects from heat flux and debris when those substances and articles are ignited in a confined structure. Multiple tests in such a confined scenario with HD 1.3 substances have shown that the heat flux and debris hazards could result in injury at distances beyond the current specified explosives safety separation distance (ESSD). …

Sensor networks collect data that is often contaminated by noise. Therefore, it is often necessary to analyze sensor data to determine if a signal is present. This research project utilizes a machine learning algorithm that is able to detect a signal in the presence of noise. The algorithm incorporates the long short-term memory (LSTM) method to determine the presence or absence of a signal in the midst of white Gaussian noise. This machine learning approach was tested with computer generated data and has an accuracy of at least 98% for signal-to-noise levels greater than -12 dB. Furthermore, this algorithm can …

There is a sizable Indian population throughout sub-Saharan Africa. A majority of the Indian population are practicing Hindus. For Hindus, ritual is a significant part of their faith tradition, often the most important. In Africa, where they are a minority, Indians often cling to these rituals to maintain their identity as both Indian and Hindu. To share Christ among Indians in Africa, a robust understanding of ritual is required. Since the early part of the twenty-first century, US adversaries have expanded their military capabilities within and their access to new warfighting domains. When faced with the growth of adversaries’ asymmetric capabilities, the means, tactics, and strategies previously used by the US military lose their proportional effectiveness. To avoid such degradation of capability, the operational concept of the military exclusion zone (MEZ) should be revised to suit the modern battlespace while also addressing the shifts in national policy that encourage diplomacy over military force. Although cyberspace is considered the newest warfighting domain, military analysts and scholars have opined the United States remains woefully behind its peers in cyberspace and have called for the creation of a separate cyber service component. Yet a cohesive and robust discussion on this topic has yet to emerge. Recent mounting nuclear threats and postures from adversary nation-states, such as Russia, China, North Korea, and Iran, represent a clear danger to the interests and security of the United States of America and its Allies. To meet these threats, the 2022 Nuclear Posture Review requires the Department of Defense (DoD) to design, develop, and manage a combat-credible U.S. military which, among other prioritizations, is survivable. The transition to digital engineering has become a major objective within the Department of Defense (DoD). One such method is Model-Based Systems Engineering (MBSE), or the use of models to facilitate systems engineering. Most new DoD programs are being built from the ground up using MBSE. However, the question of whether MBSE should be incorporated into existing systems still lingers. Little research currently exists on the efforts required to transition existing systems to MBSE. The United States stands at an important crossroads. Polarization and paralysis are the political norm. Social divisions are deep and seemingly intractable. Concerted action is disappointingly rare. Social and political pressures continue to build like tectonic plates waiting to release. What will come next? This Article begins with a description of the current situation before turning to a consideration of five possible paths forward. First, stasis. The Rise Of Native Lordships At Pashash, A.D. 200–600, North Highlands Of Ancash, Peru, George F. Lau, Milton Luján Dávila, Jacob L. Bongers, David Chicoine

This article examines the rise of native, segmentary lordships in the highlands of north-central Peru. It reports on new excavations and mapping at the seat of a prehispanic polity, Pashash (Recuay culture), a large hilltop center that developed after the collapse of Chavín civilization. Fieldwork revealed monumental constructions and two special activity contexts radiocarbon-dated to ca. a.d. 200–400: an offering area in a large palatial compound and a room-complex with chambers closed off and sealed with feasting refuse. America was a different place at the time Judge Marvin Frankel penned his now-famous text Criminal Sentences: Law without Order in 1973. Richard Nixon was the U.S. president. The Vietnam War was ending. The Watergate scandal was unfolding. There was much to grab the public’s attention, and criminal sentencing was not a national or international headline. Just two years earlier, President Nixon had declared a war on drugs and targeted drug abuse as “public enemy number one,” but it would be over a decade before punitive mandatory minimum drug sentences would become our sentencing norm. This Article is about how biometric data collected through VR technologies will greatly exacerbate existing problems with political ad microtargeting. Commercially available VR devices can—and in some cases, must—be integrated with sensors that track users’ eyes, faces, hands, and bodies. Political campaigns will be able to leverage this data to target ads with extraordinary precision. Indeed, targeting ads with biometric data may well be the next step in the evolution of microtargeted political messaging—a practice that has contributed to a rise in disinformation, filter-bubbles, and privacy invasions. Antisemitism and anti-Black racism have often been viewed as separate issues. The exhibit “Confronting Hate: Racism, Antisemitism, and The Resistance,” a fruit of the work of students in HIST 4312: Antisemitism and Racism taught by Professors Westenley (Wes) Alcenat and Magda Teter in 2021-2022, seeks to open a conversation about historical and phenomenological connections between racism and antisemitism.
