This essay attends to the sticky web of indigenous terminology concerning divination and other so-called “mundane” or “worldly” arts, focusing primarily upon Buddhist canonical texts preserved in Pāli, augmented by references to commentarial and exegetical literature. It asks: How have some Buddhists, as evinced in this canonical and exegetical literature, understood the broader category of “worldly arts,” which includes techniques we call divinatory? Are Buddhists discouraged from engaging with such practices, as has been commonly asserted? If so, then for whom, specifically, are such words of discouragement primarily meant? And why, specifically, are such practices discouraged? Are the penalties for …

Lawyers regularly experience numerous fears endemic to their work. This is not surprising considering that lawyers generally operate in environments that frequently stimulate many fears. Lawyers’ fears can lead them to enhance their performance due to increased preparation and effective “thinking on their feet.” Fear is problematic when it is out of proportion to actual threats, is expressed inappropriately, or is chronically unaddressed effectively. It can lead to sub-optimal and counterproductive performance through paralysis, ritualized behavior, or inappropriate aggression. This article, prepared for a symposium on the centennial of the ratification of the Sixteenth Amendment, argues that the Amendment was legally and politically necessary in 1913, if there was going to be a modern income tax, and that it remains significant today. The Amendment provides that “taxes on incomes” need not be apportioned among the states on the basis of population, as would otherwise be required for direct taxes. An apportioned income tax would be an absurdity, and, if there were no Amendment, Congress could not enact an unapportioned tax on income from property, the sort of tax that …

Following the American Civil War, the United States fought a major war against the Sioux, Cheyenne, and Arapaho Indians known as Red Cloud's War, which lasted from 1866 to 1868. The conflict is noteworthy for its many raids, for its three significant battles, and because it was a costly American defeat and an important Indian victory. A prominent leader of the Native Americans was the great war chief, Red Cloud, who engineered much of their success. The conflict included several important and bloody engagements including the Hayfield and the Wagon Box Battles in 1867, and the highly significant Fetterman Massacre …

Accelerated Formation Of Customary International Law, Michael P. Scharf

This article examines the phenomenon of accelerated formation of customary international law. It argues that in periods of fundamental change (which the author characterizes as "Grotian Moments"), whether by technological advances, the commission of new forms of crimes against humanity, or the development of new means of warfare or terrorism, customary international law may form much more rapidly and with less state practice than is normally the case to keep up with the pace of developments. The article examines several case studies that explore the application and contours of the concept of "Grotian Moments."

The period from the end of the seventeenth year of the reign of the judges to the beginning of the nineteenth year was a particularly unstable time in the history of the Nephite people. The amount of text Mormon devotes to it reveals the importance of this time period in their history. The crises that emerged during this time affected every Nephite, but they did not arise out of a vacuum. Password reuse – using the same password for multiple accounts – is a prevalent phenomenon that can make even the most secure systems vulnerable. When passwords are reused across multiple systems, hackers may compromise accounts by stealing passwords from lowsecurity sites to access sites with higher security. Password reuse can be particularly threatening to users in developing countries in which cybersecurity training is limited, law enforcement of cybersecurity is non-existent, or in which programs to secure cyberspace are limited. The Church of Jesus Christ of Latter-day Saints (LDS) was formally organized on April 6, 1830, in Palmyra, New York, by founding president Joseph Smith during the era of U.S. history known as the Second Great Awakening. Smith was considered a prophet, through whom God restored the church of that Latter-day Saints (i.e., the Mormons), believed to be lost to apostasy in ancient times.

Ample research has documented the long-term interaction between Mesoamerica and the U.S. Southwest/Northwest Mexico (SW/NW). Nelson (2006:345) has used the phrase ''Mesoamerican interaction markers" as a way to describe evidence of the is contact in the SW /NW. He further defines these as "a variety of archaeological patterns that are reminiscent of Mesoamerican counterparts" including "objects, practices, and styles." Robotics has been considered as one of the five key technology areas for defense against attacks with weapons of mass destruction (WMD). However, due to the mass impact nature of WMD, failures of counter-WMD (C-WMD) missions can have catastrophic consequences.To ensure robot's success in carrying out C-WMD missions, we have developed a novel verification framework in providing performance guarantees for behavior-based and probabilistic robot algorithms in complex real-world environments. This paper describes the system architecture and discusses how the verification framework can be used to provide pre-mission performance guarantees for robots in executing C-WMD missions.

The Delaware General Corporation Law contains an obscure provision stating that all corporations have the power to “[t]ransact any lawful business which the corporation’s board of directors shall find to be in aid of governmental authority.” 8 DGCL §122(12). This oddly worded provision has never been applied, analyzed, or interpreted by any court. It has received almost no treatment by corporate law scholars. Herbert Hoover was an orphan, who retained great empathy for the weak and hungry his entire life. Working without pay, he organized and administered Belgian Relief starting in 1914 to get food to ten million Belgians and Frenchmen behind German lines. His efforts doubtlessly saved hundreds of thousands from starvation. This was only the starting point in his career as the "Great Humanitarian." He got food to Germany at the end of both world wars, aided Russia in their great famine, and reportedly got food to hundreds of millions of people in his lengthy career. No one has ever done …

Next to grizzly bears and Mother Nature, the most feared enemy of American fur trappers traveling along the upper Missouri River were the Niitsftapi or Blackfeet, the "Original People" or "Prairie People." The Blackfeet Confederacy comprised the dominant military power on the northwestern plains. Blackfeet sought to maintain their hegemony by preventing American traders and trappers from trading with and strengthening the Shoshones, Crows, Flatheads (Salish), and Nez Perces. They accomplished this by harassing and attacking American trappers and stealing their horses and furs. We describe a cognitive vision system for a mobile robot. This system works in a manner similar to the human vision system, using saccadic, vergence and pursuit movements to extract information from visual input. At each fixation, the system builds a 3D model of a small region, combining information about distance, shape, texture and motion. These 3D models are embedded within an overall 3D model of the robot's environment. This approach turns the computer vision problem into a search problem, with the goal of constructing a physically realistic model of the entire environment. At each step, the vision system selects …

At the International Criminal Court's (ICC) Review Conference in 2010, the ICC's Assembly of States Parties (ASP) agreed upon a definition of the crime of aggression, jurisdictional conditions, and a mechanism for its entry into force (the "Kampala Compromise"). These amendments give the ICC jurisdiction to prosecute political and military leaders of states for planning, preparing, initiating, or executing illegal wars, beginning as early as January 2017.

The ability to work effectively on a team is highly valued by employers, and collaboration among students can lead to intrinsic motivation, increased persistence, and greater transferability of skills. Moreover, innovation often arises from multidisciplinary teamwork. The influence of personality and ability on undergraduate teamwork and performance is not comprehensively understood. An investigation was undertaken to explore correlations between team outcomes, personality measures and ability in an undergraduate population. Team outcomes included various self-, peer- and instructor ratings of skills, performance, and experience. Personality measures and ability involved the Five-Factor Model personality traits and GPA. Al Qaeda is today a fragmented organization, and its strategic communication efforts now focus largely on recruiting individuals in the West to carry out “individual jihad” in their home countries. One Al Qaeda–affiliated publication, Inspire, represents an unusual use of the digital magazine format and content for recruitment. This study examines the content and design of Inspire to determine how the magazine may advance the self-radicalization that it seeks to induce in its readers. When government takes private property for a public purpose, the Fifth Amendment to the U.S. Constitution requires just compensation. Courts, however, have long recognized an exception to takings law for the destruction of private property when necessary to prevent a public disaster. In those circumstances, unless the state accepts an obligation to pay damages, individuals must bear their own losses. This Article contends that the public necessity defense should be rejected.
