The Space Rescue Professional: Operationalizing Guardians For The Future, Benjamin Johnis, Robert Bettinger, James Dean

Faculty Publications

The escalating competition in space exploration demands a dedicated space rescue capability. This article argues for the establishment of a space rescue professional (SRP) career field within the Department of Defense and the US Space Force. By harnessing existing US Air Force combat rescue expertise and partnering with the National Aeronautics and Space Administration, the Space Force can rapidly develop a robust SRP program with the warrant officer corps as its backbone. This article addresses a critical gap in national space policy to outline a cost-effective dual-service training pipeline and SRP operational roles. Such an investment safeguards astronauts, bolsters US …

The Forms Of Representation: How To Be A Kantian Realist, Willem A. Devries Jan 2025

The Forms Of Representation: How To Be A Kantian Realist, Willem A. Devries

Faculty Publications

Sellars argued that Kant did not make certain distinctions concerning space and time, and because of this adopted his transcendental idealism. Once these distinctions are made, the path to realism remains open. Sellars' argument is not entirely clear. This essay attempts to clarify the argument, showing why Sellars believed he could remain a scientific realist while also adopting a Kantian style epistemology.

Growing Organizational Marketing, Publicity, And Outreach Strategies With Intention, Elizabeth R. Fowler, Wendy G. Pothier, Donald Dow Jan 2025

Growing Organizational Marketing, Publicity, And Outreach Strategies With Intention, Elizabeth R. Fowler, Wendy G. Pothier, Donald Dow

Faculty Publications

Marketing is a necessary function of academic libraries but is frequently deprioritized in library job descriptions and organizational structures. This article serves as a case study of how one library worked to formalize marketing efforts by moving from ad hoc committee-based work to structured positions guided by an organizational marketing plan. Sharing examples over time to show the impact of marketing efforts, the authors detail the process of creating an outline for a marketing plan, as well as new initiatives that developed through the process.

The Serendipity Of Discovery: Life Of A Geochemist, Willard S. Moore Jan 2025

The Serendipity Of Discovery: Life Of A Geochemist, Willard S. Moore

Faculty Publications

My strategy for writing this autobiography is to use examples of how working on seemingly different projects can often lead to outcomes more important than originally envisioned. Serendipity is a "happy accident"; specifically, the accident of discovering something useful without directly looking for it. This often occurs when two research projects converge unexpectedly. The main text contains examples of how serendipity has led me to important discoveries including: (a) finding surprisingly high 228Ra activities in the ocean, (b) developing a means of rapidly and quantitatively extracting radium from seawater, (c) devising a rapid, sensitive method of measuring 224Ra …

Finite Element Simulation Of Interstitial–Lymphatic Fluid Flow And Nanodrug Transport In A Solid Tumor: An Intratumoral Injection Approach, Gobinda Debnath, Buddakkagari Vasu, Rama Subba Reddy Gorla

Faculty Publications

Objective: This study presents a mathematical model and finite element simulations to investigate interstitial fluid flow and nanodrug transport in a solid tumor, incorporating transvascular exchange, convection–diffusion–reaction dynamics, and intratumoral injection mechanisms. Impact Statement: Optimizing nanodrug distribution remains a critical challenge in cancer therapy. The proposed model advances nanomedicine by enhancing the mechanistic understanding of nanodrug transport in a solid tumor. Introduction: Cancer, a global threat, often manifests as solid tumors driven by uncontrolled cell growth. The heterogeneous microenvironment, lymphatic drainage, nano-bio interactions, and elevated interstitial fluid pressure (IFP) hinder effective nanodrug delivery. Nanoparticle (NP)-based drug delivery systems offer a …

Navigating Together: The Conav Testbed And Framework For Benchmarking Cooperative Localization, Rohith Boyinine, Jayanth Ammapalli, Anusna Chakraborty, Rajnikant Sharma, Kevin Brink, Clark N. Taylor

Faculty Publications

This paper presents CoNaV, a comprehensive framework for creating a multi-vehicle cooperative localization (CL) testbed designed to support the benchmarking, development, and deployment of cooperative navigation algorithms. Given the essential role of CL in improving localization accuracy for both defense and civilian applications, CoNaV provides a robust environment for rigorously validating algorithms under real-world conditions. By establishing a benchmark for CL algorithms, CoNaV lays a foundation for advancing research into more sophisticated and distributed CL solutions. This framework highlights the potential of cooperative navigation to enhance multi-vehicle operations and offers a scalable, practical approach for future developments in CL technology.

Prosecuting Families, Anna Arons Jan 2025

Prosecuting Families, Anna Arons

Faculty Publications

Hundreds of thousands of parents are prosecuted in the family regulation system each year. Their cases are investigated by family regulation agencies and prosecuted by lawyers employed by the government—family regulation prosecutors. Like police and prosecutors in the criminal legal system, this family regulation prosecutorial team wields immense power, particularly over race–class subjugated communities. Yet even as scholarship on criminal prosecutors and on the family regulation system has proliferated, the role of family regulation prosecutors has gone underexamined and undertheorized.

This Article offers a critical examination of the role of these family regulation prosecutors. Drawing on a variety of primary …

Extending Revised Lewis Gear Root Bending Stress Model To Addendum Modified Cylindrical Gears, Edward E. Osakue Jan 2025

Extending Revised Lewis Gear Root Bending Stress Model To Addendum Modified Cylindrical Gears, Edward E. Osakue

Faculty Publications

This paper presents a new revised Lewis gear bending root stress model for both standard profile and profile-shifted cylindrical gears. The three parameters that are used to extend the root bending stress capacity of standard profile gears to profile-shifted gears are the profile shift radius factor, the profile shift load factor, and the modified Lewis stress factor. These three parameters are functions of the profile shift factor. The new bending capacity model is used to estimate the bending stresses for some standard profile gears with nominal helix angles between 0o to 41.41o and compared with estimates of AGMA model. The …

A Bevel Gear Root Bending Stress Model, Edward E. Osakue, Rasoul Saneifard Jan 2025

A Bevel Gear Root Bending Stress Model, Edward E. Osakue, Rasoul Saneifard

Faculty Publications

A reversed Lewis root bending stress capacity model for bevel gears is presented. The model is developed from first principle based on the Tredgold’s approximation of a bevel gear. The approximation conceptually transforms a bevel gear into a spur gear. The load distribution of the bevel gear facewidth is assumed to be triangular so that the stress at the gear is constant over the facewidth. Six design cases of root bending stress computations from different references are done using the new and AGMA models. The stress estimates from the new and AGMA models were compared. The stress deviations associated with …

Administrability Over Testamentary Freedom Of Disposition, Kevin Bennardo Jan 2025

Administrability Over Testamentary Freedom Of Disposition, Kevin Bennardo

Faculty Publications

This Article challenges the widely accepted view that testamentary freedom is the dominant principle of American inheritance law. It argues that administrability—the need for a predictable, efficient probate system—frequently overrides freedom of disposition. Examining executor selection, procedural constraints, contest doctrines, settlement mechanisms, and the pervasive role of judicial and statutory oversight, the Article shows that testators have far less control over the disposition of their estates than traditional rhetoric suggests. Because process shapes outcomes, limits on testators’ ability to control the probate process constitute significant limits on testamentary freedom. The Article also demonstrates how doctrines such as intestacy and settlement …

Servicing Trade Dress: Demystifying The Tertium Quid, Dustin Marlan Jan 2025

Servicing Trade Dress: Demystifying The Tertium Quid, Dustin Marlan

Faculty Publications

Trademarks are often brand names or logos. Yet other marks involve the overall appearance of a product or business — a concept called “trade dress.” Courts and scholars have long struggled with how to determine whether trade dress is distinctive enough to function as a legally protectable trademark. In attempting to clarify this murky area, Justice Scalia articulated three types of trade dress in Wal-Mart Stores, Inc. v. Samara Brothers, Inc. These include (i) product packaging (e.g., a candy wrapper) and (ii) product design (e.g., an iPhone’s unique shape). The trouble lies in understanding the third category — what …

Reflections On The Ferguson Report, Eisha Jain Jan 2025

Reflections On The Ferguson Report, Eisha Jain

Faculty Publications

This Essay reflects on the significance of the Investigation of the Ferguson Police Department by the Civil Rights Division of the Department of Justice (“Ferguson Report”). The Ferguson Report is a valuable teaching tool for criminal procedure because it documents detailed cases of police misconduct. But it also reveals how many deeply intrusive and over-reaching policing practices are not, in fact, unconstitutional. Reading the Report offers a window into how the law can enable misconduct, and it reveals how little opportunity the community affected had to create change.

The Art Belongs To The Artists, Deborah M. Weissman, Louis A. Pérez Jan 2025

The Art Belongs To The Artists, Deborah M. Weissman, Louis A. Pérez

Faculty Publications

This Article examines the rights of detainees interned at the Guantánamo Bay Naval Station to claim ownership of cultural work produced during their imprisonment. Through a series of arbitrary policies, the U.S. government alternately punished detainees for creating works of art, confiscated paintings and drawings, and otherwise denied detainees’ rights to control their creative works. This Article suggests the need to understand these policies as acts akin to plunder—that is, as a practice long associated with colonialism as a means through which the artifacts of the material culture of conquered peoples were expropriated and claimed as “trophies” of conquest. It …

More Information Or More Frequent Information? A Proposal For Quarterly 1099s, Kathleen Delaney Thomas Jan 2025

More Information Or More Frequent Information? A Proposal For Quarterly 1099s, Kathleen Delaney Thomas

Faculty Publications

Third-party information reporting enhances tax compliance. When substantial information reporting is present, the compliance rate reaches 94 percent, compared to just 45 percent when there is little or no information reporting. Accordingly, policymakers have expanded information reporting requirements over the past several decades to enhance revenue collection. More recently, Congress has expanded information reporting requirements for third-party settlement organizations (“TPSOs”) by significantly lowering the reporting threshold from $20,000 to $600 as well as eliminating the requirement for 200 or more transactions. While such a shift will subject more taxpayers to information reporting, it will also create additional burden on the …

Suspending The Truancy Paradigm, Barbara A. Fedders, Lucy Carlson, Max Parker Jan 2025

Suspending The Truancy Paradigm, Barbara A. Fedders, Lucy Carlson, Max Parker

Faculty Publications

In the aftermath of the COVID-19 pandemic, school absences have skyrocketed. While racially minoritized, disabled, and low-income students have historically been, and remain, most likely to experience absence, white and affluent students’ rates of attendance have also declined. To respond to this new universality of student absenteeism, some policymakers have begun to seek alternatives to what we term “the truancy paradigm.”

We define the truancy paradigm as the range of coercive and often punitive interventions deployed by states and school districts to enforce compulsory attendance statutes. This paradigm, we argue, wrongly assumes (a) that strict enforcement of compulsory attendance laws …

Pierce, Don't Say Gay Laws, And The Rise Of Illiberal Authoritarianism, Maxine Eichner Jan 2025

Pierce, Don't Say Gay Laws, And The Rise Of Illiberal Authoritarianism, Maxine Eichner

Faculty Publications

In the last four years, legislators and policymakers in red states have passed a wave of measures directed at reforming public schools’ policies and curricula. Some of these measures deal with issues of sexual orientation and gender identity. Others restrict educators’ ability to teach issues of race. Still other initiatives seek to insert Christianity into the schools. While a number of these reforms have been passed under the label of “parental-rights laws,” these measures actually do little to foster the autonomy of parents to direct their children’s upbringing. Instead, they are muscular attempts by state governments, themselves, to impose their …

Troubling Trends: Ada Definition-Of-Disability Cases 2019-2023, Nicole Buonocore Porter

Faculty Publications

This empirical Article continues my every-five-year tradition of examining every federal case discussing the definition of disability since the Americans with Disabilities Act (ADA) was amended, effective 2009. The results of this research from the third five-year period (2019–2023) are disappointing in both familiar and surprising ways. Similar to the 2014–2018 period, we continue to see way too many courts incorrectly applying (or not even citing to) the ADA Amendments Act. Moreover, I discovered several new troubling trends in this dataset that raise the possibility that we might be heading toward another backlash against ADA plaintiffs. This Article presents my …

In this moment, Diversity, Equity, and Inclusion (DEI) programs are hotly debated and very misunderstood. Contrary to popular belief, DEI programs do not drastically change an employer’s hiring practices. They are, to some extent, performative. In this essay, I explain what DEI really is and why a rebranding (or at least a new name) might be in order.
