The Role Of Economic Analysis In Public Range Management, B. Delworth Gardner

This rather sweeping conclusion is justified by the nature of the management problems faced by the BLM and by the unique view of the world provided by the field of economics.

Exercises at the end of part three are intended to illustrate the types of questions such sources can answer and …

Coordinating Environmental Regulation: Program Responses To A Multifaceted Problem, Melvin J. Dubnick Jan 1982

Coordinating Environmental Regulation: Program Responses To A Multifaceted Problem, Melvin J. Dubnick

Faculty Publications

This research proposal addresses a particularly problematic aspect of government regulation: the coordination of regulatory policy implementation. While most analyses of government regulations concentrate on their formulation and legitimation in the policymaking process, little systematic attention is given to their “delivery” through public sector programs. The proposal argues that coordination problems play a central role in many regulatory programs throughout the country, and presents a typology of coordination problems organized along two dimensions: the nature of the complaint (overlapping jurisdictions, duplication of agency efforts, contradictory policy objectives, lack of central guidance) and the level of program operation (intra-agency, interagency, intergovernmental). …

The Federal Tool Box: Administrative Craftsmanship In Intergovernmental Regulation, Melvin J. Dubnick, Alan R. Gitelson, Eric Anderson

Faculty Publications

This paper examines the administrative instruments — the “tool box” — available to federal agencies in implementing intergovernmental regulatory programs. The paper develops a framework for understanding administrative craftsmanship in intergovernmental regulation, focusing on how federal officials select, design, and deploy regulatory tools in response to the coordination challenges inherent in a federal system. The analysis draws on cases of intergovernmental regulatory implementation to assess the effectiveness of alternative administrative approaches.

Band Crossing And The Prealignment B(E2) Anomaly In 126Ba, J. P. Draayer, C. S. Han, K. J. Weeks, K. T. Hecht Jul 1981

Band Crossing And The Prealignment B(E2) Anomaly In 126Ba, J. P. Draayer, C. S. Han, K. J. Weeks, K. T. Hecht

Faculty Publications

A theoretical interpretation of the reduction in E2 strengths in 126Ba prior to backbending is presented. A shell model basis is built from normal parity orbilals organized into multiplets of a pseudo SU(3) symmetry coupled to h 11 2 configurations restricted to states of seniority zero and two. Within the framework of the model the scattering of a pair of protons from normal parity to the h 11 2 orbital produces band crossing and a corresponding reduction in E2 transition strengths prior to pair alignment which is the principal mechanism of the backbending. © 1981.

Agencies, Functions And Actions: The Conceptual Quagmire In Regulatory Policy Theory And Practice, Melvin J. Dubnick

Faculty Publications

This paper examines the conceptual confusion at the heart of regulatory policy theory and practice, particularly around the definitions and relationships among regulatory agencies, their functions, and their actions. The paper argues that this “conceptual quagmire” — the lack of clear, consistent definitions — undermines both theoretical understanding and practical reform efforts in regulatory policy. The paper was presented at a symposium focused on the impact of regulatory policy.

North Haven And Dougherty: Narrowing The Scope Of Title Ix, Rosemary C. Salomone

Faculty Publications

(Excerpt)

Since 1975 when the former Department of Health, Education and Welfare (hereinafter referred to as HEW) initially promulgated regulations pursuant to Title IX of the Education Amendments of 1972 (hereinafter referred to as Title IX), four Courts of Appeals and numerous District Courts have declared invalid the Title IX regulations governing the employment practices and policies of educational institutions. In an attempt to avoid administrative chaos resulting from enforcement inconsistencies, the Justice Department petitioned the Supreme Court to review the decisions of the First, Sixth and Eighth Circuits. This petition was denied on November 26, 1979, thereby letting the …
