Antitrust And Employer Restraints In Labor Markets, Robert H. Jerry Ii Jan 1984

Antitrust And Employer Restraints In Labor Markets, Robert H. Jerry Ii

Faculty Publications

This Article argues that the Sherman Act regulates concerted employer activity in the labor market only if such activity restrains or attempts to restrain the product market. After discussing the legislative history of the Act, the Article examines and synthesizes two conflicting lines of cases. Finally, the Article suggests how courts should dispose of challenges to employer conduct and posits the basis for a unified theory of labor-antitrust law.

Recent Developments In Kansas Insurance Law: A Survey, Some Analysis, And Some Suggestions, Robert H. Jerry Ii

Faculty Publications

For most of us the "small world" of insurance law, as it reflects and responds to changes in the "larger world," is also becoming increasingly complex. Part I of this article discusses cases involving questions of contract formation and termination; Part II concerns issues involving the performance of obligations arising out of the insurance contract; Part III studies several cases involving the construction and interpretation of contract language; Part IV is devoted solely to automobile insurance issues; finally, Part V discusses a few detached ideas.

Religion And A Neutral State: Imperative Or Impossibility?, Carl H. Esbeck Jan 1984

Religion And A Neutral State: Imperative Or Impossibility?, Carl H. Esbeck

Faculty Publications

The thesis of this Article is that the myth-of-neutrality argument is partially right and partially wrong. For reasons of religious liberty, the state can and should avoid any involvement with matters of religious worship, and the propagation or inculcation of matters that comprise the very heart of one's belief concerning the nature and destiny of mankind. Conversely, the state cannot retreat from the regulation of certain conduct which is arguably immoral and still claim its neutrality concerning the rightness of the conduct. The very decision by the state to withdraw its regulation, leaving the morality of the conduct up to …

Who Volunteers For Adult Development Research? Research Findings And Practical Steps To Reach Low Volunteering Groups, Michael Todd, Keith E. Davis, Thomas P. Cafferty Jan 1984

Who Volunteers For Adult Development Research? Research Findings And Practical Steps To Reach Low Volunteering Groups, Michael Todd, Keith E. Davis, Thomas P. Cafferty

Faculty Publications

The present study is an attempt to determine volunteering bias in racial, gender, and age groups in an adult development study. Samples were drawn from three different types of organizations in the Columbia, South Carolina SMSA. Volunteering rates were calculated as a function of the number eligible to participate in three age groups: 1) young adult (aged 20-25); 2) middle adult (aged 40-45); and 3) old (aged 60-80). The middle group volunteered at a higher rate than the other two age groups, but this effect was restricted to the white sample. Women volunteered more readily than men, but not among …

It will no surprise to readers of this Journal that in recent years there has been an enormous increase of interest by lawyers in non-litigous methods of resolving disputes. We have seen a vast proliferation of newsletters, magazines, bar association committees, and other organs.

A Harnack Estimate For Real Normal Surface Singularities, William A. Adkins Jan 1984

A Harnack Estimate For Real Normal Surface Singularities, William A. Adkins

Faculty Publications

According to Harnack’s theorem the number of topological components of the real part of a nonsingular projective curve X defined over R is at most g(X) + 1, where g(X) is the genus of X. The purpose of the present paper is to present two estimates which can be considered analogs of Harnack’s theorem for normal surface singularities defined over R. © 1984 by Pacific Journal of Mathematics.

Two Agricultural Economists Look At Rural Sociology, B. Delworth Gardner, Carole Frank Nuckton Jan 1984

Two Agricultural Economists Look At Rural Sociology, B. Delworth Gardner, Carole Frank Nuckton

Faculty Publications

At the invitation of the editor, we shall attempt to describe our perceptions as agricultural economists of what is known to us as rural sociology. We should say right off that we are complimented that this invitation has been extended to us. We think that a comparison of our two disciplines has been useful to us, if only to clarify our thinking about our own. We emphasize that our perceptions are based on limited contact, and we have made no systematic study of your discipline. Even to attempt the critique and analysis of the kind requested of us presumes an …

A Probabilistic Approach To The Spatial Assessment Of River Channel Instability, William L. Graf Jan 1984

A Probabilistic Approach To The Spatial Assessment Of River Channel Instability, William L. Graf

Faculty Publications

The deterministic approach to the analysis of river channel instability has not proved to be a completely useful basis for geographic predictions of channel behavior. Economic estimates for benefits of structural channel control projects commonly account for flood inundation, but in arid and semiarid regions these estimates are incomplete because they fail to take into account destructive channel migration and erosion. As a solution, a method whereby historical records of channel locations are reduced to spatially defined probabilistic functions allows calculation of the probability that given parcels of near-channel terrain will be destroyed by erosion. The probability of erosion for …

Inverse Liability Of The State Of Wisconsin For A De Facto "Temporary Taking" As A Result Of An Administrative Decision: Zinn V. State, Alemante G. Selassie Jan 1984

Inverse Liability Of The State Of Wisconsin For A De Facto "Temporary Taking" As A Result Of An Administrative Decision: Zinn V. State, Alemante G. Selassie

Faculty Publications

This Note examines Zinn v. State, a Wisconsin Supreme Court decision, which held that plaintiff stated a claim for inverse condemnation against the State of Wisconsin when, as a result of an erroneous quasi-judicial decision by the DNR, plaintiff lost the use of her property for a little longer than a month. This Note takes the position that Zinn represents the growing tendency among courts to enlarge the scope of fact situations in which they will find a taking. Given this tendency, and given that the substantive test in Wisconsin of what constitutes a taking is identical whether a taking …
