Stepping Out Of The Morass Of Duress Cases: A Suggested Policy Guide, Juliet P. Kostritsky Jan 1989

Stepping Out Of The Morass Of Duress Cases: A Suggested Policy Guide, Juliet P. Kostritsky

Faculty Publications

Traditional coercion theories and elements are simply inadequate as an exclusive focus of analysis in duress cases. This Article does not propose a new theory of duress. Instead, it suggests a refinement of doctrine in which the courts candidly articulate certain key policy goals and develop elements based on them. These policy goals include efficiency, disclosure of unexpected risks, judicial capability, reliance, and economic incentives. If decisionmakers adopted the policy analyses suggested here, the predictability of judicial decisionmaking would be enhanced and a supplemental analysis would be available when the doctrinal elements become difficult to apply. Moreover, this approach would …

Coronary Arteriography And Coronary Bypass Survey Among Whites And Other Racial Groups Relative To Hospital-Based Incidence Rates For Coronary Artery Disease: Findings From Nhds, E. Ford, R. Cooper, A. Castaner, B. Simmons, M. Mar Jan 1989

Coronary Arteriography And Coronary Bypass Survey Among Whites And Other Racial Groups Relative To Hospital-Based Incidence Rates For Coronary Artery Disease: Findings From Nhds, E. Ford, R. Cooper, A. Castaner, B. Simmons, M. Mar

Faculty Publications

To assess racial differences in health care utilization for coronary artery disease (CAD) the data of the National Hospital Discharge Survey (NHDS) from 1979-84 were examined. Discharge rates for acute myocardial infarction (AMI) were utilized as a measure of hospital-based incidence and relative need for the designated cardiac procedures. Although 35-74 year old Black men had discharge rates of AMI that were 77 per cent of those observed for White men, they underwent coronary arteriography half as often and were only a third as likely to have coronary artery bypass graft (CABG) surgery. Black women in this age range were …

Regularization, Pseudofunction, And Hadamard Finite Part, R. Estrada, R. P. Kanwal

Faculty Publications

First, we discuss and correlate the various types of regularizations available in the literature for the singular function H(x) xk, where k is an integer and H(x) is the Heaviside function. Then we present the corresponding regularization for the function r-k, where r is the radial distance in Rn. Thereafter, we express the recently discovered distributional derivatives of this function in terms of pseudofunctional language commonly used in the Coulomb, gravitational, and interparticle potentials where the function 1 r plays a fundamental role. © 1989.

An Incentive-Based Wild Horse Management System On Public Rangeland, Ray G. Huffaker, James E. Wilen, B. Gardner Delworth Jan 1989

An Incentive-Based Wild Horse Management System On Public Rangeland, Ray G. Huffaker, James E. Wilen, B. Gardner Delworth

Faculty Publications

This paper explores an incentive-based management system to induce federal grazing permittees to choose sustained cattle stocking strategies which accommodate government-set wild horse numbers and nongrazing uses. Particular attention is paid to constraints imposed by federal grazing statutes. The proposed system employs increased livestock grazing fees to induce permittees to provide increased vegetation for consumption by wild horses and nongrazing uses. The negative impact of increased fees on permittee wealth is counterbalanced with compensatory transfer payments. Taken together, grazing fees and compensation payments induce multiple-use compliance by permittee-stewards and keep their discounted livestock profits intact at some predetermined level.

The Renewed Concern Over Soil Erosion: The Current Federal Programs And Proposals, Linda A. Malone Jan 1989

The Renewed Concern Over Soil Erosion: The Current Federal Programs And Proposals, Linda A. Malone

Faculty Publications

Because soil erosion affects the quantity and quality of farmland, it is a matter of great concern for both the government and the farm industry. Whereas in the past concern was over the potential damage to productivity, concern is now being voiced over off-site damage and water pollution. There are numerous federal programs set up to fight soil erosion, but they are all voluntary, thereby making it difficult for the government to target funds. The author reviews the seriousness of the problem, looks at the numerous government programs, and then analyzes the Food Security Act of 1985—the first act to …

The University Of Choice: Social Work Students At Uni, James G. Mccullagh Jan 1989

The University Of Choice: Social Work Students At Uni, James G. Mccullagh

Faculty Publications

The study examined expressed reasons for choosing the University of Northern Iowa (UNI) by undergraduate students majoring in social work there. Responses of 205 social work majors to a questionnaire found that these students chose UNI primarily because of location; size; cost; the presence of a social work program; to get a good education; to be with their friends; and to continue a family tradition. Other findings indicated that 44% of students had attended other colleges previously; that many students considered other majors before deciding on social work; that 84% of the students had been born in Iowa; that 50% …

Oxygen Reduction In A Proton Exchange Membrane Test Cell, S. J. Ridge, Ralph E. White, Y. Tsou, R. N. Beaver, G. A. Eisman

Faculty Publications

Oxygen reduction in a gas-fed porous electrode attached to a proton exchange membrane is discussed. Experimental data and a mathematical model are presented for the test cell used. Various membrane and electrode assemblies were tested at different levels of platinum loading and Teflon® content. The model accounts for the diffusion and reaction of oxygen and the diffusion and reaction of hydrogen ions. Sulfuric acid was placed above the membrane in the test cell reservoir to provide a source of protons for the reduction of oxygen at the cathode. Based upon model predictions, it is shown that the transport of the …

An Algebraic Model For A Zinc/Bromine Flow Cell, G. D. Simpson, Ralph E. White Jan 1989

An Algebraic Model For A Zinc/Bromine Flow Cell, G. D. Simpson, Ralph E. White

Faculty Publications

An algebraic model for a parallel plate, zinc/bromine flow cell is presented and used to predict various performance quantities, which are compared to those predicted by using previously published differential equation models. The results presented compare well with previous work. The model is based on the concept of using well-mixed zones and linear concentration and potential profiles for the diffusion layers and the separator. The Butler-Volmer equation is used for the electrochemical reactions, and the homogeneous reaction between bromine and bromide is included.

Estimation Of Electrode Kinetic Parameters Of The Lithium/Thionyl Chloride Cell Using A Mathematical Model, T. I. Evans, Ralph E. White Jan 1989

Estimation Of Electrode Kinetic Parameters Of The Lithium/Thionyl Chloride Cell Using A Mathematical Model, T. I. Evans, Ralph E. White

Faculty Publications

A one-dimensional mathematical model for the lithium/thionyl chloride primary cell is used in conjunction with a parameter estimation technique, in order to estimate the electrode kinetic parameters of this electrochemical system. The electrode kinetic parameters include the anodic transfer coefficient and exchange current density of the lithium oxidation, a,1 and i0,1,ref; the cathodic transfer coefficient and the effective exchange current density of the thionyl chloride reduction, c,4 and a0i0,4,ref, and a morphology parameter, . The parameter estimation is performed on simulated data first in order to gain confidence in the method. Data reported in …

A Mathematical Model Of A Lithium/Thionyl Chloride Primary Cell, T. I. Evans, T. V. Nguyen, Ralph E. White

Faculty Publications

A one-dimensional mathematical model for the lithium/thionyl chloride primary cell has been developed to investigate methods of improving its performance and safety. The model includes many of the components of a typical lithium/thionyl chloride cell such as the porous lithium chloride film which forms on the lithium anode surface. The governing equations are formulated from fundamental conservation laws using porous electrode theory and concentrated solution theory. The model is used to predict one-dimensional, time dependent profiles of concentration, porosity, current, and potentialas well as cell temperature and voltage. When a certain discharge rate is required, the model can be used …

A Thermal Analysis Of A Spirally Wound Battery Using A Simple Mathematical Model, T. I. Evans, Ralph E. White Jan 1989

A Thermal Analysis Of A Spirally Wound Battery Using A Simple Mathematical Model, T. I. Evans, Ralph E. White

Faculty Publications

A two-dimensional thermal model for spirally wound batteries has been developed. The governing equation of the model is the energy balance. Convective and insulated boundary conditions are used, and the equations are solved using a finite element code called TOPAZ2D. The finite element mesh is generated using a preprocessor to TOPAZ2D called MAZE. The model is used to estimate temperature profiles within a spirally wound D-size cell. The model is applied to the lithium/thionyl chloride cell because of the thermal management problems that this cell exhibits. Simplified one-dimensional models are presented that can be used to predict best and worst …

Unobtrusive Studies And The Quality Of Academic Library Reference Services, Jo Bell Whitlatch Jan 1989

Unobtrusive Studies And The Quality Of Academic Library Reference Services, Jo Bell Whitlatch

Faculty Publications

This article uses empirical data from a recent obtrusive study of reference performance to explore content validity and assumptions regarding unobtrusive studies. Data collected by author support the contention that improvements are highly desirable before conducting more unobtrusive studies of reference service. The two most important changes concern the development of test questions representing all types of queries and supplementing the correct fill rate with other measures of reference performance.

Union Effects On Productivity, Profits, And Growth - Has The Long Run Arrived?, John T. Addison, Barry T. Hirsch Jan 1989

Union Effects On Productivity, Profits, And Growth - Has The Long Run Arrived?, John T. Addison, Barry T. Hirsch

Faculty Publications

This article interprets literature examining union effects on economic performance. Production function studies indicate small overall union impacts on productivity; positive effects, where they exist, appear to result from management response to decreased profit expectations and from a natural selection process. Lower profitability among unionized firms is well established; more interesting is the possibility that unions appropriate quasi rents deriving from long-lived tangible and intangible capital. the connection between unions, investment behavior, and productivity growth emerges as a particularly fruitful line of empirical inquiry, although it does not encourage a sanguine view of unionism's long-run impact.

Tommaso Campanella's La Città Del Sole: Topography And Astrology, Ilona Klein Jan 1989

Tommaso Campanella's La Città Del Sole: Topography And Astrology, Ilona Klein

Faculty Publications

At the beginning of the seventeenth century the Dominican friar from Calabria, fra' Tommaso Campanella, had already solidified his anti-Aristotelian theories, had been persecuted and arrested, and was simulating madness in order to save his life while incarcerated in Naples. When Campanella conceived La Città del Sole under these circumstances in 1602, he was interpreting Telesio's naturalistic philosophy in a metaphysical manner, and was expressing in nuce the fundamental theories he would amplify two years later in Del Senso delle Cose e delle Magie.

Models And Tests In Functional Morphology: The Significance Of Description And Integration, Dominique G. Homberger

Faculty Publications

SYNOPSIS: Functional-anatomical work on complex structural systems is handicapped by several difficulties: (1) Lack of established guidelines on how to select the structures that are relevant for the intended study, (2) lack of methods to check the accuracy of the description of a system's morphology, and (3) the need to integrate a large mass of results obtained through a variety of approaches taken from different disciplines, such as anatomy, physiology, physics, biochemistry, ecology and evolutionary biology. Suggestions to alleviate some of the problems include (1) to use information on the physiological and physical properties of the tissues in a system …
