Uncooperative Environmental Federalism 2.0, Jonathan H. Adler
Uncooperative Environmental Federalism 2.0, Jonathan H. Adler
Faculty Publications
As a presidential candidate, Donald Trump promised to curtail federal environmental regulation and empower the states. Has the Trump Administration made good on these pledges to reinvigorate cooperative federalism and constrain environmental regulatory overreach by the federal government? Perhaps less than one would think. This Essay provides a critical assessment of the Trump Administration’s approach to environmental federalism. Despite the Administration’s embrace of “cooperative federalism” rhetoric, environmental policy reforms have not consistently embodied a principled approach to environmental federalism in which the state and federal governments are each encouraged to focus resources on areas of comparative advantage.

Evaluating collections and ultimately removing content poses a variety of difficult issues, including choosing appropriate deselection criteria, communicating with stakeholders, providing accountability, and managing the overall timetable to finish projects on time. The Science and Engineering librarians at Brigham Young University evaluated their entire print collection of over 350,000 items within one year, significantly reducing the number of items kept on the open shelves and the physical collection footprint. Keys to accomplishing this project were extensive preparation, tracking progress and accountability facilitated by Google Sheets and an interactive GIS stacks map, and stakeholder feedback facilitated by a novel web-based tool. …

Cultivation of C3 and C4 crops in semi-arid regions will be severely constrained as global temperatures rise. Consequently, alternative crops need to be sought out that adapt well to heat and drought and are productive despite limited access to water. Traits, such as crassulacean acid metabolism (CAM), enable economically important species such as those in the Agave genus adapt to drought and high temperatures. The succulence and high efficiency of agaves, which enables them to produce biomass with little water, underscores their feasibility as an alternative crop for semi-arid regions, such as the Sonoran Desert in the southwestern U.S. In …

A cognitive intervention that may reduce weight and caloric intake is inhibitory control training (ICT; having individuals repeatedly withhold dominant responses to unhealthy food images). We conducted a randomized controlled trial where 100 individuals with overweight or obesity were assigned to complete a generic (n = 48) or food-specific ICT (n = 52) training four times per week for four weeks. Weight and caloric intake were obtained at baseline, four-weeks, and 12-weeks. Participants also completed high-calorie and neutral go/no-go tasks while N2 event-related potential (ERP) data, a neural indicator of inhibitory control, was measured at all visits. Results …

© 2019 The Royal Entomological Society 1. Interactions among herbivores mediated by plant responses to herbivore injury may have large impacts on herbivore population densities. Responses may persist for weeks after injury and may affect not only the initial (inducing) herbivore, but also herbivores that are spatially or temporally separated from the initial attacker. 2. In many plant–insect interactions, multiple life stages of the insect may be associated with the same plant, and these various stages may interact indirectly with one another via induced responses. The rice water weevil (RWW), Lissorhoptrus oryzophilus, a serious global pest of rice, is one …

© 2019 by the authors. A leading factor in the creation of avoidable household food waste is confusion about food date labels. In the United States, date labels are largely unregulated, resulting in a plethora of date label phrases used in commerce. Federal regulation has been proposed but never passed, while both industry and government have provided voluntary guidance on preferred label phrases. We study food producer adherence to the label phrases endorsed by the Trading Partner Alliance (TPA, an industry group), which includes "Use By" for perishable products subject to a material degradation of critical performance or potential food …

One of the most important transmission routes of foodborne pathogens is through contaminated food contact surfaces. In this study, we investigated the survival and inactivation of Salmonella enterica serovar Typhimurium on frequently used food contact surfaces in household settings, including plastic cutting board (CB), formica laminate (LA), and stainless steel (SS) surfaces. S. Typhimurium at log (6 h), stationary (24 h), or long-term stationary (LTS) (14 days) phases were evaluated. Results showed that, at medium and high microbial loads, LTS phase cells had significantly higher survivor population compared to log and stationary phase cells at 24 h after inoculation (p < 0.05). Disinfection study showed that LTS phase cells were very resilient to sodium hypochlorite when the initial microbial load was high with disinfection efficacy ranging from 26 to 35%. Scanning electron microscopy of these surfaces at 24 h after inoculation with a high microbial load revealed an early biofilm structure.

Although genotyping-by-sequencing (GBS) is a well-established marker technology in diploids, the development of best practices for tetraploid species is a topic of current research. We determined the theoretical relationship between read depth and the phred-scaled probability of genotype misclassification conditioned on the true genotype, which we call expected genotype quality (EGQ). If the GBS method has 0.5% allelic error, then 17 reads are needed to classify simplex tetraploids as heterozygous with 95% accuracy (EGQ = 13) vs. 61 reads to determine allele dosage. We developed an R script to convert tetraploid GBS data in variant call format (VCF) into diploidized …

The circadian system regulates daily rhythms of physiology and behavior. Although extraordinary advances have been made to elucidate the brain mechanisms underlying the circadian system in nocturnal species, less is known in diurnal species. Recent studies have shown that retinorecipient brain areas such as the intergeniculate leaflet (IGL) and olivary pretectal nucleus (OPT) are critical for the display of normal patterns of daily activity in diurnal grass rats (Arvicanthis niloticus). Specifically, grass rats with IGL and OPT lesions respond to light in similar ways to intact nocturnal animals. Importantly, both the IGL and OPT project to one another …

Iron (Fe) and phosphorus (P) are two essential mineral nutrients whose acquisition by plants presents important environmental and economic implications. Both elements are abundant in most soils but scarcely available to plants. To prevent Fe or P deficiency dicot plants initiate morphological and physiological responses in their roots aimed to specifically acquire these elements. The existence of common signals in Fe and P deficiency pathways suggests the signaling factors must act in conjunction with distinct nutrient-specific signals in order to confer tolerance to each deficiency. …

© 2019 The Author(s) Published by the Royal Society. All rights reserved. Understanding the role of biotic interactions in shaping natural communities is a long-standing challenge in ecology. It is particularly pertinent to parasite communities sharing the same host communities and individuals, as the interactions among parasites—both competition and facilitation—may have far-reaching implications for parasite transmission and evolution. Aggregated parasite burdens may suggest that infected host individuals are either more prone to infection, or that infection by a parasite species facilitates another, leading to a positive parasite–parasite interaction. However, parasite species may also compete for host resources, leading to the …

In aquatic settings, animals directly affect ecosystem functions through excretion of dissolved nutrients. However, the comparative role of egestion as an animal-mediated nutrient flux remains understudied. We conducted a literature survey and meta-analysis to directly compare nitrogen (N), phosphorus (P), and N:P of egestion compared to excretion rates and ratios across freshwater animals. Synthesizing 215 datasets across 47 animal species (all primary consumers or omnivores), we show that the total N and P egestion rates exceed inorganic N and P excretion rates but not total N and P excretion rates, and that proportions of P egested compared to excreted depend …

School Wellness Integration Targeting Child Health (SWITCH®) is a school wellness implementation initiative focused on building capacity for schools to plan and coordinate wellness programming. Grounded in Social Cognitive Theory (SCT), the purpose of this study was to evaluate the utility of the web-based, self-regulation system on physical activity (PA) behavior outcomes. At pre-test and post-test, students in SWITCH® schools (n = 8) completed the online Youth Activity Profile (YAP) to assess PA and sedentary behavior (SB). Students (n = 513) were categorized into high or low self-monitoring groups (using a median split) based on their use of the web-based …

The recent discovery of significant brown fat depots in adult humans has revived discussion of exploiting brown fat thermogenesis in the control of energy balance and body weight. The sympathetic nervous system (SNS) has a key role in the activation of brown fat and functional mapping of its components will be crucial for the development of specific neuromodulation techniques. The mouse is an important species used for molecular genetic modulations, but its small size is …

Alfalfa sprouts have been implicated in multiple foodborne disease outbreaks. This study evaluated the growth of Listeria monocytogenes during sprouting of alfalfa seeds and the effectiveness of daily chlorine dioxide & ozone rinsing in controlling the growth. Alfalfa seeds inoculated with L. monocytogenes were sprouted for 5 days (25°C) with a daily aqueous ClO2 (3 ppm, 10 min) or ozone water (2 ppm, 5 min) rinse. Neither treatment significantly reduced the growth of L. monocytogenes on sprouting alfalfa seeds. The initial level of L. monocytogenes was 3·44 ± 0·27, which increased to c. 7·0 log CFU per g following 3 …
