Third Party Intervention And Joinder As Of Right In International Arbitration: An Infringement Of Individual Contract Rights Or A Proper Equitable Measure?, S. I. Strong Jan 1998

Third Party Intervention And Joinder As Of Right In International Arbitration: An Infringement Of Individual Contract Rights Or A Proper Equitable Measure?, S. I. Strong

Faculty Publications

Arbitration has long been called a creature of contract, a dispute resolution mechanism that has no form or validity outside the four corners of the parties' arbitration agreement. Some feel, however, that it may be time to change this narrow interpretation of arbitration's function and scope, and nowhere is this need for reform more apparent than in the realm of multi-party international disputes. Arbitration has taken on an increasingly important role in international commercial transactions and has become the preferred dispute resolution mechanism in many types of transnational contracts. Although there are any number of reasons why this may be …

Prying, Spying And Lying: Intrusive Newsgather And What The Law Should Do About Them, Lyrissa Lidsky Jan 1998

Prying, Spying And Lying: Intrusive Newsgather And What The Law Should Do About Them, Lyrissa Lidsky

Faculty Publications

The media's use of intrusive newsgathering techniques poses an increasing threat to individual privacy. Courts currently resolve the overwhelming majority of conflicts in favor of the media. This is not because the First Amendment bars the imposition of tort liability on the media for its newsgathering practices. It does not. Rather, tort law has failed to seize the opportunity to create meaninful privacy protection. After surveying the economic, philosophical, and practical obstacles to reform, this Article proposes to rejuvenate the tort of intrusion to tip the balance between privacy and the press back in privacy's direction. Working within the framework …

Antiferromagnetic Hedgehogs With Superconducting Cores, Paul M. Goldbart, Daniel E. Sheehy Jan 1998

Antiferromagnetic Hedgehogs With Superconducting Cores, Paul M. Goldbart, Daniel E. Sheehy

Faculty Publications

Excitations of the antiferromagnetic state that resemble antiferromagnetic hedgehogs at large distances but are predominantly superconducting inside a core region are discussed within the context of Zhang’s SO(5)-symmetry-based approach to the physics of high-temperature superconducting materials. Nonsingular, in contrast with their hedgehog cousins in pure antiferromagnetism, these texture excitations are what hedgehogs become when the antiferromagnetic order parameter is permitted to “escape” into superconducting directions. The structure of such excitations is determined in a simple setting, and a number of their experimental implications are examined. © 1998 The American Physical Society.

Single-Head Spin Modes In Frontal Polymerization, Victor M. Ilyashenko, John A. Pojman Jan 1998

Single-Head Spin Modes In Frontal Polymerization, Victor M. Ilyashenko, John A. Pojman

Faculty Publications

The single-head spin mode is the first two-dimensional pattern of self-propagating thermal reaction fronts observed after the planar front loses stability. A "hot spot" is observed to propagate around the periphery of the front. The dynamics of the single-head frontal polymerization regime were studied experimentally, and two novel results were found. The "hot spot" was measured and found to be superadiabatic. The relationship between the rotational velocity and the propagating velocity was found. Experimental data were also compared with the theoretical results based on the linear stability analysis and found to be in a reasonable agreement. © 1998 American Institute …

Overt And Relational Aggression In Russian Nursery-School-Age Children: Parenting Style And Marital Linkages., C. H. Hart, D. A. Nelson, C. C. Robinson, S. F. Olsen, M. K. Mcneilly-Choque

Faculty Publications

Maternal and paternal parenting styles and marital interactions linked to childhood aggressive behavior as described in Western psychological literature were measured in an ethnic Russian sample of 207 families of nursery-school-age children. Results corroborated and extended findings from Western samples. Maternal and paternal coercion, lack of responsiveness, and psychological control (for mothers only) were significantly correlated with children's overt aggression with peers. Less responsiveness (for mothers and fathers) and maternal coercion positively correlated with relational aggression. Some of these associations differed for boys versus girls. Marital conflict was also linked to more overt and relational aggression for boys. When entered …

Accelerated Degradation Tests: Modeling And Analysis, William Q. Meeker, Luis A. Escobar, C. Joseph Lu Jan 1998

Accelerated Degradation Tests: Modeling And Analysis, William Q. Meeker, Luis A. Escobar, C. Joseph Lu

Faculty Publications

High reliability systems generally require individual system components having extremely high reliability over long periods of time. Short product development times require reliability tests to be conducted with severe time constraints. Frequently few or no failures occur during such tests, even with acceleration. Thus, it is difficult to assess reliability with traditional life tests that record only failure times. For some components, degradation measures can be taken over time. A relationship between component failure and amount of degradation makes it possible to use degradation models and data to make inferences and predictions about a failure-time distribution. This article describes degradation …

Heat Conduction In Fine Scale Mixtures With Interfacial Contact Resistance, Robert Lipton Jan 1998

Heat Conduction In Fine Scale Mixtures With Interfacial Contact Resistance, Robert Lipton

Faculty Publications

Heat conduction in a fine scale mixture of two conductors is examined in the presence of a contact resistance between phases. The problem is studied rigorously in the context of periodic homogenization. Unlike the case of perfect heat transmission between phases, the temperature gradients converge weakly as Radon measures. The strict ellipticity of the homogenized transport equation depends upon the geometry of the interface. The effective conductivity associated with the overall heat dissipation rate inside a composite cube is considered. It is shown that this property exhibits a size effect under rescaling.

Removal Of Bovine Serum Albumin From Cow's Milk Using Chicken Egg-Yolk Antibodies Immobilized On Chitosan Gel, Jack N. Losso, John Vanderstoep, Shuryo Nakai Jan 1998

Removal Of Bovine Serum Albumin From Cow's Milk Using Chicken Egg-Yolk Antibodies Immobilized On Chitosan Gel, Jack N. Losso, John Vanderstoep, Shuryo Nakai

Faculty Publications

Polyclonal chicken antibodies raised against bovine serum albumin (BSA) were immobilized on chitosan gel for the immunoaffinity isolation of BSA from cow's milk. Antibodies (IgY) against BSA were isolated from egg-yolk, purified and antibody reactivity to antigen was measured. lgY developed against BSA was reduced by 2-mercaptoethylamine. The reactivities of reduced and whole IgY against BSA were not significantly different. The reduced IgY was covalently linked to chitosan gel through stable covalent thioether linkages using sulfo-succinimidyl-4-(N-maleimidomethyl)cyclohexane-1-carboxylate (sulfo-SMCC) as a cross-linker. The density of antibody IgY immobilized on chitosan gel was approximately 3-5 mg per ml of chitosan gel. The ligand-binding …

Evidence In The Global Village: The Promise And Challenge Of Computer-Assisted Research In Intercollegiate Debate, Pat J. Gehrke

Faculty Publications

The growing importance of research databases and the proliferation of evidence sources on the Internet have provoked responses from the debate community ranging from ecstatic hope to pronounced fear. The debate community should critically incorporate databases and the Internet into its research. The benefits of computer-assisted research are plentiful, if we can appropriately adjust as a community to the age of digitized research.

Spatiotemporal Autoregressive Models Of Neighborhood Effects, R. Kelley Pace, Ronald Barry, John M. Clapp, Mauricio Rodriquez

Faculty Publications

Using 70,822 observations on housing prices from 1969 to 1991 from Fairfax County Virginia, this article demonstrates the substantial benefits obtained by modeling the spatial as well as the temporal dependence of the data. Specifically, the spatiotemporal autoregression with twelve variables reduced median absolute error by 37.35% relative to an indicator-based model with twenty-six variables. One-step ahead forecasts also document the improved performance of the proposed spatiotemporal model. In addition, the article illustrates techniques for rapidly computing the estimates and shows how to compute indices for any location.

Compilation Techniques For Out-Of-Core Parallel Computations, M. Kandemir, A. Choudhary, J. Ramanujam, R. Bordawekar

Faculty Publications

The difficulty of handling out-of-core data limits the performance of supercomputers as well as the potential of the parallel machines. Since writing an efficient out-of-core version of a program is a difficult task and virtual memory systems do not perform well on scientific computations, we believe that there is a clear need for compiler directed explicit I/O approach for out-of-core computations. In this paper, we first present an out-of-core compilation strategy based on a disk storage abstraction. Then, we offer a compiler algorithm to optimize locality of disk accesses in out-of-core codes by choosing a good combination of file layouts …

Struggling With The Devil: A Case Study Of Values In Conflict, Rosemary C. Salomone Jan 1998

Struggling With The Devil: A Case Study Of Values In Conflict, Rosemary C. Salomone

Faculty Publications

(Excerpt)

In recent years, with increasing frequency, the media has drawn national attention to communities caught in gridlock over value conflicts in the schools. From Lake County, Florida, where a conservative Christian school board required teaching that American culture is superior to others, to New York City, where a controversial multicultural curriculum and the now infamous book Heather Has Two Mommies precipitated the Chancellor's downfall, these stories capture our imagination. Nevertheless, regardless of where we stand on the political spectrum, we often dismiss such compelling conflicts as isolated and distant incidents, never to be replicated with any real or lasting …

The Evolution Of Health Care Decision Making: The Political Paradigm And Beyond, Elizabeth Price Foley, Elizabeth C. Price Jan 1998

The Evolution Of Health Care Decision Making: The Political Paradigm And Beyond, Elizabeth Price Foley, Elizabeth C. Price

Faculty Publications

The ascendancy of the political paradigm as the primary mode of health care decision-making is a natural evolutionary reaction to the unrestrained market paradigm. Although a certain of political intrusion into the health care marketplace is both necessary and useful, it has the potential to unravel the efficiencies achieved by managed care. Overzealous intervention in the health care market in the name of "reform" may cause the health care decision-making pendulum to swing back to the provider paradigm, with its tendency to escalate health care costs and diminish access. One possible way to achieve decision-making equilibrium and and end the …

Bureaucracy In The Postmodern World: Problems And Solutions, Paul C. Godfrey, Grant C. Madsen Jan 1998

Bureaucracy In The Postmodern World: Problems And Solutions, Paul C. Godfrey, Grant C. Madsen

Faculty Publications

This paper considers the problems presented by modern bureaucratic organizations within the framework of postmodern philosophy. Bureaucracy represents the logical outcome of the rational tradition in western philosophy. Because of their efficiency properties, individuals are both the beneficiaries and victims of bureaucratic behavior. We suggest that a solution to these problems will not be found by using existing philosophical frameworks. The French philosopher Jean-Francois Lyotard presents a model of postmodern relationships based on language games. We explore the concept of language games within bureaucratic settings.

Faculty Publications

This study explored the psychometric properties of the Orientation Toward Domestic Labor Questionnaire (ODL-Q) with a sample of 622 dual-earner wives. Adequate internal consistency reliability was obtained for most of the construct in the ODL-Q. In addition, construct validity for the ODL-Q was provided with multiple regression and discriminant analyses of the constructs' relationships to wives' sense of fairness about family work. The ODL-Q scales accounted for 57% of the variance in wives' sense of fairness. Effective communication about domestic labor (expressions of appreciation, sympathetic listening, mutual decision making) was by far the most powerful predictor and discriminator of fairness. …
