The Year Of Truman Capote: Legal Ethics And In Cold Blood, David S. Caudill Jan 2007

The Year Of Truman Capote: Legal Ethics And In Cold Blood, David S. Caudill

Faculty Publications

The purpose of this study is to use Capote’s In Cold Blood as a point of reflection on several ethical obligations of lawyers. In Part I, I focus on Capote’s accounts of the prosecution’s use of expert witnesses, and his suggestion that defense counsel were (i) unable or unwilling to deal with their personal conflicts of interest and (ii) incompetent, the latter of which became the subject of disciplinary investigations and federal court review. In terms of the duties of an advocate, Capote sees the prosecution as going too far, and the defense as failing to go far enough. In …

Before Jeremiah Was: Divine Election In The Ancient Near East, Dana M. Pike

Faculty Publications

FRAGMENTS OF GOSPEL TRUTHS are often detected by Latter-day Saint scholars studying ancient texts, especially texts from the ancient Near East. This essay focuses on one example of this phenomenon. Divine election—the academic designation for the choosing of people by deity for position and opportunity in mortal life—is a claim that is well attested in ancient Near Eastern texts, including the Hebrew Bible.¹ Latter-day Saints correlate certain aspects of this concept with premortal foreordination and are familiar with a few key biblical passages, such as Jeremiah 1:5, that feature divine election. However, many Latter-day Saints are less familiar with the …

Art, Ecology And Art Education: Locating Art Education In A Critical Place-Based Pedagogy, Mark Graham Jan 2007

Art, Ecology And Art Education: Locating Art Education In A Critical Place-Based Pedagogy, Mark Graham

Faculty Publications

In contemporary life and education, the local is marginalized in favor of large-scale economies of consumption that are indifferent to ecological concerns. The consequences of neglecting local human and natural communities include a degraded habitat, loss of wilderness, alienation, rootlessness, and lack of connection to communities. Critical place-based pedagogy provides a robust framework for the theory and practice of art education that is concerned with ecological issues. This article locates art education within a critical pedagogy of place as a prelude to describing contemporary art and art education that is engaged with ecological Issues.

An Interview With Fred Wilson, Mark Graham Jan 2007

An Interview With Fred Wilson, Mark Graham

Faculty Publications

Abstract The medium of artist Fred Wilson is the museum. He delves deep into museum collections to expose unexamined assumptions about power, place, privilege, and history. His installations include wall labels, educational materials, lighting, and non-traditional pairings of objects. His work is not only about the objects on display, but about how the whole museum environment can generate meaningful questions about art, history, and the role of the museum in its community. In this interview, Fred Wilson discusses how he works with the objects, places, and people that are part of the museum environment.

Empowering Or Compelling Reluctant Participators Using Audience Response Systems, Charles R. Graham, Tonya R. Tripp, Larry Seawright, George L. Joeckel Iii

Faculty Publications

This article investigates the impact of an audience response system (ARS) on student engagement in undergraduate university courses. A survey was administered to students in a dozen courses piloting the ARS system. On 13 out of 14 measures the majority of students thought the system was helpful. Overall, students were more positive about the use of the ARS in courses that used the tool for formative feedback (empowering) rather than for grading or attendance purposes (compelling). The authors discuss the positive impact of the ARS on the engagement of ‘reluctant participators’ or students who reported that they are least likely …

Graduate Digital Forensics Education At The Air Force Institute Of Technology, Gilbert L. Peterson, Richard A. Raines, Rusty O. Baldwin

Faculty Publications

The Department of Electrical and Computer Engineering (AFIT/ENG) at the Air Force Institute of Technology (AFIT), currently offers a graduate-level introductory course in digital forensics. Students are introduced and exposed to several challenges and topics in the digital forensics course. The course addresses the ethical and legal procedures as well as basic forensic science principles in only the most general manner. A larger percentage of lecture and lab time is spent discussing the technical details of incident response and media analysis. The detail into the network forensics and digital device analysis topics start to breach technical details but not to …

Australian youth engage in behaviour that threatens their health and wellbeing. National surveys report that about a third of young Australians have tried an illicit drug. High rates of substance use and risky sexual behaviour among young Australians suggest that effective prevention efforts based on empirical evidence need to be expanded. Church-associated organisations are an untapped resource that could be used to improve the health and welfare of young people. We describe eight evidence-based elements to consider in designing strategies to prevent high-risk behaviour in young people.

Homogenization And Field Concentrations In Heterogeneous Media, Robert Lipton Dec 2006

Homogenization And Field Concentrations In Heterogeneous Media, Robert Lipton

Faculty Publications

A multiscale characterization of the field concentrations inside composite and polycrystalline media is developed. We focus on gradient fields associated with the intensive quantities given by the temperature and the electric potential. In the linear regime these quantities are modeled by the solution of a second order elliptic partial differential equation with oscillatory coefficients. The characteristic length scale of the heterogeneity relative to the sample size is denoted by ε and the intensive quantity is denoted by u ε. Field concentrations are measured using the L p norm of the gradient field ||∇u ε||L p(D) for 2 ≤ p < ∞. The analysis focuses on the case when 0 < ε ≪ 1. Explicit lower bounds on lim inf ε→0 are developed. These bounds provide a way to rigorously assess field concentrations generated by the microgeometry without having to compute the actual field u ε. © 2006 Society for Industrial and Applied Mathematics.

Optimization Of Composite Structures Subject To Local Stress Constraints, Robert Lipton, Michael Stuebner Dec 2006

Optimization Of Composite Structures Subject To Local Stress Constraints, Robert Lipton, Michael Stuebner

Faculty Publications

An extension of current methodologies is introduced for optimization of graded microstructure subject to local stress criteria. The method is based on new multiscale stress criteria given by macrostress modulation functions. The modulation functions quantify the intensity of local stress fluctuations at the scale of the microstructure due to the imposed macroscopic stress. The methodology is illustrated for long cylindrical shafts reinforced with stiff cylindrical elastic fibers with generators parallel to the shaft. Examples are presented for shaft cross sections that possess reentrant corners typically seen in lap joints and junctions of struts. It is shown that the computational methodology …

The Smith-Mundt Act's Ban On Domestic Propaganda: An Analysis Of The Cold War Statute Limiting Access To Public Diplomacy, Edward L. Carter, Allen W. Palmer Dec 2006

The Smith-Mundt Act's Ban On Domestic Propaganda: An Analysis Of The Cold War Statute Limiting Access To Public Diplomacy, Edward L. Carter, Allen W. Palmer

Faculty Publications

For more than fifty years, the U.S. Code has authorized the federal government to disseminate messages about America to international audiences. For at least thirty years, federal law has also prohibited those international propaganda messages from being disseminated within the United States. Given the realities of the acceleration and dispersion of information flow across international borders in the twenty-first century, a ban on dissemination of information that is tied to geographic boundaries raises both practical and policy issues. The domestic dissemination ban may have outlived its usefulness and relevance. Further, futile enforcement of the statute contradicts general U.S. policy promoting …

Information Infrastructure For Integrated Ecohydraulic And Water Resources Modeling And Assessment, R. Wallace, K. Pathak, M. Fife, Norman L. Jones, J. P. Holland, D. Stuart, J. Harris, C. Butler, D. R. Richards Dec 2006

Information Infrastructure For Integrated Ecohydraulic And Water Resources Modeling And Assessment, R. Wallace, K. Pathak, M. Fife, Norman L. Jones, J. P. Holland, D. Stuart, J. Harris, C. Butler, D. R. Richards

Faculty Publications

Watershed management increasingly requires ecohydraulic modeling and assessment within a regional context, rather than on a project-by-project basis. Such holistic modeling and assessment require evaluation capabilities across multiple temporal and spatial scales. Thus, modeling and assessment tools must be integrated in a scientifically and computationally effective infrastructure. The US Army Engineer Research and Development Center, in concert with the Hydrologic Engineering Center and its academic partners, including Brigham Young University, is establishing a comprehensive set of hydroinformatics modeling and assessment tools for ecohydraulic and water resources management applications, all linked based on a common data and information infrastructure. This paper …

Two experiments studied the effects of pretreatment with estradiol benzoate before treatment with a dopamine antagonist on prolactin secretion and reproductive traits in mares during (1) the seasonal anovulatory period and (2) the normal breeding season. Experiment 1 was performed in winter with 17 mares selected for low follicular activity. Nine mares received estradiol benzoate injections every other day for a total of 10 injections; 8 mares received similar injections of vehicle. Ten days after onset of injections, all mares were placed on daily injections of sulpiride (250 mg) for 35 days or until ovulation. Plasma prolactin concentrations were higher …

The synthesis of new benzo[a]- and [b]xanthene dye frameworks is described. A unique benzo[a]xanthene, seminaphtho[a]fluorone (SNAFR-1), is studied in a variety of media. The optimization of solution parameters and excitation wavelengths allows SNAFR-1 to display red, green, and blue emission bands of approximately equal intensities and also to produce white light. Ratiometric red (anion) and green (neutral) emissions are observed upon varying solution pH. A pH-independent violet-blue emission band is due to the addition of nucleophiles to the benzylic carbon of SNAFR-1. © 2006 American Chemical Society.

Developing A Campus Copyright Education Program: Conquering The Challenge, Susie Quartey Nov 2006

Developing A Campus Copyright Education Program: Conquering The Challenge, Susie Quartey

Faculty Publications

Developing a copyright educational program at a University can be a daunting task. Many professors do not want to hear the word in connection with their teaching or academic pursuits. It can strike fear in the hearts of many educators who have hidden behind the mask of ignorance for years. With the complex nature of copyright law and budget restrictions, few institutions have the luxury of on-site copyright experts. A well-planned, conscientiously formulated copyright education campaign can ease the anxieties of the ignorant; empower the helpless; and fuel the passion of those striving to enlighten others about copyright compliance at …

Alienated Catholics: Establishing The Groundwork For Dialogue, Catherine M. Murphy

One of the earliest arguments against women's ordination the U.S. Conference of Catholic Bishops articulated in 1972 was that, since the incarnation of God was in a male, this culminates in a male priesthood. This reflects a hierarchical anthropology well-known from Christianity's earliest encounters with the Greco-Roman world, whereby the male was associated with the mind, reason, and the spirit, while the female was associated with the body, passion, and the material world.1 In fact, some Greek doctors and philosophers thought that every fetus began as a male, but those that didn't develop fully became female.2 Thomas Laqueur …

Bankruptcy Reform: What's Tax Got To Do With It?, Michelle A. Cecil Oct 2006

Bankruptcy Reform: What's Tax Got To Do With It?, Michelle A. Cecil

Faculty Publications

The article takes a two-pronged approach to the issue. First, it argues that all post-petition appreciation should be taxed to the debtor rather than to the debtor's bankruptcy estate because the debtor enjoys the benefits of the asset's appreciation in value and because, from a tax perspective, the results will be identical irrespective of whether the debtor or the bankruptcy estate is taxed on the asset's post-petition appreciation. Second, the article proposes that the gain accruing before the termination of the bankruptcy proceeding be treated as discharge of indebtedness income so that the debtor can defer recognition of the gain …

This spring the New York Stock Exchange, Inc. (NYSE) completed an historic restructuring. On March 7, 2006, the NYSE completed its merger with Archipelago Holdings Inc. (Archipelago), a publicly traded electronic trading platform. As a result, the old NYSE itself will become the New York Stock Exchange LLC, a wholly owned subsidiary of NYSE Group, Inc. (NYSE Group). The former members, or seat holders, of the NYSE will receive one of three forms of consideration: all cash, all stock in NYSE Group, or a package of cash and stock. Then, NYSE Group will allow those former members to offer their …

Steganography (stego) is used primarily when the very existence of a communication signal is to be kept covert. Detecting the presence of stego is a very difficult problem which is made even more difficult when the embedding technique is not known. This article presents an investigation of the process and necessary considerations inherent in the development of a new method applied for the detection of hidden data within digital images. We demonstrate the effectiveness of learning vector quantization (LVQ) as a clustering technique which assists in discerning clean or non-stego images from anomalous or stego images. This comparison is conducted …

With the growth of open source software and other related trends, a culture of openness is advancing from the edges of society to the core of academic culture. In this article I provide an overview of how the expansion of open source software in culture at large has affected the world of education, describe how the greater use of open source software in education has unfolded hand-in-hand with the development of open course content and open access research, and argue that this more comprehensive shift towards "openness" in academic practice is not only a positive trend, but a necessary one …
