Missing Evidence, Dale A. Nance Jan 1991

Missing Evidence, Dale A. Nance

Faculty Publications

Given the nature of my enterprise, I resist stating a specific thesis. Nevertheless, for the reader who wants an organizing or motivating principle, I offer the following two recurrent themes. First, I want to examine the relationship of traditional admissibility rules to the problem of missing evidence and to other forms of juridical response to that problem. The reason for this interest will be explained in the next section. Second, I want to investigate, as we proceed, the extent to which the regulation of proof, evidence law broadly conceived, is instrumentally related to accuracy or truth seeking, and the extent …

'The Savior Of The World' (John 4:42), Craig R. Koester Jan 1990

'The Savior Of The World' (John 4:42), Craig R. Koester

Faculty Publications

Jesus’ encounter with the Samaritan woman in John 4 draws on themes of Roman imperialism and Samaria’s colonial history. The Samaritan townspeople call Jesus “the Savior of the world” (4:42), a title used for Roman emperors from Julius Caesar to Hadrian. They go out to meet Jesus and welcome him to their town, a practice used to welcome emperors and other dignitaries. Using a title of empire-wide significance emphasizes that Jesus now transcends older national divisions. The Samaritan woman speaks as an individual and representative of her people. Her personal history with five husbands parallels her national history of colonization …

The Burden Of Responsibility In The Libro De Buen Amor, Lynn Williams Jan 1990

The Burden Of Responsibility In The Libro De Buen Amor, Lynn Williams

Faculty Publications

In three of the early sections of the Libro de buen amor, Juan Ruiz explains to his public how, for various reasons, he is conditioned to love women. In stanzas 71-76 he uses the unimpeachable authority of Aristotle to argue that men and animals are biologically determined to seek 'juntamiento con fenbra plazentera' (st. 71d), and since he is a man like any other, it is natural, perhaps even inevitable, that from time to time he too should feel the attraction of the opposite sex. Paraphrasing St Paul (I Thessalonians 5.21), the Archpriest tells us rather cheekily that one must …

Primo Levi: The Drowned, The Saved, And The "Grey Zone", Ilona Klein Jan 1990

Primo Levi: The Drowned, The Saved, And The "Grey Zone", Ilona Klein

Faculty Publications

Primo Levi has been well known in Italy for many years. Even though his first book Se questo è un uomo–published in English as Survival in Auschwitz–did not sell well when first published by De Silva in 1947 (2,500 copies published, of which 600 remained unsold and were eventually destroyed by the 1966 flood in Florence), it was accepted unanimously in Italy as a literary masterpiece and a great witness to history when Einaudi republished the volume in 1956. From that moment on, Italian readers and critics have acknowledged the literary beauty and importance of Levi's writings. He …

Teaching In A Liberal Arts College: How Foreign Language Courses Contribute To "Writing Across The Curriculum" Programs, Ilona Klein Jan 1990

Teaching In A Liberal Arts College: How Foreign Language Courses Contribute To "Writing Across The Curriculum" Programs, Ilona Klein

Faculty Publications

This essay shares some thoughts about the need for interaction between foreign language instructors and English teachers, both in high schools and at the university level. As a foreign language teacher for the past nine years (the last four in a liberal arts college), I have encountered several problems and difficulties that could be overcome, I believe, if English, Writing, and Foreign Language departments addressed them together. I do not claim to be able to give definite answers, since many pedagogical concepts concerting L2 acquisition/learning and their possible application to writing programs remain misunderstood or are presently debated by teacher …

"Official Science Often Lacks Humility": Humor, Science, And Technology In Levi's Storie Naturali, Ilona Klein Jan 1990

"Official Science Often Lacks Humility": Humor, Science, And Technology In Levi's Storie Naturali, Ilona Klein

Faculty Publications

Primo Levi's third book, written under the pseudonym of "Damiano Malabaila," was published for the first time in the fall of 1966 by Einaudi. Storie naturali is a collection of fifteen short stories which represent the beginning of a new Cours in the author's narrative. After the autobiographical Survival in Auschwitz of 1947 and his second book of 1963 The Reawakening–both dealing with the Holocaust and its aftermath–Storie Naturali ("Natural Stories," not yet published in English) represented such a break in the literary patter established by Levi up to that point, that the author decided to use a …

Distancing As A Casual Factor In The Development Of /0/ And /X/ In Spanish, David Eddington Jan 1990

Distancing As A Casual Factor In The Development Of /0/ And /X/ In Spanish, David Eddington

Faculty Publications

The evolution of the Spanish sibilant system has been an object of study since the late nineteenth century. Since that time, a myriad of books and articles have been published on the subject whose major focus has been to determine the exact nature of the sibilant changes and the chronology of each change. As is the case in most historical work, the question of why phonological systems evolve usually takes on only secondary importance. Among those theories proposed in order to explain why phonetic changes occur is the functionalist idea that there needs to be an optimal acoustic distance between …

The Order Of Santo Stefano In The Levant: An Unpublished Account Of A Voyage In 1627, Ilona Klein, Christopher Kleinhenz

Faculty Publications

On 12 April 1627 a fleet of six galleys belonging to the Order of Santo Stefano set sail from Livorno on their expedition "contro il comune nemico"–the Turks. This journey would take them along the western and southern coast of Italy, through the Ionian Sea to the Peloponnese and across the Aegean Sea to the Dardanelles. Along the way the sailors encountered many vessels, both friend and foe, heard reports of sea battles and movements of ships in those waters, and listened to an account of a miracle wrought by the Virgin Mary. After having engaged in two fierce skirmishes …

Meeting The Needs Of The Foreign Matesl Student, Cheryl A. Roberts, Carolyn L. Shields

Faculty Publications

In response to the increasing proportion of foreign graduate students in master's programs for teachers of English as a second language (MATESL); students in the University of Northern Iowa's program were surveyed concerning the appropriateness of the programs' design. In in-depth interviews and on questionnaires; foreign graduate students were asked which courses are most applicable to their home teaching situation; what courses should be added; whether the program fulfills original expectations; how the differences in the educational system make the program easier or more difficult; and what changes might make the program more relevant to student needs. Overall; little need …

Communication Strategies And Psychological Processes In Interlanguage Written Discourse, B Kumaravadivelu Jan 1988

Communication Strategies And Psychological Processes In Interlanguage Written Discourse, B Kumaravadivelu

Faculty Publications

Several papers have appeared on the strategies of communication used by L2 learners. However, very little work has been done to determine the underlying psychological processes that generate communication strategies (CS). This paper assumes that any description of CS should be based on a description of the processes governing CS. The paper attempts to correlate CS with psychological processes by analyzing interlanguage (IL) written discourse produced by advanced Tamil learners of English as a Second Language.

Giovanni Maria Artusi's L'Artusi Overo Delle Imperfettioni Della Moderna Musica (1600): A Translation And Commentary, Malcolm Litchfield Aug 1987

Giovanni Maria Artusi's L'Artusi Overo Delle Imperfettioni Della Moderna Musica (1600): A Translation And Commentary, Malcolm Litchfield

Faculty Publications

Giovanni Maria Artusi is well known for his conservative role in the debate between advocates of the prima and seconda pratiche. Contemporary authors marvel at Artusi's audacity in criticizing the genius of Monteverdi. Though often viewed as a pedant, Artusi was a significant Italian theorist who understood ancient Greek theory and had innovative ideas for applying this ancient knowledge to modern practice.

L' Artusi, overo Delle imperfettioni deIla moderna musica was written to illuminate and correct errors Artusi found in contemporary scholarship (chiefly in Bottrigari's work) and composition (specifically, certain liberties in Monteverdi's madrigals). Artusi effectively argues for a universal …

A Few Still Later Words On Translating Homer, Or C. S. Calverley And The Victorian Parodic, Patrick G. Scott

Faculty Publications

Argues (largely in the style of Matthew Arnold) that the Victorian verse parodist C.S. Calverley can best be understood through 19th century ideas of verse translation, and especially through the writing on parody of the Scottish lawyer Alexander Fraser Tytler, Lord Woodhouselee, in his Essay on the Principles of Translation (1792).

"Your Honor Our Honor, It Was Lik , It Was Like This... E This...": Narr ": Narrative Discourse In Small Discourse In Small Claims Court, Mark W. Tanner

Faculty Publications

Small claims court is not a building or a courtroom, but a special procedure, established by each state, which simplifies the court process for a specified range of civil disputes involving relatively small amounts of money (Ruhnka 1878: 1). The intent of the small claims process is to provide the parties involved (litigants) with an opportunity for a low cost, speedy means of settling a dispute. Litigants (plaintiff and defendant) in small claims court may represent themselves in a semi-formal setting where the normal legal rules for the presentation of evidence have been simplified.

The Separation Of Law And Morals, Noel B. Reynolds Nov 1986

The Separation Of Law And Morals, Noel B. Reynolds

Faculty Publications

The classic opposition of legal positivism and natural law theory resurfaces continually and reminds us that we have yet to resolve this key conflict in our ways of understanding the moral authority of law. The strengths and weaknesses of the two theories are reviewed—both have fatal flaws. Conventionalism is proposed as a means of finding internal standards in a man-made system of law. The naturally emerging standards for a conventionalist system of law turn out to be the already familiar principles of the rule of law.

Eager, bright eyed children gather close around the teacher's chair, where she holds several enticing books. In this multiethnic class she makes very sure that Juanita, Pablo, and Kim, who know little English, are seated close to her where they can point to pictures and hear her words clearly. The teacher begins with The Very Hungry Caterpillar, the children giggling as he eats his way through "One red apple", "Two yellow pears", etc. While the story is reread the children join in chorus as different pupils point to the pictures. The teacher continues with Teddy Bears One to Ten, Ape …
