Branding In China: Alternative Brand Strategiesbranding In China: Global Product Strategy Alternatives, Ilan Alon, Romie F. Littrell, Allan K.K. Chan

Faculty Publications

This article reviews and discusses issues in translation of international brand names to Chinese, and provides a framework for international brand managers who want to expand into China. Linguistic differences between Chinese and English are wide and deep, making translation of brand names difficult. Cultural context, pronunciation, written vs. oral language, and meaning of characters are just a few examples of such difficulties. We discuss four global-product-naming strategic alternatives available to country/brand managers, along with their usage, and give examples of brands utilizing the different approaches. The four approaches we discuss include (1) dual extension, (2) brand meaning extension, (3) …

Environmental Dynamism, Innovation And Dynamic Capabilities: The Case Of China, Ilan Alon, Hao Jiao, Yu Cui

Faculty Publications

Based on the resource-based view, creating and maintaining a long-term competitive advantage requires significant attention to developing and nurturing dynamic capabilities in emerging markets. This study considers environmental dynamism as a moderating variable, then builds a theoretical model for innovation strategy and dynamic capabilities, and finally summarizes the building mechanism for dynamic capabilities. The empirical results find that an innovation strategy can build and upgrade dynamic capabilities in both stable and rapidly changing environments. Managerial implications and future research directions are discussed.

Bidirectional Interference Between Speech And Postural Stability In Individuals With Parkinson's Disease, Christopher Dromey, Eon Jarvis, Stuart Sondrup, Shawn Nissen, K. Bo Foreman, Leland E. Dibble Jan 2010

Bidirectional Interference Between Speech And Postural Stability In Individuals With Parkinson's Disease, Christopher Dromey, Eon Jarvis, Stuart Sondrup, Shawn Nissen, K. Bo Foreman, Leland E. Dibble

Faculty Publications

Because people frequently talk while engaged in other activities, and because Parkinson's disease (PD) is known to diminish multi-tasking performance, we examined dual task interference between speaking and postural stability in 9 individuals with PD, 7 age-matched and 10 healthy young controls. Participants repeated a target utterance and performed a rise to toes task in both single and dual task conditions. Diphthong transitions were measured from audio recordings and postural variables reflecting planning, coordination, and stability were derived from a multi-camera motion capture system and force plate recordings. Thus, sensitive measures of both control groups for the isolated postural task, …

The Political Fourth Amendment, Thomas P. Crocker Jan 2010

The Political Fourth Amendment, Thomas P. Crocker

Faculty Publications

The Political Fourth Amendment builds on Justice Ginsburg's recent dissent in Herring v. United States to argue for a "more majestic conception" of the Fourth Amendment focused on protecting political liberty. To put the point dramatically, we misread the Fourth Amendment when we read it exclusively as a criminal procedure provision focused entirely on either regulating police or protecting privacy. In order to see the Fourth Amendment as contributing to the Constitution's protections for political liberty, and not simply as an invitation to regulate police practice, we must take seriously the fact that the Fourth Amendment's textual purpose is to …

Dangerous Terrain: Mapping The Female Body In Gonzales V. Carhart, B. Jessie Hill Jan 2010

Dangerous Terrain: Mapping The Female Body In Gonzales V. Carhart, B. Jessie Hill

Faculty Publications

The body occupies an ambiguous position within the law. It is, in one sense, the quintessential object of state regulatory and police power, the object that the state acts both upon and for. At the same time, the body is often constructed in legal discourse as the site of personhood - our most intimate, sacred, and inviolate possession. The inherent tension between these two concepts of the body permeates the law, but it is perhaps nowhere more prominent than in the constitutional doctrine pertaining to abortion. Abortion is one of the most heavily regulated medical procedures in the United States, …

Of Christmas Trees And Corpus Christi: Ceremonial Deism And Change In Meaning Over Time, B. Jessie Hill

Faculty Publications

Although the Supreme Court turned away an Establishment Clause challenge to the words “under God” in the Pledge of Allegiance in Elk Grove Unified School District v. Newdow, the issues raised by that case are not going away anytime soon. Legal controversies over facially religious government speech have become one of the most regular and prominent features of Establishment Clause jurisprudence – and indeed, a second-round challenge to the Pledge of Allegiance is currently percolating, which is likely to result in resolution by the Supreme Court.

That resolution will depend on an understanding of the social meaning of the practice …

Legal Forms And The Common Law Of Patents, Craig Allen Nard Jan 2010

Legal Forms And The Common Law Of Patents, Craig Allen Nard

Faculty Publications

The question of institutional choice is important in all areas of the law, but particularly in the context of patent law with its divergent stakeholders, decentralized variance among industries regarding how the patent system is viewed and relied upon, and a persistent focus on reform in recent years. For over two hundred years, the courts have been the dominant force in the development of patent law. It should therefore come as no surprise to learn that a significant portion of American patent law, including some of the most important and controversial patent law doctrines, is either built upon judicial interpretation …

Tag Dictionaries Accelerate Manual Annotation, Deryle W. Lonsdale, Marc A. Carmen, Paul Felt, Robbie A. Haertel, Peter J. Mcclanahan, Eric K. Ringger, Kevin Seppi

Faculty Publications

Expert human input can contribute in various ways to facilitate automatic annotation of natural language text. For example, a part-of-speech tagger can be trained on labeled input provided offline by experts. In addition, expert input can be solicited by way of active learning to make the most of annotator expertise. However, hiring individuals to perform manual annotation is costly both in terms of money and time. This paper reports on a user study that was performed to determine the degree of effect that a part-of-speech dictionary has on a group of subjects performing the annotation task. The user study was …

Multiple Intelligences In The Gospel Classroom, John Hilton Iii Jan 2010

Multiple Intelligences In The Gospel Classroom, John Hilton Iii

Faculty Publications

In a worldwide training broadcast, Elder W. Rolfe Kerr taught, “We cannot expect our students to learn all that we hope they will learn by just hearing a concept or principle one time. Multiple presentations, utilizing various approaches, often appealing to multiple senses, increase the likelihood of our students actually learning and internalizing the concepts we teach.”

A Probabilistic Morphological Analyzer For Syriac, Deryle W. Lonsdale, Peter J. Mcclanahan, George Busby, Robbie A. Haertel, Kristian Heal, Kevin Seppi, Eric K. Ringger Jan 2010

A Probabilistic Morphological Analyzer For Syriac, Deryle W. Lonsdale, Peter J. Mcclanahan, George Busby, Robbie A. Haertel, Kristian Heal, Kevin Seppi, Eric K. Ringger

Faculty Publications

We define a probabilistic morphological analyzer using a data-driven approach for Syriac in order to facilitate the creation of an annotated corpus. Syriac is an under-resourced Semitic language for which there are no available language tools such as morphological analyzers. We introduce novel probabilistic models for segmentation, dictionary linkage, and morphological tagging and connect them in a pipeline to create a probabilistic morphological analyzer requiring only labeled data. We explore the performance of models with varying amounts of training data and find that with about 34,500 labeled tokens, we can outperform a reasonable baseline trained on over 99,000 tokens and …

Legal Transitions And The Problem Of Reliance, David M. Hasen Jan 2010

Legal Transitions And The Problem Of Reliance, David M. Hasen

Faculty Publications

This Article analyzes the literature on legal transitions. The principal focus is taxation, but the analysis generalizes to other areas. I argue that the theoretical apparatus developed by scholars active in the legal transitions area suffers from significant conceptual shortcomings. These shortcomings include the unwarranted assimilation of legal to factual change, the naturalization of conventional arrangements, and the disregard of the distinction between making law and finding it. As a consequence, the recent literature offers an analysis that is unable either to explain actual transitions or to provide an adequate theory of how legal change should take place. In the …

Up To D[Eb]Ate On Raising And Control, Part 1: Properties And Analyses Of The Constructions, Susannah Kirby, William D. Davies, Stanley William Dubinsky

Faculty Publications

This is the first part of a two-part article that reviews a number of the current debates regarding raising and control constructions. The issues addressed in this part include the syntactic attributes governing their distribution; the characterization of the relevant silent elements; the empirical properties which may distinguish/unify two classes of constructions (on either syntactic or semantic grounds).

Argument Constructions And Language Processing: Evidence From A Priming Experiment And Pedagogical Implications, David Eddington, Francisco Ruiz De Mendoza Jan 2010

Argument Constructions And Language Processing: Evidence From A Priming Experiment And Pedagogical Implications, David Eddington, Francisco Ruiz De Mendoza

Faculty Publications

The notion of argument construction is widely accepted in Cognitive Linguistics circles as a highly explanatory theoretical construct. It has recently been incorporated into the Lexical-Constructional Model (LCM; Ruiz de Mendoza and Mairal 2007, 2008), a theoretical approach to meaning construction that integrates argument constructions into a broader model that incorporates meaning dimensions traditionally dealt with in the domain of pragmatics and discourse analysis. The LCM has an argument level of description, in the form of constructional templates, which are in general equivalent to the argument constructions postulated in Goldberg’s (1995, 2006) Construction Grammar, although there are crucial differences in …

Statutory Interpretation In The Roberts Court's First Era: An Empirical And Doctrinal Analysis, Anita S. Krishnakumar Jan 2010

Statutory Interpretation In The Roberts Court's First Era: An Empirical And Doctrinal Analysis, Anita S. Krishnakumar

Faculty Publications

This Article examines the Roberts Court's statutory cases from its 2005-2008 Terms, beginning with cases decided after January 31, 2006, when Justice Alito joined the Court, and concluding with cases decided on June 29, 2009, when Justice Souter retired. The Article's approach is both empirical and doctrinal, in that it (1) presents descriptive statistics illustrating the Court's and individual Justices' rates of reliance on fourteen different tools of statutory construction, and (2) engages in doctrinal analysis of the Court's statutory cases, highlighting discernable patterns in the individual Justices' interpretive approaches. The Article makes two significant contributions to the field of …

From Kosovo To Catalonia: Separatism And Integration In Europe, Christopher J. Borgen Jan 2010

From Kosovo To Catalonia: Separatism And Integration In Europe, Christopher J. Borgen

Faculty Publications

In July 2010 the International Court of Justice rendered its Advisory Opinion on the legality of Kosovo's declaration of independence and the Constitutional Court of Spain rendered an opinion concerning the autonomy of Catalonia. Two very different cases, from very different places, decided by very different courts. Nonetheless, they each provide insights on the issue of separatism in the midst of European integration. Does the Kosovo opinion open the door for other separatist groups? Does the process of European integration increase or undercut separatism? In addressing these questions, this article proceeds in three main parts. Part A briefly recaps the …

Ontologies For Multilingual Extraction, Deryle W. Lonsdale, David W. Embley, Stephen W. Liddle Jan 2010

Ontologies For Multilingual Extraction, Deryle W. Lonsdale, David W. Embley, Stephen W. Liddle

Faculty Publications

In our global society, multilingual barriers sometimes prohibit and often discourage people from accessing a wider variety of goods and services. We propose multilingual extraction ontologies as an approach to resolving these issues. As envisioned, our ontologies provide a conceptual framework for a narrow domain of interest. Grounding narrow-domain ontologies linguistically enables them to map relevant utterances and text to meaningful concepts in the ontology. Our prior work includes leveraging large-scale lexicons and terminology resources for grounding and augmenting ontological content [12]. Linguistically grounding ontologies in multiple languages enables cross-language communication within the scope of the various ontologies’ domains. Technically, …

A Comparison Of Two Tools For Analyzing Linguistic Data: Logistic Regression And Decision Trees, David Eddington Jan 2010

A Comparison Of Two Tools For Analyzing Linguistic Data: Logistic Regression And Decision Trees, David Eddington

Faculty Publications

The present paper compares logistic regression (referred to herein as its implementation in Varbrul) with another method for analyzing linguistic data-decision trees. Comparison of the two methods demonstrates that decision trees are able to find the same sorts of generalizations as Varbrul. However, decision trees provide more coarsely-grained output compared with Varbrul’s more informative factor weights. In addition, decision trees often mistakenly overgeneralize. Nevertheless, decision trees can be used in tandem with Varbrul. Because decision trees automatically calculate interactions, they suggest interaction terms that may be considered in subsequent Varbrul analyses. Decision trees also allow continuous variables in contrast to …

"Life Is Beautiful, Or Is It?" Asked Jakob The Liar, Ilona Klein Jan 2010

"Life Is Beautiful, Or Is It?" Asked Jakob The Liar, Ilona Klein

Faculty Publications

In 1999 the 71st Academy Awards ceremony awarded to the film The Last Days the prize for Best Documentary Feature. Underwritten by Steven Spielberg's Survivors of the Shoah Visual History Foundation, this documentary depicts in a compelling, historically objective fashion what the Nazi regime called the "Endlösung" ["Final Solution"]: the effort to annihilate all of European Jewry. In the film, five Hungarian survivors are interviews with honesty and compassion. Their answers record history as it unwound. Clearly, the intent of the interviews is to assure that historical facts are not falsified, nor taken for granted. Documentaries of this kind can …

Contextualizing Corrective Feedback In L2 Writing Pedagogy, Norman W. Evans, K. James Hartshorn, Robb M. Mccollum, Mark Wolfersberger

Faculty Publications

Although effective writing skills are vital to the success of university-level students, second language (L2) writers face unique challenges in developing these skills. This is particularly relevant to their ability to produce writing that is linguistically accurate. While many writing teachers feel a great commitment to these students, much of the research has either led to conflicting results or provided teachers with limited practical guidelines that can be utilized effectively in the classroom. This is especially true regarding written corrective feedback (WCF). Therefore, this article provides L2 writing teachers with a paradigm for understanding the WCF debate and interpreting the …
