The Structural Safeguards Of Federal Jurisdiction, Tara Leigh Grove

Scholars have long debated Congress’s power to curb federal jurisdiction and have consistently assumed that the constitutional limits on Congress’s authority (if any) must be judicially enforceable and found in the text and structure of Article III. In this Article, I challenge that fundamental assumption. I argue that the primary constitutional protection for the federal judiciary lies instead in the bicameralism and presentment requirements of Article I. These Article I lawmaking procedures give competing political factions (even political minorities) considerable power to “veto” legislation. Drawing on recent social science and legal scholarship, I argue that political factions are particularly likely …

Aims.T Pyx is the first recurrent nova ever historically studied. It was seen in outburst six times between 1890 and 1966 and then not for 45 years. We report on near-IR interferometric observations of the recent outburst of 2011. Methods.We obtained near-IR observations of T Pyx at dates ranging from t = 2.37 d to t = 48.2 d after the outburst, with the CLASSIC recombiner located at the CHARA array and with the PIONIER and AMBER recombiners located at the VLTI array. These data are supplemented with near-IR photometry and spectra obtained at Mount Abu, India. We compare expansion …

Susan L. Siegfried’s Ingres: Painting Reimagined is a magisterial consideration of one of the most intriguing and elusive artists of the nineteenth century, Jean-Auguste-Dominique Ingres. As the summation of a three-decade long engagement with Ingres studies, this ambitious tome sets out to account for the strange and yet beguiling nature of his paintings, c. 1800-1840. In this book, Siegfried argues that the reason Ingres has remained an enigma has much to do with his refusal to produce works that conformed to centuries-old conventions structuring narrative painting. Ingres’s imaginative project, then, was to conceive of innovative strategies for imaging classical tales …

The infamous "Extermination Order" issued October 27, 1838, by Missouri Governor Lilburn W. Boggs caused thousands of Latter-day Saints to flee the state and seek refuge in Illinois. Throughout the harsh winter of 1838-39, many Latter-day Saint families traveled to Missouri's eastern border (some 150 miles) in carts and wagons and on foot. While most crossed the Mississippi River by ferry at Quincy, some voyaged by riverboats from Richmond, Missouri, to the Quincy region in Illinois.

A Stakeholder Identity Orientation Approach To Corporate Social Performance In Family Firms, John B. Bingham, W. Gibb Dyer Jr., Isaac Smith, Gregory L. Adams

Extending the dialogue on corporate social performance (CSP) as descriptive stakeholder management (Clarkson, Acad Manage Rev 20:92, 1995), we examine differences in CSP activity between family and nonfamily firms. We argue that CSP activity can be explained by the firm’s identity orientation toward stakeholders (Brickson, Admin Sci Quart 50:576, 2005; Acad Manage Rev 32:864, 2007). Specifically, individualistic, relational, or collectivistic identity orientations can describe a firm’s level of CSP activity toward certain stakeholders. Family firms, we suggest, adopt a more relational orientation toward their stakeholders than nonfamily firms, and thus engage in higher levels of CSP. Further, we invoke collectivistic …

Scholars have been extending social-movement analysis beyond its base in the industrialized West to Latin America and Asia, but rarely to Africa. Social movements resisting repression in nondemocratic settings have usually had the help of external "opportunities" or favorable circumstances. This study, however, examines a peaceful social movement in Liberia, a movement that resisted repression under two regimes, advocating for human rights and democratic freedom without such "opportunities." How did this happen? The study finds four explanations: the formation of a microsocial movement with no formal leadership and only loosely connected strands of resistance, which were harder to control; a …

This paper was originally given at the professional workshop In Search of Egypt's Past: Problems and Perspectives of the Historiography of Ancient Egypt; A North American workshop at the University of British Columbia, Vancouver, inaugurating the Journal of Egyptian History, April 23-24, 2008, most of the remaining papers of which will appear in Fascicle 2 of this journal. While many Egyptologists teach Egyptian history, we often fail to carefully conceive of just what this means. Good instructional storytelling engages students’ attention and cognitive abilities to the end of more effective learning, and instructional researchers have discussed whether the principles of storytelling could lead to the same or similar results if applied to educational situations beyond only telling traditional stories. But despite this potential, the principles of storytelling are seemingly underutilized by today’s instructional designers. This study investigates what instructional designers might learn from another design field that is more experienced in the art of storytelling, specifically that of film production. Into The Imagined Forest: A 2000-Year Retrospective Of The German Woods, Richard Hacken

In a "House of Learning" lecture in the Harold B. Lee Library in October, 2008, Richard Hacken gave this presentation, a combination of text and images. Coming from the history of ideas, this retrospective of the German woods looked at historical, linguistic, artistic, philosophical, political, literary, cultural, and of course botanical aspects of the German forest. In summary, five major forest themes arise from Germans imagining their own German woods: (1) taming the external and internal wilderness; (2) establishing social justice; (3) advocating national unity; (4) maintaining a sense of the sacred; and (5) encouraging ecological awareness.

Military nursing service during wartime represents significant contributions to a unique type of health care. The purposes of this study were to: (1) generate themes that elucidate combat nursing experiences, (2) honor nurses who served by sharing their stories, and (3) permanently archive accounts of nursing personnel who served during the Persian Gulf Wars during the late 20th and early 21st centuries. Eleven military nurses who provided health care to American troops in the Persian Gulf participated in a historical study as part of the ongoing Nurses at War oral history project documenting the experiences of nurses during times of …

Maintenance of a sustainable clean water supply is critical for our future. However, watershed degradation is a common phenomenon around the world that leads to poor water quality. In order to protect water resources, the Watershed Forest Management Information System (WFMIS), was developed as an extension of ArcGIS® and is described in this paper. There are three submodels to address nonpoint source pollution mitigation, road system management, and silvicultural operations, respectively. The Watershed Management Priority Indices (WMPI) is a zoning approach to prioritize critical areas for conservation and restoration management. Timber harvesting changes the condition of forest ecosystems, which are a major influence on the characteristics of headwater streams. Such characteristics include the quantity and timing of base flow and storm flow, concentrations of sediment and dissolved nutrients, water temperature, and the stability of the stream channels. This paper explores previous studies dealing with the relationship between timber harvesting and its hydrologic effects, especially long term water yield increase. The watershed disturbance threshold theory is raised and investigated in detail. This book review of Jeffrey Morris’s Establishing Justice in Middle America argues that although Morris makes an important contribution to the understudied Court of Appeals for the Eighth Circuit, he fails to engage the reader in the personalities that populated the court, eschews the development of coherent themes running through the court’s membership changes and temporal scope, and omits important cases that helped define the court as an independent judicial body.

Problem This dissertation studies the nature of Jesus’ ascension to heaven and its role in the argument of Hebrews. Method The study consists of an analysis of those passages in which Jesus’ ascension is referred to directly (Heb 1:6; 4:14-16; 6:19-20; 9:11-14, 24; 10:19-22) and a study of the imagery Hebrews uses to couch its theology, giving special attention to the role of this imagery in the progression of the argument. The study is both exegetical and theological in nature, seeking to provide an analysis of specific passages as well as systematization of their import. Results The six passages that …

The Emergence Of Community Radio In The United States: A Historical Examination Of The National Federation Of Community Broadcasters, 1970 To 1990, Michael William Huntsberger

The National Federation of Community Broadcasters is the oldest and largest organization of community-oriented, nonprofit radio stations in the United States. Nevertheless, only a handful of scholars have considered the NFCB and its place in the history of mass media in the U.S. In the years leading up to and following the establishment of the NFCB in 1975, the public policy environment that guided the activities noncommercial radio, and all of American mass media, changed dramatically. This study provides a historical account of the NFCB during these formative years, and examines the political, economic, and social forces that propelled the …
