Paved With Good Intentions: The Fate Of Strict Liability Under The Migratory Bird Treaty Act, Kalyani Robbins Jan 2012

Paved With Good Intentions: The Fate Of Strict Liability Under The Migratory Bird Treaty Act, Kalyani Robbins

Faculty Publications

The Migratory Bird Treaty Act (MBTA) contains a very broad ban on harming migratory birds, as well as a strict liability standard for misdemeanor violations. Without further limitation, the MBTA would theoretically apply to countless ordinary life activities, such as driving a car or having windows on one’s home. Naturally, there are due process concerns with such a scenario, so Congress expressly left it to the Department of the Interior to draft more detailed implementing regulations. Unfortunately, the existing regulations fail to adequately address the potential overbreadth of the MBTA’s misdemeanor application, forcing the courts to do so on an …

Alternative Justifications For Academic Support Iii: An Empirical Analysis Of The Impact Of Academic Support On Perceived Autonomy Support And Humanizing Law Schools, Louis N. Schulze Jr., Adam A. Ding

Faculty Publications

This article details the findings of a two-year empirical study on the impact of a law school academic support program (ASP) on law students. The hypothesis of the study was that as students' participation in a well-resourced, open-access ASP increases, students' perception of "autonomy support" and "humanizing" grows as well. The study concludes, based upon statistically significant data, that law school ASPs impact students in positive ways and therefore are worth the investment. This article is the third in a series designed to show that law school academic support measures positively impact students' well-being and lead to a more robust …

Citing agenda-building theory, this article examines the influence of three key factors on the news media's coverage of the process of placing tobacco and tobacco products under regulation of the U.S. Food and Drug Administration between 1993 and 2009. We analyzed data from a content analysis of 570 news articles from The New York Times and Washington Post and found that the media published significantly more FDA regulation articles during the Clinton administration than during the Bush administration. Our analysis links that imbalance of media coverage to the influence of the president of the United States (Clinton and Bush, during …

Bayesian Credible Sets For A Binomial Proportion Based On One-Sample Binary Data Subject To One Type Of Misclassification, Dewi Rahardja, Yan D. Zhao, Hongmei Zhang Jan 2012

Bayesian Credible Sets For A Binomial Proportion Based On One-Sample Binary Data Subject To One Type Of Misclassification, Dewi Rahardja, Yan D. Zhao, Hongmei Zhang

Faculty Publications

Interval estimation for the proportion parameter in one-sample misclassified binary data has caught much interest in the literature. Recently, an approximate Bayesian approach has been proposed. This approach is simpler to implement and performs better than existing frequentist approaches. However, because a normal approximation to the marginal posterior density was used in the Bayesian approach, some efficiency may be lost. We develop a closed-form fully Bayesian algorithm which draws a posterior sample of the proportion parameter from the exact marginal posterior distribution. We conducted simulations to show that our fully Bayesian algorithm is easier to implement and has better coverage …

Electropalatographic Measures Of Stop Consonants In Speakers With And Without Apraxia Of Speech On Repeated Sampling Occasions, Christopher Dromey, Shannon C. Mauszycki, Julie L. Wambaugh

Faculty Publications

Apraxia of speech (AOS) is an acquired motor speech disorder characterized by difficulty producing speech sounds caused by deficits in motor planning. Various tools exist to examine the physiologic aspects of articulation. Unfortunately, very few physiologic studies of AOS have been conducted. Electropalatography (EPG) is one method for examining the tongue's role in articulation by measuring tongue-to-palate contact. However, there is limited research examining the articulatory changes that are attributable to repeated exposure with wearing the pseudopalate as well as desensitization to the pseudopalate. The purpose of this investigation was to examine the impact of repeated measurement using EPG with …

Parental Problems, Case Plan Requirements, And Service Targeting In Child Welfare Reunification, Amy C. D’Andrade, R. Chambers

Faculty Publications

Only about half of parents attempting to reunify with their children in foster care succeed in their efforts. Parents are ordered by the court to use treatment services in order to resolve their problems. These treatment services thus play a critical role in reunification, and in fact the use of services appropriately matched to parents' problems has been found to be associated with a greater likelihood of reunification. However, there is little in the literature regarding the specific requirements of reunification case plans, and whether they are accurately targeted at reunifying parents' problems. This mostly descriptive study uses case file …

Alternative Justifications For Academic Support Ii: How “Academic Support Across The Curriculum” Helps Meet The Goals Of The Carnegie Report And Best Practices, Louis N. Schulze Jr.

Faculty Publications

In the wake of two momentous critiques of legal education, popularly known as the “Carnegie Report” and “Best Practices,” law schools are reconsidering certain basic assumptions about how we educate future lawyers. Even the most forward-thinking reformers, however, struggle with the details of how to implement many of the recommendations of those reports. Providing more formative assessment, for instance, is a laudable objective but one that has serious ramifications in terms of resource expenditures. This article seeks to provide a remedy for many of these struggles: “Academic Support Across the Curriculum.” This piece argues that the reconceptualization of an under-leveraged …

Measuring Life Skills: Standardizing The Assessment Of Youth Development Indicators, Mat D. Duerden, Peter A. Witt, Mariela Fernandez, Marie Jolliff Bryant, Daniel Theriault

Faculty Publications

While the development of life skills (e.g., communication, problem solving, etc.) is a commonly targeted youth program outcome, the lack of standardized conceptualizations and instrumentation make it difficult to compare impacts across programs and develop validated best practices. In order to promote a more unified approach to life skill development, literature reviews were conducted for 10 life skill domains to identify common definitions and, if available, appropriate outcome measures. Data were then collected from an ethnically diverse sample (N = 758) of elementary, middle, and high school aged youth for the 10 identified instruments. Analyses were conducted to ascertain the …
