Mandatory Arbitration: Alternative Dispute Resolution Or Coercive Dispute Suppression?, Sharona Hoffman

The enforceability of mandatory arbitration policies contained in employment contracts between employees and their direct employers remains an open question, even after the Supreme Court's 1991 decision in Gilmer v. Interstate Johnson Lane Corp. While Gilmer gave effect to a mandatory arbitration clause in a contract between a securities broker and his licensing exchange, the Court noted that the contract at issue was not an ordinary employment contract between employer and employee. The Court declined to decide whether arbitration agreements in ordinary employment contracts are per se enforceable under the Federal Arbitration Act or whether these provisions are exempt from …

Efficient Long-Pcr Site-Specific Mutagenesis Of A High Gc Template, Vladimir Chouljenko, Sukhanya Jayachandra, Galina Rybachuk, Konstantin G. Kousoulas

A long-PCR method was developed for the efficient site-specific mutagenesis of herpes simplex virus (HSV-1) DNA fragments with high GC content. In this protocol, a PCR product was partially extended first using a cloned DNA fragment. The final mutagenized fragment was produced after a second extension using another PCR product and final amplification using external primers. The sequential use of two extension reduction increased the predicted frequency of the engineered mutation in the final product to 100%. This method was used to generate a mutated glycoprotein K (gK) gene specified by HSV-1. A recombinant virus that carried the mutated gK …

The Htra Stress Response Protease Contributes To Resistance Of Brucella Abortus To Killing By Murine Phagocytes, Philip H. Elzer, Robert W. Phillips, Gregory T. Robertson, R. Martin Roop

Compared with virulent Brucella abortus 2308, the isogenic htrA mutant PHE1 shows decreased resistance to killing by cultured murine neutrophils and macrophages and significant attenuation during the early stages of infection in the BALB/c mouse model. These findings further define the contributions of the htrA gene product to the pathogenesis of B. abortus infections.

An understanding of the relationship between gastrointestinal (GI) motility and disease is imperative for the proper treatment of large animal patients, especially as new therapeutic agents become available. However, the abundance of information that has become available in the last 2 decades makes gaining this understanding a formidable task. This article summarizes the changes in GI motility caused by some common diseases and conditions encountered in large animal practice, such as GI obstruction, postoperative ileus, resection and anastomosis, diarrhea, endotoxemia, GI parasitism, hypocalcemia, and pregnancy. Screening of a human genomic library with an oligonucleotide probe specific for one of the young subfamilies of Alu repeats (Ya5/8) resulted in the identification of several hundred positive clones. Thirty-three of these clones were analyzed in detail by DNA sequencing. Oligonucleotide primers complementary to the unique sequence regions flanking each Alu repeat were used in PCR-based assays to perform phylogenetic analyses, chromosomal localization, and insertion polymorphism analyses within different human population groups. All 33 Alu repeats were present only in humans and absent from orthologous positions in several nonhuman primate genomes. Seven Alu repeats were polymorphic for their presence/absence …

Development Of A Defined Minimal Medium For The Growth Of Edwardsiella Ictaluri, L. A. Collins, R. L. Thune

In this report, a complete defined medium and a minimally defined medium are described for Edwardsiella ictaluri. The complete defined medium consists of 46 individual components, including a basal salt solution, glucose, magnesium sulfate, iron sulfate, six trace metals, four nucleotides, 10 vitamins, and 19 amino acids. This medium supports growth in broth and on solid media. Optimal growth at 30°C was obtained at pH 7.0, and at an osmolality of 390 mosmol/kg of H2O, with a glucose concentration of 4 g/liter. The use of durable powers of attorney (DPA) has developed rapidly over the last decade. This growth reflects the public's desire for a simple and effective method of planning for possible incapacity. Although there are other planning tools, individuals frequently prefer the DPA. It is more comprehensive and provides greater certainty of result than does a joint bank account. A DPA is much easier to create than a revocable trust. By using a DPA, one can avoid an intrusive and possibly cumbersome guardianship or conservatorship proceeding.

We discuss the data acquisition and analysis procedures used on the Allegro gravity wave detector, including a full description of the filtering used for bursts of gravity waves. The uncertainties introduced into timing and signal strength estimates due to stationary noise are measured, giving the windows for both quantities in coincidence searches. © 1996 The American Physical Society.

Effect Of Mutations On The Sensitivity Of Human Beta-Cell Glucokinase To Liver Regulatory Protein, M. Veiga-Da-Cunha, L. Z. Xu, Y. H. Lee, D. Marotta, S. J. Pilkis, E. Van Schaftingen

Human beta-cell glucokinase and its liver counterpart displayed a half-saturating concentration of glucose (S0.5) of about 8 mmol/l and a Hill coefficient of 1.7, and were as sensitive to inhibition by the rat liver regulatory protein as the rat liver enzyme. These results indicate that the N-terminal region of glucokinase, which differs among these three enzymes, is not implicated in the recognition of the regulatory protein. They also suggest that the regulatory protein, or a related protein, could modulate the affinity of glucokinase for glucose in beta cells. A simplified solid-substrate fermentation and milling process for preparing flour from nondecorticated cowpeas (cv. White Acre) was developed. Yield of fermented flours compared to starting substrate was about 73%. Total solids loss (ca. 21-23%) was due to soaking (6%), boiling (11%), fermentation (2-4%) and grinding (2%). Moisture loss during drying was approximately 5%. The pH of fermented flours ranged from 6.4 to 6.9. Fermented flours had less packed density but greater unpacked density than the control flour. About 41-44% of flour particles passed through a 0.297-mm sieve; 65-72% of these particles were in the exclusion range of 0.037-0.074 mm. An …

Classifications, like race, that historically have been used to saddle certain people with disabilities on the basis of a characteristic that otherwise would be irrelevant to an individual's ability to contribute to society are inherently suspect as more likely to have been the product of irrational prejudice and, thus, are deserving of heightened equal protection scrutiny. Thus, in adjudicating whether a sexual orientation classification is deserving of heightened equal protection scrutiny, a court should ask only whether gay people have suffered a history of discrimination and whether their sexual orientation says anything about their ability to contribute to society.

This report seeks to describe and analyze that dysfunction as it manifests itself in three low-income neighborhoods in San Francisco and Oakland. It does not examine the causes nor scope of poverty in those communities nor does it intend to estimate or describe the prevalence of hunger. These measures are amply documented in a 1995 report on hunger and the problem of food "insecurity" commissioned by the California Senate Office of Research and, in 1993 and 1994, reports on hunger from the Alameda County Community Food Bank and San Francisco Food Bank, respectively. Individual-Level Determinants Of Employee Shirking, Timothy A. Judge, Timothy D. Chandler

Employee shirking, where workers give less than full effort on the job, has typically been investigated as a construct subject to organization-level influences. Neglected are individual differences that could explain why employees in the same organization or work-group might shirk. Using a sample of workers from the health care profession in the United States, the present study sought to address these limitations by investigating subjective well-being (a dispositional construct), job satisfaction, as well as other individual-level determinants of shirking. Results indicate that whites shirk significantly more than nonwhites, and that subjective well-being, job satisfaction, and age have significant, negative effects …

Aluminum (Al) has been suggested to be an important stress factor in forest decline due to its mobilization in soil following atmospheric deposition of acidic pollutants. A major goal of our research is to develop physiological and biochemical markers of stress in trees using cell cultures and whole plants. Needles of red spruce (Picea rubens) collected from several sites in the northeastern United States and red spruce cells grown in suspension cultures were examined for polyamine and inorganic-ion content.
