This article provides a nutshell description of the leading theories and identifies some of the leading theorists on the Constitution. The unit of currency here is the academic law review article, not the Supreme Court decision. The citations here provide illustrative examples of the vast body of literature. The discussion provides preliminary sketches of an intellectual landscape that is vast and often foreboding to the beginner. Taking Assessment On The Road: Utah Academic Librarians Focus On Distance Learners, Allyson Washburn, Rob Morrison

This paper presents the results of focus groups conducted by Utah academic librarians at branch campuses in Utah. Librarians met with distance learners on-site to gain insights into their information-seeking behavior and to learn if they are using library services. Students rely heavily on the web for information and also utilize known resources in friends and family. Marketing and publicizing library services through classes and at the delivery sites is vital. Students appreciate the services libraries offer and strongly prefer face-face instruction and direct assistance from a librarian.

Cross sections for e+ p neutral current deep inelastic scattering have been measured at a center-of-mass energy of √s = 318 GeV with the ZEUS detector at HERA using an integrated luminosity of 63.2 pb -1. The double-differential cross section, d2σ/ dxdQ2, is presented for 200 GeV2 < Q2 < 30 000 GeV2 and for 0.005 < x < 0.65. The single-differential cross sections dσ/dQ2, dσ/dx and dσ/dy are presented for Q2 > 200 GeV2. The effect of Z-boson-exchange is seen in dσ/dx measured for Q2 > 10 000 GeV2. The data presented here were combined with ZEUS e+ p neutral current data taken at √s = 300 GeV and the structure function F2em was extracted. All results agree well with the predictions of the Standard Model.

Cognitive-behavioral therapy (CBT) for bulimia nervosa (BN) has received consid- erable empirical support for its efficacy. However, few investigators have examined the mechanisms proposed to account for the reduction of BN symptoms during CBT. The current study examined the associations between therapist interventions, client mechanisms, and symptoms during treatment in a sample of 56 clients under- going CBT for BN. Results suggested that behavioral interventions were most asso- ciated with symptom change during treatment whereas relational interventions were most associated with change in client mechanisms such as client engagement. Adolescents with impaired language comprehension and formulation skills often experience difficulty keeping up with the linguistic and social demands of peer interaction. This clinical exchange describes an individualized treatment program designed to increase the conversational skill of an adolescent male with language impairment. Treatment focused on increasing awareness of the listener’s needs and on balancing the exchange of conversational turns. Clinical performance, parent report, and client report were used to assess outcomes.

The Hop/Sti1 co-chaperone binds to both Hsp70 and Hsp90. Biochemical and co-crystallographic studies have suggested that the EEVD-containing C terminus of Hsp70 or Hsp90 binds specifically to one of the Hop tetratricopeptide repeat domains, TPR1 or TPR2a, respectively. Mutational analyses of Hsp70 and Hop were undertaken to better characterize interactions between the C terminus of Hsp70 and Hop domains. Surprisingly, truncation of EEVD plus as many as 34 additional amino acids from the Hsp70 C terminus did not reduce the ability of Hsp70 mutants to co-immunoprecipitate with Hop, although further truncation eliminated Hop binding. Intracellular transport and egress of alphaherpesviruses require the coordinate function of multiple proteins and glycoproteins. Recently, we showed that gK is expressed on infected cell surfaces and that gK cell-surface expression required the presence of the UL20 protein [J. Virol. 77 (2003), 499]. Overexpression of gK by gK-transformed cells blocked transport of enveloped virions from perinuclear spaces and inhibited virus-induced cell fusion caused by gK syncytial mutants [J. Virol. 69 (1995), 5401]. Therefore, we investigated whether altered synthesis and transport of gK was responsible for the observed gK-mediated interference phenomena. Nurses have identified a need for improving their knowledge and skills in providing end-of-life care. Critical care nursing textbooks can serve as an important source of information on end-of-life care for critical care nurses. Hence, an analysis of end-of-life content in 14 critical care nursing textbooks was conducted. Critical care nursing textbooks used for review were published in 1995 or later and identified from the libraries at the University of Wisconsin-Madison and Brigham Young University. Cross sections for e+p charged current deep inelastic scattering at a centre-of-mass energy of 318 GeV have been determined with an integrated luminosity of 60.9 pb-1 collected with the ZEUS detector at HERA. The differential cross sections dσ/dQ2, dσ/dx and dσ/dy for Q2 > 200 GeV2 are presented. In addition, d2σ/dxdQ2 has been measured in the kinematic range 280 GeV2 < Q2 < 17 000 GeV2 and 0.008 < x < 0.42. The predictions of the Standard Model agree well with the measured cross sections. The mass of the W boson propagator is determined to be MW = 78.9 ± 2.0 (stat.) ± 1.8 (syst.) -1.8+2.0 (PDF) GeV from a fit to dσ/dQ2. The chiral structure of the Standard Model is also investigated in terms of the (1-y)2 dependence of the double-differential cross section. The structure-function F2CC has been extracted by combining the measurements presented here with previous ZEUS results from e-p scattering, extending the measurement obtained in a neutrino-nucleus scattering experiment to a significantly higher Q2 region.

The absence of neutrality and objectivity in constitutional decision-making has vexed scholars and courts. In this Article, the author describes and analyzes "constitutional empiricism," a trend instituted by the Rehnquist Court, which is characterized by judicial reliance in constitutional review on empirical and scientific conventions and processes. Courts have generally relied upon traditional sources, such as text and history, to interpret consititutional powers and rights. In its search for neutrality and objectivity, however, the Court has recently turned not only to social science and other data, which are fast becoming common sources of interpretation, but also to the precepts and …

Identifying those seniors most likely to adopt a healthy diet, the relative importance they place on certain perceived benefits associated with a healthy diet, and whether these perceived benefits are associated with selected demographic, lifestyle, and health history variables is important for directing effective dietary health promotion programs. Methods: Analyses are based on a cross-sectional convenience sample of 670 seniors aged 50 years and older at the 2002 World Senior Games in St. George, Utah. Data are assessed using frequencies, bivariate analysis, analysis of variance, and multiple logistic regression analysis. Production of D*±(2010) mesons in diffractive deep inelastic scattering has been measured with the ZEUS detector at HERA using an integrated luminosity of 82 pb-1. CD1d presents lipid antigen to a conserved population of natural killer (NK) T cells, which participate in host immune defense, tumor cell rejection and suppression of autoimmunity. The levels of human CD1d expression vary significantly between individuals. To understand such variation, we sequenced the region up to 1.7 kb 5′ upstream of the translation start site and partially through exon 2 in 44 white Americans. We also studied two tagged single nucleotide polymorphisms (SNP) in 112 white Americans, 60 African-Americans, 88 Europeans, and 84 Chinese people from the region. The production rates and substructure of jets have been studied in charged current deep inelastic e+p scattering for Q2 > 200 GeV2 with the ZEUS detector at HERA using an integrated luminosity of 110.5 pb-1. Inclusive jet cross sections are presented for jets with transverse energies ETjet > 14 GeV and pseudorapidities in the range -1 < ηjet < 2. Dijet cross sections are presented for events with a jet having ETjet > 14 GeV and a second jet having ETjet > 5 GeV. Measurements of the mean subjet multiplicity, 〈ηsbj〉, of the inclusive jet sample are presented. Predictions based on parton-shower Monte Carlo models and next-to-leading-order QCD calculations are compared to the measurements. The value of αs (MZ), determined …

Throughout most of this introductory Article, we will focus our arguments primarily on economics and law and economics. We believe, however, that the implications of our inquiry extend far beyond those domains. The tendencies we hope to elucidate find their origins in the human animal, not in any particular legal theoretic perspective. Alu elements have inserted in primate genomes throughout the evolution of the order. One particular Alu lineage (Ye) began amplifying relatively early in hominid evolution and continued propagating at a low level as many of its members are found in a variety of hominid genomes. This study represents the first conclusive application of short interspersed elements, which are considered nearly homoplasy-free, to elucidate the phylogeny of hominids. Phylogenetic analysis of Alu Ye5 elements and elements from several other subfamilies reveals high levels of support for monophyly of Hominidae, tribe Hominini and subtribe Hominina. Maillard or browning reactions between reducing sugars and protein lead to formation of advanced glycation end products (AGEs) and are thought to contribute to the pathogenesis of diabetic complications. AGE inhibitors such as aminoguanidine and pyridoxamine (PM) inhibit both the formation of AGEs and development of complications in animal models of diabetes. PM also inhibits the chemical modification of protein by advanced lipoxidation end products (ALEs) during lipid peroxidation reactions in vitro. We show here that several PM adducts, formed in incubations of PM with linoleate and arachidonate in vitro, are also excreted in the urine of PM-treated animals. The …

A comprehensive analysis of the human sex chromosomes was undertaken to assess Alu-associated human genomic diversity and to identify novel Alu insertion polymorphisms for the study of human evolution. Three hundred forty-five recently integrated Alu elements from eight different Alu subfamilies were identified on the X and Y chromosomes, 225 of which were selected and analyzed by polymerase chain reaction (PCR). From a total of 225 elements analyzed, 16 were found to be polymorphic on the X chromosome and one on the Y chromosome. This article seeks to provide a comprehensive account of doctrinal issues related to the use of pay secrecy/confidentiality rules (“PSC rules”) under the NLRA. In Part II, we describe what pay secrecy/confidentiality is and discuss recent survey evidence of their presence in workplaces across the United States. In Part III, we describe the current legal framework under which PSC rules are evaluated under the NLRA, while in Parts IV and V, we explore various doctrinal issues related to these rules in more detail. This leads us to Part VI, where we ponder the future of PSC rules under the NLRA …

Background and Purpose - Whether physical activity reduces stroke risk remains controversial. We used a meta-analysis to examine the overall association between physical activity or cardiorespiratory fitness and stroke incidence or mortality.
Methods - We searched MEDLINE from 1966 to 2002 and identified 23 studies (18 cohort and 5 case-control) that met inclusion criteria. We estimated the overall relative risk (RR) of stroke incidence or mortality for highly and moderately active individuals versus individuals with low levels of activity using the general variance-based method.

Rhetorically Reasonable Police Practices: Viewing The Supreme Court's Multiple Discourse Paths, Kathryn R. Urbonya

This Article analyzes the United States Supreme Court's numerous and shifting rhetorical discourse paths for declaring whether particular governmental practices constituted unreasonable searches or seizures under the Fourth Amendment to the United States Constitution. It examines how the Court has manipulated classic discourse paths arising from text, history, precedent and structure. It reveals that among and within each of these categories, the Court has created conflicting approaches. The Article argues that the Court's construction of Fourth Amendment reasonableness has depended upon which discourse paths it has selected as well as how it has characterized the values embedded within the discourse …
