Valuing Diversity As An Imperative For Fulfilling The Mission Of The Church, Walter B. T. Douglas Jan 2005

Valuing Diversity As An Imperative For Fulfilling The Mission Of The Church, Walter B. T. Douglas

Faculty Publications

Demographic shifts, cultural and ethnic diversity, globalization, and the rapid expansion of the church in the southern hemisphere strongly suggest that the future growth of Adventism may emerge in the developing nations. This article is an attempt to engage in conversation on the changing face of Adventism and the challenge this new Adventism presents across cultural, ethnic, and racially diverse communities. This article provides the church with a window of opportunity to view diversity not as an event but as a process to maximize and explore the richness of its diversity and to see it not as a problem to …

Life On A Tricycle A Case Study Of Language Impairment From 4 To 19, Lee Robinson, Bonnie Brinton, Martin Fujiki

Faculty Publications

This article presents a longitudinal case study of a child named Cody identified with specific language impairment. Cody was followed from 4 to 19 years of age, at which time he compared his social skills with those of peers: “It’s like they’re driving sports car and I’m on a tricycle.” His initial long- and short-term intervention goals are presented, along with the treatment methods employed and the resulting outcomes. Although long-term goals remained consistent, as the nature of Cody’s academic, social, and emotional challenges shifted, it was necessary to gear treatment to address his changing needs. Cody’s case illustrates the …

Maternal Education And Child Nutritional Status In Bolivia: Finding The Links, Michelle Bellessa Frost, Renata Forste, David W. Haas Jan 2005

Maternal Education And Child Nutritional Status In Bolivia: Finding The Links, Michelle Bellessa Frost, Renata Forste, David W. Haas

Faculty Publications

This study models various pathways linking maternal education and child nutritional status in Bolivia, using a national sample of children. Pathways examined include socioeconomic status, health knowledge, modern attitudes towards health care, female autonomy, and reproductive behavior. The data come from the 1998 Bolivia Demographic and Health Survey. Logistic regression results suggest that socioeconomic factors are the most important pathways linking maternal education and child nutritional status, and that modern attitudes about health care also explain the impact of education. Health care knowledge accounts for less of the effect of maternal education on child nutritional status, with autonomy being the …

Policing The Border Between Trademarks And Free Speech: Protecting Unauthorized Trademark Use In Expressive Works, Pratheepan Gulasekaram Jan 2005

Policing The Border Between Trademarks And Free Speech: Protecting Unauthorized Trademark Use In Expressive Works, Pratheepan Gulasekaram

Faculty Publications

Artists and other creators of expressive works often include trademarks and trademarked products as part of their works. They do so for a number of reasons, including lighthearted humor, critical cultural commentary, parody, or even simply to shock. In instances where such use is both unauthorized by and perceived as disparaging to the mark owner or the trademarked product, owners have attempted to sue under trademark law to enjoin the expressive use. This Article argues that, under a proper analysis of trademark law, precedent, and the free expression ideal enshrined in the First Amendment, mark owners should rarely, if ever, …

Data Mining And Attention Consumption, Eric Goldman Jan 2005

Data Mining And Attention Consumption, Eric Goldman

Faculty Publications

This Essay challenges the prevailing hostility towards data mining and direct marketing. The Essay starts by defining data mining and shows that the only important step is how data is used, not its aggregation or sorting. The Essay then discusses one particular type of data use, the sending of direct marketing. The Essay establishes a model for calculating the private utility experienced by a direct marketing recipient. The model posits that utility is a function of the message's substantive content, the degree of attention consumed, and the recipient's reaction to receiving the message. The Essay concludes with some policy recommendations …

From Queer To Paternity: How Primary Gay Fathers Are Changing Fatherhood And Gay Identity, E. Gary Spitko Jan 2005

From Queer To Paternity: How Primary Gay Fathers Are Changing Fatherhood And Gay Identity, E. Gary Spitko

Faculty Publications

In this symposium paper, I reflect upon how public images of gay fathers who raise children from the start as a gay couple are likely to impact the identity both of gay men and of fatherhood. I consider both the perceptions of the larger society as well as the self-images of gay men and their perceptions of fatherhood. For ease of reference, I refer to such gay fathers who begin fathering while in a gay relationship as primary gay fathers. I contrast primary gay fathers with the first generation of gay fathers to come to American public consciousness - gay …

Competing Perspectives During Organizational Socialization On The Role Of Certified Athletic Trainers In High School Settings, James M. Mensch, Candice Crews, Murrary F. Mitchell Jan 2005

Competing Perspectives During Organizational Socialization On The Role Of Certified Athletic Trainers In High School Settings, James M. Mensch, Candice Crews, Murrary F. Mitchell

Faculty Publications

When certified athletic trainers (ATCs) enter a workplace, their potential for professional effectiveness is affected by a number of factors, including the individual's ability to put acquired knowledge, skills, and attitudes into practice. This ability may be influenced by the preconceived attitudes and expectations of athletes, athletes' parents, athletic directors, physical therapists, physicians, and coaches.

Objective: To examine the perspectives of high school coaches and ATCs toward the ATC's role in the high school setting by looking at 3 questions: (1) What are coaches' expectations of ATCs during different phases of a sport season? (2) What do ATCs perceive their …

Reliability And Validity Of The Behavioral And Emotional Rating Scale-Second Edition: Parent Rating Scale, Paul Mooney, Michael H. Epstein, Gail Ryser, Corey D. Pierce

Faculty Publications

Three studies are reported addressing the test-retest reliability and convergent validity of the Behavioral and Emotional Rating Scale-Second Edition (BERS-2): Parent Rating Scale (PRS). In the first study, test-retest reliability was investigated over a one-week period to determine the stability of the BERS-2 PRS over time. Reliability coefficients were at or above.80. Convergent validity was assessed as parents completed the PRS and a second measure of perceived child functioning. In the second study, the six BERS-2 PRS subscales and overall strength index were correlated with composite scores from the parent forms of the Social Skills Rating System. Correlations were generally …

Devotion To Tibetan Lamas, Self Psychology, And Healing In The United States, Daniel S. Capper Jan 2005

Devotion To Tibetan Lamas, Self Psychology, And Healing In The United States, Daniel S. Capper

Faculty Publications

This essay offers an alternative, self psychological model for understanding the possible healing dynamics of the guru-disciple relationship. Previous psychological studies often have interpreted the devotion of Americans to Eastern gurus as inherently enriching pathology for the disciple, yet this understanding does not helpfully explicate much data derived from more than two years of ethnographic fieldwork at a Tibetan Buddhist center in the United States. Instead, re-exploration of the dynamics of the transference and the vicissitudes of Buddhist practice for disciples reveals positive healing processes for some disciples as a result of guru devotion practice.

Using Trusts To Settle Lawsuits, Thomas Simmons Jan 2005

Using Trusts To Settle Lawsuits, Thomas Simmons

Faculty Publications

Special considerations come into play when a plaintiff poised to recover money is a child or an individual with a disability. In the context of settling a lawsuit or receiving judgment proceeds, cash cannot simply be delivered to such a person because of the plaintiff's legal incapacity. Instead, recovered funds must be delivered to a third party for the plaintiff's benefit. This third party can be a trustee, a custodian, or a conservator. In most circumstances, the use of a trust offers greater flexibility and better protections of the plaintiff/client's interests. Not uncommonly, however, attorneys select a conservator or simply …

Jurisdictional Mismatch In Environmental Federalism, Jonathan H. Adler Jan 2005

Jurisdictional Mismatch In Environmental Federalism, Jonathan H. Adler

Faculty Publications

Jurisdictional mismatch plagues contemporary environmental law and policy. The division of authority and responsibility for environmental protection between the federal and state governments lacks any cohesive rationale or justification. The federal government regulates in many areas where there is no clear analytical basis for federal involvement. At the same time, the federal government is relatively absent where a stronger federal presence could be justified. Conversely, states are precluded, discouraged or otherwise inhibited from adopting environmental protections where state efforts would be worthwhile. At the same time, state intervention seeps into areas where a dominant federal role would be more defensible. …

Rediscovering Williston, Mark L. Movsesian Jan 2005

Rediscovering Williston, Mark L. Movsesian

Faculty Publications

This Article is an intellectual history of classical contracts scholar Samuel Williston. Professor Movsesian argues that the conventional account of Williston's jurisprudence presents an incomplete and distorted picture. While much of Williston's work can strike a contemporary reader as arid and conceptual, there are strong elements of pragmatism as well. Williston insists that doctrine be justified in terms of real-world consequences, maintains that rules can have only presumptive force, and offers institutional explanations for judicial restraint. As a result, his scholarship shares more in common with today's new formalism than commonly supposed. Even the under-theorized quality of Williston's scholarship—to contemporary …

The Challenge Of Motive In The Criminal Law, Elaine M. Chiu Jan 2005

The Challenge Of Motive In The Criminal Law, Elaine M. Chiu

Faculty Publications

The purchase of illegal drugs by an undercover police officer is commonly known as a “buy and bust” operation. In the twenty-first century, the stakes in the longstanding war on drugs are high as law enforcement and national security agencies join forces to confront the disturbing ties between terrorism and illegal narcotics. In addition to being a weapon in the arsenal of law enforcement, the buy and bust operation also tells an interesting story about motive in the criminal law. This article uses the simple street sale to demonstrate how the criminal law suffers from its ambivalent attitude towards the …

In Defense Of The Debt Limit Statute, Anita S. Krishnakumar Jan 2005

In Defense Of The Debt Limit Statute, Anita S. Krishnakumar

Faculty Publications

The debt limit statute is a critical feature of the federal budget process and prompts frequent legislation to increase the government's borrowing authority. In this Article, Professor Anita S. Krishnakumar examines the history of the debt limit statute as well as its function in the fiscal constitution. The Article deconstructs several popular criticisms of the debt limit statute, arguing that the criticisms exaggerate and that the statute in fact serves two important roles: first, the statute is the last remnant of congressional control and accountability over the national debt; second, it acts as an important institutional check on party and …

The Sutherland Report And Dispute Settlement, Mark L. Movsesian Jan 2005

The Sutherland Report And Dispute Settlement, Mark L. Movsesian

Faculty Publications

Ten years after the organization's founding, an air of disappointment surrounds the WTO. The great promise of a global trade regime, dedicated to the principle of comparative advantage, seems to have stalled. The Doha Development Round, launched in 2001 in an attempt to redeem the disastrous Seattle Ministerial Conference of 1999, has been stymied by familiar disputes between North and South, mostly with respect to agricultural issues, but with respect to nonagricultural market access and services as well. Frustrated by impasses at the WTO, members have increasingly bypassed the organization in favor of discrete "preferential trade agreements", or PTAs, that …

Habitat Patch Occupancy Dynamics Of Glaucous-Winged Gulls (Larus Glaucescens) I: A Discrete-Time Model, Karl W. Phillips, Smruti P. Damania, James L. Hayward, Shandelle M. Henson, Clara J. Logan Jan 2005

Habitat Patch Occupancy Dynamics Of Glaucous-Winged Gulls (Larus Glaucescens) I: A Discrete-Time Model, Karl W. Phillips, Smruti P. Damania, James L. Hayward, Shandelle M. Henson, Clara J. Logan

Faculty Publications

Diurnal habitat occupancy dynamics of Glaucous-winged Gulls were evaluated in a system of six habitats on and around Protection Island, Washington. Data were collected on the rates of gull movement between habitat patches, and from these data the probabilities of transitions between habitats were estimated as functions of tide height and time of day. A discrete-time matrix model based on the transition probabilities was used to generate habitat occupancy predictions, which were then compared to hourly census data. All model parameters were estimated directly from data rather than through model fitting. The model made reasonable predictions for two of the …

The Epistle To The Hebrews And Patron-Client Relationships: Toward A Missiological Appropriation, Cheryl D. Doss

Faculty Publications

Missionaries in cultures where patron-client relationships are common can find their participation in such relationships difficult. Recent New Testament scholarship has illuminated the patron-client relationships implicitly described in the epistle to the Hebrews. Utilizing this scholarship, this article explores the patron-client relationships illustrated in the epistle to the Hebrews seeking biblical principles to guide missionary life and practice.

Mission And Unity, Patricia Jo Gustin Jan 2005

Mission And Unity, Patricia Jo Gustin

Faculty Publications

This article examines some of the ways the church has traditionally met this challenge and then focuses on the place of cross-cultural mission in aiding the church to meet it.

Beyond The 10/40 Window: When All You Thought You Had To Do Is Not Enough, Bruce Campbell Moyer Jan 2005

Beyond The 10/40 Window: When All You Thought You Had To Do Is Not Enough, Bruce Campbell Moyer

Faculty Publications

There is always a danger in being overly focused on a task. When this happens, we can fail to see other tasks or parallel tasks that are equally demanding. This paper focuses on some other “windows,” beyond the “10/40 Window,” that also call for serious attention, concerted prayer, specialized training, their own unique strategies, and a variety of personnel/gifts.
