Preparing For Disaster: Protecting The Most Vulnerable In Emergencies, Sharona Hoffman
Preparing For Disaster: Protecting The Most Vulnerable In Emergencies, Sharona Hoffman
Faculty Publications
Many federal, state, local and private entities are investing significant resources in disaster readiness initiatives. Often disregarded, however, are the special needs of vulnerable populations during disasters. In the context of emergencies, vulnerable groups may include individuals with disabilities, pregnant women, children, the elderly, prisoners, members of ethnic minorities, people with language barriers, and the impoverished. The fate of the disadvantaged during disasters has received little attention in the legal literature, and this article begins to fill that gap. It examines ethical theories of distributive justice and existing federal and state civil rights and emergency response laws and argues that …

Safford Unified School District No. 1 V. Redding, And The Future Of School Strip Searches, Lewis R. Katz
Safford Unified School District No. 1 V. Redding, And The Future Of School Strip Searches, Lewis R. Katz
Faculty Publications
Each year in America an unknown number of children in primary and secondary schools are strip searched by teachers and/or school administrators, forced to remove pants and shirts down to their underwear and sometimes forced to expose their breasts and genitals. In Safford Unified School District No. 1 v. Redding, 129 S.Ct. 2633 (29), the Supreme Court weighed in on the issue, finding that school officials violated the child’s Fourth Amendment rights during a strip search but reversing the Ninth Circuit and awarding the school officials qualified immunity not withstanding the ineptitude of the investigation. The Court purported to apply …
Taking Property Rights Seriously: The Case Of Climate Change, Jonathan H. Adler
Taking Property Rights Seriously: The Case Of Climate Change, Jonathan H. Adler
Faculty Publications
The dominant approach to environmental policy endorsed by conservative and libertarian policy thinkers, so-called "free market environmentalism" (FME), is grounded in the recognition and protection of property rights in environmental resources. Despite this normative commitment to property rights, most self-described advocates of FME adopt a utilitarian, welfare-maximization, approach to climate change policy, arguing that the costs of mitigation measures could outweigh the costs of climate change itself. Yet even if anthropogenic climate change is decidedly less than catastrophic - indeed, even if it net beneficial to the globe as whole - human-induced climate change is likely to contribute to environmental …
A New History And Discussion Of 180-Day Exclusivity, Erika Lietzan, David E. Korn, Shaw W. Scott
A New History And Discussion Of 180-Day Exclusivity, Erika Lietzan, David E. Korn, Shaw W. Scott
Faculty Publications
This is the third in a series of articles on 180-day exclusivity. The first article traced the history of 180-day exclusivity from 1984 through its amendment in 2003 and court cases in 2004. A second article, published by two of the authors in 2007, updated the earlier piece through the end of 2006 but was arranged by issue rather than in a chronology. This article, which includes a third author, provides a comprehensive resource on 180-day exclusivity for old abbreviated new drug applications (ANDAs) (but less detail in some places where the 2007 article may be referenced) and focuses more …

Care Of The Dying Child: Pediatric Icu Nurses’ Perceptions Of Obstacles And Supportive Behaviors In End-Of-Life Care, Renea L. Beckstrand, Lynn Clark Callister, Barbara L. Mandleco, Nicole L. Rawle
Faculty Publications
Each year 55,000 children die in the United States. The vast majority of children’s deaths, 75 – 85%, occur in hospital settings with most in pediatric intensive care units. Oftentimes, a nurse is at the bedside of the dying child. Determining the barriers and supportive behaviors in pediatric end-of-life (EOL) care is needed.

Bison (Bison bison) and elk (Cervus elaphus nekoni) in the Greater Yellowstone Area (GYA), USA, are infected with Brucella abortus, the causative agent of bovine brucellosis, and they serve as a wildlife reservoir for the disease. Bovine brucellosis recently has been transmitted from infected elk to cattle in Montana, Wyoming, and Idaho and has resulted in their loss of brucellosisfree status. An efficacious Brucella vaccine with a delivery system suitable for wildlife would be a valuable tool in a disease prevention and control program. We evaluated Strain 19 (S19) in a sustained release vehicle consisting of alginate microspheres containing live …

Enhanced Immune Response Of Red Deer (Cervus Elaphus) To Live Rb51 Vaccine Strain Using Composite Microspheres, Angela M. Arenas-Gamboa, Thomas A. Ficht, Donald S. Davis, Philip H. Elzer, Alfredo Wong-Gonzalez, Allison C. Rice-Ficht
Faculty Publications
Brucellosis is an important zoonotic disease of nearly worldwide distribution. The occurrence of the infection in humans is largely dependent on the prevalence of brucellosis in animal reservoirs, including wildlife. The current vaccine used for cattle Brucella abortus strain RB51, has proven ineffective in protecting bison (Bison bison) and elk (Cervus nelsoni) from infection and abortion. To test possible improvements in vaccine efficacy, a novel approach of immunization was examined from April 2004 to November 2006 using alginate composite microspheres containing a nonimmunogenic, eggshell-precursor protein of the parasite Fasciola hepatica (Vitelline protein B, VpB) to deliver live vaccine strain RB51. …

Participation And The Right To Health: Lessons From Indonesia, Sam F. Halabi
Faculty Publications
The right to participation is the “the right of rights” — the basic right of people to have a say in how decisions that affect their lives are made. All legally binding international human rights treaties explicitly recognize the essential role of participation in realizing fundamental human rights. While the substance of the human right to health has been extensively developed, the right to participation as one of its components has remained largely unexplored. Should rights-based health advocacy focus on participation because there is a relationship between an individual’s or a community’s active involvement in health care decision-making and the …

Anonymity In Cyberspace: What Can We Learn From John Doe?, Lyrissa Lidsky
Faculty Publications
This Article examines the evolution of the law governing libel suits against anonymous “John Doe” defendants based on Internet speech. Between 1999 and 2009, courts crafted new First Amendment doctrines to protect Internet speakers from having their anonymity automatically stripped away upon the filing of a libel action. Courts also adapted existing First Amendment protections for hyperbole, satire and other non-factual speech to protect the distinctive discourse of Internet message boards. Despite these positive developments, the current state of the law is unsatisfactory. Because the scope of protection for anonymous Internet speech varies greatly by jurisdiction, resourceful plaintiffs can make …
Ambient Dose Equivalent Versus Effective Dose For Quantifying Stray Radiation Exposures To A Patient Receiving Proton Therapy For Prostate Cancer, Jonas D. Fontenot, Phillip T. Taddei, Yuanshui Zheng, Dragan Mirkovic, Wayne D. Newhauser
Ambient Dose Equivalent Versus Effective Dose For Quantifying Stray Radiation Exposures To A Patient Receiving Proton Therapy For Prostate Cancer, Jonas D. Fontenot, Phillip T. Taddei, Yuanshui Zheng, Dragan Mirkovic, Wayne D. Newhauser
Faculty Publications
The purpose of this study was to evaluate the suitability of the quantity ambient dose equivalent H*(10) as a conservative estimate of effective dose E for estimating stray radiation exposures to patients receiving passively scattered proton radiotherapy for cancer of the prostate. H*(10), which is determined from fluence free-in-air, is potentially useful because it is simpler to measure or calculate because it avoids the complexities associated with phantoms or patient anatomy. However, the suitability of H*(10) as a surrogate for E has not been demonstrated for exposures to high-energy neutrons emanating from radiation treatments with proton beams. The suitability was …

Intercomparision Of Monte Carlo Radiation Transport Codes Mcnpx, Geant4, And Fluka For Simulating Proton Radiotherapy Of The Eye, S. D. Randeniya, P. J. Taddei, W. D. Newhauser, P. Yepes
Faculty Publications
Monte Carlo simulations of an ocular treatment beam- line consisting of a nozzle and a water phantom were carried out using MCNPX, GEANT4, and FLUKA to compare the dosimetric accuracy and the simulation efficiency of the codes. Simulated central axis percent depth- dose profiles and cross-field dose profiles were compared with experimentally measured data for the comparison. Simulation speed was evaluated by comparing the number of proton histories simulated per second using each code. The results indicate that all the Monte Carlo transport codes calculate sufficiently accurate proton dose distributions in the eye and that the FLUKA transport code has …

Reducing Stray Radiation Dose For A Pediatric Patient Receiving Proton Craniospinal Irradiation, Phillip J. Taddei, Dragan Mirkovic, Jonas D. Fontenot, Annelise Giebeler, Yuanshui Zheng, Uwe Titt, Shiao Woo, Wayne D. Newhauser
Faculty Publications
The aim of this study was to quantify stray radiation dose from neutrons emanating from a proton treatment unit and to evaluate methods of reducing this dose for a pediatric patient undergoing craniospinal irradiation. The organ equivalent doses and effective dose from stray radiation were estimated for a 30.6-Gy treatment using Monte Carlo simulations of a passive scattering treatment unit and a patient-specific voxelized anatomy. The treatment plan was based on computed tomography images of a 10-yr-old male patient. The contribution to stray radiation was evaluated for the standard nozzle and for the same nozzle but with modest modifications to …

A Track-Repeating Algorithm For Fast Monte Carlo Dose Calculations Of Proton Radiotherapy, Pablo Yepes, Sharmalee Randeniya, Phillip J. Taddei, Wayne D. Newhauser
Faculty Publications
Monte Carlo codes are utilized for accurate dose calculations in proton radiation therapy research. While they are superior in accuracy to commonly used analytical dose calculations, they require significantly longer computation times. The aim of this work is to characterize a Monte Carlo track-repeating algorithm to increase computation speed without compromising dosimetric accuracy. The track-repeating approach reduced the CPU time required for a complete dose calculation in voxel- ized patient anatomy by more than two orders of magnitude, while on average reproducing the results from the traditional Monte Carlo approach within 4% dose difference and within 1-mm distance to agreement.

Objectives: Basic science studies show that the extracellular matrix of adipose tissue, mainly represented by collagen VI, is dysfunctional in obesity and contributes to the development of the metabolic syndrome. We hypothesized in humans that increased collagen VI α3-subunit (COL6A3) mRNAis associated with adipose tissue macrophage chemotaxis and inflammation and that weight gain is accompanied by changes in the expression of COL6A3. Research Design and Methods: Adipose tissue biopsies were obtained from a cross-sectional study (n = 109), an overfeeding study (n = 9), and a pioglitazone treatment study (n = 14). Adipose tissue gene expression was measured by quantitative …

Recent breakthroughs in the determination of the crystal structures of G protein-coupled receptors (GPCRs) have provided new opportunities for structure-based drug design strategies targeting this protein family. With the aim of evaluating the current status of GPCR structure prediction and ligand docking, a community-wide, blind prediction assessment - GPCR Dock 2008 - was conducted in coordination with the publication of the crystal structure of the human adenosine A2Areceptor bound to the ligand ZM241385. Twenty-nine groups submitted 206 structural models before the release of the experimental structure, which were evaluated for the accuracy of the ligand binding mode and the overall …

All adults, including those with and without CKD, should receive counseling on the benefits of a healthy lifestyle, which includes a healthy diet, physical activity, and smoking cessation. In people with CKD who are overweight, but not obese, potential benefits of weight loss to the recommended "ideal" range are uncertain. Nevertheless, obesity is associated with increased inflammation, insulin resistance, hypertension, and dyslipidemia, and overweight adults with CKD should be counseled about the risks of weight gain. In persons with CKD and generalized or abdominal obesity, weight loss should be encouraged. For patients on dialysis therapy, survival can be greatly increased …

Background: The relation between variation in interindividual levels of energy expenditure and weight gain remains controversial. Objective: To determine whether or not components of the energy budget predict weight change, we conducted an international comparative study in 2 cohorts of women from sociocultural environments that give rise to the extremes of obesity prevalence. Design: This was a prospective study with energy expenditure measured at baseline and weight measured annually for 3 y. Participants included 149 women from rural Nigeria and 172 African American women. The energy budget was determined by using respiratory gas exchange and doubly labeled water. Main outcomes …

Patient motion is inevitable in SPECT and PET due to the lengthy period of time patients are imaged. The authors hypothesized that the use of external-tracking devices which provide additional information on patient motion independent of SPECT data could be employed to provide a more robust correction than obtainable from data-driven methods. Therefore, the authors investigated the Vicon MX visual-tracking system (VTS) which utilizes near-infrared (NIR) cameras to stereo-image small retroreflective markers on stretchy bands wrapped about the chest and abdomen of patients during cardiac SPECT. The chest markers are used to provide an estimate of the rigid-body (RB) motion …

Fishes of the genus Xiphophorus are well-studied biomedical research models, and some species, such as X. couchianus, are currently listed as endangered in the wild. Sperm cryopreservation in these live-bearing fishes has begun recently. Thus far, live young have been produced with cryopreserved sperm only in one species (Xiphophorus helleri). In this study, the goal was to develop a practical protocol for sperm cryopreservation of Xiphophorus couchianus, and to produce live young with cryopreserved sperm. Sperm were collected by crushing of testis in Hanks' balanced salt solution at an osmolality of 500 mOsmol/kg (HBSS500), and were cryopreserved with 14% glycerol …

The sourcing of application development is becoming increasingly complex. While much prior work has investigated sourcing in a homogeneous marketplace, sourcing choices have increased in complexity, with a myriad of choices ranging from insourcing to domestic outsourcing to engaging Application Service Providers (ASP) to offshoring. In this study, based upon four organizational theories (Transaction Cost, Resource-Based View, Resource-Dependence View, and the Knowledge-Based View of the Firm), we suggest 10 attributes that firms consider when deciding upon outsourcing of applications. We tested the attributes' strength by performing conjoint analysis on data collected from 84 IS executives. We constructed profiles, which are …

Jail inmates face substantial emotional, economic, legal, and other challenges when they are incarcerated. The extent to which they are able to maintain contacts with individuals on the outside can substantially determine how well they cope with these concerns, and visitation is the primary way that such links may be maintained. To date, no systematic assessment of jail visitation policies has been conducted. The current study examined the availability of visitation policy information and the content of policies for national samples of large and small jails. The results suggest that large jails provide more opportunities for visitation and that they …
