Adsorption of molecular and nanoscale matter in mesoporous materials is important in filtration and chromatography as well as membrane processes. However, the morphology and distribution of self-assembled structures of adsorbate formed within nanoconfined environments is largely unknown. Small Angle Neutron Scattering (SANS) with porous matrix matching the neutron scattering length density of the solvent has the potential to provide detailed information on the self-assemblies formed in pore spaces. However, analysis of such SANS profiles remains a challenge. In this study, we extend the SANS analysis method previously developed by Findenegg and co-workers to include interparticle correlations, providing a qualitative characterisation …

Effects Of Dilution And Pressure On Combustion Characteristics Within Externally Heated Micro-Tubes, Seyed Navid Roohani Isfahani, Vinicius M. Sauer, Ingmar Schoegl
Faculty Publications
This study investigates the impact of pressure and dilution on combustion behavior of C2H6/air/N2 mixtures within an externally heated micro-tube using both experimental and analytical techniques. Experiments are conducted for pressures up to 10 bar at multiple dilution levels and document three flame regimes, i.e. weak flames, FREI and normal flames. Characteristic temperatures for flame stabilization, as well as ignition and extinction are obtained by applying a novel thin filament pyrometry method (TFP), which uses a thin silicon carbide (SiC) filament that enables temperature measurements for both reacting and non-reacting cases. Results show a decrease of characteristic temperatures with increasing …

Anthony Kronman and John Sexton have both authored books about the state of higher education: Kronman's entitled, The Assault on American Excellence; Sexton's entitled, Standing for Reason. Both authors have extensive experience as instructors and administrators. Both have academic careers centered around law schools. Both use their books to explore the critical mission of universities in modern society, political and social challenges to that mission, and how to overcome those challenges. Both books are informed, provocative, and ultimately hopeful about the future of higher education. Both, while centered on universities more generally, provide avenues to think about the …
An Open-Source Code For Fluid Flow Simulations In Unconventional Fractured Reservoirs, B Wang, C Fidelibus
An Open-Source Code For Fluid Flow Simulations In Unconventional Fractured Reservoirs, B Wang, C Fidelibus
Faculty Publications
In this article, an open-source code for the simulation of fluid flow, including adsorption, transport, and indirect hydromechanical coupling in unconventional fractured reservoirs is described. The code leverages cutting-edge numerical modeling capabilities like automatic differentiation, stochastic fracture modeling, multicontinuum modeling, and discrete fracture models. In the fluid mass balance equation, specific physical mechanisms, unique to organic-rich source rocks, are included, like an adsorption isotherm, a dynamic permeability-correction function, and an Embedded Discrete Fracture Model (EDFM) with fracture-to-well connectivity. The code is validated against an industrial simulator and applied for a study of the performance of the Barnett shale reservoir, where …
An Auditing Imperative For Automated Hiring, Ifeoma Ajunwa
An Auditing Imperative For Automated Hiring, Ifeoma Ajunwa
Faculty Publications
The goal of this Article is neither to argue against or for the use of automated decision-making in employment, nor is it to examine whether automated hiring systems are better than humans at making hiring decisions. For antidiscrimination law, the efficacy of any particular hiring system is a secondary concern to ensuring that any such system does not unlawfully discriminate against protected categories. Therefore, the aim is to suggest collaborative regulatory regimes for automated hiring systems that will ensure that any benefits of automated hiring are not negated by (un)intended outcomes, such as unlawful discrimination on the basis of protected …
The Road To Free-Market Family Policy, Maxine Eichner
The Road To Free-Market Family Policy, Maxine Eichner
Faculty Publications
This essay investigates and ultimately rejects the claim that the United States’ comparatively heavily reliance on markets over government to provide the resources that families need is a natural outgrowth of the country’s longstanding veneration of capitalism. In tracing the nation’s economic ideology over time, it demonstrates that, at least until the end of the twentieth century, the constant in US history has not been the expectation of a free-market economy, but rather a commitment to ensuring that the economy, however structured, will enable families to thrive. The dramatic recent shift in economic ideology, when the prevailing commitment to government …
Barring Married Same-Sex Couples From Joint Adoption: Comparative Perspectives And The Case Of Taiwan, Holning S. Lau
Barring Married Same-Sex Couples From Joint Adoption: Comparative Perspectives And The Case Of Taiwan, Holning S. Lau
Faculty Publications
Taiwan is the first country in Asia to legalize same-sex marriage, but it forbids married same-sex couples from jointly adopting children. This article examines this restriction through the lens of comparative law, which brings into focus two main insights. First, we see that, out of all countries that have legalized same-sex marriage, Taiwan is one of only two that bar married same-sex couples from joint adoption. As this article will explain, the fact that Taiwan’s policy is so anomalous should spur skepticism of the policy’s appropriateness. Second, judicial opinions from around the world contain persuasive reasoning that further calls into …

Is The Word “Consumer” Biasing Trademark Law?, Dustin Marlan
Is The Word “Consumer” Biasing Trademark Law?, Dustin Marlan
Faculty Publications
Our trademark law uses the term “consumer” constantly, reflexively, and unconsciously to label the subject of its purpose—the purchasing public. According to the U.S. Supreme Court, trademark law has “a specialized mission: to help consumers identify goods and services they wish to purchase, as well as those they want to avoid.” As one leading commentator puts it, “trademarks are a property of consumers’ minds,” and “the consumer, we are led to believe, is the measure of all things in trademark law.”
Much criticism has been rightly levied against trademark law’s treatment of the consumer as passive, ignorant, and gullible. For …

Environmental Crimes And Green Victimization, Averi R. Fegadel
Faculty Publications
The field of criminology continues to give little attention to the behaviors and crimes that adversely impact the environment although decades of research has highlighted these crimes result in greater social harms, losses, and deaths compared to traditional street crimes. Moreover, these crimes are met with little consequences despite several laws and regulations charged with protecting the environment and public welfare. As a result, residents of minority and poor communities are faced with social, racial, and economic inequalities. This draws attention to the green victimization of marginalized groups and underrepresented populations worldwide. In the United States, these groups include Native …

Estimating Primary Forest Attributes And Rare Community Characteristics Using Unmanned Aerial Systems (Uas): An Enrichment Of Conventional Forest Inventories, Benjamin T. Fraser, Russell G. Congalton
Faculty Publications
The techniques for conducting forest inventories have been established over centuries of land management and conservation. In recent decades, however, compelling new tools and methodologies in remote sensing, computer vision, and data science have offered innovative pathways for enhancing the effectiveness and comprehension of these sampling designs. Now with the aid of Unmanned Aerial Systems (UAS) and advanced image processing techniques, we have never been closer to mapping forests at field-based inventory scales. Our research, conducted in New Hampshire on complex mixed-species forests, used natural color UAS imagery for estimating individual tree diameters (diameter at breast height (dbh)) as well …

Among single-cell analysis technologies, single-cell RNA-seq (scRNA-seq) has been one of the front runners in technical inventions. Since its induction, scRNA-seq has been well received and undergone many fast-paced technical improvements in cDNA synthesis and amplification, processing and alignment of next generation sequencing reads, differentially expressed gene calling, cell clustering, subpopulation identification, and developmental trajectory prediction. scRNA-seq has been exponentially applied to study global transcriptional profiles in all cell types in humans and animal models, healthy or with diseases, including cancer. Accumulative novel subtypes and rare subpopulations have been discovered as potential underlying mechanisms of stochasticity, differentiation, proliferation, tumorigenesis, and …

(Excerpt)
This paper challenges prevailing stereotypes about public defenders and prosecutors and updates those stereotypes with a more accurate narrative about how reform-minded public defenders and prosecutors can plea bargain race to yield more equitable justice outcomes.
I was invited to the discussion about criminal justice reform in plea bargaining, because of my work in dispute resolution, dispute system design, and discrimination. Plea bargaining is a justice system negotiation that is used in upwards of 97% of criminal case dispositions. Unlike many of my colleagues in criminal justice reform who have also had years of experience working in the criminal …

In the history of the United States Supreme Court, 1937 was a huge year—perhaps the Court’s most important year ever.
Before 1933, the Supreme Court sometimes held that progressive policies enacted by political branches of government were unconstitutional. Such decisions became much more prevalent during President Franklin D. Roosevelt’s first term, from 1933 through 1936. In those years, the Court struck down, often by narrow margins, both federal “New Deal” laws and state law counterparts that sought to combat the devastation of the Great Depression.
Then, in early 1937, President Roosevelt proposed to “pack”—to enlarge—the Court, so that it would …
Victims, Right?, Anna Roberts
Victims, Right?, Anna Roberts

In criminal contexts, a “victim” is typically defined as someone who has been harmed by a crime. Yet the word commonly appears in legal contexts that precede the adjudication of whether a crime has occurred. Each U.S. state guarantees “victims’ rights,” including many that apply pre-adjudication; ongoing “Marsy’s Law” efforts seek to expand and constitutionalize them nationwide. At trial, advocates, judges, and jury instructions employ this word even though the existence or not of crime (and thus of a crime victim) is a central question to be decided. This usage matters in part because of its possible consequences: it risks …

Following the police killing of George Floyd in the summer of 2020, there has been a renewed focus on protecting Black people in America from excessive police violence. While the images of George Floyd were shocking to the public, that level of extreme violence and disregard for life has been a common aspect of the lives of Black Americans throughout history. In America, Black people are "presumed punishable." Due to the historical and persistent biases against Black people, Black people find themselves subject to false assumptions about their criminality and presumptions that they are deserving of punishment. This stands …

During the summer of 2020, the police killings of George Floyd, Breonna Taylor, and others created a movement that unearthed a reality that Black people in the United States have always been aware of: systemic racism, in the form of police brutality, is alive and well. While the blatant brutality of George Floyd’s murder at the hands of police is the flame, the spark was ignited long ago. One need only review the record of recent years — the killings of Eric Garner, Michael Brown, Tamir Rice, Antwon Rose, Alton Sterling, Philando Castile, Breonna Taylor, and countless other souls …
Meta Rules For Ordinary Meaning, Anita S. Krishnakumar
Meta Rules For Ordinary Meaning, Anita S. Krishnakumar

(Excerpt)
“Ordinary meaning” is a notoriously undefined concept in statutory interpretation theory. Courts and scholars sometimes describe ordinary meaning as the meaning that a “reasonable reader” would ascribe to the statutory language at issue, but it remains unclear how judges and lawyers should go about identifying such meaning. Over the past few decades, as textualism has come to dominate statutory interpretation, courts increasingly have employed dictionary definitions as (purportedly) neutral, and sometimes dispositive, evidence of ordinary meaning. And in the past few years especially, some judges and scholars have advocated using corpus linguistics — patterns of usage across various English …
The Cognitive Power Of Analogies In The Legal Writing Classroom, Patricia G. Montana
The Cognitive Power Of Analogies In The Legal Writing Classroom, Patricia G. Montana

(Excerpt)
New law students traditionally learn better when they can connect what they are learning to a familiar non-legal experience. Therefore, the use of an analogy, which can be defined as a comparison showing the similarities of two otherwise unlike things to help explain an idea or concept, is an obvious way to facilitate a student’s connection between the new and what is already known. An analogy is a logical step in introducing the complex processes of legal research and analysis by attempting to simplify the alien structure of summarizing that legal research and analysis into a coherent piece of …

On 1 January 2021 the Dutch Wet Homologatie Onderhands Akoord, also referred to as the Dutch scheme, entered into force. The Dutch scheme represents a robust restructuring framework that incorporates many of the main restructuring concepts from both the English scheme of arrangement and US chapter 11. It also adds a few new restructuring tools that will make it easier to restructure enterprise group debt by expressly providing that a restructuring plan may include the release of group guarantees and by adopting liberal jurisdictional rules that should permit proceedings to be opened in the Netherlands for all members of …

An Estimate Of The Pitting Strength Of Steel Materials, Edward E. Osakue, Lucky Anetor, Kendall Harris
Faculty Publications
A single expression for estimating the nominal pitting strength of steel materials, based on surface hardness, is developed from first principles for a reliability of 99% at 107 load cycles. It requires the hardness values to be measured in Vicker’s hardness scale. The expression may be used for any steel material processed by hot rolling, cold drawing, quenching and tempering or case-hardening. The formulation incorporates a nominal design factor at 99% reliability which is estimated from a probabilistic model based on the lognormal probability density function. Pitting strength estimates from the expression are compared with those of American Gear Manufacturers …

This paper empirically examines the causal linkages of Japan's stock market (proxied by Nikkei 225 index) performance with selected key macroeconomic fundamentals. Relatively recent Toda-Yamamoto and Dolado-Lutkepohl, multivariate Granger causality tests are implemented. Monthly time series data from September 1974 to February 2017 with a large sample size of 510 monthly observations covering the floating exchange rate regime were utilized. The study documents some interesting and some unexpected results. Bi-directional causality is evidenced only between the stock market and the industrial production. Somewhat counterintuitively, unidirectional causality runs from stock market to money supply. Furthermore, unidirectional causality flows from interest rate …

When we incorporate diversity and inclusion into Library and Information Science course design and content and build communication and learning frameworks in the classroom on inclusive principles, we build a cohort of students who cannot “unsee” these basic principles as they engage in practice. By designing lecture and activity materials that allow students to read and engage with different perspectives about professional values and content, we create opportunities for awareness building and prepare students to engage with the same practices as they join the profession. This chapter provides insights for and examples of how to create courses that bring diversity, …
