This article will examine the issues of judicial assignment. Then the article will return to the Cameron situation in an effort to put that controversy into broader perspective. Finally, the article will consider state procedures that, for practical purposes, authorize litigants to make peremptory challenges to judges in certain circumstances. Those procedures have implications for the discussion of random assignments and for the way we think about Judge Cameron's charges.

A central question of contract law remains: when should the law supply a term not expressly agreed to? Many scholars have addressed that question, yet the justification for law-supplied terms often remains unconvincing. Because many proposals to supply terms do not incorporate a comparative framework for assessing the costs and benefits of legal interventions, they are incompletely justified. This Article proposes that a comparative net benefit approach (developed in institutional economics to explain private arrangements) be adapted and expanded to resolve the fundamental issues of legal intervention. The Article uses that framework to critique the hypothetical bargain and Ayres/Gertner penalty …

The parental right to use physical force to discipline and restrain children is a privilege firmly rooted in the American system of jurisprudence. This privilege is often asserted as a defense when parents are charged with a crime of aggression against their child. While the privilege to use disciplinary force is universally recognized as a defense in criminal actions, it is equally acknowledged that child abuse is a pervasive reality of American life. This article postulates that current laws, addressing assertion of the parental privilege defense in criminal actions, fail either to provide adequate guidance to parents or to sufficiently …
Spanish Diphthongization As A Non-Derivational Phenomenon, David Eddington
Spanish Diphthongization As A Non-Derivational Phenomenon, David Eddington
Faculty Publications
In a previous study on derivational morphology (Eddington 1996), the alternation between the unstressed mid-vowels /e/ and lo/, and the stressed diphthongs /je/ and /we/ was seen to escape straigh tforward explanation in rule-based a nalyses. Diphthongization in Spanish was instead attributed to the influence of other lexical items which contain the same derivational suffix.
The purpose of the present study is twofold. First, an experiment was carried out to test the validity of the findings of the previous study. Spanish speakers completed a questionn aire in which they decided between neologisms containing mid-vowels or diphthongs (e.g. hielo 'ice'+ -azo …

Dijet cross sections are presented using photoproduction data obtained with the ZEUS detector during 1994. These measurements represent an extension of previous results, as the higher statistics allow cross sections to be measured at higher jet transverse energy (ETjet). Jets are identified in the hadronic final state using three different algorithms, and the cross sections compared to complete next-to-leading order QCD calculations. Agreement with these calculations is seen for the pseudorapidity dependence of the direct photon events with ETjet > 6 GeV and of the resolved photon events with ETjet > 11 GeV. Calculated cross sections for resolved photon processes with 6 …

Charged particles (h±) and K0 mesons have been studied in photoproduced events containing at least one jet of ET > 8 GeV n a pseudorapidity interval (-0.5, 0.5) in the ZEUS laboratory frame. Distributions are presented in terms of transverse momentum, pseudorapidity and distance of the particle from the axis of a jet. The properties of h± within the jet are described well using the standard settings of PYTHIA, but the use of the multiparton interaction option improves the description outside the jets.

The shape of jets produced in quasi-real photon-proton collisions at centre-of-mass energies in the range 134-277 GeV has been measured using the hadronic energy flow. The measurement was done with the ZEUS detector at HERA. Jets are identified using a cone algorithm in the η - φ plane with a cone radius of one unit. Measured jet shapes both in inclusive jet and dijet production with transverse energies EjetT > 14 GeV are presented. The jet shape broadens as the jet pseudorapidity (ηjet) increases and narrows as EjetT increases. In dijet photoproduction, the jet shapes have been measured separately for samples …

Inclusive jet differential cross sections for the reaction e+p → e+ + jet + X with quasi-real photons have been measured with the ZEUS detector at HERA. These cross sections are given for the photon-proton centre-of-mass energy interval 134 < W < 277 GeV and jet pseudorapidity in the range -1 < ηjet < 2 in the laboratory frame. The results are presented for three cone radii in the η - φ plane, R = 1.0, 0.7 and 0.5. Measurements of dσ/dηjet above various jet-transverse-energy thresholds up to 25 GeV and in three ranges of W are presented and compared to next-to-leading order (NLO) QCD calculations. For jets defined with R = 1.0 differences between data and NLO calculations are seen at high ηjet and low EjetT. The measured cross sections for jets defined with R = 0.7 are well described by the calculations in the entire measured range ηjet and EjetT. The inclusive jet cross section for EjetT > 21 GeV is consistent with an approximately linear variation with the cone radius R in the range between 0.5 and 1.0, and with NLO calculations.

Elastic and proton-dissociative ρ0 photoproduction (γp → p0p, γp → ρ0N, respectively, with p0 → π+π-) has been studied in ep interactions at HERA for photon-proton centre-of-mass energies in the range 50 < W < 100 GeV and for |t| < 0.5 GeV2, where t is the square of the four-momentum transfer at the proton vertex; the results on the proton-dissociative reaction are presented for masses of the dissociated proton system in the range M2N < 0.1W2. For the elastic process, the π+π- invariant mass spectrum has been investigated as a function of t. As in fixed target experiments, the ρ0 resonance shape is asymmetric; this asymmetry decreases with increasing |t|, as expected in models in which the asymmetry is ascribed to the interference of resonant and non-resonant π+π- production. The cross section has been studied as a function of W; a fit to the resonant part with the form Wa gives a = 0.16 ± 0.06 (stat.) +0.11-0.15 (syst.). The resonant part of the γp → π+π-p cross section is 11.2 ± 0.1 (stat.) +1.1-1.2 (syst.) μb at 〈W〉 = 71.7 GeV. The t dependence of the cross section can be described by a function of the type Aρ exp (-bρ|t| + cρt2) with bρ = 10.9 ± 0.3 (stat.) +1.0-0.5 (syst.) GeV-2 and cρ = 2.7 ± 0.9 (stat.) +1.9-1.7 (syst.) GeV-4. The t dependence has also been studied as a function of W and a value of the slope of the pomeron trajectory α IP′ = 0.23 ± 0.15 (stat.) +0.10-0.07 (syst.) GeV-2 has been deduced. The ρ0 spin density matrix elements r0400 r041-1 and ℜe[r0410] have been measured and found to be consistent with expectations based on s-channel helicity conservation. For proton-dissociative π+π- photoproduction in the ρ0 mass range, the distributions of the two-pion invariant mass, W and the polar and azimuthal angles of the pions in the helicity frame are the same within errors as those for the elastic process. The t distribution has been fitted to an exponential function with a slope parameter 5.8 ± 0.3 (stat.) ± 0.5 (syst.) GeV-2. The ratio of the elastic to proton-dissociative ρ0 photoproduction cross section is 2.0 ± 0.2 (stat.) ± 0.7 (syst.).

Effects Of Ammonium And Non-Ammonium Salt Additions On Methane Oxidation By Methylosinus Trichosporium Ob3b And Maine Forest Soils, G. M. King, S. Schnell

Additions of ammonium and non-ammonium salts inhibit atmospheric methane consumption by soil at salt concentrations that do not significantly affect the soil water potential. The response of soils to non-ammonium salts has previously raised questions about the mechanism of ammonium inhibition. Results presented here show that inhibition of methane consumption by non-ammonium salts can be explained in part by ion-exchange reactions: cations desorb ammonium, with the level of desorption varying as a function of both the cation and anion added; differential desorption results in differential inhibition levels. Differences in the extent of inhibition among ammonium salts can also be explained …

Forty-two Holstein calves were used to study performance and metabolic responses when milk replacer and then postweaning starter were supplemented with 1 ppm of Cr as Cr-tripicolinate. From birth through 8 wk of age, supplemental Cr tended to improve the growth performance of bull calves but not of heifer calves. Starter intake and feed efficiency were not affected by supplemental Cr. From 1 to 5 wk of age, plasma cortisol concentrations sampled just prior to feeding decreased, and concentrations of insulinlike growth factor-I increased. All calves appeared to become less sensitive to insulin as they aged. From 1 to 5 …

We analyzed the European genetic contribution to 10 populations of African descent in the United States (Maywood, Illinois; Detroit; New York; Philadelphia; Pittsburgh; Baltimore; Charleston, South Carolina; New Orleans; and Houston) and in Jamaica, using nine autosomal DNA markers. These markers either are population-specific or show frequency differences >45% between the parental populations and are thus especially informative for admixture. European genetic ancestry ranged from 6.8% (Jamaica) to 22.5% (New Orleans). The unique utility of these markers is reflected in the low variance associated with these admixture estimates (SEM 1.3%-2.7%). We also estimated the male and female European contribution to …

Crossing The Line: The Political And Moral Battle Over Late-Term Abortion, Rigel C. Oliveri
Faculty Publications
This paper focuses on the political and moral debate surrounding two pieces of federal legislation which sought to criminalize a particular late term abortion technique scientifically known as "intact dilation and extraction," and popularly known as "partial birth abortion." The Congressional "Partial Birth Abortion" Bans of 1996 and 1997 inflamed the already emotionally charged contest over abortion rights. The intense lobbying and advocacy efforts put pro-choice activists in the uncomfortable position of having to defend one of the most extreme positions on the abortion-rights spectrum. The advocacy was further complicated by the fact that very few women obtain late term …

Reforming The Law: The Payment Rule As A Paradigm , Dale A. Whitman

The concept of negotiability of promissory notes is solidly entrenched in American commercial law. It derives from the English common law notion that a negotiable instrument is a reification of the obligation it describes; the instrument is regarded as a tangible form of the obligation. This notion has multiple ramifications, but three stand out. The first is the holder in due course doctrine which asserts that, when a negotiable instrument is transferred by the correct process (negotiation, which requires delivery of the paper) to someone with the right qualities (good faith, lack of notice, and payment of value), the maker …

High-resolution (>10 samples a−1) glaciochemical analyses covering the last 110 years from a Siplc Dome, Antarctica, ire core reveal limited migration of certain soluble ionic species (methane sulfonic acid, NO3 − and Mg2+). The observed chemical migration may be due in part to seasonal alternation between less acidic winter (from high sea-salt concentrations) and more acidic summer (from high marine biogenic acid concentrations) layers, common at coastal siles such as Siplc Dome. Exact mechanisms to expla in the migration are unclear, although simple diffusion and gravitational movement are unlikely since new peaks are formed where none previously existed in …

The light curve of the Type Ia supernova SN 1974G (in NGC 4414) is important because the Hubble Space Telescope has measured the distance to the host galaxy by means of Cepheid variables, and thus the Hubble constant can be derived. Light curves from the secondary literature are inadequate, since the majority of data is misreported, the majority of the published data is overlooked, and the majority of all data is unpublished, while comparison-star sequences have offsets of over half a magnitude. I have recovered and validated all data, remeasured the comparison stars, and performed light-curve template fits. I find …

The ultimate fate of the Universe, infinite expansion or a big crunch, can be determined by using the redshifts and distances of very distant supernovae to monitor changes in the expansion rate. We can now find large numbers of these distant supernovae, and measure their redshifts and apparent brightnesses; moreover, recent studies of nearby type Ia supernovae have shown how to determine their intrinsic luminosities- and therefore with their apparent brightnesses obtain their distances. The >50 distant supernovae discovered so far provide a record of changes in the expansion rate over the past several billion years. However, it is necessary …

The all-sky survey in high-energy gamma rays (E > 30 MeV) carried out by EGRET aboard the Compton Gamma Ray Observatory provides a unique opportunity to examine in detail the diffuse gamma-ray emission. The observed diffuse emission has a Galactic component arising from cosmic-ray interactions with the local interstellar gas and radiation, as well as an almost uniformly distributed component that is generally believed to originate outside the Galaxy. Through a careful study and removal of the Galactic diffuse emission, the flux, spectrum, and uniformity of the extragalactic emission are deduced. We have searched the COBE DMR time-ordered data sets for instances when one of the DMR horns (FWHM ∼ 7°) was pointing in the direction of a gamma-ray burst at the time of burst occurrence. During the overlap period 1991 April-December corresponding to the first public release of COBE data, 210 Compton Gamma Ray Observatory (CGRO)/BATSE gamma-ray bursts listed in the Third BATSE (3B) Catalog were viewable by the COBE …

We derive generalized quasiclassical transport equations that include the terms responsible for the Hall effect in the vortex state of a clean type-II superconductor, and calculate the conductivity tensor for an (Formula presented)-wave superconductor in the high-field regime. We find that below the superconducting transition the contribution to the transverse conductivity due to dynamical fluctuations of the order parameter is compensated by the modification of the quasiparticle contribution. In this regime the nonlinear behavior of the Hall angle is governed by the change in the effective quasiparticle scattering rate due to the reduction in the density of states at the …

We consider high harmonic generation by ultrashort (27–108 fs) laser pulses and calculate the macroscopic response of a collection of atoms to such a short pulse. We show how the harmonic spectrum after propagation through the medium is significantly different from the single-atom spectrum. We use single-atom data calculated by integration of the time-dependent Schrödinger equation and propose a method, based on an adiabatic approximation, to extract the data necessary to perform a propagation calculation. © 1998 The American Physical Society.

We describe the development of a new balloon-borne telescope known as MARGIE (Minute-of-Arc Resolution Gamma ray Imaging Experiment). It is a coded aperture telescope designed to image photons (in various configurations) over the 20-600 keV range with an angular resolution approaching 1′. MARGIE will use one (or both) of two different detection plane technologies. One such technology involves the use of Cadmium Zinc Telluride (CZT) strip detectors, for which we have successfully demonstrated a spatial resolution of < 375 μm. A second detector option is based on CsI microfiber arrays coupled to a large area silicon CCD readout array, providing spatial resolutions comparable to that of the CZT prototype. In one possible configuration, the coded mask would be 0.5 mm thick tungsten, with 0.5 mm pixels at a distance of 1.5 m from the central detector, giving an angular resolution of 1′ and a fully coded FoV of 12°. © 1998 COSPAR. Miocene to Holocene sediments cores at Site 918 and 919 in the Irminger Basin contain windblown ash layers drived from Icelandic volcanoes. They represent the most explosive volcanism of the rift system. In contrast, only those eruptions that produced lava flowing far from the rift zone are now exposed on Iceland due to subsidence close to the rift axis. Sediments older than 3.2 Ma contain little fresh glass, due to the hydrating effect of diagenetic fluids, although one basaltic layer dated at 10.5 Ma and three rhyolitic layers data at 12.1-12.7 Ma were found to contain fresh glass. Boundary elements are thought to define the ends of functionally independent domains of genetic activity. An assay for boundary activity based on this concept measures the ability to insulate a bracketed, chromosomally integrated reporter gene from position effects. Despite their presumed importance, the few examples identified to date apparently do not share sequence motifs or DNA binding proteins. The Drosophila protein BEAF binds the scs' boundary element of the 87A7 hsp70 locus and roughly half of polytene chromosome interband loci. To see if these sites represent a class of boundary elements that have BEAF in common, we have isolated and …

Objectives. The purpose of this study was to assess the mortality pattern of the adult Hispanic population in the United States. Methods. This was a cohort study using data from the National Health Interview Survey from 1986 through 1990. Deaths were ascertained by matching to the National Death Index through 1991. Results. This representative national sample included 297 640 non-Hispanic Whites, 53 552 Blacks, and 27 239 Hispanics, all aged 18 years or older at baseline. Different matching criteria resulted in modest differential estimates of the number of deaths by ethnic group; these differences were quantitatively more important for Hispanics. …
