Examining The Self-Regulation Abilities Of Students Enrolled In An Online Secondary Charter School, Karen T. Arnesen, Charles R. Graham, Heather Leary

Faculty Publications

This exploratory research addresses the state of student selfregulation (SR) in an online secondary school. Students are more likely to be successful, especially in online schools, when they are self-regulated. Understanding these students’ current SR abilities can facilitate targeted interventions. Data for this study was gathered from a student survey and interviews of students, parents, and teachers from an online secondary school. Quantitative and qualitative analysis revealed that many students perceived their SR as being adequate to strong and that students were more aware of the help-seeking and time management dimensions of SR than of the other dimensions. This awareness …

This research seeks to understand parental support for online students. Using a survey, this study examined perceptions from 567 parents from eight online K-12 programs in a Midwestern state regarding their support for students’ online affective, behavioral, and cognitive engagement. Guided by the Academic Communities of Engagement Framework, our analysis identified eight main challenges parents faced when supporting their online student: (a) focus; (b) keeping on pace; (c) lack of motivation; (d) lack of organization, learning materials, live sessions, and support from online schools; (e) lack of feedback, support, and communication from teachers; (f) parents in need of additional skills …

Costs And Benefits Of A Risk-Based Pcaob Inspection Regime, Brant E. Christensen, Nathan J. Newton, Michael S. Wilkins Jan 2024

Costs And Benefits Of A Risk-Based Pcaob Inspection Regime, Brant E. Christensen, Nathan J. Newton, Michael S. Wilkins

Faculty Publications

We investigate the costs and benefits of the PCAOB’s risk-based inspection regime by studying how auditors respond to engagement-level inspection risk. Using an established inspection selection model, we find evidence that auditors behave consistent with accountability theory when auditing clients with elevated ex-ante inspection risk. Specifically, we observe an increased propensity to report material weaknesses, a decreased propensity to assert that previous material weaknesses have been remediated, increased audit effort, and a decreased likelihood of subsequent financial statement restatement. In general, these outcomes reflect auditors’ attempts to minimize negative inspection outcomes in a way that could be beneficial to investors. …

Language Change At The Intersections Of Movement, Economy, And Orientation, Joseph A. Stanley, Margaret E. L. Renwick, Monica Nesbitt Jan 2024

Language Change At The Intersections Of Movement, Economy, And Orientation, Joseph A. Stanley, Margaret E. L. Renwick, Monica Nesbitt

Faculty Publications

A growing amount of research on North American English varieties shows that many sociolinguistic variables peaked among the Baby Boomer Generation (born approximately 1946–64). By “peak,” we mean that a linguistic phenomenon in one community has reached its point of greatest intensity and is maximally divergent from realizations of that same variable in most other North American communities. Similarly, we also find studies that describe a “cliff” beginning among Generation X (born approximately 1965–82) such that after generations of relative stability, local dialect features are lost. Nesbitt (2021, 359) observes that “the Baby Boomer–Gen X transition appears to be a …

What Are University Students Doing With Language?: A Proportional Description Of University Student Mode And Register Use, Brett James Hashimoto Jan 2024

What Are University Students Doing With Language?: A Proportional Description Of University Student Mode And Register Use, Brett James Hashimoto

Faculty Publications

The extent to which university students read, write, speak, and listen in a range of registers is not completely understood, but such descriptions could lead to better designed curriculum for English learners. The purpose of this study is to estimate the proportions of time American university students spend reading, writing, speaking, and listening in various registers. The present study combines diary and survey techniques to describe the language use behavior for 53 university students. The results indicated that nearly half of university student language use time is spent listening (49.5 %), followed by reading (20.7 %), writing (18.2 %), and …

From Three-Pillars To Three-Environments: Shifting The Paradigm Of Sustainability In Civil And Construction Engineering, Xiaomei Wang, Andrew South, Clifton Farnsworth, Brett James Hashimoto

Faculty Publications

This research explores the usage of sustainability in literature and presents ‘three environments’ for addressing sustainability in the Civil and Construction Engineering (CCE) disciplines. Scholars have increasingly studied sustainability and sustainable development across CCE disciplines as the importance of sustainability awareness and action in society has increased. However, the vastness of its conceptual breadth and depth in CCE research is difficult to holistically evaluate. As a result, CCE researchers often focus on specific aspects of sustainability applied to discrete contexts, or address sustainability in broad aspirational terms and guiding motivations. This research utilized a rigorous analytical corpus linguistics approach for …

Employers And The Privatization Of Public Health, Sharona Hoffman Jan 2024

Employers And The Privatization Of Public Health, Sharona Hoffman

Faculty Publications

This Article focuses on the role of employers in public health and argues that they constitute increasingly important actors in the U.S. public health arena. In the aftermath of the COVID-19 pandemic, a series of judicial decisions and newly enacted statutes enfeebled the public health powers of the federal and state governments. In a 2023 statement, Supreme Court Justice Neil Gorsuch clearly articulated his antagonism towards government-initiated COVID-19 interventions, describing them as “the greatest intrusions on civil liberties in the peacetime history of this country.” All too many share his views.

Employers may be highly motivated to safeguard their workers’ …

Demographic Change, Migration, And The African American Vowel System In Georgia, Jon Forrest, Margaret E. L. Renwick, Joseph A. Stanley, Lelia Glass

Faculty Publications

The theme of this volume is generational trends in language change, with an emphasis on the Baby Boomer to Gen X transition as an important period of time. Many studies have found sharp changes in vowel systems in communities after the Baby Boomer Generation on the East Coast (Thiel and Dinkin 2020) and in the Midwest (Nesbitt 2021). Though we know a great deal about the geographic consistency of the Baby Boomer to Gen X transition, in all of these cases, the focus has been on White speakers and regional varieties. Besides the general importance of including a breadth of …

Neurological Evidence For The Contextindependent Multisensorial Semantics Of Ideophones In Pastaza Kichwa: An Fnirs Study In The Ecuadorian Amazon, Dan Dewey, Jeffrey J. Green, Janis Nuckolls, Auna Nygaard, Tod D. Swanson

Faculty Publications

Ideophones – imitative words using the stream of speech to simulate/depict the rise and fall of sensory perceptions and emotions and temporal experiences of completiveness, instantaneousness, and repetitiveness – have been characterized as semantically empty and context dependent. The research reported here tested a simple schematic for the semantic categories of Pastaza Kichwa ideophones by tracking neurological responses to ideophones categorized as VISUAL, MOTION, and SOUND. Seventeen native speakers of Pastaza Kichwa listened to audio clips of ideophones extracted from sentential contexts. Subjects’ neural activity was assessed using functional near-infrared spectroscopy. Results demonstrate that these posited semantic categories activate areas …

How The Police Released Body-Worn Camera Footage Matters, Angelo Kevin Brown

Faculty Publications

Body-worn cameras (BWC) policies can have a significant impact on police-community relations in various ways, which this chapter will examine. BWCs have been implemented internationally, especially in the developed world. This chapter will primarily focus on law enforcement policies within the United States of America (USA). BWCs have become very common among law enforcement officers, including police officers, sheriff deputies, state patrol, and federal agents. No national law forces law enforcement to wear BWCs. Since no national policy outlines when footage can or cannot be released to the public, which leaves states and municipalities to deal with the legality and …

The Seven Elements Of Dispute Systems Design, Lisa K. Dicker, Neil Mcgaraghan Jan 2024

The Seven Elements Of Dispute Systems Design, Lisa K. Dicker, Neil Mcgaraghan

Faculty Publications

In this article, clinical instructors at the Harvard Law School Dispute Systems Design (“DSD”) Clinic propose adapting an old analytical framework — The Seven Elements of Interest-Based Negotiation — for a new context, dispute systems design (“DSD”). A relatively young field, DSD is the “applied art and science of designing the means to prevent, manage, and resolve streams of disputes or conflict.” DSD can feel broad and opaque to newcomers and thus is in need of a foundational framework, especially for beginners. The Seven Elements of DSD — alternatives, interests, options, criteria, communication, relationship, and commitment — can serve a …

Legal education is transforming. The American Bar Association's accreditation standards now require law schools to provide students with substantial opportunities for the development of professional identities together with an education that results in competencies in oral and written communication. As the professional identity formation requirement changes law school curricula, the COVID-19 pandemic has accelerated changes in the practice of law resulting in an emphasis on remote advocacy and presentation skills. This article explains the design and implementation of an innovative co-curricular program that addresses the new educational standard and the realities of practicing law today. In the Student Scholars …

Distorted Narratives In The Treatment Program Complex, Evelyn Lia Malavé Jan 2024

Distorted Narratives In The Treatment Program Complex, Evelyn Lia Malavé

Faculty Publications

Problem-solving courts and alternatives to incarceration have been both celebrated as successful attempts to address the factors that lead to defendants’ involvement in the criminal legal system and critiqued as ineffective reforms that worsen mass incarceration. Specifically, critiques of the “treatment program complex” have tended to focus on how it harms defendants by exposing them to higher levels of incarceration if they fail to complete court mandates. But these critiques have failed to account for another way the treatment program complex harms defendants: by suppressing their voices regarding what kind of help they need and how they are affected by …

In-House Counsel(Or): The Case For Providing Integrated Mental Health Support Services To Law Students, Eric W. Shannon

Faculty Publications

While some American law schools currently provide onsite mental health support services to their student populations, many still do not. This essay is the first to argue that all law schools should provide onsite mental health support services to their students—ideally, by way of a mental health professional integrated within the law school’s staff (an “integrated mental health professional,” or “IMHP”) who is familiar not only with the unique pressures of law school generally, but also with the school-specific environment. It explores current data on law student well-being as well as external considerations including ABA recommendations and standards for law …

Critical Race Theory Model Measure And Implementation In Curriculum, Taifha Natalee Alexander, Ahilan Arulanantham Jan 2024

Critical Race Theory Model Measure And Implementation In Curriculum, Taifha Natalee Alexander, Ahilan Arulanantham

Faculty Publications

(Excerpt)

This memorandum aims to explain the purpose of the following model measure. The proposed legislation would preserve the freedom of teachers to teach—and students to learn—about racism, including its history and on-going effects in this country. It does this by providing a framework through which state governments can encourage the teaching and learning of Critical Race Theory ("CRT") principles as a lens through which to teach and learn about racial inequality in America, its history, and its current manifestations, to enhance K-12 public school curricula.

We believe the model measure should be of interest to a broad range of …

Outside The Margins: Journal Alternatives For Professional Skill And Identity Development, Eric W. Shannon

Faculty Publications

(Excerpt)

Every summer I hear from students who did not receive an offer to join their preferred journal—or sometimes any journal at all. Overall student interest in journal staff member positions generally outnumbers available spots in publications. Still other students opt out of participating in the writing competition entirely because of significant out-of-school responsibilities or other constraints on their time.

The appeal of journal membership is in many ways self-evident. It affords the space, time, and resources to sharpen legal research and writing skills. It can facilitate exploration of subject-matter areas of interest and help staff members decide on an …

“The Times They Are A Changin’”: Generational Comparisons Of The Civil Rights Movement With The Current-Day Climate Movement, Robin Boyle-Laisure Jan 2024

“The Times They Are A Changin’”: Generational Comparisons Of The Civil Rights Movement With The Current-Day Climate Movement, Robin Boyle-Laisure

Faculty Publications

(Excerpt)

Bob Dylan’s famous song lyric, capturing the spirit of the 1960s, is just as apropos today: “The times they are a changin’” (1964). The civil rights movement changed history by securing legislation and court decisions advancing the constitutional rights of black people (Dalton 2008, 7). The movement took flight at a time when the Baby Boomer generation was politically active and seeking social change. As outlined in the introduction to this book, the generations and their birth years are as follows: Silents (1925–45); Baby Boomers (1946–64); Gen X (1965–80); Millennials (1981–95); and Gen Z (1996–2013). Baby Boomers “experienced the …

Formalizing Compliance To Reduce Board Exposure To Civil And Criminal Liability, Cheryl L. Wade Jan 2024

Formalizing Compliance To Reduce Board Exposure To Civil And Criminal Liability, Cheryl L. Wade

Faculty Publications

(Excerpt)

Fraternities and sororities (Greek-letter organizations or “GLOs” as used herein) are nonprofit organizations that present uniquely complex issues when considering the GLO directors’ ability to oversee and manage the organizations’ potential exposure to criminal and civil liability. Legal analysis of the fiduciary obligations of nonprofit directors borrows from, and analogizes to, the law of directorial fiduciary duty in the for-profit context. There are, however, important structural differences between for-profit and nonprofit firms that require consideration when thinking about how GLO boards operate. The potentiality of criminal and civil liability for a GLO is uniquely driven by the misconduct of …

Faculty Publications

In the summer of 2020, spurred by George Floyd’s murder and amid a worldwide pandemic, Black Lives Matter demonstrations peaked in the United States. The viral nature of the police violence that caused Floyd’s death was a triggering event for transnational Black Lives Matter protests. Around the world, millions took to the streets to demand justice. In Italy, a resounding demand that “Black Lives Matter” filled the streets during solidarity protests that occurred in Milan, Naples, and Rome. Less than six months later, in September 2020, the fatal civilian beating of Willy Monteiro Duarte, a Black Italian, revealed the necessity …

Review Of The Cavity Effect: Modeling And Impact Of Cavity Shape On Apparent Radiative Surface Properties, Ehsan Mofidipour, Matthew R. Jones, Brian D. Iverson

Faculty Publications

Radiative surface properties play a critical role in the analysis, design, and optimization of thermal systems. Geometry has a strong influence on the emission and absorption characteristics of a surface. Modification of radiative surface properties may be achieved by using engineered surfaces or cavities by capitalizing on the cavity effect. A model for the apparent emissivity of an arbitrarily shaped cavity with spectrally and directionally dependent radiative surface properties is presented in this work. This model is verified through comparison with published models of the apparent radiative properties of cylindrical cavities. The merit of this model is demonstrated by obtaining …

This article investigates the effectiveness of positive psychology interventions (PPIs) in an intensive English program for non-matriculated university students. Interventions based on the PERMA model were implemented through weekly 65-minute lessons given during the first class of each week. These were followed by short daily activities during the rest of the week. Using positive psychology topics as the content, students concurrently engaged in language learning activities. Each participant was asked to complete a questionnaire at the end of the semester consisting of five open-ended questions relating to the PPIs, the lessons, the activities, the topics, and how they felt the …

Here-, There-, And Every Where-: Exploring The Role Of Pronominal Adverbs In Legal Language, David Chandler, Brett James Hashimoto Jan 2024

Here-, There-, And Every Where-: Exploring The Role Of Pronominal Adverbs In Legal Language, David Chandler, Brett James Hashimoto

Faculty Publications

Many have claimed that pronominal adverbs, such as hereby, thereafter, and wherein, are a frequent, distinctive, and problematic in their use in legal language (Tiersma, 1999; Mellinkoff, 2004). The purpose of this study is to examine those claims empirically. In the present study, the prevalence of PAs in legal registers is compared to more general registers of contemporary American English to determine the extent to which these words are distinctly legal. The study will also explore why different types of PAs may be (in)frequent in specific legal registers to better understand their use. The frequency of PAs was extracted from …

Parent Motivations For Enrolling Their Young Children In Early Childhood Programs: An Application Of The Theory Of Planned Behaviour, Rachel A. Mcgovern, Camilla Hodge, Edward Ruddell Jan 2024

Parent Motivations For Enrolling Their Young Children In Early Childhood Programs: An Application Of The Theory Of Planned Behaviour, Rachel A. Mcgovern, Camilla Hodge, Edward Ruddell

Faculty Publications

This study used the theory of planned behaviour to identify and determine the relative influence of factors influencing parents’ decisions to enrol their young children (3 to 5 years old) in early childhood programs at a specific museum venue. An eliciting questionnaire was distributed to museum members with at least one child 3–5 years old to elicit outcome expectancies, normative beliefs, and control beliefs, and these responses were developed into items for the main questionnaire. Regression and correlation analyses were conducted to determine factors associated with parents’ intention to enrol their children. Parents across socioeconomic and educational backgrounds indicated they …

How Can Chatbots Improve The Gender Gap In Information Systems?, Rebecca Berthelsen, Cherileigh L. Chandler, Lauren Dean, Mark Keith, Ryan M. Schuetzle, Degan Kettles, Greg Anderson

Faculty Publications

The underrepresentation of women in STEM fields, including information systems (IS), is an ongoing issue that warrants our efforts to understand why a gender gap exists in this domain and what can be done to mitigate it. Prior research shows that women often have lower levels of self-efficacy than men regarding information systems tasks, which may explain the discrepancy between genders. In a previous study, we explored the effectiveness of a chatbot programming tutor in building self-efficacy of IS students and found that chatbot usage, which was self-reported, improved self-efficacy for all students but had a greater effect on self-efficacy …

The Original Meaning Of The Sixteenth Amendment, David Gamage, John R. Brooks Jan 2024

The Original Meaning Of The Sixteenth Amendment, David Gamage, John R. Brooks

Faculty Publications

The Sixteenth Amendment to the United States Constitution enshrines Congress’s “power to lay and collect taxes on incomes, from whatever source derived.” Challenges to the exercise of that power have typically turned on whether the thing being taxed is “income” or not. In the most recent example, the 2024 Supreme Court case of Moore v. United States, taxpayers argued that the Sixteenth Amendment only authorizes taxation of realized income—that is, that gain from appreciated property can only be taxed as “income” when there has been a sale or conversion of that property.

In this Article we argue—based on the original …

Psychological Traits And Public Attitudes Towards Abortion: The Role Of Empathy, Locus Of Control, And Need For Cognition, Jiuqing Cheng, Ping Xu, Chloe Thostenson

Faculty Publications

In the summer of 2022, the U.S. Supreme Court overturned the historic Roe v. Wade ruling, prompting various states to put forth ballot measures regarding state-level abortion rights. While earlier studies have established associations between demographics, such as religious beliefs and political ideologies, and attitudes toward abortion, the current research delves into the role of psychological traits such as empathy, locus of control, and need for cognition. A sample of 294 U.S. adults was obtained via Amazon Mechanical Turk, and participants were asked to provide their attitudes on seven abortion scenarios. They also responded to scales measuring empathy toward the …
