Avoiding Regulatory Mismatch In The Workplace: An Informational Approach To Workplace Safety Regulation, Thom Lambert Jan 2004

Avoiding Regulatory Mismatch In The Workplace: An Informational Approach To Workplace Safety Regulation, Thom Lambert

Faculty Publications

The purpose of this article is to do just that. As it turns out, there is fertile middle ground between the pure libertarian “do nothing” approach and the paternalistic command-and-control approach OSHA tends to favor. Even the middle ground “information-provision” approach a number of theorists have advocated (in imprecise terms) could be implemented several different ways, some of which would be more effective than others. It is therefore possible to make some systematic policy prescriptions that may aid regulators attempting to avoid regulatory mismatch. In the course of exploring the range of regulatory options, this article attempts to make several contributions …

Relations Between Lawyer And Client In Damages: Model, Typical, Or Dysfunctional?, Rodney J. Uphoff Jan 2004

Relations Between Lawyer And Client In Damages: Model, Typical, Or Dysfunctional?, Rodney J. Uphoff

Faculty Publications

This essay begins, therefore, by briefly examining the question of what constitutes good lawyering. The essay acknowledges the difficulty of defining precisely what is good lawyering. In fact, scholars, judges, and lawyers often disagree markedly when they characterize lawyer behavior using the term. Not surprising, then, even though academic commentators routinely trumpet the importance of establishing a meaningful attorney-client relationship as an important aspect of good lawyering, not all in the legal profession embrace that view.8Indeed, the debate about the importance of a good lawyer-client relationship largely reflects contrasting attitudes within the legal profession about the client's role in the …

Combining Learning Approaches For Incremental On-Line Parsing, Deryle W. Lonsdale, Michael B. Manookin Jan 2004

Combining Learning Approaches For Incremental On-Line Parsing, Deryle W. Lonsdale, Michael B. Manookin

Faculty Publications

This paper discusses the integration of two different machine learning approaches to modeling language, NL-Soar and analogical modeling (AM). The resulting hybrid system is capable of functionality that is not possible when using only one of the systems in isolation. After a brief introduction of each system, an explanation is given of how AM is used to provide information useful to NL-Soar for two tasks. Examples are given, and related issues are outlined.

Coordinated Uav Target Assignment Using Distributed Tour Calculation, David H. Walker, Timothy W. Mclain, Jason K. Kowlett Jan 2004

Coordinated Uav Target Assignment Using Distributed Tour Calculation, David H. Walker, Timothy W. Mclain, Jason K. Kowlett

Faculty Publications

In this chapter a method for assigning unmanned aerial vehicle agents to targets through the use of preplanned vehicle tours is presented. Assignments are based on multi-target tours that consider the spread of the targets and the sensor capabilities of the vehicles. In this way, the individual agents and the team as a whole make better use of team resources and improve team cooperation. Planning and assignments are accomplished in reasonable computational time through the use of heuristics to reduce the problem size.

Microstructure Design Of A Two Phase Composite Using Two-Point Correlation Functions, Brent L. Adams, H. Garmestani, G. Saheli Jan 2004

Microstructure Design Of A Two Phase Composite Using Two-Point Correlation Functions, Brent L. Adams, H. Garmestani, G. Saheli

Faculty Publications

This work has been funded under the AFOSR Grant no. F49620-03-1-0011 and Army Research Lab contract no. DAAD17-02-P-0398 and DAAD 19-01-1-0742. Two-point distribution functions are used here as to introduce "Microstructure Sensitive Design" in two-phase composites. Statistical distribution functions are commonly used for the representation of microstructures and also for homogenization of materials properties. The use of two-point statistics allows the composite designer to include the morphology and distribution in addition to the properties of the individual phases and components. Statistical continuum mechanics is used to make a direct link between the microstructure and properties (elastic and plastic) in terms …

Dynamic Spill Monitoring: A Coordinated Approach, Peter Jones, James K. Archibald, Randal Beard, Matthew Blake Jan 2004

Dynamic Spill Monitoring: A Coordinated Approach, Peter Jones, James K. Archibald, Randal Beard, Matthew Blake

Faculty Publications

Sponsorship: INEEL. This paper presents a coordinated control strategy for autonomous monitoring of a dynamically changing hazardous spill. The control strategy is a two level hierarchy that uses use coordination variables to communicate between the levels. The upper level is a resource allocator. The lower level consists of several "commanders" each with a possibly different objective. A physical description of the problem is given, as well as the methods of spill modeling and simulation. Tactics for locating, gravitating to and circling the spill are presented. Finally, both simulation and hardware results are given.

Wideband Channel Model For Aeronautical Telemetry, Christian Bettweiser, Adam Davis, Michael D. Rice Jan 2004

Wideband Channel Model For Aeronautical Telemetry, Christian Bettweiser, Adam Davis, Michael D. Rice

Faculty Publications

A multipath channel model for wideband aeronautical telemetry links is presented. Channel sounding data were collected at Edwards AFB, CA, at both L-band and lower S-band. Frequency domain analysis techniques were used to evaluate candidate channel models. The channel model is composed of three propagation paths: a line-of-sight direct path and two specular reflections. The first specular reflection is characterized by a relative amplitude of 70% to 96% of the line-of-sight amplitude and a delay of 10—80 ns. This path is the result of “ground bounces” off the dry lake bed at Edwards and is a typical terrain feature at …

Description Of A Program For Social Language Intervention: “If You Can Have A Conversation, You Can Have A Relationship, Lee Robinson, Bonnie Brinton, Martin Fujiki

Faculty Publications

Adolescents with impaired language comprehension and formulation skills often experience difficulty keeping up with the linguistic and social demands of peer interaction. This clinical exchange describes an individualized treatment program designed to increase the conversational skill of an adolescent male with language impairment. Treatment focused on increasing awareness of the listener’s needs and on balancing the exchange of conversational turns. Clinical performance, parent report, and client report were used to assess outcomes.

Toxicity And Behavioral Effects Of Nootkatone, 1,10-Dihydronootkatone, And Tetrahydronootkatone To The Formosan Subterranean Termite (Isoptera: Rhinotermitidae), Sanaa A. Ibrahim, Gregg Henderson, Betty C.R. Zhu, Huixin Fei, Roger A. Laine Jan 2004

Laine

Faculty Publications

Toxicity and behavioral effects of nootkatone and two of its derivatives, 1,10-dihydronootkatone and tetrahydronootkatone, to Coptotermes formosanus Shiraki were investigated on workers from two different colonies by using topical application assays, repellency assays, and sand barrier assays. The acute toxicity of the nootkatones on workers from both colonies increased as the saturation of the molecule increased, but the difference was significant for only one colony. The results of the repellency assays showed a similar trend of efficiency; the threshold concentration for significant repellency was four-fold higher in nootkatone treatments (50 ppm) than in the reduced derivatives 1,10-dihydronootkatone or tetrahydronootkatone (12.5 …

Defining Terrorism As The Peacetime Equivalent Of War Crimes: Problems And Prospects, Michael P. Scharf Jan 2004

Defining Terrorism As The Peacetime Equivalent Of War Crimes: Problems And Prospects, Michael P. Scharf

Faculty Publications

This article examines the proposal to define terrorism as the peacetime equivalent of war crimes in the context of answering two questions: First, why might it be useful to define terrorism by reference to the existing laws of war? And second, what are the potential negative consequences which might counsel against such an approach?

Do Rhinoceros Auklet, Cerorhinca Monocerata, Fledglings Fly To The Sea From Their Natal Burrows?, James L. Hayward, Jere K. Clayburn Jan 2004

Do Rhinoceros Auklet, Cerorhinca Monocerata, Fledglings Fly To The Sea From Their Natal Burrows?, James L. Hayward, Jere K. Clayburn

Faculty Publications

The mode of departure of Rhinoceros Auklet fledglings from their nest burrows has remained uncertain. Both walk-down and fly-down hypotheses have been proposed. Here we use the unique geography of Protection Island, Washington, to evaluate the fly-down hypothesis. Some fledglings raised on Protection Island do appear to walk to the water, but our results suggest that many of the island's fledgling Rhinoceros Auklets fly to the sea.

Anatomy Of A Chaotic Attractor: Subtle Model-Predicted Patterns Revealed In Population Data, Aaron A. King, R. F. Costantino, J. M. Cushing, Shandelle M. Henson, Robert A. Desharnais, Brian Dennis Jan 2004

Anatomy Of A Chaotic Attractor: Subtle Model-Predicted Patterns Revealed In Population Data, Aaron A. King, R. F. Costantino, J. M. Cushing, Shandelle M. Henson, Robert A. Desharnais, Brian Dennis

Faculty Publications

Mathematically, chaotic dynamics are not devoid of order but display episodes of near-cyclic temporal patterns. This is illustrated, in interesting ways, in the case of chaotic biological populations. Despite the individual nature of organisms and the noisy nature of biological time series, subtle temporal patterns have been detected. By using data drawn from chaotic insect populations, we show quantitatively that chaos manifests itself as a tapestry of identifiable and predictable patterns woven together by stochasticity. We show too that the mixture of patterns an experimentalist can expect to see depends on the scale of the system under study.

Access Denied: Improper Use Of The Computer Fraud And Abuse Act To Control Information On Publicly Accessible Internet Websites, Christine Galbraith Davik Jan 2004

Access Denied: Improper Use Of The Computer Fraud And Abuse Act To Control Information On Publicly Accessible Internet Websites, Christine Galbraith Davik

Faculty Publications

The Computer Fraud and Abuse Act (CFAA) was originally enacted in 1984 as a criminal statute to address hacking and the growing problem of computer crime. Recently, however, in an attempt to control competition and maintain market share, a number of companies have sought to prevent entities they deem unwelcome from obtaining data on their websites. Utilizing the civil action provisions of the CFAA, these companies have surprisingly succeeded in convincing federal courts that hacking includes accessing and using the factual information a company has chosen to post on a publicly available website. Despite the fact that many of the …

The chirp rate of harmonics 13 to 23 in argon was measured by cross correlation with a 12 femtosecond probe pulse. The negative chirp was directly measured under low ionization conditions due to the atomic dipole phase. It was showed that the additional chirp on the pump pulse was transferred to the qth harmonic as q times the fundamental chirp. The attosecond pulse trains synthesized from these harmonics had a pulse spacing that increased linearly with time.

High-Latitude Tertiary Migrations Of An Exclusively Tropical Clade: Evidence From Malpighiaceae, Charles C. Davis, Peter W. Fritsch, Charles D. Bell, Sarah Mathews Jan 2004

High-Latitude Tertiary Migrations Of An Exclusively Tropical Clade: Evidence From Malpighiaceae, Charles C. Davis, Peter W. Fritsch, Charles D. Bell, Sarah Mathews

Faculty Publications

Explanations of tropical intercontinental disjunctions involving South America and Africa typically invoke vicariance of western Gondwanan biotas or long-distance dispersal. However, many plant groups originated and diversified well after the last direct connection between Africa and South America (ca. 105 million years before the present [mybp]), and it is unlikely that long-distance dispersal accounts for the distribution of all of these. A less commonly invoked explanation, the boreotropics hypothesis, indicates that some tropical disjunctions arose during the Tertiary via high-latitude land connections when northern forests supported tropical vegetation. Malpighiaceae are widely distributed across Africa and South America and have been …

Response Of A Gall-Forming Guild (Hymenoptera: Cynipidae) To Stressed And Vigorous Prairie Roses, Mark A. Williams, James T. Cronin

Faculty Publications

Two general hypotheses that describe the relationship between plant quality and host-plant preference of insect herbivores are the plant-stress and plant-vigor hypotheses. We examined the response of a gall-forming guild of insect herbivores associated with prairie rose, Rosa arkansana Porter (Rosaceae), to experimental manipulations of plant stress (addition of NaCl) and vigor (addition of nitrogen; NH4NO3). The most common members of the gall-forming guild on roses are Diplolepis ignota Osten Sacken, D. nodulosa Beutenmüller, and D. rosaefolii Cockerell (Hymenoptera: Cynipidae). The repeated application of nitrogen throughout the growing season to prairie plots resulted in significantly higher plant nitrogen levels and …

Improving Low-Temperature Performance Of Infrared Thin-Film Interference Filters Utilizing The Intrinsic Properties Of Iv-Vi Narrow-Gap Semiconductors, B. Li, S. Y. Zhang, J. C. Jiang, B. Fan, F. S. Zhang Jan 2004

Improving Low-Temperature Performance Of Infrared Thin-Film Interference Filters Utilizing The Intrinsic Properties Of Iv-Vi Narrow-Gap Semiconductors, B. Li, S. Y. Zhang, J. C. Jiang, B. Fan, F. S. Zhang

Faculty Publications

Pb1-xGexTe is a pseudobinary alloy of IV-VI narrow-gap semiconductor, of which maximum refractive index corresponds to the ferroelectric phase transition. Since the temperature coefficient of refractive index can be tunable from negative to positive by changing the Ge composition, it is possible to utilize the intrinsic property in the fabrication of infrared thin-film interference filters. In this letter, we report a narrow-bandpass filter, in which Pb0.94Ge0.06Te was substituted for PbTe. It found that the low-temperature stability of the filter is obviously improved: in the temperature range of 80-300K, the shift of center wavelength with temperature is reduced from 0.48nm.K-1 to …

This article proves the conjecture of Thomas that, for every graph G, there is an integer k such that every graph with no minor isomorphic to G has a 2-coloring of either its vertices or its edges where each color induces a graph of tree-width at most k. Some generalizations are also proved. © 2003 Elsevier Inc. All rights reserved.

Let μ be a probability measure on the real line with finite moments of all orders. Suppose the linear span of polynomials is dense in L 2(μ). Then there exists a sequence {Pn} n=0∞ orthogonal polynomials with respect to μ such that Pn is a polynomial of degree n with leading coefficient 1 and the equality (x -αn)Pn(x) = Pn+1(x) + wnPn-1(x) holds, where αn and w n are Szegö-Jacobi parameters. In this paper we use the concepts of pre-generating function, multiplicative renormalization, and generating function to derive {Pn,αn,wn} from a given μ Two types of pre-generating functions are studied. …

Homogeneous Multivariate Polynomials With The Half-Plane Property, Young Bin Choe, James G. Oxley, Alan D. Sokal, David G. Wagner Jan 2004

Homogeneous Multivariate Polynomials With The Half-Plane Property, Young Bin Choe, James G. Oxley, Alan D. Sokal, David G. Wagner

Faculty Publications

A polynomial P in n complex variables is said to have the "half-plane property" (or Hurwitz property) if it is nonvanishing whenever all the variables lie in the open right half-plane. Such polynomials arise in combinatorics, reliability theory, electrical circuit theory and statistical mechanics. A particularly important case is when the polynomial is homogeneous and multiaffine: then it is the (weighted) generating polynomial of an r-uniform set system. We prove that the support (set of nonzero coefficients) of a homogeneous multiaffine polynomial with the half-plane property is necessarily the set of bases of a matroid. Conversely, we ask: For which …

Camptothecin Accumulation In Camptotheca Acuminata Seedlings In Response To Acetylsalicylic Acid Treatment, Zhanhai Li, Zhijun Liu

Faculty Publications

Camptothecin is an anti-cancer alkaloid. Acetylsalicylic acid (ASA) treatment was evaluated as a potential tool for increasing camptothecin accumulation (concentration and yield) in Camptotheca acuminata. Increasing ASA concentration increased leaf camptothecin concentration, but stunted growth and decreased total leaf camptothecin yield. Thus, ASA treatment does not enhance camptothecin yield.

Copyright, Derivative Works And Fixation: Is Galoob A Mirage, Or Does The Form (Gen) Of The Alleged Derivative Work Matter?, Tyler T. Ochoa

Faculty Publications

The Copyright Act gives a copyright owner the exclusive right "to prepare derivative works based on the copyrighted work." Does the Copyright Act require that a derivative work be "fixed in a tangible medium of expression" in order to be infringing? Existing case law is contradictory, stating both that a derivative work does not need to be "fixed" but that it does need to be embodied in some "concrete or permanent form." This contradiction stems from the fact that although the statutory language does not appear to require fixation, reading the statutory language literally would render illegal merely imagining a …

An Inequality Among Equals: Disparities In The Judicial Treatment Of Free Speech And Religious Exercise Claims, Patrick Garry

Faculty Publications

The constitutional models governing the religion clauses of the First Amendment have undergone significant transformations. These transformations have sought to bring a greater consistency and historical harmony to the Court's religious liberty decisions. The success of this endeavor can be gauged in part by comparing the judicial treatment of religion clause claims with free speech claims. However, such a comparison reveals that the former occupy a lower constitutional status than do the latter.
