Valuing Diversity As An Imperative For Fulfilling The Mission Of The Church, Walter B. T. Douglas Jan 2005

Valuing Diversity As An Imperative For Fulfilling The Mission Of The Church, Walter B. T. Douglas

Faculty Publications

Demographic shifts, cultural and ethnic diversity, globalization, and the rapid expansion of the church in the southern hemisphere strongly suggest that the future growth of Adventism may emerge in the developing nations. This article is an attempt to engage in conversation on the changing face of Adventism and the challenge this new Adventism presents across cultural, ethnic, and racially diverse communities. This article provides the church with a window of opportunity to view diversity not as an event but as a process to maximize and explore the richness of its diversity and to see it not as a problem to …

Pricing In The New Economy: Lessons From The Period Of The E-Commerce Bubble, Phillip J. Bryson Jan 2005

Pricing In The New Economy: Lessons From The Period Of The E-Commerce Bubble, Phillip J. Bryson

Faculty Publications

The New Economy increased U.S. productivity sharply after 1995. The latest economics literature on the topic, which generally forecasts a secure future for the information economy, is reviewed. The down side of the New Economy were the strategies, especially the pricing strategies of NASDAQ and virtual firms. The critique of Michael Porter regarding the non-strategic price cutting common to those firms is reviewed. Traditional models by Sweezy and Baumol, which focus on pricing in imperfectly competitive industries, are applied to provide a cogent theory as to why those firms made mistakes that were once viewed as common for neophyte industries.

Thorium-Based Thin Films As Highly Reflective Mirrors In The Euv, David D. Allred, William R. Evans, Jed E. Johnson, Richard L. Sandberg, R. Steven Turley Jan 2005

Thorium-Based Thin Films As Highly Reflective Mirrors In The Euv, David D. Allred, William R. Evans, Jed E. Johnson, Richard L. Sandberg, R. Steven Turley

Faculty Publications

As applications for extreme ultraviolet (EUV) radiation have been identified, the demand for better optics has also increased. Thorium and thorium oxide thin films (19 to 61 nm thick) were RF-sputtered and characterized using atomic force microscopy (AFM), spectroscopic ellipsometry, low-angle x-ray diffraction (LAXRD), x-ray photoelectron spectroscopy (XPS), and x-ray absorption near edge structure (XANES) in order to assess their capability as EUV reflectors. Their reflectance and absorption at different energies were also measured and analyzed at the Advanced Light Source in Berkeley. The reflectance of oxidized thorium is reported between 2 and 32 nm at 5, 10, and 15 …

A World In Darkness -- Early Latter-Day Saint Understanding Of The Apostasy, 1830-1834, Richard Bennett, Amber J. Seidel Jan 2005

A World In Darkness -- Early Latter-Day Saint Understanding Of The Apostasy, 1830-1834, Richard Bennett, Amber J. Seidel

Faculty Publications

Our first purpose will be to show that Joseph Smith's sense of an apostasy from the true Christian faith was ratified in the first vision; furthermore, that this understanding changed and developed during the early years of his prophetic training. Our second objective will be to examine how the doctrine of the apostasy was understood and taught by both leaders and missionaries within the first four years of the organization of the Church of Christ in 1830. Although this is a subjective rather than a quantitative study, we have concluded, after an extensive review of many of the contemporary sources, …

The Terminator As Eraser: How Arnold Schwarzenegger Used The Right Of Publicity To Terminate Non-Defamatory Political Speech, David Welkowitz, Tyler Ochoa Jan 2005

The Terminator As Eraser: How Arnold Schwarzenegger Used The Right Of Publicity To Terminate Non-Defamatory Political Speech, David Welkowitz, Tyler Ochoa

Faculty Publications

INTRODUCTION

While it is no longer unusual for a politician to have been a recent celebrity in the commercial world of entertainment, the Schwarzenegger bobblehead case is one of the rare cases in which a politician has filed a lawsuit asserting a right of publicity claim. However, the Schwarzenegger case and its settlement exposed some basic flaws in the analysis of celebrity rights problems, flaws that are not unique to its political context. Two of those flaws converged in this case and are the main subjects of this article. First, rights of publicity claims frequently are used as a "stealth" …

The Schwarzenegger Bobblehead Case: Introduction And Statement Of Facts, Tyler T. Ochoa Jan 2005

The Schwarzenegger Bobblehead Case: Introduction And Statement Of Facts, Tyler T. Ochoa

Faculty Publications

In May 2004, news media around the world buzzed after learning that Arnold Schwarzenegger, movie-star-turned Governor of California, had filed a lawsuit against an Ohio manufacturer of bobblehead dolls bearing his name and likeness. The case presented a seemingly stark choice between the right of a celebrity-politician to protect his image against commercial appropriation and the First Amendment rights of the public to lampoon that image, and commentators hoped that the case would set a precedent regarding how those rights should be balanced. Just three months later, however, before any court ruling had been made, the parties announced that they …

Democracy And Social Justice: Founding Centers For Social Justice In Law Schools, Stephanie M. Wildman Jan 2005

Democracy And Social Justice: Founding Centers For Social Justice In Law Schools, Stephanie M. Wildman

Faculty Publications

Protecting democracy by combating inequality is the task of social justice lawyers. The practice of democracy mandates inclusion of the diverse populations of this nation into the social order. Social justice lawyers seek to give material meaning to democratic ideals in the daily lives of individuals and communities that are marginalized, subordinated, and underrepresented. Currently, not enough lawyers serve the disenfranchised and not enough lawyers emerge from disenfranchised communities. Hence, the disenfranchised continue to be denied access to legal resources, to the detriment of democracy.

Legal educators must begin to think about how to institutionalize consciousness about social justice as …

Policing The Border Between Trademarks And Free Speech: Protecting Unauthorized Trademark Use In Expressive Works, Pratheepan Gulasekaram Jan 2005

Policing The Border Between Trademarks And Free Speech: Protecting Unauthorized Trademark Use In Expressive Works, Pratheepan Gulasekaram

Faculty Publications

Artists and other creators of expressive works often include trademarks and trademarked products as part of their works. They do so for a number of reasons, including lighthearted humor, critical cultural commentary, parody, or even simply to shock. In instances where such use is both unauthorized by and perceived as disparaging to the mark owner or the trademarked product, owners have attempted to sue under trademark law to enjoin the expressive use. This Article argues that, under a proper analysis of trademark law, precedent, and the free expression ideal enshrined in the First Amendment, mark owners should rarely, if ever, …

Data Mining And Attention Consumption, Eric Goldman Jan 2005

Data Mining And Attention Consumption, Eric Goldman

Faculty Publications

This Essay challenges the prevailing hostility towards data mining and direct marketing. The Essay starts by defining data mining and shows that the only important step is how data is used, not its aggregation or sorting. The Essay then discusses one particular type of data use, the sending of direct marketing. The Essay establishes a model for calculating the private utility experienced by a direct marketing recipient. The model posits that utility is a function of the message's substantive content, the degree of attention consumed, and the recipient's reaction to receiving the message. The Essay concludes with some policy recommendations …

‘We’Re Just Like The Irish’: Narratives Of Assimilation, Belonging, And Citizenship Among Arab American Activists, Caroline R. Nagel, Lynn A. Staeheli Jan 2005

‘We’Re Just Like The Irish’: Narratives Of Assimilation, Belonging, And Citizenship Among Arab American Activists, Caroline R. Nagel, Lynn A. Staeheli

Faculty Publications

This paper examines narratives of assimilation and belonging as activists attempt to position Arab-Americans as citizens and full members of the American polity. In interviews with activists, the experience of the Irish as immigrants and citizens was often invoked as the paradigmatic example of how immigrants are incorporated as citizens—an example that activists promoted as one that Arabs would follow. By invoking the Irish experience, activists hope to remind Americans that immigration history is not one of effortless assimilation, but is rather characterized by systematic exclusion and marginalization. In so doing, they articulate narratives of assimilation and belonging that draw …

Competing Perspectives During Organizational Socialization On The Role Of Certified Athletic Trainers In High School Settings, James M. Mensch, Candice Crews, Murrary F. Mitchell Jan 2005

Competing Perspectives During Organizational Socialization On The Role Of Certified Athletic Trainers In High School Settings, James M. Mensch, Candice Crews, Murrary F. Mitchell

Faculty Publications

When certified athletic trainers (ATCs) enter a workplace, their potential for professional effectiveness is affected by a number of factors, including the individual's ability to put acquired knowledge, skills, and attitudes into practice. This ability may be influenced by the preconceived attitudes and expectations of athletes, athletes' parents, athletic directors, physical therapists, physicians, and coaches.

Objective: To examine the perspectives of high school coaches and ATCs toward the ATC's role in the high school setting by looking at 3 questions: (1) What are coaches' expectations of ATCs during different phases of a sport season? (2) What do ATCs perceive their …

The Constitutional Failing Of The Anticybersquatting Act, Ned Snow Jan 2005

The Constitutional Failing Of The Anticybersquatting Act, Ned Snow

Faculty Publications

Eminent domain and thought control are occurring in cyberspace. Through the Anticybersquatting Consumer Protection Act (ACPA), the government transfers domain names from domain-name owners to private parties based on the owners' bad-faith intent. The owners receive no just compensation. The private parties who are recipients of the domain names are trademark holders whose trademarks correspond with the domain names. Often the trademark holders have no property rights in those domain names: trademark law only allows mark holders to exclude others from making commercial use of their marks; it does not allow mark holders to reserve the marks for their own …

Reliability And Validity Of The Behavioral And Emotional Rating Scale-Second Edition: Parent Rating Scale, Paul Mooney, Michael H. Epstein, Gail Ryser, Corey D. Pierce Jan 2005

Reliability And Validity Of The Behavioral And Emotional Rating Scale-Second Edition: Parent Rating Scale, Paul Mooney, Michael H. Epstein, Gail Ryser, Corey D. Pierce

Faculty Publications

Three studies are reported addressing the test-retest reliability and convergent validity of the Behavioral and Emotional Rating Scale-Second Edition (BERS-2): Parent Rating Scale (PRS). In the first study, test-retest reliability was investigated over a one-week period to determine the stability of the BERS-2 PRS over time. Reliability coefficients were at or above.80. Convergent validity was assessed as parents completed the PRS and a second measure of perceived child functioning. In the second study, the six BERS-2 PRS subscales and overall strength index were correlated with composite scores from the parent forms of the Social Skills Rating System. Correlations were generally …

An Evaluation Of Lidar-Derived Elevation And Terrain Slope In Leaf-Off Conditions, Michael E. Hodgson, John Jensen, George Raber, Jason Tullis, Bruce A. Davis, Gary Thompson, Karen Schuckman

Faculty Publications

The effects of land cover and surface slope on lidar-derived elevation data were examined for a watershed in the piedmont of North Carolina. Lidar data were collected over the study area in a winter (leaf-off) overflight. Survey-grade elevation points (1,225) for six different land cover classes were used as reference points. Root mean squared error (RMSE) for land cover classes ranged from 14.5 cm to 36.1 cm. Land cover with taller canopy vegetation exhibited the largest errors. The largest mean error (36.1 cm RMSE) was in the scrub-shrub cover class. Over the small slope range (0° to 10°) in this …

Today's service-oriented systems realize many ideas from the research conducted a decade or so ago in multiagent systems. Because these two fields are so deeply connected, further advances in multiagent systems could feed into tomorrow's successful service-oriented computing approaches. This article describes a 15-year roadmap for service-oriented multiagent system research.

"That Could Happen": Nature Writing, The Nature Fakers, And A Rhetoric Of Assent, David Thomas Sumner Jan 2005

"That Could Happen": Nature Writing, The Nature Fakers, And A Rhetoric Of Assent, David Thomas Sumner

Faculty Publications

Much has been made about the relationship between nature writing and science. The foundation of the genre is empirical observation of the more-than-human world. That’s not the whole of it, however. Because of the pairing of empiricism and other human experience, readers come to the genre with certain assumptions: they assume the text will tell them something independently verifiable about the object world--something they could see, hear, or touch if they were in the same location at the same time. They assume they are reading nonfiction, and for most readers, that distinction is important. Readers also come to nature writing …

Arrival Timing And Seasonal Reproductive Performance In A Long-Distance Migratory Landbird, Robert J. Smith, Frank R. Moore Jan 2005

Arrival Timing And Seasonal Reproductive Performance In A Long-Distance Migratory Landbird, Robert J. Smith, Frank R. Moore

Faculty Publications

The date when a landbird migrant arrives on its breeding grounds may have reproductive consequences. Generally, early arriving individuals begin breeding earlier and consequently experience greater seasonal reproductive performance. Here, we describe relationships between arrival timing and seasonal reproductive performance in the American redstart (Setophaga ruticilla), a long-distance passerine migrant, arriving at northerly breeding grounds in Michigan’s eastern Upper Peninsula. Evidence suggests that both males and females benefited from early arrival at the breeding grounds. Early males appeared to settle on higher quality territories and hatched nestlings sooner than later arrivals. Early females began their clutches early, produced …
