A Coasean Analysis Of Marketing, Eric Goldman Jan 2006

A Coasean Analysis Of Marketing, Eric Goldman

Faculty Publications

Consumers claim to hate marketing - mostly, because they get too much unwanted marketing. In response, regulators develop medium-by-medium marketing suppression regulations. Unfortunately, these ad hoc solutions do little to satisfy consumers, and dynamic technologies and business practices quickly render them moot. Instead of continuing this cycle, there would be some benefit to developing a cross-media marketing regulatory scheme.

However, any holistic solution must be predicated on a clear rationale for regulating marketing. The most common justification is that marketing imposes a negative externality on consumers, but this argument ignores the private and social welfare created by marketing and can …

Using International Law To Enhance Democracy, David Sloss Jan 2006

Using International Law To Enhance Democracy, David Sloss

Faculty Publications

This article analyzes the domestic application of international human rights law from the standpoint of John Hart Ely's political process theory. The article contends that an Elysian theory favors direct application of international human rights treaties, rather than indirect application of international law as an aid to constitutional interpretation, because direct application keeps the channels of political participation open. Moreover, there are certain areas of substantive law, such as capital punishment, where the Supreme Court functions as the primary lawmaker in the United States. From an Elysian viewpoint, in areas of law like capital punishment, where Congress takes a back …

Co-Blogging Law, Eric Goldman Jan 2006

Co-Blogging Law, Eric Goldman

Faculty Publications

Abstract: Bloggers often work collaboratively with other bloggers, a phenomenon I call "co-blogging. " The decision to co-blog may seem casual, but it can have significant and unexpected legal consequences forthe co-bloggers. This essay looks at some of these consequences under partnership law, employment law, and copyright law and explains how each of these legal doctrines can lead to counterintuitive results. The essay then discusses some recommendations to mitigate the harshness of these results.

Future Foreign Language Teachers' Social And Cognitive Collaboration In An Online Environment, Nike Arnold, Lara Ducate Jan 2006

Future Foreign Language Teachers' Social And Cognitive Collaboration In An Online Environment, Nike Arnold, Lara Ducate

Faculty Publications

Discussion boards provide an interactive venue where new and future language teachers can reflect, evaluate, solve problems or simply exchange ideas (e.g., Bonk, Hansen, Grabner-Hagen, Lazar, & Mirabelli, 1996; DeWert, Babinski, & Jones, 2003; Kumari, 2001; Pawan, Paulus, Yalcin, & Chang, 2003). In addition, encouraging future teachers to learn with technology before teaching with it allows them to become comfortable using various computer applications.

This article examines transcripts from a semester-long asynchronous discussion between foreign language methodology classes at two different universities. Social and cognitive presence in the discussions was analyzed using Garrison, Anderson, and Archer's Framework of a Community …

Concurrent Multiple- Issue Negotiation For Internet-Based Services, Jiangbo Dang, Michael N. Huhns Jan 2006

Concurrent Multiple- Issue Negotiation For Internet-Based Services, Jiangbo Dang, Michael N. Huhns

Faculty Publications

Negotiation is a technique for reaching a mutually beneficial agreement among autonomous entities. In an Internet-based services context, multiple entities are negotiating simultaneously. The concurrent negotiation protocol extends existing negotiation protocols, letting both service requestors and service providers manage several negotiation processes in parallel. Colored Petri nets, which have greater expressive power than finite state machines and offer support for concurrency, represent the negotiation protocol and facilitate the analysis of desirable properties.

Estimating And Reducing The Memory Requirements Of Signal Processing Codes For Embedded Systems, J. Ramanujam, Jinpyo Hong, Mahmut Kandemir, Ashish Narayan, Ankush Agarwal Jan 2006

Estimating And Reducing The Memory Requirements Of Signal Processing Codes For Embedded Systems, J. Ramanujam, Jinpyo Hong, Mahmut Kandemir, Ashish Narayan, Ankush Agarwal

Faculty Publications

Most embedded systems have limited amount of memory. In contrast, the memory requirements of the digital signal processing (DSP) and video processing codes (in nested loops, in particular) running on embedded systems is significant. This paper addresses the problem of estimating and reducing the amount of memory needed for transfers of data in embedded systems. First, the problem of estimating the region associated with a statement or the set of elements referenced by a statement during the execution of nested loops is analyzed. For a fixed execution ordering, a quantitative analysis of the number of elements referenced is presented; exact …

Active Noise Control Of Stageloader Noise In Longwall Mining, Jeremy M. Slagley, Steven Guffey Jan 2006

Active Noise Control Of Stageloader Noise In Longwall Mining, Jeremy M. Slagley, Steven Guffey

Faculty Publications

With the large-scale mechanization inherent to the mining industry, noise-induced hearing loss remains a major concern. As part of on-going efforts to develop engineering controls to reduce noise levels in longwall mining, active noise control experiments were conducted above ground on a modified non-working stageloader. Recorded underground stageloader noise was broadcast into the above ground stageloader. The result was an average 7 dBA reduction when the active noise control was applied. These results suggest the possibility that active noise reduction can be a useful means to reduce stageloader noise if the control system can be made sufficiently rugged. The study …

Web Services And Virtual Communities, Qingyu Zhang Jan 2006

Web Services And Virtual Communities, Qingyu Zhang

Faculty Publications

With the escalating need for global and flexible interactions in an increasingly networked society, virtual communities as a new model are becoming important for virtual communication and collaboration. Virtual community refers to a group of people who interact socially for mutual benefits in a shared cyberspace, and a social network of relationships that provide information and a sense of belongings (de Moor & van den Heuvel, 2004; Schubert & Ginsburg, 2000). Schubert and Ginsburg (2000) describe virtual communities as the union between individuals or organizations who share common values and interests using electronic media to regularly communicate within a shared …

User Choices And Regret: Understanding Users' Decision Process About Consensually Acquired Spyware, Nathaniel Good, Jens Grossklags, David Thaw, Aaron K. Perzanowski, Deirdre K. Mulligan, Joseph Konstan Jan 2006

User Choices And Regret: Understanding Users' Decision Process About Consensually Acquired Spyware, Nathaniel Good, Jens Grossklags, David Thaw, Aaron K. Perzanowski, Deirdre K. Mulligan, Joseph Konstan

Faculty Publications

Spyware is software which monitors user actions, gathers personal data, and/or displays advertisements to users. While some spyware is installed surreptitiously, a surprising amount is installed on users’ computers with their active participation. In some cases, users agree to accept spyware as part of a software bundle as a cost associated with gaining functionality they desire. In many other cases, however, users are unaware that they installed spyware, or of the consequences of that installation. This lack of awareness occurs even when the functioning of the spyware is explicitly declared in the end user license agreement (EULA). We argue and …

Gendering The City, Gendering The Nation: Contesting Urban Space In Fes, Morocco, Rachel Newcomb Jan 2006

Gendering The City, Gendering The Nation: Contesting Urban Space In Fes, Morocco, Rachel Newcomb

Faculty Publications

An actor-centered approach to the gendering of urban spaces demonstrates how individuals respond to competing ideologies in determining the rules that surround women’s presence in urban, Muslim spaces. This article examines how women in the Ville Nouvelle of Fes, Morocco draw on local conceptualizations of hospitality, kinship, and shame as they debate the gendering of four urban areas: the street, the café, a cosmopolitan exercise club, and cyber space. Women’s tactics for occupying social space indicate the resilience of local culture in the face of ideologies that attempt to posit a specific vision of women in the Moroccan nation state.

Miniature Circularly Polarized Rectenna With Reduced Out-Of-Band Harmonics, Mohammod Ali, Guangli Yang, Roger A. Dougal Jan 2006

Miniature Circularly Polarized Rectenna With Reduced Out-Of-Band Harmonics, Mohammod Ali, Guangli Yang, Roger A. Dougal

Faculty Publications

Wireless embedded sensors are becoming increasingly important for many safety critical applications. Sensor batteries or capacitors must be charged as needed in order to achieve high data rate communications. A miniature circularly polarized rectenna operating at 5.5 GHz is introduced which, with the help of an integrated band-reject filter, reduces out-of-band harmonic emission significantly. The rectenna has a conversion efficiency of 74% with more than 50 dB out-of-band harmonic suppression at 11 GHz.

Decentering The Firm: The Limited Liability Company And Low-Wage Immigrant Women Workers, Miriam A. Cherry Jan 2006

Decentering The Firm: The Limited Liability Company And Low-Wage Immigrant Women Workers, Miriam A. Cherry

Faculty Publications

(Excerpt)

Imagine the following scenario: a group of immigrant women clean houses and offices in the suburbs of a large northeastern city. These workers speak languages other than English. Therefore they depend on an intermediary, another immigrant who has been in the United States for a longer period of time, to solicit jobs, negotiate schedules, and communicate with customers. Although this “intermediary” does not actually perform any of the cleaning work, the intermediary’s “cut,” or share of the income generated, is substantial. The immigrant workers are typically paid a low wage, often averaging below the minimum wage set by the …

Formalism In American Contract Law: Classical And Contemporary, Mark L. Movsesian Jan 2006

Formalism In American Contract Law: Classical And Contemporary, Mark L. Movsesian

Faculty Publications

It is a universally acknowledged truth that we live in a formalist era—at least when it comes to American contract law. Much more than the jurisprudence of a generation ago, today's cutting-edge work in American contract scholarship values the formalist virtues of bright-line rules, objective interpretation, and party autonomy. Policing bargains for substantive fairness seems more and more an outdated notion. Courts, it is thought, should refrain from interfering with market exchanges. Private arbitration has displaced courts in the context of many traditional contract disputes. Even adhesion contracts find their defenders, much to the chagrin of communitarian scholars.

This is …

Contract Drafting Courses For Upper-Level Students: Teaching Tips, Robin A. Boyle

Faculty Publications

(Excerpt)
/="/">Contract-drafting courses are gaining in popularity in law school, and they are a pleasure to teach. On July 20–21, 2005,Northwestern University School of Law provided the location and Judith A. Rosenbaum provided on-site assistance in hosting the first national conference, in recent times, on the topic of contract drafting. The conference was aptly called “Teaching Contract Drafting.” Approximately 100 participants attended, which was significantly more than the organizers expected. The conference’s large attendance indicates the need and growing enthusiasm for guidance on how to develop and teach contract drafting courses. The organizers of the conference, Susan Irion, Richard …

The New Religious Prisons And Their Retributivist Commitments, Marc O. Degirolami Jan 2006

The New Religious Prisons And Their Retributivist Commitments, Marc O. Degirolami

Faculty Publications

The rise of the religious, or "faith-based," prison at the turn of the twenty-first century bears witness to the remarkable resilience of religion in shaping the philosophy of punishment. In the last decade, prisons that incorporate religion in various ways have sprouted around the country and there are some indications, though preliminary, inconclusive, and hotly contested, that inmates who participate in religious instruction and “programming” recidivate at lower rates than those who do not. The early success of these programs (and, some say, the preferential treatment accorded to participants in them) has resulted in high demand and long waiting lists. …
