Understanding Transatlantic Cultural Mobility: For A Cross-Reading Of Fitón In Calderón De La Barca’S El Laurel De Apolo And Alonso De Ercilla’S La Araucana, Carmela Mattza Jan 2022

Understanding Transatlantic Cultural Mobility: For A Cross-Reading Of Fitón In Calderón De La Barca’S El Laurel De Apolo And Alonso De Ercilla’S La Araucana, Carmela Mattza

Faculty Publications

This essay focuses on the intertextual origins and depiction of Fitón in Calderón de la Barca’s play El laurel de Apolo. After contrasting Calderón’s depiction of Fitón with those in Ovid’s Metamorphoses and Alonso de Ercilla’s La Araucana, I demonstrate the special signif icance Calderón’s variations on the classical myth of Fitón acquires when considered within the context of the intersection of Early Modern Spanish literature, history, arts, and politics. Here, I argue that Calderón’s recasting of Fitón serves as propaganda, the origins of which can be found in the four Titian paintings commissioned by María de Hungría in 1548. …

Cross-Modal Reorganization From Both Visual And Somatosensory Modalities In Cochlear Implanted Children And Its Relationship To Speech Perception, Garrett Cardon, Theresa Hennesy, Julia Campbell, Hannah Glick, Don Bell-Souder Jan 2022

Cross-Modal Reorganization From Both Visual And Somatosensory Modalities In Cochlear Implanted Children And Its Relationship To Speech Perception, Garrett Cardon, Theresa Hennesy, Julia Campbell, Hannah Glick, Don Bell-Souder

Faculty Publications

Hypothesis: We hypothesized that children with cochlear implants (CIs) who demonstrate cross-modal reorganization by vision also demonstrate cross-modal reorganization by somatosensation and that these processes are interrelated and impact speech perception. Background: Cross-modal reorganization, which occurs when a deprived sensory modality's cortical resources are recruited by other intact modalities, has been proposed as a source of variability underlying speech perception in deaf children with CIs. Visual and somatosensory cross-modal reorganization of auditory cortex have been documented separately in CI children, but reorganization in these modalities has not been documented within the same subjects. Our goal was to examine the relationship …

This chapter addresses three topics inspired by the discoveries made during Jackson Flat’s archaeological investigations. The first topic examines the implications of the discovery of early maize agriculture in the Far Western region. Our data suggest that the Far Western Basketmaker tradition developed on a trajectory separate from the Western Basketmaker groups associated with the White Dog Phase in the Four Corners region.

The Sticks Of Judah And Joseph: Reflections On Defending The Kingdom, Joseph M. Spencer Jan 2022

The Sticks Of Judah And Joseph: Reflections On Defending The Kingdom, Joseph M. Spencer

Faculty Publications

I wish to pursue two tasks simultaneously in this essay. First, in line with its title, I will address a very old matter of interpretation. I aim to explain as definitively as possible how to make sense of the relationship between Ezekiel 37:15–19, with its talk of the sticks of Judah and Joseph, and the claims of the Restoration, which include somehow connecting the stick of Joseph to the Book of Mormon. Second, in line with the subtitle of this essay, I wish to draw a crucial lesson from the history of how Latter-day Saints have dealt with this issue …

Disparities In Demand For Covid-19 Hospital Care In The United States: Insights From A Longitudinal Hierarchical Study, Wolfgang Messner Jan 2022

Disparities In Demand For Covid-19 Hospital Care In The United States: Insights From A Longitudinal Hierarchical Study, Wolfgang Messner

Faculty Publications

Background and aims

This study examined disparities in hospitalization for COVID-19 within the U.S. by racial and ethnic groups, health insurance status, and social support structure.

Methods

Using publicly available ecological case and contextual data from July 2020 to April 2021, a longitudinal hierarchical model for the 51 U.S. states was constructed.

Results

Racial/ethnic disparities were observed, such as that hospitalization rates were higher in states with a higher percentage of Black (β = .002, P = .009) and American Indian or Alaska Native persons (β = .003, P = .03). Conversely, lack of health insurance was related …

White Injury And Innocence: On The Legal Future Of Antiracism Education, Osamudia James Jan 2022

White Injury And Innocence: On The Legal Future Of Antiracism Education, Osamudia James

Faculty Publications

In the wake of the “racial reckoning” of 2020, antiracism education attracted intense attention and prompted renewed educator commitments to teach more explicitly about the function, operation, and harm of racism in the United States. The increased visibility of antiracism education engendered sustained critique and opposition, resulting in executive orders prohibiting its adoption in the federal government, the introduction or adoption of over sixty state-level bills attempting to control how race is taught in schools, and a round of lawsuits challenging antiracism education as racially discriminatory. Because antiracism so directly runs afoul of norms underlying American antidiscrimination law, including anticlassification, …

Reverse Confusion And The Justification Of Trademark Protection, Jeremy N. Sheff Jan 2022

Reverse Confusion And The Justification Of Trademark Protection, Jeremy N. Sheff

Faculty Publications

Theories of private law are dominated by welfarist normative frameworks, and trademark law is no exception. One such framework—the “search costs” theory associated with the Chicago School of law and economics—has long been the primary accepted justification for trademark rights. However, this theory fails to account for numerous features of actual trademark doctrine, as earlier scholarship has shown. This Article demonstrates how one underexamined area of trademark law—reverse confusion liability— is a similarly poor fit with the predictions and prescriptions of conventional economic theory. Plausible economic theories of trademark rights would either refuse to impose liability in reverse confusion cases …

(Excerpt)

Investing has been evolving for decades. On “Mayday” in 1975, the SEC abolished fixed commissions, changing the face of the brokerage industry. A few months later, Charles Schwab opened its first offices, and discount brokerages were born. By the mid-1980s, there were over 600 discount brokers operating. By 1990, discount brokerage firms captured just under than 10% of the market, although Charles Schwab captured 40% of the discount brokerage market. Throughout the 1990s, new firms entered the market, including E*Trade and AmeriTrade. Online trading became more prevalent; by 1999 25% of all trades occurred online. The term “day trader” …

Law, Religion, And The Covid Crisis, Mark L. Movsesian

Faculty Publications

This essay explores judicial responses to legal restrictions on worship during the COVID-19 pandemic and draws two lessons, one comparative and one relating specifically to U.S. law. As a comparative matter, courts across the globe have approached the problem in essentially the same way, through intuition and balancing. This has been the case regardless of what formal test applies, the proportionality test outside the United States, which expressly calls for judges to weigh the relative costs and benefits of a restriction, or the Employment Division v. Smith test inside the United States, which rejects judicial line-drawing and balancing in favor …

In this chapter we share many fi rst- person quotations about ritual and practice in Jewish families from three major branches of Judaism: Conservative, Orthodox, and Reform. A unique aspect of these quotes is that a number are from observant Jewish children, youth, and young adults, a group that has been largely overlooked in …

Employment Status For "Essential Workers": The Case For Gig Worker Parity, Miriam A. Cherry Jan 2022

Employment Status For "Essential Workers": The Case For Gig Worker Parity, Miriam A. Cherry

Faculty Publications

The continuing misclassification of gig workers as independent contractors has been problematic for over a decade. Several misconceptions have contributed to this marginalization of on-demand workers: technology that often obscures the work that is being performed; the view that platform work is a side hustle; or that platform work exists only for customer convenience or frivolous requests. During the coronavirus pandemic these myths about gig work were turned upside down as on-demand workers were recognized for their efforts and labeled essential workers. With that recognition came newly-awarded benefits, like pandemic unemployment assistance and paid sick leave. As such, the events …

Judean Piracy, Judea And Parthia, And The Roman Annexation Of Judea: The Evidence Of Pompeius Trogus, Kenneth Atkinson

Faculty Publications

Pompey the Great’s 63 BCE conquest of the Jewish kingdom known as the Hasmonean State has traditionally been viewed as an inevitable event since the Roman Republic had long desired to annex the Middle Eastern nations. The prevailing consensus is that the Romans captured the Hasmonean state, removed its high-priest kings from power, and made its territory part of the Republic merely through military force. However, Justin’s Epitome of the Philippic Histories of Pompeius Trogus is a neglected source of new information for understanding relations between the Romans and the Jews at this time. Trogus’s brief account of this period …

Legalization Without Disruption: Why Congress Should Let States Restrict Interstate Commerce In Marijuana, Scott P. Bloomberg

Faculty Publications

Over the past twenty-five years, states have developed elaborate regulatory systems to govern lawful marijuana markets. In designing these systems, states have assumed that the Dormant Commerce Clause (“DCC”) does not apply; Congress, after all, has banned all commerce in marijuana. However, the states’ reprieve from the doctrine may soon come to an end. Congress is on the verge of legalizing marijuana federally, and once it does, it will unleash the DCC, with dire consequences for the states and the markets they now regulate. This Article serves as a wake-up call. It provides the most extensive analysis to date of …

This article emanates from a geospatial database of over 600 premieres of the Cines company’s Quo Vadis? (1913), an eight-reel film distributed by George Kleine, and nearly 250 premieres of the Quo Vadis Film Company’s Quo Vadis? (1913), a three-reel film of ambiguous origins distributed by Paul De Outo. By mapping local premieres of both films across the United States from 1913 through 1916, the data show with spatiotemporal precision the spread of Quo Vadis? as one of cinema’s early blockbuster titles. Yet within this national phenomenon, the two films’ footprints reveal differing cultural geographies served by competing efforts to …

Online forums sponsored by electronic networks of practice (ENPs) have become an important platform for technology-mediated knowledge exchange, yet relatively little is known about how ENP participants filter and evaluate the information they encounter on these forums. This study integrates perspectives from expectation confirmation theory, prospect theory, and neuroscience research to explore how ENP forum filtering judgments are influenced when expectations formed on the basis of contextual cues are confirmed or disconfirmed by the examination of solution quality. We summarize six different models of expectation confirmation explored in previous IS literature and report the results of a neuroimaging experiment using …

Deconstructing Narratives About Artistic Mastery In Art Education, Mark Graham Jan 2022

Deconstructing Narratives About Artistic Mastery In Art Education, Mark Graham

Faculty Publications

A recurring challenge for art educators is how to include Black voices within the art curriculum. This challenge seems ever more relevant as a pandemic underlined the inequalities and injustices within our culture and society. A critical question for many White visual arts educators is: How do I, as a White educator, bring important issues of race, privilege, ideology, gender, and anti-racism into the art classroom? How can I help students to understand Whiteness as a cultural text and set about destabilizing White identity? How does one make space for an antiracist pedagogy? One way to begin conversations about these …

A Chatbot Tutor Can Lessen The Gender Confidence Gap In Information Systems Learning, Cherileigh Leavitt, Madison Corbin, Mark Keith, Ryan Schuetzler, Degan Kettles, Greg Anderson

Faculty Publications

Women are underrepresented in the information systems discipline as well as other STEM fields. A common explanation for the significant gender gap is the difference in women’s and men’s self-efficacy concerning information systems (IS) tasks and roles during their secondary education. As a potential solution, this study explores how chatbot tutors impact confidence differently between 136 women and men in an introductory programming course. Our findings confirmed prior research showing that while men have greater confidence in information systems tasks, there is no difference in performance in those tasks between women and men. Next, we found that a chatbot used …

The Problems, And Positives, Of Passives: Exploring Why Controlling Passive Voice And Nominalizations Is About More Than Preference And Style, Jacob M. Carpenter Jan 2022

The Problems, And Positives, Of Passives: Exploring Why Controlling Passive Voice And Nominalizations Is About More Than Preference And Style, Jacob M. Carpenter

Faculty Publications

As professional writers, attorneys should understand and have command of two of “the worst writing weaknesses”—passive voice and nominalizations. Studies show that compared to active voice, passive voice and nominalizations can make writing slower to read, harder to read, harder to comprehend, harder to remember, less concise, less familiar feeling, and less engaging. However, passive voice isn’t always bad. Expert writers can use passive voice to create cohesion, shift emphasis, imply objectivity, and make readers feel more distant and less emotional about an event. The problem is that attorneys commonly use passive voice indiscriminately, unknowingly, and excessively, amplifying its negative …

Unleashing Pets From Dead-Hand Control, Kaity Emerson, Kevin Bennardo Jan 2022

Unleashing Pets From Dead-Hand Control, Kaity Emerson, Kevin Bennardo

Faculty Publications

Many pet owners feel strongly about their animals. Some feel so strongly that they desire their pets to accompany them to the grave. This Article addresses the validity of pet euthanasia provisions in decedents’ wills.

Pet owners generally have the legal power to humanely euthanize their pets. In addition, the primary focus of the law of wills is to effectuate the wishes of the decedent. These two facts seem to counsel in favor of carrying out a testamentary instruction to humanely euthanize a companion animal. Yet courts generally decline to enforce pet euthanasia provisions whenever an objection is raised by …

The Last Breakfast With Aunt Jemima And Its Impact On Trademark Theory, Deborah R. Gerhardt Jan 2022

The Last Breakfast With Aunt Jemima And Its Impact On Trademark Theory, Deborah R. Gerhardt

Faculty Publications

The generally-accepted law and economics theory of trademarks fails to explain why a brand owner would ever walk away from a trademark that generates financially lucrative returns. In 2020, that is exactly what happened again and again as brand owners pledged to abandon racially explicit marks in the weeks following George Floyd’s murder. As citizens became more attuned to the experiences of those depicted in racial marks, the owners of Aunt Jemima, Uncle Ben’s, the Cleveland Indians, the Redskins, the Dixie Chicks, Lady Antebellum and others announced these brands’ days were numbered. By evoking racist stereotypes, they became a moral …

Superior Status: Relational Obstacles In Law To Racial Justice And Lgbtq Equality, Osamudia James

Faculty Publications

Animus and discrimination are the two legal lenses through which in-equality is typically assessed and understood. Insufficient attention, however, is paid to the role of status in animating inequality, even in landmark cases thought to be equality-promoting. More than an animating force between intractable po-litical conflicts, status also informs the development of equality law in the United States. When courts, advocates, and policymakers affirm, ignore, miss, or con-cede to status hierarchies instead of dismantling them, those groups that perceive a decrease in their status relative to others will only use “equality-promoting” doctrine to rebalance status hierarchy in their favor. Public …

Automated Legal Guidance At Federal Agencies, Joshua D. Blank, Leigh Z. Osofsky

Faculty Publications

When individuals have questions about Federal benefits, services, and legal rules, they are increasingly seeking help from government chatbots, virtual assistants, and other automated tools. Current forms of automated legal guidance platforms include the U.S. Citizenship and Immigration Services’s “Emma,” the U.S. Department of Education’s “Aidan,” and the Internal Revenue Service’s “Interactive Tax Assistant.” Most scholars who have studied artificial intelligence and Federal government agencies have not focused on the government’s use of technology to offer guidance to the public. The absence of scholarly attention to automation as a means of communicating government guidance is an important gap in the …
