Subject To Surveillance: Genocide Law As Epistemology Of The Object, Tawia Baidoe Ansah
Subject To Surveillance: Genocide Law As Epistemology Of The Object, Tawia Baidoe Ansah
Faculty Publications
This article analyzes the discourse on genocide from two angles: the legal genesis of the term in the 1940s and subsequent legal "capture" of the concept of genocide, and a recent socio-political critique of the legal meaning of genocide. The article suggests that a cross-disciplinary critique of genocidal violence not only describes the event and the victim, but also produces knowledge of them as discursive "objects." The key issue is the "surveillance" role of the outside observer, also produced as such in discursive relation to the object. At stake in this view of genocide law as epistemology is the capacity …

Background: Rodent studies show that neurogenesis is necessary for mediating the salutary effects of antidepressants. Nonhuman primate (NHP) studies may bridge important rodent findings to the clinical realm since NHP-depression shares significant homology with human depression and kinetics of primate neurogenesis differ from those in rodents. After demonstrating that antidepressants can stimulate neurogenesis in NHPs, our present study examines whether neurogenesis is required for antidepressant efficacy in NHPs. Materials/Methodology: Adult female bonnets were randomized to three social pens (N = 6 each). Pen-1 subjects were exposed to control-conditions for 15 weeks with half receiving the antidepressant fluoxetine and the rest …
Reconciling The Controversy Of Animal Cruelty And The Shoah: A Look At Primo Levi's Compassionate Writings, Ilona Klein

Is it ethically admissible to compare the suffering of Jews during World War II to the general suffering of animals in the Western world? Who considers this parallel to be morally obscene, and who supports the comparison? Based on the historical evidence of Nazis insulting Jews with animal verbiage and herding them into the gas chambers of concentration camps, this study looks at a few textual examples by the Italian Jewish author Primo Levi, finding a conciliatory position in his poetry and prose.

Picturing Flag Violence In Civil War Sheet Music: The Case Of “Down With The Traitors’ Serpent Flag”, Kenneth Hartvigsen
Faculty Publications
Published in Chicago in 1861, “Down with the Traitors’ Serpent Flag” is one of thousands of political parlor songs from the American Civil War. Many of these songs are unremarkable musically and were preserved in homes, archives, and museum collections largely for their vibrant illustrations. In my presentation I examine this song’s lithographic cover illustration—a Union soldier grinding a Confederate flag into the dust—within a broader discourse of Civil War flag imagery taken from songs, political cartoons, and cartes-de-visite.
Compelling secrets exist within this colorful image that may not first meet the eye; to uncover these meanings along with the …

Roman law treated differently speech restricted to small, closed communities and speech within or among large, permeable communities. Intracommunity speech was subject to unlimited tort consequences, while intercommunity speech was subject to central government regulation. As English speech law evolved, slander rules governing spoken speech became a convenient proxy for intracommunity speech regulation, while libel rules governing written speech became a convenient proxy for intercommunity speech. In American law, the conceptual collapse of slander and libel meant that constitutional limits designed to lift central government regulation of intercommunity speech perhaps inadvertently vitiated tort consequences for intracommunity speech. The Supreme Court's …

Theoretical calculations have shown that proton therapy can reduce the incidence of radiation-induced secondary malignant neoplasms (SMN) compared with photon therapy for patients with prostate cancer. However, the uncertainties associated with calculations of SMN risk had not been assessed. The objective of this study was to quantify the uncertainties in projected risks of secondary cancer following contemporary proton and photon radiotherapies for prostate cancer. We performed a rigorous propagation of errors and several sensitivity tests to estimate the uncertainty in the ratio of relative risk (RRR) due to the largest contributors to the uncertainty: the radiation weighting factor for neutrons, …
A Contractual Approach To Shareholder Oppression Law, Benjamin Means
A Contractual Approach To Shareholder Oppression Law, Benjamin Means

According to standard law and economics, minority shareholders in closely held corporations must bargain against opportunism by controlling shareholders before investing. Put simply, you made your bed, now you must lie in it. Yet most courts offer a remedy for shareholder oppression, often premised on the notion that controlling shareholders owe fiduciary duties to the minority or must honor the minority's reasonable expectations. Thus, law and economics, the dominant mode of corporate law scholarship, appears irreconcilably opposed to minority shareholder protection, a defining feature of the existing law of close corporations.
This Article contends that a more nuanced theory of …

Respiratory syncytial virus (RSV) infection is the most significant cause of viral death in infants worldwide. The significant morbidity and mortality associated with this disease underscores the urgent need for the development of an RSV vaccine. The development of an RSV vaccine has been hampered by our limited understanding of the human host immune system, which plays a significant role in RSV pathogenesis, susceptibility and vaccine efficacy. As a result, animal models have been developed to better understand the mechanisms by which RSV causes disease. Within the past few years, a revolutionary variation on these animal models has emerged - …

Neuromodulators including gonadotropin-releasing hormone (GnRH) and sex steroids help integrate an animal's internal physiological state with incoming external cues, and can have profound effects on the processing of behaviorally relevant information, particularly from the olfactory system. While GnRH and steroid receptors are present in olfactory processing regions across vertebrates, little is known about whether their expression levels change with internal physiological state or external social cues. We used qRT-PCR to measure mRNA levels of two GnRH receptors (GnRH-R1, GnRH-R2), five sex steroid receptors (estrogen receptors: ERα, ERβa, ERβb; androgen receptors: ARα, ARβ), and aromatase in the olfactory bulb of the …

Namibia is the driest country in sub-Saharan Africa, but well known for its richness in species and sustainable natural resource utilization. The Namibian farming sector consists mainly of extensive farming systems. Cattle production contributes 54% of the livestock sector's production output, followed by sheep and goats (25%), hides and skins (9%), and other forms of agricultural production (12%). Namibia's freehold farmers have obtained ownership rights over land and livestock since the early 1900s; commercial rights over wildlife and plants were given to freehold farmers in 1967 and to communal farmers in 1996. Natural resource-based production systems then overtook agricultural production …

The goal of this study was to test whether the breeding system and/or the degree of inbreeding of field colonies of the Formosan subterranean termite, Coptotermes formosanus, Shiraki (Isoptera: Rhinotermitidae) influences bacterial load on the cuticle of foraging workers. We enumerated bacterial load on the cuticle of groups of workers foraging in 20 inground monitoring stations surrounding the French Market in New Orleans, LA, and identified bacteria species using 16S rRNA gene sequencing. We used microsatellite genotyping to assign the 20 worker groups to seven simple family colonies (headed by a single pair of reproductives) and four extended family colonies …

Nilaparvata lugens (Stål) and Sogatella furcifera (Horváth) are the two most important long-distance migratory insect pests that cause great yield losses to rice in China. Accurate long-term population forecast is needed to implement effective management strategies for these two rice pests. In this paper, a transition probability matrix of 5-yr steps of Markov chain theory was constructed based on 31-yr light-trapping data of the two pests from 1977 to 2007 in Jiangkou County, Guizhou, China. The weight of each step for the transition probability matrix was calculated according to its prediction accuracy. Insect occurrence levels in the sixth year were …

Background: Military and industrial activities have lead to reported release of 2,4-dinitrotoluene (2,4DNT) into soil, groundwater or surface water. It has been reported that 2,4DNT can induce toxic effects on humans and other organisms. However the mechanism of 2,4DNT induced toxicity is still unclear. Although a series of methods for gene network construction have been developed, few instances of applying such technology to generate pathway connected networks have been reported.
Results: Microarray analyses were conducted using liver tissue of rats collected 24h after exposure to a single oral gavage with one of five concentrations of 2,4DNT. We observed …

Justice Souter And The Civil Rules, Scott Dodson
Faculty Publications
Justice Souter’s recent retirement from the Court after nearly twenty years presents a unique opportunity to comment on his legacy. No doubt others will eulogize or castigate him for his membership in the Planned Parenthood v. Casey troika, but there is much more to the man and his jurisprudence. Indeed, the danger is that Justice Souter will be pigeonholed into one opinion, an opinion that he wrote early in his Supreme Court career, to the detriment of understanding the complex justice that he was. And what it finds is a justice deeply committed to the fair treatment of the litigants …

World renowned animal scientist and autism self-advocate Temple Grandin said, "People on the autism/Asperger spectrum have uneven skills. They are often good at one type of learning and bad at another. Educators need to work on building up the area of strength." She explains that three cognitive areas of strength are those who are visual thinkers, pattern thinkers, and word thinkers. Visual thinkers are more inclined to think in pictures rather than words. They may excel in graphic design, industrial design, animation, geometry, or trigonometry. Pattern thinkers have abstract visual thoughts where they can see patterns and relationships between numbers. …
Who's To Blame? Elaborating The Role Of Attributions In General Strain Theory, John P. Hoffmann, Karen R. Spence
Who's To Blame? Elaborating The Role Of Attributions In General Strain Theory, John P. Hoffmann, Karen R. Spence

Agnew’s general strain theory (GST) has motivated dozens of criminological studies over the past two decades. Borrowing in part from Cloward and Ohlin’s model of delinquency, Agnew claimed that anger, a key component of GST, occurs when adolescents externalize blame for their adversity. This implies that adolescents who blame strain on an external causal agent (e.g., a parent, a teacher, economic disadvantages) are more likely to get angry and thus lash out through delinquent acts. However, this essential characteristic has been largely neglected in studies of GST. The purpose of this article is to show that external attributions of blame …

Near-surface waters ranging from the Pacific subarctic (58°N) to the Southern Ocean (66°S) contain the neurotoxin domoic acid (DA), associated with the diatom Pseudo-nitzschia. Of the 35 stations sampled, including ones from historic iron fertilization experiments (SOFeX, IronEx II), we found Pseudo-nitzschia at 34 stations and DA measurable at 14 of the 26 stations analyzed for DA. Toxin ranged from 0.3 fg·cell-1 to 2 pg·cell-1, comparable with levels found in similar-sized cells from coastal waters. In the western subarctic, descent of intact Pseudo-nitzschia likely delivered significant amounts of toxin (up to 4 μg of DA·m-2·d …
