In-Silico Hyperthermia Performance Of A Near-Field Patch Antenna At Various Positions On A Human Body Model, Sergio Curto, Terrence See, Patrick Mcevoy, Max Ammann, Zhi Ning Chen

Articles

A compact patch applicator designed to enhance targeted energy coupling at 434 MHz is a key enabler for sensitizing temperature increments in body regions containing superficial tumours. A detailed FDTD body model is used to explore simulated RF coupling and temperature increments for typical clinical conditions. The antenna impedance matching, specific absorption rate and thermal distribution parameters are evaluated to identify applied performance outcomes. The analysis reveals physiological-RF coupling patterns for an optimised closely-coupled single element applicator.

Betting On Tort Suits After The Event: From Champerty To Insurance, Anthony J. Sebok Jan 2011

Betting On Tort Suits After The Event: From Champerty To Insurance, Anthony J. Sebok

Articles

The article challenges the notion that champerty, a form of third-party litigation funding, is a form of gambling. It argues that champerty serves a functional purpose similar to insurance by transferring risk, thereby providing a legitimate form of "after the event" insurance for plaintiffs. The author, Anthony Sebok, contends that while champerty involves contingent outcomes, it should be recognized for its role in risk management rather than being dismissed as speculative gambling.

Is Integration A Discriminatory Purpose?, Michelle Adams Jan 2011

Is Integration A Discriminatory Purpose?, Michelle Adams

Articles

Is integration a form of discrimination? Remarkably, recent Supreme Court doctrine suggests that the answer to this question may well be yes. In Ricci v. DeStefano, the Court characterizes - for the very first time - government action taken to avoid disparate-impact liability and to integrate the workplace as "race-based," and then invalidates that action under a heightened level of judicial review. Consequently, Ricci suggests that the Court is open to the "equivalence doctrine," which posits that laws intended to racially integrate are morally and constitutionally equivalent to laws intended to racially separate. Under the equivalence doctrine, integration is simply …

Articles

The physical structure of a city frequently defines how people interact with each other and their environment. This paper examines the use of personas as a user-centred design tool for the re-engineering of a city to promote sustainable behaviour and social inclusion of its citizens (the Eight Eyes of Dublin Project). The research was carried out through the adoption of personas and collaboration with design partners to identify barriers to sustainability, and resulted in recommendations for the future development of Dublin city, Ireland. These recommendations are then compared with the draft Dublin development plan 2011–17 to determine the effectiveness of …

Too Close To Home: Limiting The Organizations Subsidized By The Charitable Deduction To Those In Economic Need, Shannon Weeks Mccormack Jan 2011

Too Close To Home: Limiting The Organizations Subsidized By The Charitable Deduction To Those In Economic Need, Shannon Weeks Mccormack

Articles

The charitable deduction allows taxpayers to deduct amounts donated to organizations pursuing statutorily designated purposes from their otherwise taxable income. By lowering the after-tax cost of giving and encouraging taxpayers to donate more than they otherwise would, the charitable deduction subsidizes a broad variety of organizations. Some of these organizations provide widespread societal benefits, while others provide narrower benefits that remain closer to the taxpayer-donor’s home. To evaluate these current laws, this Article focuses on efficiency criteria, which limit subsidized organizations to those with donor support that does not cover the costs needed to optimally provide goods and services. Existing …

From Substance To Shadows: An Essay On Salazar V. Buono And Establishment Clause Remedies, David B. Owens Jan 2011

From Substance To Shadows: An Essay On Salazar V. Buono And Establishment Clause Remedies, David B. Owens

Articles

Most disputes about the Establishment Clause center on its substantive meaning; whether, for example, a state subsidy promotes religion, the phrase “In God We Trust” can appear on currency, or a display of the Ten Commandments is unconstitutional. Often overlooked and lurking behind these substantive disputes is a question about what remedies are available when an Establishment Clause violation is found. Typically, an injunction prohibiting the subsidy, practice, or display is the choice. In Salazar v. Buono, however, the Supreme Court was confronted with an unusual case for two reasons. First, the doctrine of res judicata formally barred the …

Student-Edited Law Reviews And Their Role In U.S. Legal Education, Daniel H. Foote Jan 2011

Student-Edited Law Reviews And Their Role In U.S. Legal Education, Daniel H. Foote

Articles

>p>For well over a centur y student-edited law reviews have been a major vehicle for publication of scholarship on law in the United States. At those law reviews, students bear responsibility for nearly all aspects of the publication process, including the vitally important task of selecting what works will be published. Criticisms have been raised over various aspects of this system, but they have not stemmed the rise of student-edited law reviews. Today, such law reviews are firmly entrenched as a central feature of the U.S. legal system; and, facilitat ed by advances in technology, the number of student-edited …

Internationalization And Integration Of Doctrine, Skills And Ethics In Legal Education: The Contrasting Situations Of The United States And Japan, Daniel H. Foote Jan 2011

Internationalization And Integration Of Doctrine, Skills And Ethics In Legal Education: The Contrasting Situations Of The United States And Japan, Daniel H. Foote

Articles

This article addresses two trends in legal education: internationalization and integration of doctrine, skills and legal ethics. In the United States, international and comparative law, skills training, and legal ethics all have deep historical roots in legal education, and the past few decades have seen further major increases in each of those areas. A particularly noteworthy recent development is the rise in efforts to integrate skills training and attention to ethical issues with doctrinal analysis, rather than just teaching each of those elements separately, Notably, Harvard Law School, which continues to influence educational patterns at other law schools within the …

Law Library Budgets In Hard Times, Taylor Fitchett, James Hambleton, Penny Hazelton, Anne Klinefelter, Judith Wright

Articles

This article begins by looking at the environment of the academic law library of the twenty-first century, followed by an analysis of the current economic climate and an assessment of how these difficult economic times will affect academic law libraries. The next section discusses strategies a law library director can marshal to manage a multimillion-dollar budget in face of reduced resources. Focusing in on the institution's own budget and accounting framework, creative thinking, and planning for use of resources can have successful and innovative outcomes for law libraries and the schools they support. Finally tools and strategies that can help …

Taking Better Depositions By Thinking "Outside The Box", Maureen A. Howard Jan 2011

Taking Better Depositions By Thinking "Outside The Box", Maureen A. Howard

Articles

While there are reasons a lawyer may ask questions in a deposition to confirm what she thinks she already knows—nailing down facts for a summary judgment motion, confirming factual and legal theories, perpetuating a witness’s testimony, or facilitating settlement by flexing favorable facts—gathering information the lawyer does not know remains the primary goal of almost every deposition. Despite this, lawyers too often ask questions based on what they already know, limiting the universe of answers and undermining the goal of gathering information.

By the time a lawyer notes depositions, she has already built a “working model” of the case based …

The Asymmetry Of Duty In Criminal Trial Practice, Maureen A. Howard Jan 2011

The Asymmetry Of Duty In Criminal Trial Practice, Maureen A. Howard

Articles

Although the American trial system has been likened to an arena in which mental combatants fight “to the death” (the verdict), each warrior similarly skilled and equally committed to vanquishing the other in a forum with formal rules of engagement enforced by a learned and impartial judge, the role of the criminal prosecutor is qualitatively different than that of other advocates. This is because, unlike any other lawyer, a criminal prosecutor has an affirmative duty to the opposing party.

A lawyer who represents an individual client is duty-bound to advance that client’s interests vigorously within the bounds of the law. …

Intellectual Property, Innovation, And The Future: Toward A Better Model For Educating Leaders In Intellectual Property Law, Robert W. Gomulkiewicz Jan 2011

Intellectual Property, Innovation, And The Future: Toward A Better Model For Educating Leaders In Intellectual Property Law, Robert W. Gomulkiewicz

Articles

Intellectual property sits at the center of today’s global information economy. Today, producers and users of intellectual property come from both developed and developing nations. Intellectual property matters as much to China and India as it does to Germany and the United States. This reality has driven a monumental demand for lawyers who can make and implement intellectual property law - that is to say, the new leaders in intellectual property law. Indeed, the demand for intellectual property law-trained lawyers triggered a “big bang” in the creation of advanced intellectual property law programs at American law schools. The new leaders …

Open Robotics, M. Ryan Calo Jan 2011

Open Robotics, M. Ryan Calo

Articles

Robotics is poised to be the next transformative technology. Robots are widely used in manufacturing, warfare, and disaster response, and the market for personal robotics is exploding. Worldwide sales of home robots—such as iRobot’s popular robotic vacuum cleaner—are in the millions. In fact, Honda has predicted that by the year 2020, it will sell as many robots as it does cars. Microsoft founder Bill Gates believes that the robotics industry is in the same place today as the personal computer (“PC”) business was in the 1970s, a belief that is significant given that there are now well over one billion …

Enforcement Of Open Source Software Licenses: The Mdy Trio's Inconvenient Compliations, Robert W. Gomulkiewicz Jan 2011

Enforcement Of Open Source Software Licenses: The Mdy Trio's Inconvenient Compliations, Robert W. Gomulkiewicz

Articles

The Federal Circuit’s ruling in Jacobsen v. Katzer [535 F.3d 1373 (Fed. Cir. 2008)] finally settled the question of whether open source licenses are enforceable. Unfortunately, three recent cases from the Ninth Circuit have complicated matters. I call this trio of cases the “MDY Trio” in honor of the Ninth Circuit’s prior trio of licensing cases known as the “MAI Trio.”

On the surface, the MDY Trio provides a boost for the enforceability of software licenses, but the MDY Trio also creates two significant complications for open source licenses. First, the MDY Trio’s test for distinguishing between licenses and copyright …

Proving Natural Resource Damage Under Opa 90: Out With The Rebuttable Presumption, In With Apa-Style Judicial Review?, Craig H. Allen Jan 2011

Proving Natural Resource Damage Under Opa 90: Out With The Rebuttable Presumption, In With Apa-Style Judicial Review?, Craig H. Allen

Articles

In the aftermath of the Deepwater Honrzon oil spill of 2010, Prsident Obama uged Congess to amend the natural resource damage provisions of the Oil Pollution Act of 1990 to replace the rebuttable presumption of validity the law presently accords to damage assessments by the designated natural resource trustees that were conducted in accordance with regulations promulgated by the National Oceanic and Atmosphenc Administration with the standard of judicial review prescrbed by the Administrative Procedures Act (APA). Although the House of Representatives passed such an amendment in 2010, the Senate failed to act on the amendment before the 111th congressional …

Electronic Chattel Paper: Invitation Accepted, Jane K. Winn Jan 2011

Electronic Chattel Paper: Invitation Accepted, Jane K. Winn

Articles

In 1999, Revised U.C.C. Article 9 governing secured lending was updated to permit the creation of "electronic chattel paper" ("ECP"). Traditional chattel paper is used widely in some sectors of the US economy to finance equipment purchases in part because a chattel paper financers who perfects by taking possession can achieve priority over a pre-existing secured lender who perfected by filing. Revised U.C.C. § 9-105 defined a new form of "control" over ECP that would be treated as equivalent to possession of traditional chattel paper, permitting chattel paper financers to retain their superpriority status with electronic documents.

Because chattel paper …

Beyond The Guantánamo Bind: Pragmatic Multilateralism In Refugee Resettlement, Melissa J. Durkee Jan 2011

Beyond The Guantánamo Bind: Pragmatic Multilateralism In Refugee Resettlement, Melissa J. Durkee

Articles

A group of detainees remains in the detention facility at the U.S. naval station in Guantánamo Bay, Cuba (“Guantánamo”) almost a decade after the facility began to hold suspected combatants arrested in connection with the U.S. conflict in Afghanistan. As U.S. officials have acknowledged, in many cases these supposed combatants turned out to have no connection to al Qaeda or terrorism. Many were foreigners who had fled home countries to escape persecution and lived as undocumented aliens in Afghanistan or Pakistan. When the United States began its military campaign in Afghanistan and offered bounties for the arrest of terrorists, the …

Common Law Same-Sex Marriage, Peter Nicolas Jan 2011

Common Law Same-Sex Marriage, Peter Nicolas

Articles

In this Essay, I demonstrate that, with the extension of the right to marry to same-sex couples in Iowa, the District of Columbia, and New Hampshire (all states that recognize common law marriage), there now exists the possibility that—for the first time in the United States—a same-sex couple may enter into a legally recognized common law marriage.

In the Essay, I first show, as a doctrinal matter, that same-sex couples have the right to enter into common law marriages in these three jurisdictions, and I explain and compare the criteria for entering into common law marriages in each of them. …

In Vitro Analysis Of Immersed Human Tissues By Raman Microspectroscopy, Franck Bonnier, A. Mehmood, Peter Knief, Aidan Meade, Helen Lambkin, Kathleen Flynn, V. Mcdonagh, C. Healy, T. C. Lee, Fiona Lyng, Hugh Byrne Jan 2011

In Vitro Analysis Of Immersed Human Tissues By Raman Microspectroscopy, Franck Bonnier, A. Mehmood, Peter Knief, Aidan Meade, Helen Lambkin, Kathleen Flynn, V. Mcdonagh, C. Healy, T. C. Lee, Fiona Lyng, Hugh Byrne

Articles

Raman microspectroscopy is a powerful tool for the analysis of tissue sections, providing a molecular map of the investigated samples. Nevertheless, data pre-processing and, particularly, the removal of the broad background to the spectra remain problematic. Indeed, the physical origin of the background has not been satisfactorily determined. Using 785 nm as source in a confocal geometry, it is demonstrated for the example of the protein kappa-elastin that the background and resulting quality of the recorded spectrum are dependent on the morphology of the sample. Whereas a fine powder yields a dominant broad background, compressed pellets and solution-cast thin films …

A Practical Photoelectrochemical Cell Using Nonprecious Metal Electrodes, Patrick Enright, Tony Betts, John Cassidy Jan 2011

A Practical Photoelectrochemical Cell Using Nonprecious Metal Electrodes, Patrick Enright, Tony Betts, John Cassidy

Articles

Abstract: Photoelectrochemical cells (PECs) can be used to harvest light from the oxidation of dissolved organic matter. Similar to fuel cells but requiring light to operate, PECs contain a light assisted electrode that oxidises electron rich materials (anode); these electrons then flow to a typically Pt cathode where O2 is normally the electron acceptor. In this work a PEC cell containing inexpensive materials was shown to (a) mineralise typical organic compounds present in waste water and (b) produce electricity from their decomposition. The PEC cell consisted of a TiO2 coated conducting ink anode exposed to a light source, …

Non Aggregated Colloidal Silver Nanoparticles For Surface Enhanced Resonance Raman Spectroscopy, Aoife Power, John Cassidy, Tony Betts Jan 2011

Non Aggregated Colloidal Silver Nanoparticles For Surface Enhanced Resonance Raman Spectroscopy, Aoife Power, John Cassidy, Tony Betts

Articles

Silver nanoparticles with a tuneable l max were produced as colloids by heterogeneous nucleation. The synthesis process is both fast and repeatable, producing stable PVA capped nanoparticles. The colloid’s effectiveness in the SERRS system was investigated using Rhodamine 6G, R6G, Crystal Violet, CV, and Malachite Green, MG, as probe molecules. A clear sensing trend was observed, where the Raman signal emitted was significantly enhanced by the addition of silver nanoparticles. A build up of signal intensity is observed until an optimum ratio is achieved, followed by a decline in signal intensity as the concentration of nanoparticles is further increased. The …

Articles

The structure-activity relationships of antiproliferative β-lactams, focusing on modifications at the 4-position of the β-lactam ring, is described. Synthesis of this series of compounds was achieved utilizing the Staudinger and Reformatsky reactions. The antiproliferative activity was assessed in MCF-7 cells, where the 4-(4-ethoxy)phenyl substituted compound 26 displayed the most potent activity with an IC50 value of 0.22 μM. The mechanism of action was demonstrated to be by inhibition of tubulin. Cell exposure to combretastatin A-4 and 26 led to arrest of MCF-7 cells in the G2/M phase of the cell cycle and induction of apoptosis. Additionally, mitotic catastrophe for …
