Tracing The Imprint: Catholicism In Some Twentieth Century Irish Fiction, Eamon Maher Jan 2011

Tracing The Imprint: Catholicism In Some Twentieth Century Irish Fiction, Eamon Maher

Articles

In a seminal article published in Studies in 1965, Augustine Martin noted now Irish writers were characterised by what he termed 'inherited dissent', a tendency that led them to replace their original religious faith with blends of the mystical and aesthetic:

Teaching Control Programming Using Programmable Automation Controllers, Dennis G. Watson, Seburn L. Pense Jan 2011

Teaching Control Programming Using Programmable Automation Controllers, Dennis G. Watson, Seburn L. Pense

Articles

Introductory control programming was included as a required course for agricultural systems students. A programmable automation controller (PAC) was programmed with a flowchart paradigm to monitor and control applications. An ex post facto research design was used, with a questionnaire to obtain student feedback. The PAC instructional unit and student feedback are described. Ninety‐two percent of students agreed the PAC unit of the course helped improve their problem‐solving skills.

Understanding Lifestyle Tourism Entrepreneurs And Digging Beneath The Issue Of Profits: Profiling Surf Tourism Lifestyle Entrepreneurs In Ireland, Ben Marchant, Ziene Mottiar

Articles

An area of particular interest for those researching in tourism entrepreneurship has been lifestyle entrepreneurs. Lifestyle entrepreneurs are primarily motivated by the need to succeed at living a certain quality of life by maintaining an income which allows them to survive (Deakins & Freel, 2006).

The dichotomy between entrepreneurs who develop businesses for profit and those who are motivated by lifestyle has formed the basis of much discussion about lifestyle entrepreneurs in the literature. Shaw & Williams (1998) have conceptualised two groups of lifestyle entrepreneurs constrained and non-constrained. This paper contributes to our understanding of lifestyle entrepreneurs by presenting six …

Towards A Decision Making Model For City Break Travel, Gerard Dunne, Sheila Flanagan, Joan Buckley Jan 2011

Towards A Decision Making Model For City Break Travel, Gerard Dunne, Sheila Flanagan, Joan Buckley

Articles

Purpose

The purpose of this paper is to examine the city break travel decision and in particular to develop a decision making model that reflects the characteristics of this type of trip taking.

Method

The research follows a sequential mixed methods approach consisting of two phases. Phase One involves a quantitative survey of 1,000 visitors to Dublin, from which city break and non city break visitor cohorts are separated and compared. Phase Two entails a qualitative analysis (involving 40 in-depth interviews) that specifically examines the decision making behaviour of city break visitors.

Findings

City break trips were shown to be …

Elijah Baker And The Churches He Planted On The Eastern Shore Of Virginia: 1776-1798, Laverne Young Smith

Articles

Elijah Baker was a church planter who spent twenty years planting churches on the Delmarva Pennisula that is shared by Delaware, Maryland, and Virginia between 1776 (when he arrived) and 1798 (when he died). He left quite a legacy on the Eastern Shore. This project highlights his ministry in the Virginia section of the Eastern Shore, and profiles the history and current ministry of the churches that he was directly responsible for planting.

Rule Of Law For Whom? Strengthening Rule Of Law As A Solution To Sexual Violence In The Democratic Republic Of Congo, Ryan S. Lincoln Jan 2011

Rule Of Law For Whom? Strengthening Rule Of Law As A Solution To Sexual Violence In The Democratic Republic Of Congo, Ryan S. Lincoln

Articles

This article suggests that programs designed to strengthen the rule of law in general are unlikely to be effective against the widespread problem of sexual violence in the Democratic Republic of the Congo. I argue that while weak rule of law perpetuates sexual violence, only rule of law programs designed specifically with respect to the needs, risks, and cultural norms pertaining to Congolese women can help curb this problem. The article begins with a brief history of conflict in the Great Lakes region of Africa to provide context for a discussion of the scope of sexual violence in the eastern …

Tangled Up In Knots: How Continued Federal Jurisdiction Over Sexual Predators On Indian Reservations Hobbles Effective Law Enforcement To The Detriment Of Indian Women, Suzianne D. Painter-Thorne Jan 2011

Tangled Up In Knots: How Continued Federal Jurisdiction Over Sexual Predators On Indian Reservations Hobbles Effective Law Enforcement To The Detriment Of Indian Women, Suzianne D. Painter-Thorne

Articles

Consequently, tribal lands have become safe havens for sexual predators, who can commit their offenses with little fear of prosecution. As Fort Peck Tribal Chairman A.T. “Rusty” Stafne explained, “Our people are afraid because there are persons committing crimes against us at night and in broad daylight....We have criminals that are simply unafraid of prosecution.” Indeed, “[t]o a sexual predator, the failure to prosecute sex crimes against American Indian women is an invitation to prey with impunity.”

Congress has responded to the epidemic of reservation crime with the Tribal Law and Order Act27 (TLOA). But, as this article explains, the …

New Ways To Teach Drafting And Drafting Ethics, Karen J. Sneddon Jan 2011

New Ways To Teach Drafting And Drafting Ethics, Karen J. Sneddon

Articles

Good morning. My name is Karen Sneddon. Today, Sue Chesler and I are going to showcase a technique to incorporate issues of ethics and professionalism into a drafting course. And that technique is Teaching Drafting Ethics Using Video Vignettes. Of course we know at this point that Carnegie’s Educating Lawyers, CLEA's Best Practices have reinvigorated examination of law school curricula, mostly especially with the inclusion of transactional based skills increasing the awareness of issues involving professionalism and ethics. As those transactional focused courses are being added to the curriculum, professors are striving for a way to infuse those issues of …

How Much Clinic For How Many Students?: Examining The Decision To Offer Clinics For One Semester Or An Academic Year, Kele Stewart Jan 2011

How Much Clinic For How Many Students?: Examining The Decision To Offer Clinics For One Semester Or An Academic Year, Kele Stewart

Articles

Many law schools are engaged in curricular reform aimed at more effectively preparing students for practice. Two publications that have influenced these reform efforts, Best Practices for Legal Education and the Carnegie Foundation's report Educating Lawyers: Preparation for the Profession of Law, suggest that there should be more clinical opportunities. With limited resources, there is an apparent tension between providing live-client clinics to as many students as possible versus a deeper clinical experience over an academic year. This Article examines the questions raised by a law school's decision to offer a clinic for one semester or two. In designing …

Rankings: Does What Gets Counted Get Done?, Ellen Hazelkorn Jan 2011

Rankings: Does What Gets Counted Get Done?, Ellen Hazelkorn

Articles

Much of the debate around rankings has focused on methodological problems—which indicators and weightings, the credibility of the statistical process, and why (or why not) inconsistencies arise. There are also complaints about the overreliance on research rather than teaching. Yet, there has been little commentary about the increasing use of quantitative methodologies to drive decision making at the national or institutional level—what I call policymaking by numbers. The same issues arise about performance indicators, in general.
Have rankings accelerated this trend? And, because indicators incentivize
behavior, are we measuring what counts or are we doing what gets measured—a classic case …

Legal Ethics And Non-Practicing Entities: Being On The Receiving End Matters Too, David Hricik Jan 2011

Legal Ethics And Non-Practicing Entities: Being On The Receiving End Matters Too, David Hricik

Articles

The symposium invited me to speak on the legal ethical issues that face counsel who represent non-practicing entities ("NPEs") in patent litigation as plaintiff patentees. My first reaction was that, although obviously the same common law, statutes, ethical rules, and procedural rules apply to such counsel as any other, owing to the tremendous costs of patent litigation, that counsel who represented such a "troll" necessarily would have enhanced obligations to court and opposing counsel to ensure that the suit was not brought in bad faith, nor so conducted.

Upon analysis, however, I came to the somewhat counterintuitive conclusion that, although …

The Evolutionary Biology Of Fungi And Fraud, Wendy Gerwick Couture Jan 2011

The Evolutionary Biology Of Fungi And Fraud, Wendy Gerwick Couture

Articles

In this Article, the authors-a law professor and a biologist-offer a fresh perspective on the use of broad federal fraud statutes to combat fraud by drawing a comparison with the use of multi-site fungicides to combat plant disease. Multi-site fungicides are effective at preventing the evolution of resistant strains of fungi, but they are subject to increased regulatory scrutiny amid concerns about off-target toxicity. Similarly, broad fraud statutes serve as a stopgap to prevent the evolution of new types of fraud, but they are widely criticized as unduly vague and as interfering with the operation of specific fraud statutes. Biologists' …

Illegal Aid: Legal Assistance To Immigrants In The United States, Geoffrey Heeren Jan 2011

Illegal Aid: Legal Assistance To Immigrants In The United States, Geoffrey Heeren

Articles

There is an enormous unmet need for immigrant legal aid in the United States. This is partly due to regulations that bar federally funded legal services organizations from representing many types of immigrants. The possible repeal of these restrictions is rarely discussed as a means to expand immigrant access to counsel. Federal funding for immigrant legal aid appears to have become taboo, despite the fact that for much of its history, legal aid was deeply connected to immigration. This forgotten history reveals that there was once broad national consensus in favor of immigrant legal aid; it became contentious and faced …

Edmund Burke’S Aims In Publishing Reflections On The Revolution In France (1790), Stephen Carruthers Jan 2011

Edmund Burke’S Aims In Publishing Reflections On The Revolution In France (1790), Stephen Carruthers

Articles

In this paper, I examine three critical aspects of Burke's beliefs, principles, and political judgment at the time of the outbreak of the French Revolution and examine how they assist in explaining different and less public strands in his motivation to publish the Reflections on the Revolution in France (1790): his views on religion and in particular his attitude to Dissenters; the state of his political career and inf1uence in 1789 as a semi-detached member of the Foxite Whigs; and finally how he saw the publication of the ideas and arguments in the Reflections as a necessary step to maintain …

Sustainable Water Resource Management And Participatory System Dynamics: Case Study: Developing The Palouse Basin Participatory Model, Barbara Cosens Jan 2011

Sustainable Water Resource Management And Participatory System Dynamics: Case Study: Developing The Palouse Basin Participatory Model, Barbara Cosens

Articles

The complexity of explaining highly scientific information and juggling a plethora of social values is leading agencies and communities such as those in the Palouse Basin to explore the use of participatory modeling processes using system dynamics. Participatory system dynamics as a methodology creates a transparent nexus of science, policy options, social concerns and local knowledge that enhances discussion of issues surrounding the use of natural resources. The process of developing a systems model uses the tenets of scientific theory, hypothesis testing and clear statements of assumptions. A unique aspect of the Palouse basin project is the use of system …

Investigation Of Singlemode-Multimode-Singlemode And Singlemode-Tapered Multitmode-Singlemode Fibre Structures And Their Application For Refractive Index Sensing, Pengfei Wang, Gilberto Brambilla, Ming Ding, Yuliya Semenova, Qiang Wu, Gerald Farrell Jan 2011

Investigation Of Singlemode-Multimode-Singlemode And Singlemode-Tapered Multitmode-Singlemode Fibre Structures And Their Application For Refractive Index Sensing, Pengfei Wang, Gilberto Brambilla, Ming Ding, Yuliya Semenova, Qiang Wu, Gerald Farrell

Articles

All-fiber in-line single-mode–multimode–single-mode (SMS) and single-mode–tapered-multimode–single-mode (STMS) fiber structures are investigated. A wide-angle beam propagation method in cylindrical coordinates is developed and employed for numerical simulations of the light propagation performance of such fiber devices. The effect of strong mode interference on the performance of the devices is studied and verified numerically; results indicate that the proposed STMS structure can be exploited for measuring a broad refractive index range with reasonable high resolution, compared with the conventional SMS structure.

Establishing Connections: Gender, Motor Vehicle Theft, And Disposal Networks, Christopher W. Mullins, Michael Cherbonneau Jan 2011

Establishing Connections: Gender, Motor Vehicle Theft, And Disposal Networks, Christopher W. Mullins, Michael Cherbonneau

Articles

As with most other serious street crimes, motor vehicle theft is a male-dominated offense. Yet, women do engage in motor vehicle theft, albeit at a reduced rate of participation. Here we examine the gendered nature of motor vehicle theft through direct comparison of qualitative data obtained from 35 juvenile and adult men and women actively involved auto theft in St. Louis, Missouri. By tracing similarities and differences between men’s and women’s pathways of initial involvement, enactment strategies, and post-theft acts, we provide a contextual analysis of offender’s perceptions and behavior. Such an approach allows a more precise discussion on gender’s …
