Convergence And Multidisciplinarity In Nanotechnology: Laboratories As Technological Hubs, Nicolas Battard
Convergence And Multidisciplinarity In Nanotechnology: Laboratories As Technological Hubs, Nicolas Battard
Articles
This article argues that research groups dedicated to nanoscience and nanotechnology are considered as technological hubs where scientists with multiple backgrounds converge in order to conduct research at the nanoscale (a billionth of a metre). Scientific production is therefore challenged as multiple ways of thinking, practices and knowledge participate in the creation of new outcomes. Through an exploratory and inductive study, I show that these technological hubs develop a specialisation based on internal competencies and stock of knowledge. The specialisation enables laboratories to position themselves as an expert among other laboratories as well as making them more visible in order …
Crisis And Policy Change: The Role Of The Political Entrepreneur, John Hogan, Sharon Feeney
Crisis And Policy Change: The Role Of The Political Entrepreneur, John Hogan, Sharon Feeney
Articles
This paper seeks to investigate the inner mechanics of policy change. It aims to discover how ideas enter the political arena, and how endogenous forces within the policy making environment transform ideas into new policies. The central hypothesis is that in times of crisis, new ideas emanate from a number of change agents, but in order for any of these ideas to enter the institutional environment, one specific agent of change must be present: the political entrepreneur. Without political entrepreneurs, ideational change, and subsequent policy change, would not occur. The paper sets out a framework for identifying and explaining the …
Young Men Consuming Newspaper Prostitution: A Discourse Analysis Of Responses To Irish Newspaper Coverage Of Prostitution., Joseph Fitzgerald, Brendan O'Rourke
Young Men Consuming Newspaper Prostitution: A Discourse Analysis Of Responses To Irish Newspaper Coverage Of Prostitution., Joseph Fitzgerald, Brendan O'Rourke
Articles
In this article we look at how young men consume coverage of prostitution in Irish newspapers. This is important for a number of reasons. Firstly, because the media, and newspapers in particular, seem to be an important source of information for people (Meade, 2008). This is especially true in the case of prostitution, as the only contact the citizenry generally have with sex-workers is through the media (Hallgrimsdottir, Phillips and Benoit, 2006). In many Western countries consuming media is one of the main activities that people, particularly young people, engage in and therefore is the prism through which they view …
Ethical Limits On Civil Litigation Advocacy: A Historical Perspective, Carol Rice Andrews
Ethical Limits On Civil Litigation Advocacy: A Historical Perspective, Carol Rice Andrews
Articles
This article considers and critiques the history of civil litigation conduct standards from ancient times to the present For hundreds of years in both England and France truth and reasonable behavior were constant duties owed to the judicial system itself and they remain paramount today The primary evolution has come with regard to whether any of three additional court duties just cause motive or objective merit also take precedence over client duties Early European litigation standards varyingly imposed versions of each and in nineteenth century America lawyers and scholars debated alternative models for proper litigation advocacy ranging from a full …

Bank Capital Regulation By Enforcement: An Empirical Study, Julie Andersen Hill
Articles
Improving commercial bank capital requirements has been a top priority on the regulatory agenda since the beginning of the 2008 financial crisis Unfortunately some of the information necessary to make informed decisions about capital regulation has been missing Existing regulations establish numerical capital requirements Regulators however have significant discretion to set higher capital requirements for individual banks In considering necessary reforms regulators often focus on specific numerical requirements but sometimes ignore the structure of the regulations and discretionary enforcement efforts Without clear information about discretionary capital enforcement actions it is impossible to make informed judgments about the current capital regulation …

Purchasers Lacking Privity Overcoming "The Rule" For Express Warranty Claims: Expanding Judicial Application Of Common Law Theories And Liberal Interpretation Of U.C.C. Section 2-318, Gary E. Sullivan, Braxton Thrash
Purchasers Lacking Privity Overcoming "The Rule" For Express Warranty Claims: Expanding Judicial Application Of Common Law Theories And Liberal Interpretation Of U.C.C. Section 2-318, Gary E. Sullivan, Braxton Thrash
Articles
The doctrine of privity has dogged contract plaintiffs for several hundred years, but it has been even more challenging for the courts. Never being fully satisfied with one take on it, courts have oscillated back and forth from allowing third-party suits to almost entirely prohibiting them. Even when the doctrine was at its strongest, the courts found ways to avoid its often inequitable dictates. The question seemed to be answered for sales contracts upon the promulgation and adoption of U.C.C. section 2-318. Many states, however, considered the provision unsatisfactory, and it was soon replaced by a set of three alternatives …

The Article Ii Safeguards Of Federal Jurisdiction, Tara Leigh Grove
Articles
Jurisdiction stripping has long been treated as a battle between Congress and the federal judiciary Scholars have thus overlooked the important and surprising role that the executive branch has played in these jurisdictional struggles I seek to fill that void Drawing on two strands of social science research I argue that the executive branch has a strong incentive to use its constitutional authority over the enactment and enforcement of federal law to oppose jurisdictionstripping measures Notably this structural argument has considerable historical support The executive branch has repeatedly opposed jurisdictionstripping proposals in Congress That has been true even when the …

The Fractal Geometry Of Invention, Alan L. Durham
The Fractal Geometry Of Invention, Alan L. Durham
Articles
Fractals are geometric objects of inexhaustible detail. Fractal structures have been found in the contours of mountain ranges, the patterns of veins on a leaf, and the fluctuations of the Dow Jones Industrial Average. The endeavor of inventing new technologies, consisting of a hierarchical network of practical inquiries, exhibits fractal properties as well. Among these are multiplicity, latency, and self-similarity. Multiplicity means that a single inventive idea may lead to an immense and diverse array of technological artifacts. Latency means that the potential of an inventive idea to yield practical embodiments only reveals itself in time, and may never be …

When Federal And State Systems Converge: Foreign National Human Trafficking Victims Within Juvenile And Family Courts, Bridgette A. Carr
Articles
This article highlights the concerns facing foreign national children who are both victims of human trafficking and under the jurisdiction of juvenile and family courts. Human trafficking is modern day slavery in which individuals, including children, are compelled into service and exploited. Foreign national human trafficking victims in juvenile and family court systems must navigate both the state system and a complex federal immigration system. This article explains the federal benefits available to these children and identifies the best practice approaches for juvenile and family court systems to increase identification of and support for foreign national child trafficking victims.jfcj_1073
Discipline And Discharge Of Public-Sector Employees: An Empirical Study Of Arbitration Awards, Laura J. Cooper
Discipline And Discharge Of Public-Sector Employees: An Empirical Study Of Arbitration Awards, Laura J. Cooper
Articles
Commentators frequently assert that government employees enjoy a level of protection from discharge far greater than privatesector employees, and, indeed, that government employers are actually unable to fire public employees who perform poorly or engage in misconduct. For example, author Mortimer B. Zuckerman maintained in a 2010 U.S. News & World Report article that there were "two Americas" with a division that "affronts a sense of fairness" between the protections afforded public-sector workers and those available to workers in the private sector.1 He stated, "it is almost impossible to fire government workers except after a long process and only for …

Applying International Human Rights Standards To The Restraint And Seclusion Of Students With Disabilities, David Weissbrodt, Willy Madeira, Daniel Stewart, William Dikel

No federal law in the United States prohibits school administrators from physically restraining or secluding students. 1 State laws diverge widely. 2 Unlike in medical, psychiatric, and law enforcement settings, where strict national standards govern the use of physical restraint and seclusion, many schools may have no, or inconsistent, guidelines to follow in deciding when the use of force upon students is appropriate. 3 This lack of industry-approved protocol and standardized training of school personnel makes restraint and seclusion susceptible to misapplication and abuse. 4

Public-Sector Employment Under Siege, Stephen F. Befort
Public-Sector Employment Under Siege, Stephen F. Befort
Articles
This article was prepared for a symposium at Indiana University Maurer School of Law on Labor and Employment Law under the Obama Administration. The article analyzes the current spate of attacks on public employees with particular reference to three sub-topics: teacher tenure and evaluation “reform,” the periodic cycles of public sector fiscal crises, and the unilateral modification of public sector collective bargaining agreements. The article concludes with the assessment that cyclical attacks on public sector workers reflect a skewed viewpoint that public employees owe first-class obligations but possess only second-class rights.
Cercla, State Law, And Federalism In The 21st Century, Alexandra B. Klass
Cercla, State Law, And Federalism In The 21st Century, Alexandra B. Klass
Articles
This essay discusses the continuing role of state statutory and common law remedies for remediating contaminated property at a time where federal liability under the Comprehensive Response, Compensation, and Liability Act (“CERCLA”) has, after thirty years, become an established part of the legal and business landscape. In recent years, a growing number of courts have struggled with the extent to which CERCLA does or should preempt or displace state statutory or common law governing claims for recovering costs associated with contaminated property. This essay begins with the premise that the language of CERCLA as well as general principles of federalism …
Bankers Behaving Badly? The Limits Of Regulatory Reform, Claire Hill
Bankers Behaving Badly? The Limits Of Regulatory Reform, Claire Hill
Articles
We may finally be emerging from a "Great Recession." But the economy remains quite fragile. What bankers did was an important cause of the recession. They structured, sold and bought "toxic" securities, taking excessive risks with other people's money. Sometimes they did so recklessly, because they did not sufficiently understand the securities. Other times, they did understand the securities, and sold them to those who didn't, sometimes omitting much relevant information. Some evidence suggests that bankers knew the quality of mortgages being securitized was plummeting; indeed, given the dramatically increasing volume of mortgages being securitized, they had to at least …
Suburban Climate Change Efforts: Possibilities For Small And Nimble Cities Participating In State, Regional, National, And International Networks, Hari M. Osofsky
Suburban Climate Change Efforts: Possibilities For Small And Nimble Cities Participating In State, Regional, National, And International Networks, Hari M. Osofsky
Articles
This Article provides a novel analysis of the capacity of suburbs to play a constructive role in addressing climate change. Small suburban cities represent the majority of metropolitan populations and emissions; encouraging their mitigation efforts, in addition to those of large center cities, is critical. In contrast to the conventional critique of suburbs as an undifferentiated group of sprawling emitters, the Article analyzes pathways for different types of small, nimble, suburban governments to learn from other localities and find cost-effective approaches to reducing emissions. It intertwines scholarship on (1) cities, suburbs, and climate change, (2) the complex demography of suburbs, …
Theories Of Contract Law And Enforcing Promissory Morality: Comments On Charles Fried, Brian H. Bix
Theories Of Contract Law And Enforcing Promissory Morality: Comments On Charles Fried, Brian H. Bix
Articles
This article considers two important themes connected with Charles Fried’s great work, "Contract as Promise": first, the nature of the theoretical claims in that book; and second, the question of whether contract law, especially when this area is equated with the enforcement of promises, is in tension with John Stuart Mill’s “Harm Principle.” While in the end I do not think that Fried's book makes out its apparent ambition of a promissory theory of contract law (or of American contract law), this is largely because the book's claims, when more carefully scrutinized, were never that ambitious to begin with. What …
Psychological Evaluation Of Parenting Capacity In Child Welfare Proceedings, Katherine L. Rosenblum, Joshua B. Kay
Psychological Evaluation Of Parenting Capacity In Child Welfare Proceedings, Katherine L. Rosenblum, Joshua B. Kay
Articles
In the child welfare context, courts, attorneys, and child protection agencies often turn to psychologists to evaluate parenting capacity. As evaluators in child protection cases, psychologists may be asked to evaluate different parties for different purposes, acting as agents of the court, the child protection agency, or directly retained by the parents or the lawyer guardian ad litem. In this article we focus specifically on psychological evaluations addressing issues pertaining to parenting capacity (in contrast to, for example, assessments that focus solely on child psychological well-being or developmental status). These types of assessments may help to inform dispositional decisions, including …

Bacterial Host Interactions In Cystic Fibrosis, Máire Callaghan, Siobhan Mcclean
Bacterial Host Interactions In Cystic Fibrosis, Máire Callaghan, Siobhan Mcclean
Articles
Chronic infection is a hallmark of cystic fibrosis (CF) and the main contributor to morbidity. Microbial infection in CF is complex, due to the number of different species that colonise the CF lung. Their colonisation is facilitated by a host response that is impaired or compromised by highly viscous mucous, zones of hypoxia and the lack of the cystic fibrosis transmembrane regulator (CFTR). Successful dominant CF pathogens combine an effective arsenal to establish infection and counter-attack the host response, together with an ability to adapt readily to an unfavourable environment. Hypermutability is common among CF pathogens facilitating adaptation and as …

Identifying And Localizing Intracellular Nanoparticles Using Raman Spectroscopy, Jennifer Dorney, Franck Bonnier, Amaya Garcia, Alan Casey, Gordon Chambers, Hugh Byrne
Articles
Raman microscopy is employed to spectroscopically image biological cells previously exposed to fluorescently labelled polystyrene nanoparticles and, in combination with K-means clustering and Principal Component Analysis (PCA), is demonstrated to be capable of localising the nanoparticles and identifying the subcellular environment based on the molecular spectroscopic signatures. The neutral nanoparticles of 50 nm or 100 nm, as characterised by dynamic light scattering, are shown to be non-toxic to a human lung adenocarcinoma cell-line (A549), according to a range of cytotoxicity assays including Neutral Red, Alamar Blue, Coomassie Blue and (3-(4,5-Dimethylthiazol-2-yl)-2,5-diphenyltetrazolium bromide (MTT). Confocal fluorescence microscopy identifies intracellular fluorescence due to …
