Succession Planning: Trends Regarding The Perspectives Of Chief Executive Officers In United States Hospitals, Sandra Collins, Scott Collins, Richard C. Mckinnies 4537260, Eric P. Matthews

Articles

A study was conducted to revisit the perceptions of chief executive officers (CEOs) in United States (U.S.) hospitals regarding the origin of leadership and how they felt about internally developed successors versus externally recruited successors. Furthermore, the study sought to understand how this group of executives utilizes the succession planning process, what factors impact successor identification, what positions are applicable for succession planning activities, and who is ultimately held responsible for leadership continuity within the hospital industry. The results of this 2012 study were compared to a previous study conducted in 2007 to determine if the perceptions had changed over …

Examining User-Created Description In The Archival Profession, Matthew J. Gorzalski Jan 2013

Examining User-Created Description In The Archival Profession, Matthew J. Gorzalski

Articles

Interest in user created metadata has increased in recent years. In 2009-2010 the RLG Partner Social Metadata Working Group examined the social metadata practices of libraries, archives, and museums worldwide. They found that more than half of studied institutions improve metadata with user created description. This article presents the results of a survey conducted in January-February 2013 on the social metadata practices of North American archival and special collections repositories. To what extent are archives allowing users to provide descriptive metadata using Web 2.0 technologies? Is user generated content integrated into finding aids, catalog records, or other authoritative metadata record? …

The Fourth Amendment In The Information Age, Ricardo J. Bascuas Jan 2013

The Fourth Amendment In The Information Age, Ricardo J. Bascuas

Articles

In 2013, the Supreme Court tacitly conceded that the expectations-of-privacy test used since 1967 to assess claims of Fourth Amendment violations was inadequate. It asserted that the previous property-based test for Fourth Amendment violations had never despite widespread agreement to the contrary been overruled. The Court compounded its artfulness by applying a new, significantly weaker trespass test that, like the expectations-of-privacy test, enjoys no legal pedigree. This new trespass test, which is to be applied together with the expectations-of-privacy test, suffers from the same defect as the test it purportedly supplements. It does not require the government to respect private …

An Fda For Financial Innovation: Applying The Insurable Interest Doctrine To 21st Century Financial Markets, Eric A. Posner, E. Glen Weyl Jan 2013

An Fda For Financial Innovation: Applying The Insurable Interest Doctrine To 21st Century Financial Markets, Eric A. Posner, E. Glen Weyl

Articles

The financial crisis of 2008 was caused in part by speculative investment in complex derivatives. In enacting the Dodd-Frank Act, Congress sought to address the problem of speculative investment, but it merely transferred that authority to various agencies, which have not yet found a solution. We propose that when firms invent new financial products, they be forbidden to sell them until they receive approval from a government agency designed along the lines of the FDA, which screens pharmaceutical innovations. The agency would approve financial products if they satisfy a test for social utility that focuses on whether the product will …

International Paretianism: A Defense, David A. Weisbach, Eric A. Posner Jan 2013

International Paretianism: A Defense, David A. Weisbach, Eric A. Posner

Articles

A treaty satisfies what we call International Paretianism (P) if it advances the interests of all states that join it, so that no state is made worse off The principle might seem obvious, but it rules out nearly all the major proposals for a climate treaty, including proposals advanced by academics and by government officials. We defend IP, and for that reason urge commentators in the debate over climate justice to abandon efforts to right past wrongs, redistribute wealth, and achieve other abstract ideals through a climate treaty. Instead, the goal should be to develop a feasible treaty that states …

No Exit? Withdrawal Rights And The Law Of Corporate Reorganizations, Douglas G. Baird, Anthony Casey Jan 2013

No Exit? Withdrawal Rights And The Law Of Corporate Reorganizations, Douglas G. Baird, Anthony Casey

Articles

Bankruptcy scholarship is largely a debate about the comparative merits of a mandatory regime on one hand and bankruptcy by free design on the other. By the standard account, the current law of corporate reorganization is mandatory. Various rules that cannot be avoided ensure that investors’ actions are limited and they do not exercise their rights against specialized assets in a way that destroys the value of a business as a whole. These rules solve collective action problems and reduce the risk of bargaining failure. But there are costs to a mandatory regime. In particular, investors cannot design their rights …

The Impending Iprize Revolution In Intellectual Property Law, Saul Levmore Jan 2013

The Impending Iprize Revolution In Intellectual Property Law, Saul Levmore

Articles

How will intellectual property law change as the economy becomes dominated by services and ideas? This Essay explains why the interest groups and other forces that brought about an expansion of property rights over the last century or two are reconfigured in an economy dominated by ideas. This reconfiguration makes prizes - including grants, subsidies, and various contractual promises - more likely and more attractive than property rights as the means of encouraging innovation. The theory predicts an increase in the use of subsidies and other prizes, rather than patents. These prizes can be of the ex ante kind, offered …
