Street Diversion And Decarceration, Mary Fan
Street Diversion And Decarceration, Mary Fan
Articles
States seeking more cost-effective approaches than imprisoning drug offenders have explored innovations such as drug courts and deferred prosecution. These treatment-based programs generally involve giving diversion discretion to prosecutors and judges, actors further down the criminal processing chain than police. The important vantage of police at the gateway of entry into the criminal system has been underutilized. [para] The article explores developing the capacity of police to take a public health approach to drug offending by engaging in street diversion to treatment rather than criminal processing. This approach entails giving police therapeutic discretion—the power to sort who gets treatment rather …
Litigation Investment And Legal Ethics: What Are The Real Issues?, Anthony J. Sebok
Litigation Investment And Legal Ethics: What Are The Real Issues?, Anthony J. Sebok
Articles
One of the foundational principles of legal ethics is that the lawyer owes an obligation of undivided loyalty to the client, and no other interests or relationships can be permitted to interfere with the lawyer's exercise of independent professional judgment on behalf of the client. The strongest objections to litigation investment by third parties is that it may compromise a lawyer's independence. This article examines this objection in the context of a recent report from the Ethics Committee of the Commercial and Federal Litigation Section of the New York State Bar Association and argues that it misses the real legal …

Investigating Automatic Measurements Of Prosodic Accommodation And Its Dynamics In Social Interaction, Celine De Looze, Stefan Scherer, Brian Vaughan, Nick Campbell
Articles
Spoken dialogue systems are increasingly being used to facilitate and enhance human communication. While these interactive systems can process the linguistic aspects of human communication, they are not yet capable of processing the complex dynamics involved in social interaction, such as the adaptation on the part of interlocutors. Providing interactive systems with the capacity to process and exhibit this accommodation could however improve their efficiency and make machines more socially-competent interactants.
At present, no automatic system is available to process prosodic accommodation, nor do any clear measures exist that quantify its dynamic manifestation. While it can be observed to be …
In-Package Atmospheric Pressure Cold Plasma Treatment Of Strawberries, N. Misra, Paula Bourke, Patrick J. Cullen, Sonal Patil
In-Package Atmospheric Pressure Cold Plasma Treatment Of Strawberries, N. Misra, Paula Bourke, Patrick J. Cullen, Sonal Patil
Articles
The ability to generate low temperature plasma at atmospheric pressure offers new opportunities to decontaminate biological materials, including fresh foods. In this study, strawberries were treated with atmospheric cold plasma (ACP), generated with a 60 kV dielectric barrier discharge (DBD) pulsed at 50 Hz, across a 40 mm electrode gap, generated inside a sealed package containing ambient air (42% relative humidity). The current-voltage characteristics revealed that the plasma operated in the filamentary regime. The background microflora (aerobic mesophillic bacteria, yeast and mould) of strawberries treated for 5 min was reduced by 2 log 10 within 24 h of post-ACP treatment. …

Examining The Practice Of Developing Human Rights Indicators To Facilitate Accountability For The Human Right To Water And Sanitation, Benjamin Mason Meier, Jocelyn Getgen Kestenbaum, Georgia Lyn Kayser, Urooj Quezon Amjad, Jamie Bartram
Articles
Flowing from the evolution of international legal obligations for water and sanitation, human rights practice has shifted to address state accountability for a human right to water and sanitation through the development of human rights indicators. This policy note focuses on efforts to develop indicators for state reporting to human rights treaty bodies, with human rights norms framing national reports and treaty bodies employing indicators to monitor the progressive realization of the human right to water and sanitation. In supporting evidence-based treaty monitoring through the United Nations (UN), both the UN High Commissioner for Human Rights and the UN Special …

On October 30th, 1913, in the French village of Montauban-de- Bretagne, Joseph Lemarchand was born, the only child of a tenant-farming family that was ripped asunder by the death of his father in the Great War. A few decades later, as a writer-priest stationed in the Breton capital, Rennes, Lemarchand took the pseudonym Jean Sulivan, a name inspired by his fascination with the movie Sullivan’s Travels . When reading Pope Francis’ groundbreaking interview last August, I had the uncanny feeling that the new pontiff’s views strongly echo what Sulivan was writing in the 1960s and 1970s. A commitment to the …

Using Acrylamide Based Photopolymers For Fabrication Of Holographic Optical Elements In Solar Energy Applications, Hoda Akbari, Izabela Naydenova, Suzanne Martin
Articles
A holographic device is under development that aims to improve light collection in solar cells. The aim is to explore the potential of using photopolymer Holographic Optical Elements (HOE) to collect light from a moving source, such as the sun, and re-direct it for concentration by a holographic lens.. A working range of 45 degrees is targeted for such a device to be useful in solar applications without tracking. A photopolymer HOE is capable of efficiently re-directing light, but the angular selectivity of a single grating is usually of the order of one degree at the thicknesses required for high …

The 1 Percent Solution: Corporate Tax Returns Should Be Public (And How To Get There), Reuven S. Avi-Yonah, Ariel Siman
Articles
The justification for publishing corporate tax returns is that corporations are given immense benefits by the state that bestows upon them unlimited life and limited liability, and therefore they owe the public the information of how they treat the state that created them. Tax returns, like the financial disclosures that publicly traded corporations must file with the SEC, also provide useful information to shareholders, creditors, and the investing public.

In-package nonthermal plasma (NTP) technology is a novel technology for the decontamination of foods and biological materials. This study presents the first report on the potential of the technology for the degradation of pesticide residues. A cocktail of pesticides, namely Azoxystrobin, Cyprodinil, Fludioxonil and Pyriproxyfen was tested on strawberries. The concentrations of these pesticides were monitored in priori and post- plasma treatment using GC-MS/MS. An applied voltage and time dependent degradation of the pesticides was observed for treatment voltages of 60, 70 and 80 kV and treatment durations ranging from 1 to 5 min, followed by 24 h in-pack storage. …

Hydrologic And Erosion Responses To Wildfire Along The Rangeland-Xeric Forest Continuum In The Western Us: A Review And Model Of Hydrologic Vulnerability, Christopher Jason Williams, Frederick B. Pierson, Peter R. Robichaud, Jan Boll
Articles
The recent increase in wildfire activity across the rangeland–xeric forest continuum in the western United States has landscape-scale consequences in terms of runoff and erosion. Concomitant cheatgrass (Bromus tectorum L.) invasions, plant community transitions and a warming climate in recent decades along grassland–shrubland–woodland–xeric forest transitions have promoted frequent and large wildfires, and continuance of the trend appears likely if warming climate conditions prevail. These changes potentially increase overall hydrologic vulnerability by spatially and temporally increasing soil exposure to runoff and erosion processes. Plot and hillslope-scale studies demonstrate burning may increase event runoff or erosion by factors of 2–40 over …

The characteristics of cadmium sulphide (CdS) and lead sulphide (PbS) nanoparticles, grown inside Langmuir-Blodgett (LB) multilayer films of 5,11,17,23-tetra-tert-butyl-25,27-dicarboxymethoxy-26,28-dihydroxycalix [arene (I), have been studied using ellipsometry, UV-visible spectroscopy, and transmission electron microscopy (TEM). Multilayer films were formed by transferring a floating Langmuir monolayer of I onto substrates using LB deposition and water subphase containing Pb2+ or Cd2+ ions. The nanoparticles were fabricated by exposing cadmium-or lead-containing multilayer films of I (20-80 monolayers thick) to hydrogen sulphide (H2S) gas for 12 hours. By Gaussian fitting of the absorbance - energy spectra, the size of the clusters and their dispersion were found …

The Governance Of Visibility: Bodies, Information, And The Politics Of Anonymity Across The Us-Mexico Borderlands, Robert Latham
Articles
This article explores the relationship between information and mobility as it is manifest at the Mexico-US border and understands that border to be one, although very important, site of information processing and production. Within the electronic as well as the physical spaces of the Mexico-US borderlands, it is argued that practices of evasion and exposure produce specific forms of politics. These forms bear on the militarization of the border, particular bourgeois anxieties, various instances of violence, the pursuit of survival strategies and recognition, and the emergence of resistance and countertactics. Also considered are possibilities for alternatives to the ways mobility …

Abstract
Introduction
Accurate corneal measurements are crucial in corneal refractive surgery (CRS) to ensure successful outcomes. Soft contact lens (SCL) wear may result in changes to corneal curvature and structure. United States Food and Drug Administration (FDA) pre-operative guidelines recommend that prior to CRS, SCL wearers cease SCL wear for “at least two weeks before examination and treatment”[1]. Corneal curvature changes induced by SCL wear may take longer than two weeks to resolve.
Purpose
To examine the effect of SCL wear on corneal curvature before and following two weeks SCL wear cessation. To explore the possible impact of different SCL …
Taking Stock: Insider And Outsider Trading By Congress, Jeanne L. Schroeder
Taking Stock: Insider And Outsider Trading By Congress, Jeanne L. Schroeder
Articles
Spring 2012 saw the enactment of the "Stop Trading on Congressional Knowledge Act of 2012" or "STOCK Act." It supposedly repealed an exemption from the federal securities laws that made insider trading by members of Congress "totally legal." As every securities lawyer knows, however, there never was such an exemption. Representatives and Senators have always been subject to the same rules as the rest of us. It is just that insider-trading law is so incoherent that legal scholars sharply disagreed as to when, or even if trading by government officials on the basis of material nonpublic information gleaned from their …

RNAi is widely appreciated as a powerful regulator of mRNA translation in the cytoplasm of mammalian cells. However, the presence and activity of RNAi factors in the mammalian nucleus has been the subject of considerable debate. Here, we show that Argonaute-2 (Ago2) and RNAi factors Dicer, TRBP, and TRNC6A/GW182 are in the human nucleus and associate together in multiprotein complexes. Small RNAs can silence nuclear RNA and guide sitespecific cleavage of the targeted RNA, demonstrating that RNAi can function in the human nucleus. Nuclear Dicer is active and miRNAs are bound to nuclear Ago2, consistent with the existence of nuclear …

The OECD has recently come to recognize that the transfer pricing system does not work as intended. In its report on base erosion and profit shifting 2013 WTD 140-17: Other Administrative Documents, the OECD recognizes that BEPS results in revenue losses that affect all states, especially poorer ones; that systematic tax avoidance by the richest and most powerful companies in the world undermines the general legitimacy of taxation; that it gives MNEs significant competitive advantages over purely domestic firms, resulting in inefficient allocations of investment and major distortions to economic activity; and that it skews the decisions of the MNEs …

Equitable Shortest Job First: A Preemptive Scheduling Algorithm For Soft Real-Time Systems, Mario Jean Rene, Dimitri Kagaris
Articles
The Shortest Job First (SJF) algorithm gives the optimal average turnaround time for a set of processes, but it suffers from starvation for long processes. In this study, the authors developed an algorithm, referred to as Equitable SJF (EQSJF), to reduce the average turnaround time of the long processes without notably affecting the turnaround time of the short processes. Two parameters, the percentage of a process’s burst time to completion and the time spent by a process in the waiting queue, were used to provide the designer with more tradeoff alternatives in keeping the turnaround time of the long processes …

A buffer stripped high birefringent photonic crystal fibre based polarimetric sensor is developed for monitoring the curing process of magnetorheological elastomer (MRE) smart composite material. Using the developed sensor, different phases of the MRE curing process are clearly visible from the phase shift variation of the embedded polarisation maintaining photonic crystal fibre (PM-PCF) sensor. During the curing process, the buffer stripped PM-PCF exhibits a stress/strain induced phase shift variation from 0 to 1.98 rad. This is a significantly large phase change, which can be used to very clearly identify the different stages in the curing process. For comparison, a fibre …
