Restructuring Rebuttal Of The Marital Presumption For The Modern Era, Jessica Feinberg
Restructuring Rebuttal Of The Marital Presumption For The Modern Era, Jessica Feinberg
Articles
The marital presumption of paternity, which arose from English common law, has served as a core component of the law governing parentage in the United States since the nation’s inception. Pursuant to the marital presumption, a husband is presumed to be the legal father of any child born to or conceived by his wife during the marriage. Historically, the marital presumption was extremely difficult to rebut, generally requiring proof of the husband’s non-access to his wife during the time of conception, the husband’s sterility or impotence, or adultery on the part of the wife. As these early grounds for rebuttal …

“You Can't Afford To Flinch In The Face Of Duty”: Judge William Augustus Bootle And The Desegregation Of The University Of Georgia, Patrick Emery Longan
Articles
On January 6, 1961, United States District Judge William Augustus Bootle granted a permanent injunction that required the University of Georgia to admit its first two black students, Hamilton E. Holmes and Charlayne A. Hunter. The backlash began immediately. Newspaper editorials condemned the decision. The Governor of Georgia threatened to close the University. Students rioted. A man escaped from an insane asylum, armed himself and went looking for Charlayne Hunter at her dormitory. Judge Bootle received numerous critical letters, including some that were threatening. Yet Judge Bootle’s attitude was that he did no more than what his position as a …

The will is a unilateral written disposition of probate property to be effective upon the will-maker's death. To have any legal effect, however, the will-maker's family, beneficiaries, and personal representatives, along with the probate court, need to implement the will provisions. To buttress the strength of the will, the language of the will is definitive, certain, and strong. But when the will relies upon standardized language, the voice of the will-maker is flattened or even non-existent. The absence of the willmaker's voice may jeopardize the legal effect of the will.
This Article argues that the over-reliance on "time-tested" formulaic language …

Improving Extraction Processes Of Crustacean Chitin Using Solid State Analytical Techniques, Fionn O'Fearghail, Michelle Giltrap, Christine O'Connor, Patrice Behan
Articles
Solid state analytical techniques are becoming more widely used for the analysis of a range of organic products which demonstrate very poor solubility in both common organic and polar solvents and as such cannot be accurately characterised using solution based techniques. Primarily used as a secondary technique for qualitative analysis of insoluble intermediates and products in organic synthesis, 13C CP-MAS NMR can be utilised in tandem with a targeted extraction and clean up procedure for accurate quantitative analysis of insoluble bio-molecules of interest. Here solid state 13C CP-MAS NMR is utilised as the primary analytical technique in the characterisation of …

Recent Advances In The Vibrational Spectroscopic Diagnosis Of Non-Small Cell Lung Cancer, Declan O'Dea, Fiona Lyng, Siobhan Nicholson, Finbar O'Connell, Aoife Maguire, Alison Malkin
Articles
Lung cancer is the leading cause of cancer deaths worldwide accounting for 1.69 million deaths in 2015. Studies have indicated a 5 year survival rate of 8%–15% in western countries, although a survival rate as low as 1% has been demonstrated for late stage diagnosis. With the advent of targeted therapies, it is imperative to accurately differentiate non-small cell lung cancer (NSCLC) subtypes in order to ensure efficacy of treatment for patients. Immunohistochemistry and molecular techniques for the diagnosis of NSCLC are increasingly part of the diagnostic algorithm and clinical work-up of lung cancer patients, however due to the limitation …
John Mcgahern, The Conscience Of Ireland, Eamon Maher
John Mcgahern, The Conscience Of Ireland, Eamon Maher
Articles
John McGahern has been referred to variously as the chronicler of a disappearing traditional rural Ireland, as a critic of narrow, repressive thinking, particularly in the religious and social spheres, as a writer with a keen appreciation of the landscape, customs and practices of his native Leitrim/Roscommon. Undoubtedly, he was all these things, but he was above all else an artist who saw his role as simply to 'get his words right.' In an interview I conducted with rhe author in 2000, he made the following observation: 'I think that ifyou actually set out to give a picture of Ireland …

Design And Development Of Artificial Spinal Ligaments For Paediatric Synthetic Spine, Nor Amalina Muhayudin, Khairul Salleh Basaruddin, Fiona Mcevoy, Anthony Tansey
Articles
A synthetic spine is a model fabricated from artificial materials consisting of the vertebrae, intervertebral discs and ligaments for spinal testing. The synthetic spine overcomes many difficulties associated with biological specimens such as handling, biohazard concerns, high costs, and limited availability of specimens, quality and large inter-specimen variability. This paper presents the design and development of spinal ligaments to mimic the stiffness of the paediatric ligaments for use in the synthetic spine. Spinal ligaments are uniaxial structures in the spine that carry tensile loads along the direction of the fibres. Early in the research, silicone materials were used to cover …

Calculating Restaurant Failure Rates Using Longitudinal Census Data, J. J. Healy, Máirtín Mac Con Iomaire
Articles
Failure rates in the restaurant industry are popularly perceived to be far higher than they actually are. This paper calculates failure rates in the Irish Food and Drinks Sector (IFDS), for the first time, using longitudinal census data from the Central Statistics Office (CSO) in Ireland, which follows the European statistical classification of economic activity (NACE). The results are compared with previously published literature on restaurant failure rates in the United States of America. This study also compares IFDS failure rates with other industry sectors in Ireland (construction, manufacturing). Drawing on Stinchcombe’s ’liability of newness’ theory, the informal fallacies theory …

Nitrogen-Vacancy Centers In Diamond For Nanoscale Magnetic Resonance Imaging Applications, Alberto Boretti, Lorenzo Rosa, Jonathan Blackledge, Stefania Castelletto
Articles
The nitrogen-vacancy (NV) center is a point defect in diamond with unique properties for use in ultra-sensitive, high-resolution magnetometry. One of the most interesting and challenging applications is nanoscale magnetic resonance imaging (nano-MRI). While many review papers have covered other NV centers in diamond applications, there is no survey targeting the specific development of nano-MRI devices based on NV centers in diamond. Several different nano-MRI methods based on NV centers have been proposed with the goal of improving the spatial and temporal resolution, but without any coordinated effort. After summarizing the main NV magnetic imaging methods, this review presents a …

Unregulated, privately owned water supplies, including groundwater wells, are relied upon extensively, particularly in rural and remote regions. While adequate stewardship behaviors (water testing, treatment, and maintenance) have been shown to decrease the incidence and frequency of faecal indicator organism (FIO) presence and, by extension, the risk of pathogenic ingress, contaminated private water supplies continue to constitute a significant public health risk. Recognizing that innovative approaches are needed to bolster well stewardship, this paper identifies and assesses 35 tools (smartphone and web-based applications) to better understand components, functionality, strengths, and weaknesses. Applications for both data collection and risk communication were …

Predicting Quality Attributes Of Strawberry Packed Under Modified Atmosphere Throughout The Cold Chain, Kompal Joshi, Brijesh Tiwari, P. J. Cullen, Jesus Maria Frias
Articles
Modified Atmosphere Packaging (MAP) is used commercially to extend the shelf life of strawberries. The attainment of desired gas (O2, CO2) concentrations inside MAP relies on the product respiration and the mass transfer through packaging and will affect the quality. The objective of this work is to build a mathematical model for strawberries to assess the effect of the uncertainties on headspace gas concentration and quality: 1) cold chain related temperature and relative humidity variations and 2) variability associated to product respiration and quality based on literature. Weight loss was more influenced by the cold chain storage conditions (temperature and …

Extreme weather events (EWEs) are increasing in frequency, posing a greater risk of adverse human health effects. As such, developing sociological and psychological based interventions is paramount to empowering individuals and communities to actively protect their own health. Accordingly, this study compared the efficacy of two established social-cognitive models, namely the Health Beliefs Model (HBM) and Risks-Attitudes-Norms-Abilities-Self-regulation (RANAS) framework, in predicting health behaviours following EWEs. Surface water flooding was used as the exemplar EWE in the current study, due to the increasing incidence of these events in the Republic of Ireland over the past decade. Levels of prior experience with …

A Twelve-Wavelength Thulium-Doped Fibre Laser Based On A Microfibre Coil Resonator Incorporating Black Phosphorus, Shi Li, Yu Yin, Elfed Lewis, Gerald Farrell, Pengfei Wang
Articles
A novel multi-wavelength continuous Thulium-doped fibre laser incorporating a microfibre coil resonator based on black phosphorus (MCR-BP) material has been successfully fabricated and demonstrated. A twelve-wavelength spectrum with 0.54 nm channel spacing has been achieved by simply adjusting the pump source power. A single peak extinction ratio of more than 40 dB was observed. The superior performance of the MCR-BP described in this article compared to conventional MCR based fibre lasers can be attributed the inclusion of the Black Phosphorous Material. The enhanced lasing is primarily due to the twin properties of the MCR-BP device combining a comb-like filter effect …

Confocal near-infrared Raman spectroscopy has been shown to have applications in the area of clinical biology. A source wavelength in the near infrared is preferred over visible wavelengths for inspecting biological samples due to superior wavenumber resolution and reduced photodamage. However, these excitation sources have a number of drawbacks when compared to lasers in the visible wavelength region, including the requirement to use expensive highly pure crystal substrates such as Raman grade calcium fluoride as well as long acquisition times due to the lower Raman scattering efficiency. This paper investigates the use of a reflective substrate comprising a low cost …

A Deep Recurrent Q Network Towards Self-Adapting Distributed Microservice Architecture, Basel Magableh, Muder Almiani
Articles
One desired aspect of microservice architecture is the ability to self-adapt its own architecture and behavior in response to changes in the operational environment. To achieve the desired high levels of self-adaptability, this research implements distributed microservice architecture model running a swarm cluster, as informed by the Monitor, Analyze, Plan, and Execute over a shared Knowledge (MAPE-K) model. The proposed architecture employs multiadaptation agents supported by a centralized controller, which can observe the environment and execute a suitable adaptation action. The adaptation planning is managed by a deep recurrent Q-learning network (DRQN). It is argued that such integration between DRQN …

A novel method with two variations is proposed with which the number of positive and negative zeros of a polynomial with real co-efficients and degree $n$ can be restricted with significantly better determinacy than that provided by the Descartes' rule of signs and also isolate quite successfully the zeros of the polynomial. The method relies on solving equations of degree smaller than that of the given polynomial. One can determine analytically the exact number of positive and negative zeros of a polynomial of degree up to and including five and also fully isolate the zeros of the polynomial analytically and …

Some Transitivity-Like Concepts In Abelian Groups, Gabor Braun, Brendan Goldsmith, Ketao Gong, Lutz Strungmann
Articles
The classical notions of transitivity and full transitivity in Abelian p-groups have natural extensions to concepts called Krylov and weak transitivity. The interconnections between these four types of transitivity are determined for Abelian p-groups; there is a marked difference in the relationships when the prime p is equal to 2. In the final section the relationship between full and Krylov transitivity is examined in the case of mixed Abelian groups which are p-local in the sense that multiplication by an integer relatively prime to p is an automorphism.
