Competition Among Municipalities As A Constraint On Land Use Exactions, Stewart E. Sterk

The article examines the limitations of competition among municipalities in constraining the abuse of land use exactions and impact fees, arguing that while competition provides some checks, it is insufficient to prevent distortions in land markets. It critiques the Tiebout hypothesis, which assumes that intermunicipal competition leads to efficient allocation of public goods, and highlights how monopoly power in certain land uses undermines this theory. The analysis emphasizes the need for legal constraints to address the exploitation of landowners and ensure exactions align with the external costs of development.

We apply a selection and estimation procedure for the detection of multiple targets in clutter. The selection and estimation (SE) test perfoms better than a fixed order statistic (OS) detector. The SE test has some similarity to a variable trimmed mean (VTM) test and has a slight performance advantage. Unlike the VTM, whose performance is evaluated only by simulation studies, the performance of the SE test, for Rayleigh fluctuating target model, can be evaluated analytically. Further improvement in the performance is possible if a better selection procedure can be found.

The bold and precedent-setting case of Martin v. Camp endowed the attorney-client relationship with the legacy of the "client discharge rule"; it provides that a client can discharge his attorney at any time without cause and without penalty. The predicate of the rule is that trust and confidence are essential features of the attorney-client relationship. If that trust and confidence dissipate, the client should not be forced to continue to confide in and rely upon that attorney. On an occasion such as this, we are called to step back from our daily work to seek what Justice Holmes called a "liberal view" of our subject. Today, I propose to do so by exploring a function of family law that I believe is basic, that underlies much of family law, that resonates with the deepest purposes of culture but that is rarely addressed expressly-namely, what I call the "channelling function." In November 1990, Congress passed the Native American Graves Protection and Repatriation Act ("NAGPRA"). NAGPRA provides for the protection and disposition of Native American cultural items discovered on federal or tribal lands after NAGPRA's effective date. NAGPRA also addresses disposition of those objects currently held or controlled by federal agencies and museums. NAGPRA represents Congress' attempt to resolve years of debate between tribes, archaeologists, and museums. Like any legislative pronouncement, however, Congress left key issues to agencies and courts to resolve. This article may be accessed from the publisher's website (additional fees may apply) at: http://www.aslo.org/lo/toc/vol_37/issue_8/1808.pdf The variation of freshwater chromophoric (or colored) dissolved organic matter (CDOM) fluorescence with respect to sample pH was examined. Trends from previous studies are supported by results obtained from fluorescence spectra collected during sample titration. The evidence suggests spectral variation of CDOM fluorescence can arise from pH-dependent photo-oxidation of a portion of the catechol component of CDOM to coumarin structures. A hypothesis is drawn that the observed shorter wavelength fluorescence exhibited by acid lake samples relative to the spectra of more neutral lake samples is, …

One slave laser divides the optical modulation frequency by 2, the other slave laser multiplies the frequency by 2. We report all-optical synchronized multiplication by rational fractions of the modulation frequency of optical signals in self-pulsing two-section semiconductor laser diodes. The effect is based on the overlap of harmonics of the input signal with harmonics of the self-pulsation. We illustrate this new generic function with modelocked inputs rich in harmonics were fractions of 1,2, and 3 / 2 are generated, and we identify a number of applications for this effect.

Section 301 of the Trade Act of 1974 allows the United States to threaten, and if necessary to impose, trade sanctions against countries that engage in certain "unfair" international trade practices. This Article defends the use of Section 301 to induce other nations to fulfill their legal obligations to the United States under international trade agreements that lack effective third-party dispute resolution. It also develops a limited argument for the use of Section 301 against practices that do not violate any international agreement, principally when a foreign country increases its level of protection, when it takes inappropriate advantage of loopholes …
