Using intellectual property assets as the proxy for innovation measures, this paper provides a comprehensive analysis of the legal and policy strategies that form the foundation for China's new role as the global manufacturer of innovation. Manufacturing innovation is evident through China's multi-prong approach regarding intellectual property production and maximization. Significantly, among many other policies that target innovation, China encourages the production of innovation by accepting patents and trademarks as collateral assets for financing. Entrepreneurs can quickly obtain loans against their portfolios of patents and trademarks. China also requires enterprises seeking to undergo an initial public offering (IPO) on the …

Conditions Of Participation: Incorporating The History Of Hospital Desegregation, Sallie Sanford Jan 2023

Conditions Of Participation: Incorporating The History Of Hospital Desegregation, Sallie Sanford

Articles

Our students ought to know about the history of formal hospital segregation and desegregation. To that end, this article urges those who teach foundational health law and policy courses to do three things. First, to teach the Simkins case. Second, to swap out the usual Medicare signing ceremony picture for one that includes W. Montague Cobb, M.D., Ph.D. Third, to highlight how the implementation of that program for the elderly led, in a matter of months, to the desegregation of hospitals throughout the country.

Contingency Fee Conflicts: Attorneys Push For Quick-Kill Settlements When Their Clients Would Be Better Off Going To Trial, Steve Calandrillo, Chryssa V. Deliganis, Neela Brocato Jan 2023

Contingency Fee Conflicts: Attorneys Push For Quick-Kill Settlements When Their Clients Would Be Better Off Going To Trial, Steve Calandrillo, Chryssa V. Deliganis, Neela Brocato

Articles

Despite the checkered history of contingency fees in the practice of law, attorneys often claim that such fee arrangements perfectly align the interests of lawyer and client. After all, contingency fee lawyers proclaim in TV ad after TV ad, "we don’t get paid unless you win." That superficial logic does not withstand economic scrutiny. Utilizing a behavioral economics lens, this Article demonstrates that contingency fee arrangements give attorneys excessive incentives to settle cases that their clients would be better off taking all the way through trial. In addition to highlighting this undertheorized problem in law, we offer normative recommendations to …

The phrase critical legal research was first coined in 2015, and it describes the application …

Honest Belief And Proof Of Unlawful Motive, Eric Schnapper Jan 2023

Honest Belief And Proof Of Unlawful Motive, Eric Schnapper

Articles

A large number of federal statutes impose liability on a defendant if it acted with a forbidden motivation. Intent is also central to the meaning of a number of constitutional provisions, including many applications of the First Amendment and the Equal Protection Clause. The large volume of litigation under these provisions does not turn on doctrinal differences about the meaning of intent or purpose, but on disputes about the types of evidence that are and are not sufficient to establish the existence of the forbidden purpose. Those standards, as a practical matter, determine the efficacy of the prohibition at issue …

Digital technology is now pervasive, however, not all groups have uniformly benefitted from technological changes and some groups have been left behind or digitally excluded. Comprehensive data from the 2017 Current Population Survey shows that older people and persons with disabilities still lag behind in computer and internet access. Furthermore unique ethical, privacy and safety implications exist for the use of technology for older persons and people with disabilities and careful reflection is required to incorporate these aspects, which are not always part of a traditional software lifecycle. In this paper we present the Inclusion4EU project that aims to co-design …

Articles

Platinum nanoparticles (PtNPs) have been investigated for their antioxidant abilities in a range of biological and other applications. The ability to reduce off-target cold atmospheric plasma (CAP) cytotoxicity would be useful in Plasma Medicine; however, little has been published to date about the ability of PtNPs to reduce or inhibit the effects of CAP. Here we investigate whether PtNPs can protect against CAP-induced cytotoxicity in cancerous and non-cancerous cell lines. PtNPs were shown to dramatically reduce intracellular reactive species (RONS) production in U-251 MG cells. However, RONS generation was unaffected by PtNPs in medium without cells. PtNPs protect …

Articles

Peatlands play a critical role in the global carbon cycle, storing large amounts of carbon because of a net imbalance between primary production and the microbial decomposition of the organic matter. Nevertheless, peatlands have historically been drained for energy sources (e.g. peat briquettes), forestry, or agriculture - practices that could affect the quality of the soil organic matter (SOM) composition, hydrophobicity and humification index. This study compared the effect of land use change on the quality and composition of peatland organic material in Co-Offaly, Ireland. Specifically, drained and grazing peat (grassland), drained and forest plantation peat (forest plantation), drained and …

Cfd Simulation Of Anaerobic Granular Sludge Reactors: A Review, Camila D' Bastiani, David Kennedy, Anthony Reynolds

Articles

Anaerobic digestion processes can generate renewable energy in the form of biogas while treating organic wastewater. The generation of biogas within anaerobic digestion systems is directly linked to the mixing conditions inside the reactors. In high-rate reactors such as the up-flow anaerobic sludge blanket (UASB) reactor, the expanded granular sludge bed (EGSB) reactor and the internal circulation (IC) reactor, the hydrodynamic behaviour will depend on the interactions between the wastewater, the biogas, and the biomass granules. Over the past few years, various researchers have used computational fluid dynamics (CFD) to study the hydrodynamic behaviour in these types of reactors. This …

Spontaneous Mirror Symmetry Breaking And Chiral Segregation In The Achiral Ferronematic Compound Dio, Neelam Yadav, Yuri Panarin, Wanhe Jiang, Georg H. Mehl, Jagdish K. Vij

Articles

An achiral compound, DIO, known to exhibit three nematic phases namely N, NX and NF, is studied by polarizing microscopy and electro-optics for different surface conditions in confinement. The high temperature N phase assigned initially as a conventional nematic phase, shows two additional unusual features: the optical activity and the linear electro-optic response related to the polar nature of this phase. An appearance of chiral domains is explained by the spontaneous symmetry breaking arising from the saddle-splay elasticity and followed by the formation of helical domains of the opposite chirality. This is the first example of helical segregation observed in …

Design Of Event-Triggered Asynchronous H∞ Filter For Switched Systems Using The Sampled-Data Approach, Sheraz Shafique, Ghulam Mustafa, Nouman Ashraf, Owais Khan

Articles

The design of networked switched systems with event-based communication is attractive due to its potential to save bandwidth and energy. However, ensuring the stability and performance of networked systems with event-triggered communication and asynchronous switching is challenging due to their time-varying nature. This paper presents a novel sampled-data approach to design event-triggered asynchronous H∞ filters for networked switched systems. Unlike most existing event-based filtering results, which either design the event-triggering scheme only or co-design the event-triggering condition and the filter, we consider that the event-triggering policy is predefined and synthesize the filter. We model the estimation error system as an …

A Molecular Dynamics Study Of Water Confined In Between Two Graphene Sheets Under Compression, Ming-Lang Tseng, Ayomide Adesiyan, Abdelaziz Gassoumi, Nima E. Gorji

Articles

Several studies have demonstrated interest in creating surfaces with improved water interaction and adaptive properties because the behavior of water confined at the nanoscale plays a significant role in the synthesis of materials for technological applications. Remarkably, confinement at the nanoscale significantly modifies the characteristics of water. We determine the phase diagram of water contained by graphene stack sheets in slab form, at T=300 K, and for a constant pressure using molecular dynamics simulations. We discover that, as shown in the simulation, water can exist in both the liquid and vapor phases depending on the confining geometry and compressibility ratio. …

Distributed Intermittent Fault Diagnosis In Wireless Sensor Network Using Likelihood Ratio Test, Bhabani Sankar Gouda, Meenakshi Panda, Trilochan Panigrahi, Sudhakar Das, Bhargav Appasani, Omprakash Acharya, Hossam Zawbaa, Salah Kamel

Articles

In current days, sensor nodes are deployed in hostile environments for various military and commercial applications. Sensor nodes are becoming faulty and having adverse effects in the network if they are not diagnosed and inform the fault status to other nodes. Fault diagnosis is difficult when the nodes behave faulty some times and provide good data at other times. The intermittent disturbances may be random or kind of spikes either in regular or irregular intervals. In literature, the fault diagnosis algorithms are based on statistical methods using repeated testing or machine learning. To avoid more complex and time consuming repeated …
