In Defense Of The 'Old' Public Health: The Legal Framework For The Regulation Of Public Health, Richard A. Epstein

The traditional forms of public health law were directed largely toward communicable diseases and other externalities, such as pollution, with negative health impacts. The more modern view treats any health issue as one of public health so long as it affects large numbers of individuals, and this definition includes such matters as obesity and diabetes. This paper examines the historical and constitutional evolution of the public health principle as it moved from the narrower to the broader conception. It then argues that the narrower principle better defines the appropriate scope of coercive government intervention than the broader definition, which could …

Frequent compliance with the adjudicative decisions of international institutions, such as the International Court of Justice (ICJ), is puzzling because these institutions do not have the power domestic courts possess to impose sanctions. This Article uses game theory to explain the power of international adjudication via a set of expressive theories, showing how law can be effective without sanctions. When two parties disagree about conventions that arise in recurrent situations involving coordination, such as a convention of deferring to territorial claims of first possessors, the pronouncements of third-party legal decision makers-adjudicators--can influence their behavior in two ways. We argue that firms undertake to reduce employee savings in order to avoid final period problems that occur when employees accumulate enough wealth to retire and leave the industry. Normally, reputation constrains employee behavior, since an employee who "cheats" at one firm will then find herself unable to get a job at another However, employees who have saved such that they no longer care about continued employment will act opportunistically in the final periods of employment, which can destroy much or all of the surplus otherwise created by the employment relationship. The reference to foreign court judgments by the US Supreme Courts - particularly in cases involving the US Constitution - has sparked controversy. This controversy flared in Lawrence v. Texas, where Justice Scalia criticized Justice Kennedy for reference to judgments by the European Court of Human Rights in Justice Kennedy's majority opinion striking down the Texas sodomy statute. This article examines the issue from a different perspective: references to 'foreign' court judgments (including US Supreme Court opinions) by the Supreme Court of Ireland. Objective. Most research on child abuse in Tanzania and Kenya is unpublished in the international literature. The purpose of this paper is to examine the various commentaries and reports extant, towards an overview of the nature and frequency of child sexual abuse in Tanzania and Kenya. Methods. Contacts were made with academics, government departments, NGOs and UN agencies. This was followed by a field trip in the summer of 2001 where all available reports were examined and a wide range of interviews conducted. Results. This report describes a process of pigment selection for reconstructing the Gamblin Conservation Colors and various artist pigments dispersed in linseed oil. Single constant Kubelka–Munk (K-M) turbid media theory and a non-negative least square (NNLS) optimization technique were employed in this experiment. Eleven pigments were selected as representative of the 30-pigments Gamblin Conservation Colors. The main goal of pharmaceutical companies is to create and deliver medicines designed to extend or enhance life. However—also being in the business of business—pharmaceutical companies need to grow their bottom lines by investing in business value drivers. This article shows sustainability performance as one of those drivers by demonstrating that: 1) the concept of integrated sustainability is generally understood; and 2) pharmaceutical companies taking action to integrate sustainability are reaping significant business value added. A simulation programme based on the nucleation-and-growth model of latent-image formation was used to study how trap depth and trap density at various tabular grain thicknesses affected quantum sensitivity and reciprocity failure. Using a 1.2x0.2 µm model ‘grain’, the unsensitized case was simulated with 0.05 eV traps located on both the face and the core of the grain, the latter to simulate the effect of twin planes on latent-image location. This study tested for sensitivity to circumplex structure in six existing and four new psychometric criteria that assess the circumplex properties of interstitiality, equal spacing, constant radius, and no preferred rotation. Simulations showed one criterion to be sensitive to equal versus unequal axes(Fisher Test) and four to be sensitive to interstitiality versus simple structure (Gap Test, Variance Test 2, Rotation Test, and Minkowski Test). Five criteria were ineffective (Squared Loadings Index, Gap* Test, Gap Difference Test, Cosine Difference Test, and Variance Test 1). The Gravitational Instability Of The Vacuum: Insight Into The Cosmological Constant Problem, Stephon Alexander, Manasse Mbonye, John Moffat

A mechanism for suppressing the cosmological constant is developed, based on an analogy with a superconducting phaseshift in which free fermions coupled perturbatively to a weak gravitational field are in an unstable false vacuum state. The coupling of the fermions to the gravitational field generates fermion condensates with zero momentum and a phase transition induces a nonperturbative transition to a true vacuum state by producing a positive energy gap $\Delta$ in the vacuum energy, identified with $\sqrt{\Lambda}$, where $\Lambda$ is the cosmological constant. The number of times a crop can be harvested on a cleared parcel of forest land (CPFL) before this land must be fallowed is dependent on the decision to use or not to use fertilizers to enhance soil fertility. As such, we first construct a theoretical model of fertilizer use by a swidden cultivator when this cultivator can choose whether or not to enhance soil fertility by using fertilizers. Small farmers in many tropical developing countries practice swidden agriculture. A key aspect of swidden agriculture is the time period during which the land is left fallow. This paper uses a new ecological-economic approach to study the fallow period and to determine the optimal length of this period in swidden agriculture. We first construct a theoretical model of a parcel of forest land that has been cleared for swidden agriculture. We then show how the dynamic and the stochastic properties of this cleared land can be used to derive two objective functions for a small farmer that are ecologically meaningful. …
