Due process protections and other constitutional restrictions normally ensure that citizens cannot be tried and punished for political dissent, but these same restrictions interfere with criminal convictions of terrorists and others who pose a nonimmediate but real threat to public safety. To counter these threats, governments may use various subterfuges to avoid constitutional protections-often with the complicity of judges-but when they do so, they risk losing the confidence of the public, which may believe that the government targets legitimate political opponents. In this speech delivered for the annual James Madison Lecture, the Honorable Diane Wood tackles the classic question of whether courts should interpret the United States Constitution from an originalist or dynamic approach. Judge Wood argues for the dynamic approach and defends it against the common criticisms that doing so allows judges to stray from the original intent of those who wrote the Constitution or take into consideration improper foreign influences. What is the optimal arrangement of judicial review? Most scholars who have addressed this question have assumed that there are only two important alternatives: judicial supremacy and parliamentary sovereignty. The literature has neglected the conceptual space that exists between these two poles, in particular the innovative legislative override model. This article describes and evaluates the experiences of the two countries that have adopted the override, Canada and Israel. It also introduces a refined override model that promises to protect fundamental rights while promoting democratic decision-making. The incarceration revolution of the late twentieth century fueled ongoing research on the relationship between rates of incarceration and crime, unemployment, education, and other social indicators. In this research, the variable intended to capture the level of confinement in society was conceptualized and measured as the rate of incarceration in state and federal prisons and county jails. This, however, fails to take account of other equally important forms of confinement, especially commitment to mental hospitals and asylums. A Simulation Of Composite Dispatching Rules, Conwip And Push Lot Release In Semiconductor Fabrication, Nizar Bahaji, Michael Kuhl

This paper evaluates dispatching rules and order release policies in two fabs representing two wafer fabrication modes, namely, ASIC and low-mix high-volume production. Order release policies were fixed-interval (push) release, and constant work-in-process, CONWIP (pull) policy. Following rigorous fab modeling and statistical analysis, new composite dispatching rules were found to be robust for system cycle time and due-date adherence measures, in both production modes.

Classroom Interpreting And Visual Information Processing In Mainstream Education For Deaf Students: Live Or Memorex?, Marc Marschark, Jeff Pelz, Carol Convertino, Patricia Sapere, Mary Ellen Arndt, Rosemarie Seewagen

This study examined visual information processing and learning in classrooms including both deaf and hearing students. Of particular interest were the effects on deaf students’ learning of live (threedimensional) versus video-recorded (two-dimensional) sign language interpreting and the visual attention strategies of more and less experienced deaf signers exposed to simultaneous, multiple sources of visual information. Results from three experiments consistently indicated no differences in learning between three-dimensional and two-dimensional presentations among hearing or deaf students. Analyses of students’ allocation of visual attention and the influence of various demographic and experimental variables suggested considerable flexibility in deaf students’ receptive communication skills. …

We investigate the central regions of 23 spiral galaxies using archival NICMOS imaging and STIS spectroscopy. The sample is taken from our program to determine the masses of central massive black holes (MBH) in 54 nearby spiral galaxies. Stars are likely to contribute significantly to any dynamical central mass concentration that we find in our MBH program and this paper is part of a series to investigate the nuclear properties of these galaxies. We use the Nuker law to fit surface brightness profiles, derived from the NICMOS images, to look for nuclear star clusters and find possible extended sources in …
