Means Testing: The Failed Bankruptcy Revolution Of 2005, David G. Carlson

The monumental bankruptcy amendments of 2005 made means testing the very center of the attempt to restore discipline to consumer spending. Yet, one year of practical experiences shows that either the means test either promotes bankruptcy abuse, or it is meanginless, depending on whether courts think the mechanical means test pre-empts pre-2005 law, or whether it merely supplements it. This article explores the means test in details, shows why it is a flop, and what the courts have made of it so far.

DeAngelo et al. (2006) have recently used the AWS criterion in a M/G/1 queuing model to show that there is no necessary tension between economic cost minimization and inspection stringency in non-native species management. In this paper, we use an alternate cost criterion (AWQ criterion) to investigate the generality of this central result in DeAngelo et al. (2006). Our theoretical analysis shows that there is no unambiguous answer to this question. Therefore, we use numerical methods and our numerical analysis leads to two findings. We use the ‘moving puncture’ approach to perform fully non-linear evolutions of spinning quasicircular black-hole binaries with individual spins unaligned with the orbital angular momentum. We evolve configurations with the individual spins (parallel and equal in magnitude) pointing in the orbital plane and 45◦ above the orbital plane. We introduce a technique to measure the spin direction and track the precession of the spin during the merger, as well as measure the spin flip in the remnant horizon. The former configuration completes 1.75 orbits before merging, with the spin precessing by 98◦ and the final remnant horizon spin flipped by …

We have undertaken an HST Space Telescope Imaging Spectrograph survey of 54 late type spiral galaxies to study the scaling relations between black holes and their host spheroids at the low mass end. Our aim is to measure black hole masses or to set upper limits for a sizeable sample of spiral galaxies. In this paper we present new Space Telescope Imaging Spectrograph (STIS) observations of three spiral galaxies, NGC 4303, NGC 3310 and NGC 4258. We report the first results from evolutions of generic black-hole binaries, i.e. a binary containing unequal mass black holes with misaligned spins. Our configuration, which has a mass ratio of 2 : 1, consists of an initially non-spinning hole orbiting a larger, rapidly spinning hole (specific spin a/m = 0.885), with the spin direction oriented −45◦ with respect to the orbital plane. We track the inspiral and merger for ∼ 2 orbits and find that the remnant receives a substantial kick of 454 kms−1, more than twice as large as the maximum kick from non-spinning binaries. Therapeutic ultrasound angioplasty has been investigated, clinically, by a number of researchers and represents a potentially promising therapy for the treatment of atherosclerotic lesions. To date, there has been no detailed analysis of the effect of mechanical design parameters, such as wire geometry or damping characteristics, on wire waveguide performance. An apparatus capable of delivering therapeutic ultrasound down small diameter nickel–titanium (NiTi) wire waveguides is described. The output peak-to-peak (p–p) displacements at the distal tip of a 1.0mm diameter waveguide were measured experimentally, by means of an optical microscope and image analysis software. In 1880, when Oliver Wendell Holmes (later to be a Justice of the U.S. Supreme Court) criticized the "logical theology" of law articulated by Christopher Columbus Langdell (the first Dean of Harvard Law School), neither Holmes nor Langdell was aware of the revolution in logic that had begun, the year before, with Frege's Begriffsschrift. But there is an important element of truth in Holmes's insistence that a legal system cannot be adequately understood as a system of "axioms and corollaries"; and this element of truth is not obviated by the more powerful logical techniques that are now available.

We show that the presence of a r−3/2 dark matter overdensity can be robustly predicted at the center of any galaxy old enough to have grown a power-law density cusp in the stars via the Bahcall-Wolf mechanism. Using both Fokker-Planck and direct N-body integrations, we demonstrate collisional generation of these dark matter “crests” (Collisionally REgenerated STtructures) even in the extreme case that the density of both stars and dark matter were previously lowered by slingshot ejection from a binary supermassive black hole. In the early 1990s, Bolivia tried to adopt a popular U.S. tax reform proposal: replacing its corporate income tax with a cash-flow -type consumption tax, broadly similar in structure to taxes proposed by a long line of theorists from Prof. William Andrews in 1974 to the President's Advisory Panel on Federal Tax Reform in 2006. Unfortunately, the Bolivian experiment ran into an insuperable obstacle: the U.S. foreign tax credit (FTC) rules. A recently developed, freely available, application specifically designed for the visualization of multimodal data sets is presented. The application allows multiple 3D data sets such as CT (x-ray computer tomography), MRI (magnetic resonance imaging), PET (positron emission tomography), and SPECT (single photon emission tomography) of the same subject to be viewed simultaneously. This is done by maintaining synchronization of the spatial location viewed within all modalities, and by providing fused views of the data where multiple data sets are displayed as a single volume. Some 11 million participants in 401(k) plans invest more than 20 percent of their retirement savings in their employer's stock. Yet investing in the stock of one's employer is risky: single securities are riskier than diversified portfolios, and an employee's human capital typically is positively correlated with the company's performance. In the worst-case scenario, workers can lose their jobs and much of their retirement wealth simultaneously. For workers who expect to work for a company for many years, a dollar of company stock can be valued at less than 50 cents after accounting for risk. However, employees still invest voluntarily …

The ACS Virgo Cluster Survey consists of HST/ACS imaging for 100 early–type galaxies in the Virgo cluster, observed in the F475W(≈ SDSS g) and F850LP (≈ SDSS z) filters. We derive distances for 84 of these galaxies using the method of Surface Brightness Fluctuations (SBF), present the SBF distance catalog, and use this database to examine the three-dimensional distribution of early–type galaxies in the Virgo Cluster. The SBF distance moduli have a mean (random) measurement error of 0.07 mag (0.5 Mpc), or roughly three times better than previous SBF measurements for Virgo Cluster galaxies. Estimation of the extent and spread of wildland fires is an important application of high spatial resolution multispectral images. This work addresses a fuzzy segmentation algorithm to map fire extent, active fire front, hot burn scar, and smoke regions based on a statistical model. The fuzzy results are useful data sources for integrated fire behavior and propagation models built using Dynamic Data Driven Applications Systems (DDDAS) concepts that use data assimilation techniques which require error estimates or probabilities for the data parameters. The purpose of this study was to determine whether common elements in fund allocation formulas could be used to articulate "best practices" for fund allocations in academic libraries. Methodology involved a meta-analysis of published articles and Internet sites in which 75 fund allocation formulas were presented. Dodgson’s election system elegantly satisfies the Condorcet criterion. However, determining the winner of a Dodgson election is known to be p 2-complete ([HHR97], see also [BTT89]), which implies that unless P = NP no polynomial-time solution to this problem exists, and unless the polynomial hierarchy collapses to NP the problem is not even in NP. Nonetheless, we prove that when the number of voters is much greater than the number of candidates (although the number of voters may still be polynomial in the number of candidates), a simple greedy algorithm very frequently finds the Dodgson winners in such a way …

The primary objective of the research presented in this paper is to qualify the reliability of mixed assemblies by comparing them to the conventional Sn–Pb assembly and completely Pb-free assembly. The research investigates both forward and backward compatibility in electronic assemblies using a design of experiments (DOE) approach. SimSET is a package for simulation of emission tomography data sets. Condor is a popular distributed computing environment. Simple C/C++ applications and shell scripts are presented which allow the execution of SimSET on the Condor environment. This is accomplished without any modification to SimSET by executing multiple instances and using its combinebin utility. This enables research facilities without dedicated parallel computing systems to utilize the idle cycles of desktop workstations to greatly reduce the run times of their SimSET simulations. The necessary steps to implement this approach in other environments are presented along with sample results.
