Subordination And The Fortuity Of Our Circumstances, Sergio J. Campos Jan 2008

Subordination And The Fortuity Of Our Circumstances, Sergio J. Campos

Articles

The antisubordination principle exists at the margins of equality law. This Article seeks to revive the antisubordination principle by taking a fresh look at its structure and underlying justification. First, the Article provides an account of the harm of subordination that focuses on one's position in society, rejecting the focus on groups popular in the existing antisubordination literature. Second, it argues for a theory of state obligation that goes beyond both the existing state action doctrine of the Equal Protection Clause and the failure to protect doctrine associated with Charles Black. The Article argues instead that the antisubordination principle mandates …

Highly photocatalytically active silver-modified ZnO has been prepared and the effect of silver modification was studied. The structural and optical properties were characterized by X-ray diffraction, Fourier transform IR, differential scanning calorimetry, BET surface area, Raman, UV-vis, and photoluminescence spectroscopy. The photocatalytic activity of these materials was studied by analyzing the degradation of an organic dye, rhodamine 6G (R6G), and it is found that 3 mol % silver-modified ZnO at 400°C shows approximately four times higher rate of degradation than that of unmodified ZnO and a three times higher rate than that of commercial TiO 2 photocatalyst Degussa P-25. It …

Natural Laws And Inevitable Infringement, Alan L. Durham Jan 2008

Natural Laws And Inevitable Infringement, Alan L. Durham

Articles

According to wellestablished principles one cannot patent natural laws or phenomena per se but one can patent new and useful applications of those laws and phenomena Justice Breyers opinion in Laboratory Corp v Metabolite Labs Inc applies this distinction to inventions exploiting natural relationships such as a method of diagnosing a vitamin deficiency by observing elevated levels of an amino acid in a patients blood Justice Breyer concludes that patenting a method based on observation and reasoning amounts to patenting the natural relationship itself a result contrary to policy because it denies others a basic tool of research In fact …

Sudoku: A Little Lesson In Oop, Axel-Tobias Schreiner, James Heliotis Jan 2008

Sudoku: A Little Lesson In Oop, Axel-Tobias Schreiner, James Heliotis

Articles

Paying only lip service to the principles of object-oriented programming rarely results in the expected benefits. This paper presents a series of designs for a Sudoku application that will lead introductory students through the allimportant process of trial and error. They will see examples of design analysis, criticism, and improvement. The paper concludes with some general pointers why and how the initial mistakes could have been avoided.

Efficient Mining Of Heterogeneous Star-Structured Data, Manjeet Rege, Qi Yu Jan 2008

Efficient Mining Of Heterogeneous Star-Structured Data, Manjeet Rege, Qi Yu

Articles

Many of the real world clustering problems arising in data mining applications are heterogeneous in nature. Heterogeneous co-clustering involves simultaneous clustering of objects of two or more data types. While pairwise co-clustering of two data types has been well studied in the literature, research on high-order heterogeneous co-clustering is still limited. In this paper, we propose a graph theoretical framework for addressing star- structured co-clustering problems in which a central data type is connected to all the other data types. Partitioning this graph leads to co-clustering of all the data types under the constraints of the star-structure. Although, graph partitioning …

Can Gravitational Collapse Sustain Singularity-Free Trapped Surfaces?, Manasse R. Mbonye, Demos Kazanas Jan 2008

Can Gravitational Collapse Sustain Singularity-Free Trapped Surfaces?, Manasse R. Mbonye, Demos Kazanas

Articles

In singularity generating spacetimes both the out-going and ingoing expansions of null geodesic congruences + and − should become increasingly negative without bound, inside the horizon. This behavior leads to geodetic incompleteness which in turn predicts the existence of a singularity. In this work we inquire on whether, in gravitational collapse, spacetime can sustain singularity-free trapped surfaces, in the sense that such a spacetime remains geodetically complete. As a test case, we consider a well known solution of the Einstien Field Equations which is Schwarzschild-like at large distances and consists of a fluid with a p = − equation of …

Canon Digital Rebel Vs. Fuji Is-1 Infrarecapd Able Camera, Andrew Davidhazy

Articles

This is an article on how one might make a makeshift infrared transmitting filter using two relatively easy to obtain glass filters to substitute for a true infrared filter, the Wratten #87. This test also compares the performance of a Canon camera not designed for IR use and a Fuji IS-1 that is infrared capable. Added here in February 2008.

Leveraging Multiple Imaging Modalities To Improve Breast Cancer Detection, Diagnosis, And Management, Karl Baum Jan 2008

Leveraging Multiple Imaging Modalities To Improve Breast Cancer Detection, Diagnosis, And Management, Karl Baum

Articles

ANSYS On Campus article. Breast cancer is the most common malignant disease in women, and the second leading cause of cancer death among American women today [1]. The primary tool for detection and diagnosis of breast cancer is x-ray mammography, but it is hoped that additional information provided by Positron Emission Tomography (PET) and Magnetic Resonance Imaging (MRI) will provide a means to determine if a suspected lesion, seen in mammography, is malignant or not. The procedure may prevent a large number of retrospectively unnecessary breast biopsies, a surgical procedure, which can result in pain, bruising, and scaring, that is …

Front Projection: A Useful Compositing Special Effects Technique, Andrew Davidhazy Jan 2008

Front Projection: A Useful Compositing Special Effects Technique, Andrew Davidhazy

Articles

Photographers have devised many different ways to place a subject of choice against some desired and visually interesting and appropriate background without going to the expense of traveling to exotic locations on the world or having at their disposal a large variety of background props. This article describes a novel "traditional" technique especially useful for social photography but also advertising and illustration. Added here in April 2008.

Digital Terrestrial Photogrammetry Project, Andrew Davidhazy Jan 2008

Digital Terrestrial Photogrammetry Project, Andrew Davidhazy

Articles

Photogrammetry is the science of making measurements of subjects. It generally also implies "remote" measurement as in aerial photography. This is a project that describes, demonstrates and puts into practice the principles at work in a terrestrial situation and should not be beyond most high school or college students with an interest in applying photography for technical purposes. Basic trigonometry at work! Added here in April 2008.

Gravitational Wave Recoil Oscillations Of Black Holes: Implications For Unified Models Of Active Galactic Nuclei, Stefanie Komossa, David Merritt Jan 2008

Gravitational Wave Recoil Oscillations Of Black Holes: Implications For Unified Models Of Active Galactic Nuclei, Stefanie Komossa, David Merritt

Articles

We consider the consequences of gravitational wave recoil for unified models of active galactic nuclei (AGNs). Spatial oscillations of supermassive black holes (SMBHs) around the cores of galaxies following gravitational wave (GW) recoil imply that the SMBHs spend a significant fraction of time off-nucleus, at scales beyond that of the molecular obscuring torus. Assuming reasonable distributions of recoil velocities, we compute the off-core timescale of (intrinsically type-2) quasars. We find that roughly one-half of major mergers result in a SMBH being displaced beyond the torus for a time of 107.5 yr or more, comparable to quasar activity timescales. Since major …

Hearts, Minds, Hands: A Dream Team For Mental Health, Julianne Gold Brunson, Judy Molner, Miriam Nathan Lerner Jan 2008

Hearts, Minds, Hands: A Dream Team For Mental Health, Julianne Gold Brunson, Judy Molner, Miriam Nathan Lerner

Articles

Interpreting in a mental health setting with hearing staff members and deaf clientele, the ethical situations fly fast and furious, providing the interpreter with a wealth of war stories with which to regale neophyte students of this dynamic profession. Much has been written to improve the many and varied mental health services being extended to deaf populations. The most commonly described dyads are that of hearing therapist and deaf patient. However, consider the case of a deaf psychologist treating hearing clients. In this instance, the interpreter becomes the liaison between the deaf professional and the hearing patient. When an interpreter …

Jagannath's Saligram: On Bruno Latour And Literary Critique After Postcoloniality, Amit Ray, Evan Selinger Jan 2008

Jagannath's Saligram: On Bruno Latour And Literary Critique After Postcoloniality, Amit Ray, Evan Selinger

Articles

Bruno Latour has turned to Indian vernacular fiction to illustrate the limits of ideology critique. In examining the method of literary analysis that underlies his appropriation of postcolonial history and culture, we appeal to Edward Said's notion of "traveling theory" in order to discuss critically the aesthetic as well as political stakes of using the technology of the modern novel for the allegorical purposes that Latour has in mind. We argue that Latourian analysis fails to uphold its own rigorous aspirations when it reduces complex literary and cultural representation to universal allegory.

Reviewing The Author-Function In The Age Of Wikipedia, Amit Ray, Erhardt Graeff Jan 2008

Reviewing The Author-Function In The Age Of Wikipedia, Amit Ray, Erhardt Graeff

Articles

In "Reviewing the Author-Function in the Age of Wikipedia," Amit Ray and Erhardt Graeff examine how wiki technology challenges traditional concepts of authorship and authority in knowledge production. The authors build on poststructuralist theory, particularly Roland Barthes's "Death of the Author" and Michel Foucault's concept of the "author-function," to analyze how wikis destabilize individual authorship in favor of collaborative, community-driven content creation.

The essay argues that wikis represent a fundamental shift from the Romantic notion of the solitary author-genius to what they term the "wiki writing process"—a dynamic system where traditional roles of reader, writer, and editor blur into a …

Consensus Mutagenesis Reveals That Non-Helical Regions Influence Thermal Stability Of Horseradish Peroxidase., Barry Ryan, CiaráN Fagan Jan 2008

Consensus Mutagenesis Reveals That Non-Helical Regions Influence Thermal Stability Of Horseradish Peroxidase., Barry Ryan, CiaráN Fagan

Articles

The enzyme horseradish peroxidase has many uses in biotechnology but a stabilized derivative would have even wider applicability. To enhance thermal stability, we applied consensus mutagenesis (used successfully with other proteins) to recombinant horseradish peroxidase and generated five single-site mutants. Unexpectedly, these mutations had greater effects on steady-state kinetics than on thermal stability. Only two mutants (T102A, T110V) marginally exceeded the wild type’s thermal stability (4% and 10% gain in half- life at 50oC respectively); the others (Q106R, Q107D, I180F) were less stable than wild type. Stability of a five-fold combination mutant matched that of Q106R, the least-stable single mutant. …

Craft And Power, Carl E. Schneider Jan 2008

Craft And Power, Carl E. Schneider

Articles

Oliver Wendell Holmes-a great judge-said that "the command of the public force is intrusted to the judges in certain cases, and the whole power of the state will be put forth, if necessary, to carry out their judgments and decrees." Appellate courts command that force in ways that principle and practicalities leave little fettered. Judges must fetter themselves, not least by honoring the judicial duty of craftsmanship. That duty obliges courts to respect procedural rules, for they keep courts within their bounds and promote fair and sound decisions. That duty obliges courts to analyze legal authority scrupulously, since judicial legitimacy …

Back To The Future? The Potential Revival Of Territoriality, Reuven S. Avi-Yonah Jan 2008

Back To The Future? The Potential Revival Of Territoriality, Reuven S. Avi-Yonah

Articles

Since 1994, the trend in the United States and other developed countries appears to be to reduce the scope of residence jurisdiction and increase the emphasis on source jurisdiction. If this trend continues, these countries are likely to move toward territoriality and decrease the emphasis on their CFC rules. In the author’s opinion, the reason for this trend is political and economic, not legal. It is part of tax competition, specifically the competition to be the headquarters jurisdiction for multinationals. The author also thinks, however, that it is not necessary to go down this road because the solution to the …

Advocating For The Constitutional Rights Of Nonresident Fathers, Vivek Sankaran Jan 2008

Advocating For The Constitutional Rights Of Nonresident Fathers, Vivek Sankaran

Articles

Months after a child welaare case is petitioned, a nonresident father appears in court and requests custody of his children who are living in foster care. Little is known about the father, and immediately, the system-judge, caseworkers, and attorneys view him with suspicion and caution, inquiring about his whereabouts and his prior involvement in the children's lives. Those doubts, in turn, raise complicated questions about his legal rights to his children. As a practioner working in the child welfare system, you're likely to face this scenario. The largest percentage of child victims of abuse and neglect come from households headed …

The Functions Of Standing, Heather Elliott Jan 2008

The Functions Of Standing, Heather Elliott

Articles

The doctrine of standing is said to be key to vindicating the separation of powers guaranteed by the structure of the Constitution But separation of powers is not monolithic and the Supreme Court has used standing doctrine to promote at least three separationofpowers functions for the courts 1 hearing only cases possessing sufficient concrete adversity to make them susceptible of judicial resolution 2 avoiding questions better answered by the political branches and 3 resisting Congresss use of citizen suits and therefore Congresss conscription of the courts to monitor the compliance of the executive branch with the lawWhatever the value of …

The Articulate Frank Allen, James J. White

Articles

Frank Allen had all of the wonderful talents that Ted St. Antoine and Rick Lempert ascribe to him. He was exceptionally smart and thoughtful (no one gets to give those fancy lectures who is not). He was a wise man (he led the faculty through the tough times at the end of the Vietnam War). And he was compassionate but tough as nails (he favored affirmative action, but was willing to close down the BAM affirmative action disruption with police if necessary-Frank's statement of his intention to call the police after the law school classes were disrupted forced the timorous …
