Daniel Arises: Notes (Such As 30 And 31) From The Schlagaground*, Richard H. Weisberg

Articles

The article critiques the state of legal academia, arguing that it has become mired in mediocrity and disconnected from the pursuit of justice and creative thinking. It contends that legal education and scholarly discourse have been stifled by a focus on narrow, unimaginative logic, leading to a decline in intellectual rigor and a failure to inspire meaningful change.

Explaining The Orbits Of The Galactic Center S-Stars, David Merritt, Alessia Gualandris, Seppo Mikkola Feb 2009

Explaining The Orbits Of The Galactic Center S-Stars, David Merritt, Alessia Gualandris, Seppo Mikkola

Articles

The young stars near the supermassive black hole at the galactic center follow orbits that are nearly random in orientation and that have an approximately “thermal” distribution of eccentricities, N(< e) e2. We show that both of these properties are a natural consequence of a few million years’ interaction with an intermediate-mass black hole (IBH), if the latter’s orbit is mildly eccentric and if its mass exceeds approximately 1500 solar masses. Producing the most tightly-bound S-stars requires an IBH orbit with periastron distance less than about 10 mpc. Our results provide support for a model in which the young stars are carried to the galactic center while bound to an IBH, and are consistent with the hypothesis that an IBH may still be orbiting within the nuclear star cluster.

When Patients Say No (To Save Money): An Essay On The Tectonics Of Health Law., Mark A. Hall, Carl E. Schneider

The ultimate aim of health care public policy is good care at good prices. Managed care stalled at achieving this goal by trying to influence providers, so health policy has turned to the only market-based option left: treating patients like consumers. Health insurance and tax policy are now pressuring patients to spend their own money when they select health plans, providers, and treatments. Expecting patients to choose what they need at the price they want, consumerists believe that market competition will constrain costs while optimizing quality. This classic form of consumerism is today's watchword. This Article evaluates this ideal type …

Single walled carbon nanotubes have gained enormous popularity due to a variety of potential applications which will ultimately lead to increased human and environmental exposure to these nanoparticles. This study was carried out in order to evaluate the inflammatory response of immortalised and primary human lung epithelial cells (A549 and NHBE) to single walled carbon nanotube samples (SWCNT). Special focus was placed on the mediating role of lung surfactant on particle toxicity. The toxicity of SWCNT dispersed in cell culture medium was compared to that of nanotubes dispersed in dipalmitoylphosphatidylcholine (DPPC, the main component of lung lining fluid). Exposure was …

Self-Addressable Memory-Based Fsm: A Scalable Intrusion Detection Engine, Benfano Soewito, Lucas Vespa, Atul Mahajan, Ning Weng, Haibo Wang

One way to detect and thwart a network attack is to compare each incoming packet with predefined patterns, also called an attack pattern database, and raise an alert upon detecting a match. This article presents a novel pattern-matching engine that exploits a memory-based, programmable state machine to achieve deterministic processing rates that are independent of packet and pattern characteristics. Our engine is a self-addressable memory-based finite state machine (SAMFSM), whose current state coding exhibits all its possible next states. Moreover, it is fully reconfigurable in that new attack patterns can be updated easily. A methodology was developed to program the …

A High-Resolution Melting Approach For Analyzing Allelic Expression Dynamics, Jiazheng Yuan, Muhammad Haroon, David A. Lightfoot, Yvan Pelletier, Qiang Liu, Xiu-Qing Li

Articles

Single nucleotide polymorphisms (SNPs) are single base pair mutations that provide new approaches to studies of allele transcript abundances. High-resolution DNA melting curve (HRM) analysis using a LightScanner (Hi-Res Melting system with Idaho's LC Green) provides post-PCR detection of mutations and SNPs in genomic DNA. This study investigated whether the HRM analysis can distinguish alleles among potato (Solanum tuberosum) transcript abundances. Transcript properties of genes encoding seven carbohydrate metabolism enzymes/proteins in various tissues and cold storage durations were studied. The HRM assay measured differential expression of alleles between different organs, between different storage treatments and stages of tubers from the …

Multigeneic Qtl: The Laccase Encoded Within The Soybean Rfs2/Rhg1 Locus Inferred To Underlie Part Of The Dual Resistance To Cyst Nematode And Sudden Death Syndrome, M Javed Iqbal, R Ahsan, Jawad Afzal, A Jamai, K Meksem, Hany A. El- Shemy, David A. Lightfoot Jan 2009

Lightfoot

Articles

Multigeneic QTL present significant problems to analysis. Resistance to soybean (Glycine max (L) Merr.) sudden death syndrome (SDS) caused by Fusarium virguliforme was partly underlain by QRfs2 that was clustered with, or pleiotropic to, the multigeneic rhg1 locus providing resistance to soybean cyst nematode (SCN; Heterodera glycines ). A group of five genes were found between the two markers that delimited the Rfs2/rhg1 locus. One of the five genes was predicted to encode an unusual diphenol oxidase (laccase; EC 1.10.3.2). The aim of this study was to characterize this member of the soybean laccase gene-family and explore its involvement in …

Locus Interactions Underlie Seed Yield In Soybeans Resistant To Heterodera Glycines, U B. Karangula, M A. Kassem, Lalit Gupta, Hany A. El-Shemy, David A. Lightfoot

Articles

In soybean (Glycine max L. Merr.) combining resistance to cyst nematode (SCN; Heterodera glycines I.) with high seed yieldremains problematic. Molecular markers linked to quantitative trait loci (QTL) have not provided a solution. Sets of markers describing a collection of favorable alleles (linkats) may assist plant breeders seeking to combine both traits. The objective of this analysis was to identify linkats in genomic regions underlying seed yield and root SCN resistance QTL. Used were groups of cultivars selected from a single recombinant inbred (RIL) population derived from 'Essex' by 'Forrest' (ExF). The yield was measured at four locations. SCN resistance …

A Mixed-Effects Height-Diameter Model For Pinus Densiflora Trees In Gangwon Province, Korea, Young Jin Lee, Dean W. Coble, Jung Kee Pyo, Sung Ho Kim, Woo Kyun Lee, Jung Kee Choi Jan 2009

A Mixed-Effects Height-Diameter Model For Pinus Densiflora Trees In Gangwon Province, Korea, Young Jin Lee, Dean W. Coble, Jung Kee Pyo, Sung Ho Kim, Woo Kyun Lee, Jung Kee Choi

Articles

A new mixed-effects model was developed that predicts individual-tree total height for Pinus densiflora trees in Gangwon province as a function of individual-tree diameter (cm). The mixed-effects model contains two random-effects parameters. Maximum likelihood estimation was used to fit the model to 560 height-diameter observations of individual trees measured throughout Gwangwon province in 2007 as part of the National Forest Inventory Program in Korea. The new model is an improvement over fixed effects models because it can be calibrated to a local area, such as an inventory plot or individual stand. The new model also appears to be an improvement …

Does Perceptual Acuity Matter? - An Investigation Of Entrepreneurial Orientation, Perceptual Acuity, And Firm Performance, Zhi Tang, Sandra Rothenberg Jan 2009

Does Perceptual Acuity Matter? - An Investigation Of Entrepreneurial Orientation, Perceptual Acuity, And Firm Performance, Zhi Tang, Sandra Rothenberg

Articles

One critical proposition in normative strategic management research is that an accurate perception of the environment by top managers is a prerequisite to attain- ing better organizational performance. However, recent entrepreneurship stud- ies suggest that entrepreneurs are often leading or even causing environmental changes, and thus they may perceive greater industrial instability than there actu- ally is. In this project, we examine if an over-perception of industrial instability exists among entrepreneurs. If it does, which perceptual mode (accurate percep- tion versus over-perception) will benefit firm performance? We conducted the study in a highly volatile environment — China — and found …

Challenges In Incorporatins Sustainability Into Product Development: An Exploratory Study, S. Athalye, S. Govindarajan, C. Lopez

Articles

Despite decades of disaggregated initiatives aimed at improving the well-being and quality of life of its employees, their families, communities and stakeholders, many high-technology firms are still struggling to develop an integrated approach to address the triple bottom line aspects of sustainability. In particular how sustainability is being integrated into the product development process, and the challenges that result, is of interest to this work. A literature review into the role of internal factors of how a firm implements a sustainability strategy revealed that it was too normative to guide the implementation of a corporate sustainability strategy at the level …

High-Accuracy Near-Infrared Imaging Polarimetry With Nicmos, Daniel Batcheldor, G. Schneider, D.C. Hines

Articles

The findings of a nine-orbit calibration plan carried out during HST Cycle 15, to fully determine the NICMOS camera 2 (2.0 !m) polarization calibration to high accuracy, are reported. Recently Ueta et al. and Batcheldor et al. have suggested that NICMOS possesses a residual instrumental polarization at a level of 1.2%–1.5%. This would completely inhibit the data reduction in a number of GO programs, and hamper the ability of the instrument to perform high-accuracy polarimetry. We obtained polarimetric calibration observations of three polarimetric standards at three spacecraft roll angles separated by ~60°. Combined with archival data, these observations were used …

Media Discourses On Autonomy In Dying And Death, Christina Quinlan

Articles

THIS PAPER IS A SYNOPSIS of a research project designed to examine the representations of particular experiences of dying and death as represented in media consumed in Ireland. This media research is a small part of a large study commissioned by the Hospice Friendly Hospitals Programme, through the Irish Hospice Foundation. The large study, undertaken by a team of researchers from University College Cork and the Royal College of Surgeons Ireland, was tasked with the development of an ethical framework for health-care practitioners on patient autonomy in end-oflife care. Patient autonomy at end-of-life is the degree of autonomy or control …

Hollywood Representations Of Irish Journalism: A Case Study Of Veronica Guerin, Pat Brereton Jan 2009

Hollywood Representations Of Irish Journalism: A Case Study Of Veronica Guerin, Pat Brereton

Articles

This paper emanates from an interest in how the journalist profession is represented on film. This discussion is framed, broadly, by an effort to gauge the performative nature of journalists, from ‘hard-boiled’ press hacks to egomaniacal TV reporters, while situating the vocation within conventional media studies, which privileges political and ethical indicators like ‘the Fourth Estate’ or as ‘Public Watchdog’.

Run Out Of The Gallery: The Changing Nature Of Irish Political Journalism, Kevin Rafter Jan 2009

Run Out Of The Gallery: The Changing Nature Of Irish Political Journalism, Kevin Rafter

Articles

THIS ARTICLE EXAMINES THE evolution of parliamentary and political reporting in Ireland and builds on earlier work by Foley (1993) and Horgan (2001). It considers the changing nature of Irish political journalism and the loss of influence of the Parliamentary Press Gallery and its constituent part, the Political Correspondents Group. This analysis takes place against a backdrop of continuing very high interest in politics in Ireland. During the 2007 general election, the television debate between Bertie Ahern and Enda Kenny, the leaders of the two main political parties, had an average audience of 941000 – a national audience share of …

The Irish Punditocracy As Contrarian Voice: Opinion Coverage Of The Workplace Smoking Ban, Declan Fahy

Articles

THE JOURNALISM OF COMMENTATORS and columnists has remained a lacuna in media studies. Their work has received so little sustained critical attention that it has become something of a ‘black box’, even as as the space devoted to opinion coverage in newspapers has expanded significantly over the past three decades. The section of the newspaper devoted to opinion journalism has traditionally been the op-ed page, so-called because of its usual placement opposite the section containing editorials. Viewed as a forum for the articulation of diverse viewpoints about current social issues, the page aims to provide a space in the ‘marketplace …

Articles

THE SEXUAL ABUSE OF children became a significant public issue in Ireland in the 1990s, with frequent media reports about the issue. In the main these focused on the issue of abuse of children by members of the clergy and religious orders. Headline cases included the abuse perpetrated by Fr Brendan Smyth, a priest of a religious order who was convicted of multiple counts of sexual abuse of children and subsequently died in prison, and Fr Seán Fortune, a diocesan priest, who committed suicide before his court trial for abuse. While child sexual abuse by clergy was widely exposed in …

Representations Of The Knowledge Economy: Irish Newspapers’ Discourses On A Key Policy Idea, Brian Trench Jan 2009

Representations Of The Knowledge Economy: Irish Newspapers’ Discourses On A Key Policy Idea, Brian Trench

Articles

FROM TIME TO TIME, notions take hold in society in such a way that they become reference ideas across diverse social sectors, and terms associated with these reference ideas proliferate in public discourses and media of various kinds. This is notably true for the ‘knowledge economy’ and ‘knowledge society’; these terms have largely displaced other terms to describe the particular character of advanced economies and societies in the early 21st century. Other terms have struggled to co-exist: ‘information society’ seems passé; ‘services society’, ‘audit society’ and ‘risk society’ are marginal or niche terms; ‘innovation society’ has had intermittent periods of …

Significant Television: Journalism, Sex Abuse And The Catholic Church, Colum Kenny

Articles

MOST CITIZENS OF THE Republic of Ireland describe themselves in their census returns as Roman Catholic, although attendances at church have been declining. Irish Catholics long endured religious discrimination and persecution under British Protestant rule. Partly for that reason, the Irish media tended to treat the Catholic Church very respectfully or deferentially after the foundation of the independent Irish Free State in 1921. However, by the closing decade of the twentieth century, Ireland had passed through a period of rapid and remarkable change. Economic, social and cultural factors made it more likely than before that Irish broadcasters would produce programmes …

War Crimes In Israel And Palestine, Tom Clonan

Articles

Gaza Weapons Use Prior to the January ceasefires, Amnesty International sent a team of independent observers into Gaza in order to investigate allegations of war crimes during the conflict on the part of Hamas and the Israeli Defence Forces (IDF). The Amnesty group were among the first independent observers to gain access to Gaza during the closing stages of the conflict. Their report, which has been seen by Dr. Tom Clonan contains disturbing evidence of the abuse of international law by all parties to the conflict.

Lynch’s Invasion Plans Exactly forty years ago, in August and September of 1969, intense rioting and civil unrest prevailed throughout Northern Ireland – violence that would ultimately lead to the outbreak of the Troubles. As the violence reached fever pitch the then Taoiseach, Jack Lynch made a televised speech to the nation on RTE in which he used – the now immortal and much misquoted phrase – ‘We will not stand by’. For almost forty years, historians and political pundits alike have argued over the precise meaning of this provocative – and yet somewhat ambiguous phrase. Had Jack Lynch intended …
