Managing Indigenous Knowledge And Traditional Cultural Expressions: Is Technology The Solution?, Amber T. Burtis Jul 2009

Managing Indigenous Knowledge And Traditional Cultural Expressions: Is Technology The Solution?, Amber T. Burtis

Articles

This paper discusses current issues surrounding the management of indigenous knowledge (IK) and traditional cultural expressions (TCEs) in libraries, archives and other cultural institutions. It addresses the need for: (1) ethical policies for the management of these knowledge systems, (2) critical approaches to the dominant library paradigm of information management, (3) recent efforts by the World Intellectual Property Organization and the American Library Association to craft policy on this topic, and (4) the need for and examples of collaboration with indigenous communities. Implications for social change with the implementation of socially responsible management systems are also considered.

Two Notions Of Privacy Online, Avner Levin, Patricia S. Abril Jul 2009

Two Notions Of Privacy Online, Avner Levin, Patricia S. Abril

Articles

Users of social networking websites tend to disclose much personal information online yet seem to retain some form of an expectation of privacy. Is this expectation of privacy always unreasonable? How do users of online social networks define their expectations of privacy online?

These questions were the impetus behind an empirical study, the findings of which are presented in this Article. The project, simultaneously conducted in Canada, at Ryerson University, and in the United States, at the University of Miami, consisted of a survey regarding personal information protection and expectations of privacy on online social networks (OSNs). Approximately 2,500 young …

Modeling No Emissions Of An Off-Road Diesel Engine Based On Emission Tests, David R. Bostic, Dennis G. Watson, Tony V. Harrison Jul 2009

Modeling No Emissions Of An Off-Road Diesel Engine Based On Emission Tests, David R. Bostic, Dennis G. Watson, Tony V. Harrison

Articles

Emissions values determined by the ISO 8178 emission certification tests do not necessarily represent emissions of a tractor in operation (Hansson et al., 2001). Rather than using ISO 8178 tests solely for certification, data collected during the tests may be suitable for predicting nitrogen oxide (NO) emissions of an engine operating at constant loads and speeds. Linear multiple regression (LMR) and nonlinear polynomial network (NPN) models were developed with data collected from ISO 8178-4 (1996) test cycle B-type tests (ISO) and an expanded set of tests (EXP) to predict NO emissions from a diesel engine. LMR using the ISO training …

The Mexican Economic Crisis Of 1982 And The Brazilian Economic Crisis Of 1999:Critical Junctures In Economic Policy?, Ana Maza Jul 2009

The Mexican Economic Crisis Of 1982 And The Brazilian Economic Crisis Of 1999:Critical Junctures In Economic Policy?, Ana Maza

Articles

This paper utilises a new critical juncture framework to help us determine whether changes to Mexican macroeconomic policy in the early 1980s, and Brazilian macroeconomic policy at the turn of the century, were clean breaks with the past, or continuations of previously established policy pathways. The framework consists of three elements, which must be identified in sequence in order to declare, with some certainty, if an event was a critical juncture. These are crisis, ideational change, and radical policy change.

Constitutional Flaw?, Carl E. Schneider Jul 2009

Constitutional Flaw?, Carl E. Schneider

Do terminally ill patients have a constitutional right "to decide, without FDA interference, whether to assume the risks of using potentially life-saving investigational drugs that the FDA has yet to approve for commercial marketing, but that the FDA has determined, after Phase I clinical human trials, are safe enough for further testing"? In Abigail Alliance for Better Access to Developmental Drugs v. McClellan, the United States District Court for the District of Columbia said "no." In Abigail Alliance for Better Access to Developmental Drugs v. von Eschenbach, a panel (three judges) of the United States Court of Appeals …

Modelling Browning And Brown Spotting Of Mushrooms (Agaricus Bisporus) Stored In Controlled Environmental Conditions Using Image Analysis, Catherine Barry-Ryan, Jesus Maria Frias, Leixuri Aguirre, Helen Grogan Jul 2009

Modelling Browning And Brown Spotting Of Mushrooms (Agaricus Bisporus) Stored In Controlled Environmental Conditions Using Image Analysis, Catherine Barry-Ryan, Jesus Maria Frias, Leixuri Aguirre, Helen Grogan

Articles

Mushrooms have a short postharvest shelf life compared to most vegetables, due to a very high metabolic activity and high water content, making them prone to microbial spoilage and to exhibit enzymatic browning. Storage conditions and natural product variability are both important factors that affect the management of mushrooms, and both of them can be managed using monitoring systems. In order to study the effect of the temperature and relative humidity on the whiteness decrease and appearance of brown spotting, an image analysis system was employed. Twenty five batches of mushrooms were subjected to combinations of three storage temperatures (T) …

Orange Juices Enriched With Chitosan: Optimisation For Extending The Shelf-Life, Catherine Barry-Ryan, Ana Belen Martin-Diana, Daniel Rico, J. Barat Jul 2009

Orange Juices Enriched With Chitosan: Optimisation For Extending The Shelf-Life, Catherine Barry-Ryan, Ana Belen Martin-Diana, Daniel Rico, J. Barat

Articles

Optimisation of the incorporation of chitosan in orange juice was accomplished by the evaluation of quality and nutritional markers. Response surface methodology was applied to obtain quadratic and second degree response surface model equations. The analyses showed that increases in chitosan concentration extended the quality of the orange juice significantly (p < 0.05), reducing enzymatic and non-enzymatic browning and controlling the spoilage during the storage time; however, concentrations N 1 g L− 1 produced a significant (p < 0.05) reduction in the concentrations of ascorbic acid and carotenoids associated with the positive charge of chitosan and its ability to flocculate and coagulate negatively charged substances. Also, concentrations N 1 g L− 1 were scored as unacceptable for the sensory panel due to an increase in bitterness. The study recommends the use of chitosan at concentrations up to 1 g L− 1 to extend quality and preserve ascorbic acid and carotenoids during storage time of fresh orange juice, thus avoiding the use of standard thermal treatments which produces a negative impact on the nutritional value. Industrial relevance: One of the major problems of fresh orange juice is its limited shelf-life. Spoilage and quick degradation of vitamins are two of the most important causes of quality loss during the shelf-life of this product. Moreover, the U. S. Food and Drug Administration issued a warning to consumers against drinking unpasteurised orange juice products because of the potential contamination with Salmonella typhimurium and its association with an outbreak of human disease caused by this organism [FDA issues nationwide health alert on Orchid Island unpasteurised orange juice. Products Recalls, Market Withdrawals and Safety Alerts.]. The main objective of this study was the study of chitosan as a natural preservative for extending the shelf-life of orange juice and as an alternative to pasteurisation.

Identification Of Volatile Quality Markers Of Ready-To-Use Lettuce And Cabbage, Catherine Barry-Ryan, Michael Devereux, Julien Lonchamp Jul 2009

Identification Of Volatile Quality Markers Of Ready-To-Use Lettuce And Cabbage, Catherine Barry-Ryan, Michael Devereux, Julien Lonchamp

Articles

Volatile emission changes of ready-to-use vegetables directly result from minimal processing and can reflect the sensory changes occurring in the product. Based on the detection of key volatile compounds, novel on-line and consumer quality-monitoring methods can be developed. The aim of this study was to identify volatile biomarkers for a range of leafy green ready-to-use vegetables (Butterhead and Iceberg lettuce and Irish York cabbage). Headspace volatile compounds were monitored using gas chromatography/mass spectrometry (GC/MS). The sensory quality of the products was evaluated at days 1, 7 and 14 using sensory and analytical measurements. Changes of volatile concentrations and sensory attributes …

The Effects Of Acid Adaptation On Escherichia Coli Inactivation Using Power Ultrasound, Sonal Patil, Paula Bourke, Bridget Cullen, Jesus Maria Frias, Patrick J. Cullen

Articles

Inactivation of Escherichia coli in liquids was carried out using power ultrasound. Parameters examined included amplitude levels (0.4µm, 7.5 µm, 37.5 µm), treatment time, cell condition (non-adapted cells, acid adapted cells), liquid media (TSB, model orange juice and model apple juice) and E. coli strain (ATCC 25922, NCTC 12900). The efficacy of ultrasound treatment was found to be a function of amplitude level, treatment time and media (p0.95), with the highest inactivation achieved using an amplitude of 37.5 µm. The D-values of E. coli 25922 at all amplitudes in model orange juice were not significantly different than in TSB media. …

The Res Judicata Worth Of Illegal Bankruptcy Reorganization Plans, David G. Carlson Jul 2009

The Res Judicata Worth Of Illegal Bankruptcy Reorganization Plans, David G. Carlson

Articles

The article examines the interplay between res judicata and the confirmation of bankruptcy reorganization plans, particularly under Chapter 13. It argues that while res judicata is essential for finality, it must not compromise procedural fairness and due process. The author advocates for a balanced approach where confirmed plans are binding but also ensure that creditors' rights are protected through proper legal procedures.

An Independent Analysis Of The Thermal Characteristics Of Irish Concrete Hollow Blocks And Hollow Block Wall Upgrades And A Discussion On Hollow Block Design, Joseph Little, Beñat Arregi Goikolea Mr Jun 2009

An Independent Analysis Of The Thermal Characteristics Of Irish Concrete Hollow Blocks And Hollow Block Wall Upgrades And A Discussion On Hollow Block Design, Joseph Little, Beñat Arregi Goikolea Mr

Articles

Hollow block walls, whether originally built with external render and internal plaster, or more recently with external render and insulated drylining, represent the most common form of wall construction in Leinster over the last 50 years (see image in Figure 8). In terms of vapour movement, air movement and thermal performance it is also one of the least understood forms of construction practiced in Ireland.

This technical paper and two articles by the same author published by Construct Ireland in February and May 2009 (Issues 6 & 7, Vol. 4) form a concerted effort to rectify this knowledge deficit. It …

A Comparative Framework: How Broadly Applicable Is A “Rigorous” Critical Junctures Framework?, John Hogan, David Doyle Jun 2009

A Comparative Framework: How Broadly Applicable Is A “Rigorous” Critical Junctures Framework?, John Hogan, David Doyle

Articles

The paper tests Hogan and Doyle’s (2007; 2008) framework for examining critical junctures. This framework sought to incorporate the concept of ideational change in understanding critical junctures. Until its development, frameworks utilised in identifying critical junctures were subjective, seeking only to identify crisis, and subsequent policy changes, arguing that one invariably led to the other, as both occurred around the same time. Hogan and Doyle (2007; 2008) hypothesised ideational change as an intermediating variable in their framework, determining if, and when, a crisis leads to radical policy change. Here we test this framework on cases similar to, but different from, …

Hypercompact Stellar Systems Around Recoiling Supermassive Black Holes, David Merritt, Jeremy Schnittman, Stefanie Komossa Jun 2009

Hypercompact Stellar Systems Around Recoiling Supermassive Black Holes, David Merritt, Jeremy Schnittman, Stefanie Komossa

Articles

A supermassive black hole ejected from the center of a galaxy by gravitational wave recoil carries a retinue of bound stars – a “hypercompact stellar system” (HCSS). The numbers and properties of HCSSs contain information about the merger histories of galaxies, the late evolution of binary black holes, and the distribution of gravitational-wave kicks. We relate the structural properties (size, mass, density profile) of HCSSs to the properties of their host galaxies and to the size of the kick, in two regimes: collisional (MBH∼ < 107M⊙), i.e. short nuclear relaxation times; and collisionless (MBH∼ > 107M⊙), i.e. long nuclear relaxtion times. HCSSs are expected to be similar in size and luminosity …

The Dynamics Of Human Capital And The World Of Work: Towards A Common Market In Contemporary Tertiary Education, Aidan Kenny Jun 2009

The Dynamics Of Human Capital And The World Of Work: Towards A Common Market In Contemporary Tertiary Education, Aidan Kenny

Articles

The drive for the so-called ‘knowledge society’, and the expected competitive advantage envisioned, has led to ‘power elites’ and vested interests applying pressure on nation states to develop and implement policies that push the balance of national education systems towards the economic imperative and away from the social good. This social inquiry will describe items, strategies and objectives relating to the pursuit of the current higher education change policy agendas, as expressed in key Irish policy documents. The inquiry concentrates on the new ‘world of work’ and the dynamic association with ‘human capital’ in particular the relationship between macro change …

Radial Ebg Cell Layout For Gps Patch Antennas, Giuseppe Ruvio, Max Ammann, Xiulong Bao Jun 2009

Radial Ebg Cell Layout For Gps Patch Antennas, Giuseppe Ruvio, Max Ammann, Xiulong Bao

Articles

A novel radial layout for mushroom-like electromagnetic-bandgap (EBG) cells surrounding a printed circularly-polarised patch antenna is proposed. Two radial EBG configurations surrounding a circular patch are compared to a reference patch on a conventional ground plane of the same dimension. The radial shape and displacement of the EBG cells around the patch offers improvements in terms of gain and axial-ratio compared to the reference antenna and is more suitable for circular geometries compared to conventional Cartesian layouts. In particular, the distance between the patch and the surrounding EBG cells is independent of the cell period, which can be arbitrarily chosen, …

Xilinx And The Arm's-Length Standard, Reuven S. Avi-Yonah

Articles

On May 7 the Ninth Circuit decided Xilinx v. Commissioner. By a 2-1 majority, the panel reversed the Tax Court and held that costs of employee stock options must be included in the pool of costs subject to a tax-sharing agreement. The Xilinx decision is important for three reasons. First, cost sharing is probably the key element in current transfer pricing law because it is the principal way in which profits from intangibles get shifted from the United States to low-tax jurisdictions. Moreover, informed observers agree that the allocation of income from intangibles is the most important problem in transfer …

An Information Theory Of Willful Breach, Omri Ben-Shahar, Oren Bar-Gill Jun 2009

An Information Theory Of Willful Breach, Omri Ben-Shahar, Oren Bar-Gill

Articles

Should willful breach be sanctioned more severely than inadvertent breach? Strikingly, there is sharp disagreement on this matter within American legal doctrine, in legal theory, and in comparative law. Within law-and-economics, the standard answer is "no"-breach should be subject to strict liability. Fault should not raise the magnitude of liability in the same way that no fault does not immune the breaching party from liability. In this paper, we develop an alternative law-and-economics account, which justifies supercompensatory damages for willful breach. Willful breach, we argue, reveals information about the "true nature" of the breaching party-that he is more likely than …

Applying Computational Models Of Spatial Prepositions To Visually Situated Dialog, John D. Kelleher, Fintan Costello Jun 2009

Applying Computational Models Of Spatial Prepositions To Visually Situated Dialog, John D. Kelleher, Fintan Costello

Articles

This article describes the application of computational models of spatial prepositions to visually situated dialog systems. In these dialogs, spatial prepositions are important because people often use them to refer to entities in the visual context of a dialog. We first describe a generic architecture for a visually situated dialog system and highlight the interactions between the spatial cognition module, which provides the interface to the models of prepositional semantics, and the other components in the architecture. Following this, we present two new computational models of topological and projective spatial prepositions. The main novelty within these models is the fact …

Family-Member And Non-Family-Member Managers In Family Firms: Adding A Seventh Country To The International Database - Kosovo, Robert Lussier, Matthew Sonfield, Robert J. Barbato May 2009

Family-Member And Non-Family-Member Managers In Family Firms: Adding A Seventh Country To The International Database - Kosovo, Robert Lussier, Matthew Sonfield, Robert J. Barbato

Articles

Extending earlier analyses of the authors in other countries with regard to the inclusion of family-member managers and non-family-member managers in family businesses, and the relationship of this variable to certain management activities, styles and characteristics, this current study analyzes data from Kosovo. Results of statistical testing indicate almost no changes in management attributes as the proportion of non-family-member managers increases in family firms. Implications for practitioners, consultants, and researchers are presented.

Characterisation Of The Humidity And Temperature Responses Of A Reflection Hologram Recorded In Acrylamide-Based Photopolymer, Izabela Naydenova, Raghavendra Jallapuram, Vincent Toal, Suzanne Martin May 2009

Characterisation Of The Humidity And Temperature Responses Of A Reflection Hologram Recorded In Acrylamide-Based Photopolymer, Izabela Naydenova, Raghavendra Jallapuram, Vincent Toal, Suzanne Martin

Articles

The humidity and temperature responses of a reflection hologram recorded in a self-processing photopolymer layer have been characterised by measurement of the position of the maximum intensity in the spectral response of the hologram. It has been demonstrated that such a hologram can be used for indication of the relative humidity (RH) in a specific temperature range. The operational range and reversibility of the holograms have been characterised in a controlled humidity and temperature environment. The humidity studies were carried out in the range from 10 to 80% RH and the temperature range under study was 15 – 50 ºC.

Obama's International Tax Plan: A Major Step Forward, Reuven S. Avi-Yonah May 2009

Obama's International Tax Plan: A Major Step Forward, Reuven S. Avi-Yonah

Articles

President Barack Obama last week personally introduced a set of proposals to reform U.S. international taxation that are the most significant advance toward preserving the income tax on cross-border transactions since the enactment of the subpart F rules by the Kennedy administration in 1962. (For prior coverage, see Doc 2009-10047 or 2009 TNT 84-1.) In essence, the Obama proposals introduce a 21stcentury version of the vision begun by Thomas Adams in 1918 and continued by Stanley Surrey in 1961: a world in which source and residence taxation are coordinated so as to achieve the underlying goals of the international tax …

Articles

Poly N-isopropylacrylamide and N-isopropylacrylamide / N-tert-butylacrylamide copolymer nanoparticles of 50 to 70 nm were prepared by free radical polymerisation. The particle sizes of the copolymer nanoparticles were measured in the test media Milli-Q water, Algae Media, Daphnia Media and Microtox Diluent as a function of temperature. Whereas in Milli-Q water the particle size was seen to decrease above the lower critical solution temperature of the thermoresponsive polymer, in the test media it was seen to increase significantly, indicative of aggregation. At the temperatures employed for the ecotoxicological studies all particles, with the exception of the 50:50 copolymer existed as nanoparticles, …
