The Desert Of The Unreal: Inequality In Virtual And Augmented Reality, Mary Anne Franks Jan 2017

The Desert Of The Unreal: Inequality In Virtual And Augmented Reality, Mary Anne Franks

Articles

The world we live in is structured by inequality: of gender, race, class, sexual orientation, disability, and more. Virtual and augmented reality technologies hold out the promise of a more perfect world, one that offers us more stimulation, more connection, more freedom, more equality than the "real" world. But for such technologies to be truly innovative, they must move us beyond our current limitations and prejudices. When existing inequalities are unacknowledged and unaddressed in the "real" world, they tend to be replicated and augmented in virtual realities. We make new worlds based on who we are and what we do …

Inner-City Anti-Poverty Campaigns, Anthony V. Alfieri Jan 2017

Inner-City Anti-Poverty Campaigns, Anthony V. Alfieri

Articles

This article offers a defense of outsider, legal-political intervention and community triage in inner-city anti-poverty campaigns under circumstances of widespread urban social disorganization, public and private sector neglect, and nonprofit resource scarcity. In mounting this defense, the Article revisits the roles of lawyers, nonprofit legal services organizations, and university-housed law school clinics in contemporary anti-poverty, civil rights, and social justice movements, in part by chronicling the emergence of a faith-based municipal equity movement in Miami, Florida. The Article proceeds in four parts. Part I introduces the notion of community triage as a means of addressing the impoverished and segregated aftermath …

"Revenge Porn" Reform: A View From The Front Lines, Mary Anne Franks Jan 2017

"Revenge Porn" Reform: A View From The Front Lines, Mary Anne Franks

Articles

The legal and social landscape of "revenge porn" has changed dramatically in the last few years. Before 2013, only three states criminalized the unauthorized disclosure of sexually explicit images of adults and few people had ever heard the ternm "revenge porn." As of July 2017, thirty-eight states and Washington, D.C. had criminalized the conduct; federal criminal legislation on the issue had been introduced in Congress; Google, Facebook, and Twitter had banned nonconsensual pornography from their platforms; and the term "revenge porn" had been added to the Merriam- Webster Dictionary. I have had the privilege of playing a role in many …

An Equal Rights Amendment For The Twenty-First Century: Bringing Global Constitutionalism Home, Julie C. Suk Jan 2017

An Equal Rights Amendment For The Twenty-First Century: Bringing Global Constitutionalism Home, Julie C. Suk

Articles

The last few years have seen a renewed push to constitutionalize sex equality in the United States. A generation after the federal Equal Rights Amendment (ERA) failed to be ratified by the requisite number of states, the ERA is on the platform of the 2017 Women's March on Washington. Oregon added a sex equality guarantee to its state constitution in 2014, joining 22 state constitutions and most constitutions around the world. Feminist coalitions, Hollywood celebrities, and members of Congress are vocally endorsing an ERA revival. Why is an ERA desired now, when judges have interpreted the Fourteenth Amendment to prohibit …

Simplexity: Plain Language And The Tax Law, Joshua D. Blank, Leigh Osofsky Jan 2017

Simplexity: Plain Language And The Tax Law, Joshua D. Blank, Leigh Osofsky

Articles

In recent years, federal government agencies have increasingly attempted to use plain language in written communications with the public. The Plain Writing Act of 2010, for instance, requires agencies to incorporate "clear and simple" explanations of rules and regulations into their official publications. In the tax context, as part of its "customer service" mission, the Internal Revenue Service bears a "duty to explain" the tax law to hundreds of millions of taxpayers who file tax returns each year. Proponents of the plain language movement have heralded this form of communication as leading to simplicity in tax compliance, more equitable access …

Cities, Inclusion And Exactions, Audrey Mcfarlane, Randall K. Johnson Jan 2017

Cities, Inclusion And Exactions, Audrey Mcfarlane, Randall K. Johnson

Articles

Cities across the country are adopting mandatory inclusionary zoning. Yet, consensus about the appropriate constitutional standard to measure the propriety of mandatory inclusionary zoning has not been fully reached. Under one doctrinal lens, inclusionary zoning is a valid land use regulation adopted to ensure a proper balance of housing within the jurisdiction. Under another doctrinal lens, challengers seek to characterize inclusionary zoning as an exaction, a discretionary condition subject to a heightened standard of review addressing the specific negative impact caused by an individual project on the supply of affordable housing in a jurisdiction. Drawing from the experience of Baltimore, …

Child Rights Trending: Accommodating Children With Disabilities In The Global Human Rights Framework And Us Foreign Policy, Janet E. Lord Jan 2017

Child Rights Trending: Accommodating Children With Disabilities In The Global Human Rights Framework And Us Foreign Policy, Janet E. Lord

Articles

This Article proceeds in three parts. Following the introduction, Part I analyzes the concept of child rights as applied to children with disabilities in instruments antecedent to the CRPD. It goes on to examine the treatment of children with disabilities in the CRC and in the text of the CRPD. In so doing, it exposes the significant conceptual shift in how children with disabilities are characterized as agents and holders of rights in the CRPD, in contrast to prior articulations. Part II explains how this new framework is used to expose and address major human rights issues that face children …

Vitamin D Improves Selected Metabolic Parameters But Not Neuropsychological Or Quality Of Life Indices In Osa: A Pilot Study, Conor Kerley, Katrina Hutchinson, Jessica Branham, Aisling Mcgowan, John Faul, Liam Cormican

Articles

Study Objectives: Our group and others have reported a high rate of vitamin D deficiency in obstructive sleep apnea (OSA), where vitamin D levels (25(OH) D) correlate negatively with OSA severity and some of its associated metabolic alterations. Data regarding vitamin D supplementation in OSA are lacking. We wanted to evaluate the effect of vitamin D3 supplementation on OSA symptoms and metabolic parameters. Methods: We conducted a pilot, double-blind, randomized, placebo-controlled trial of daily supplementation with 4,000 IU vitamin D3 (D3) or placebo (PL). We studied 19 Caucasian adults (14 male, mean age 55 y, mean body mass index [BMI] …

Exploring Smoking, Mental Health And Smoking-Related Disease In A Nationally Representative Sample Of Older Adults In Ireland: A Retrospective Secondary Analysis, Annette Burns, Judith Strawbridge, Luke Clancy, Frank Doyle

Articles

Objective

Smoking is the leading preventable cause of death among individuals with mental health difficulties (MHD). The aim of the current study was to determine the impact of smoking on the physical health of older adults with MHD in Ireland and to explore the extent to which smoking mediated or moderated associations between MHD and smoking-related diseases.

Methods

Cross-sectional analysis of a nationally representative sample of 8175 community-dwelling adults aged 50 and over from The Irish Longitudinal Study on Ageing (TILDA) was undertaken. Multivariate adjusted logistic regression models were used to assess the association between MHD, smoking (current/past/never) and smoking-related …

The Death Of The Firm, June Carbone, Nancy Levit Jan 2017

The Death Of The Firm, June Carbone, Nancy Levit

Articles

This Article maintains that the decision in Burwell v. Hobby Lobby, which referred to the corporation as a legal fiction designed to serve the interests of the people behind it, signals the “death of the firm” as a unit of legal analysis in which business entities are treated as more than the sum of their parts and appropriate partners to advance not just commercial, but public ends. The Hobby Lobby reference to the firm as a fiction is a product of a decades-long shift in the treatment of corporations. This shift reflects both an ideological embrace of the free-market-oriented “agency-cost” …

Auditory Fatigue Model Applications To Predict Noise Induced Hearing Loss In Human And Chinchilla, Pengfei Sun, Daniel Fox, Kathleen Campbell, Jun Qin

Articles

Noise induced hearing loss (NIHL) remains a severe health problem worldwide. Current noise metrics and models have assessment limitations on gradually developing NIHL (GDNIHL). In this study, we apply a complex velocity level (CVL) auditory fatigue model to quantitatively assess the impact of basilar membrane (BM) movement on GDNIHL. The transfer functions of chinchilla and human auditory systems, including the triple-path nonlinear (TRNL) filters to simulate the inner ear responses, are applied to obtain BM velocity distribution. Chinchilla and human experimental hearing loss data are used to validate the proposed CVL model’s effectiveness. The results reveal that the developed CVL …

Be An Advocate For Others, Unless You Are A Man: Backlash Against Gender-Atypical Male Job Candidates, Mary Kinahan, Janine Bosak Dec 2016

Be An Advocate For Others, Unless You Are A Man: Backlash Against Gender-Atypical Male Job Candidates, Mary Kinahan, Janine Bosak

Articles

Previous research shows that gender vanguards (individuals who demonstrate gender-atypical skills and behavior) suffer backlash in the form of social and economic penalties (Rudman & Phelan, 2008). This study examined backlash against female and male job applicants who were either gender-atypical or typical. Professionals (N = 149) evaluated female or male managerial applicants for internal promotion described in their performance review as showing either self-advocacy or advocacy on behalf of their team. Atypical, other-advocating men were judged to be low on agency and competence and penalized with job dismissal. Serial mediation analysis demonstrated that, compared with other-advocating women, other-advocating …

Investigating The Impact Of Green Exercise On Population Health And Well-Being In A Small Community In Ireland:A Novel Approach Using A Natural Laboratory Ecosystem., Nollaig O'Sullivan, Aoife Donnelly, Tadhg Macintyre, Giles Warrington Dec 2016

Investigating The Impact Of Green Exercise On Population Health And Well-Being In A Small Community In Ireland:A Novel Approach Using A Natural Laboratory Ecosystem., Nollaig O'Sullivan, Aoife Donnelly, Tadhg Macintyre, Giles Warrington

Articles

Green exercise is defined as undertaking physical activity whilst being directly exposed to nature (Pretty et al., 2005; 2007). Pretty et al. (2003) were among the first wave of researchers to investigate the synergistic benefits of incorporating physical activity and exposure to the natural environment to produce positive psychological affect. Over the past decade, investigations into the possible additive effects on well-being of green exercise and how it can be used as an influential tool to help combat the rising rate of both physical inactivity and non –communicable disease has gained prominence in scientific literature. However, there is still a …

Supervision Of Students In Social Care Education: Practice Teachers' Views Of Their Role, Fiona Mcsweeney Oct 2016

Supervision Of Students In Social Care Education: Practice Teachers' Views Of Their Role, Fiona Mcsweeney

Articles

This paper presents findings from research about how practice

teachers in social care education in Ireland view their role, in

particular what elements they prioritise and what they see as relatively

unimportant. The aim of the research was exploratory, seeking to

discover commonalities and differences in how practice teachers saw

their role in the supervision of social care students. Q methodology

was used to compare the participants’ viewpoints. Twenty practice

teachers, from varying practice backgrounds and levels of experience,

sorted statements outlining aspects of the practice teacher’s role,

during individual interviews. Analysis indicates participants had two

ways of conceptualising the …

Setting The Irish State Table, Elaine Mahon Oct 2016

Setting The Irish State Table, Elaine Mahon

Articles

This year Ireland celebrates the centenary of the Easter rebellion of 1916, the event which is generally regarded as having led to Ireland’s independence six years later. Drawing on Irish government archives, this paper presents the beginnings of Irish state hospitality in the 1920s the emergence of diplomatic dining in the 1930s hosted by the Irish head of state and the first attempts to establish inventories of state owned furniture abroad. The paper then discusses how the Department of External Affairs set out to acquire a dinner service for official entertainment by the Minister of External Affairs as a showcase …

Predicting Altruistic Behavior And Assessing Homophily: Evidence From The Sisterhood, Michael J. Vernarelli Oct 2016

Predicting Altruistic Behavior And Assessing Homophily: Evidence From The Sisterhood, Michael J. Vernarelli

Articles

The persistence of altruism throughout the evolutionary process has been explained by some on the basis of assortation, which requires the ability to detect dispositional altruism in others and voluntary interaction, resulting in altruism homophily. Numerous studies have identified the ability to detect dispositional altruism in strangers, but few have investigated this ability and altruism homophily in social networks. The purpose of this study is to provide additional evidence with regard to the ability to detect dispositional altruism among individuals who have repeated interactions in a collegiate social organization and the extent of altruism homophily. The results indicate that individuals …

A Comparison Of Three Emerging Online Government 3d Printing Resources: Nasa 3d Resources, Smithsonian X3d, And The Nih 3d Print Exchange, Jennifer J. Horton, Jian Anna Xiong

Articles

United States governmental agencies, departments, and affiliates, are increasingly making 3D printable models available to the general public online. On March 20, 2014, a memorandum was sent out to United States executive departments and agencies about improving access to the government’s scientific collections (Holdren, 2014). This memorandum, from the White House Office of Science and Technology Policy (OSTP), not only addressed physical collections, but specifically mentioned digital 3D models. On the White House’s blog, several reasons were given for making these collections more accessible including the idea that these collections are “… treasure troves of information ripe for exploration and …

An Argument Against Civil Marriage, J. David Bleich Oct 2016

An Argument Against Civil Marriage, J. David Bleich

Articles

The article argues against the legal recognition of civil marriage, particularly in the context of same-sex marriage as upheld by the Supreme Court in Obergefell v. Hodges. The author contends that legal recognition of same-sex marriage conflates moral approval with legal neutrality, leading to potential conflicts between individual conscience and state mandates. Drawing on Talmudic principles and historical legal precedents, the article advocates for the abolition of civil marriage and proposes an alternative system of designating "close friends" for legal purposes to avoid such conflicts.

What Remains "Real" About The Law And Literature Movement?: A Global Appraisal, Richard H. Weisberg Oct 2016

What Remains "Real" About The Law And Literature Movement?: A Global Appraisal, Richard H. Weisberg

Articles

The article explores the enduring relevance and global expansion of the Law and Literature movement, emphasizing its unique contribution to legal discourse by analyzing how narratives reveal the operation of law, the interpretations of legal authorities, and the identifiable causes of legal errors. It argues that literary jurisprudence provides a distinct methodology for understanding jurisprudence, challenging traditional legal scholarship and offering insights into systemic injustices and pathways to justice.

What’S Wrong With Sentencing Equality?, Richard A. Bierschbach, Stephanos Bibas Oct 2016

What’S Wrong With Sentencing Equality?, Richard A. Bierschbach, Stephanos Bibas

Articles

Equality in criminal sentencing often translates into equalizing outcomes and stamping out variations, whether race-based, geographic, or random. This approach conflates the concept of equality with one contestable conception focused on outputs and numbers, not inputs and processes. Racial equality is crucial, but a concern with eliminating racism has hypertrophied well beyond race. Equalizing outcomes seems appealing as a neutral way to dodge contentious substantive policy debates about the purposes of punishment. But it actually privileges deterrence and incapacitation over rehabilitation, subjective elements of retribution, and procedural justice, and it provides little normative guidance for punishment. It also has unintended …

Emotional Intelligence And Graduates - Employers' Perspectives, Ailish Jameson, Aiden Carthy, Colm Mcguinness, Fiona Mcsweeney

Articles

Research has demonstrated that employers favour graduates who possess higher levels of emotional intelligence. Many

initiatives to increase students’ levels of EI have involved ‘whole school’ approaches, whereby generic EI skills programmes are

delivered to all students in a third level institute. This paper details an initial survey of employers’ (n = 500) opinions on the

importance and current level of graduates’ social and emotional competencies. The survey was completed across five sectors:

engineering, IT/computing, professional services (including accounting, business, finance, HR, law, retail), science (including

pharmaceutical and life), and social science which are identified growth industries in Ireland. It …
