A Guide To The Estate And Gift Tax Amendments Of 1970, Douglas A. Kahn Jan 1971

A Guide To The Estate And Gift Tax Amendments Of 1970, Douglas A. Kahn

Articles

The Excise, Estate, and Gift Tax Adjustment Act of 1970 [Pub. L. No. 91-614 (Dec. 31, 1970) made a number of amendments to the federal estate and gift tax laws. The estate tax laws were amended to shorten the period of time for filing estate tax returns and for the alternate valuation date and for several related items. In addition, for income tax purposes, the holding period of property that was included in a decedent's gross estate and that was acquired from the decedent was altered; and fiduciaries were granted additional means of obtaining a discharge of their personal liability …

The Area Of Origin And A Columbia River Diversion, Ralph W. Johnson Jan 1971

The Area Of Origin And A Columbia River Diversion, Ralph W. Johnson

Articles

In 1968 Congress declared a ten-year moratorium on any study of diversion of Columbia River water to the Southwest. One of the reasons for the moratorium was to give residents of the Pacific Northwest time to analyze their region's water needs to determine if "surplus" waters are available for export, and to establish, in a broader sense, a regional policy towards diversion proposals.

This article assumes a neutral stance towards the ultimate issue of diversion and attempts only to analyze the problem of protecting the area of origin in the event of a Columbia River to Southwest interbasin water transfer.

The Persistent Problem Of The Persistent Pesticides: A Lesson In Environmental Law, William H. Rodgers, Jr. Apr 1970

The Persistent Problem Of The Persistent Pesticides: A Lesson In Environmental Law, William H. Rodgers, Jr.

Articles

This article will present an interpretation and criticism of the Commission on Pesticides and Their Relationship to Environmental Health's conclusions, with a special emphasis on the treatment and relevance of the DDT issue. Each of the fourteen recommendations will be reviewed where relevant to the four major goals set forth above. The crucial and often decisive role of the law as a lever for reform, as a catalyst for transmitting scientific information to the political decision-maker and as a medium for planning to protect against the effects of pesticides pollution on the environment and the population will be emphasized. Obstacles …

Filling And Building On Small Lakes—Time For Judicial And Legislative Controls, Ralph W. Johnson, G. Richard Morry Mar 1970

Filling And Building On Small Lakes—Time For Judicial And Legislative Controls, Ralph W. Johnson, G. Richard Morry

Articles

During this new decade, Americans will, and indeed must, become increasingly concerned about the preservation of open spaces and the maintenance of a habitable environment. The lack of adequate open space in metropolitan areas is already particularly disturbing. Despite years of planning and zoning, the few remaining open areas in American cities continue to succumb to developmental pressures. In some communities the existence of lakes constitutes an important exception to this history of failure. Lakes are natural open spaces and are more difficult to destroy, br encroach upon, than dry land areas, and, as such, they offer a special dimension …

Representing The Low Income Consumer In Repossessions, Resales And Deficiency Judgment Cases, James J. White Jan 1970

Representing The Low Income Consumer In Repossessions, Resales And Deficiency Judgment Cases, James J. White

Articles

The goal of this article is to lend a helping hand to the debtor's lawyer in his job of defending deficiency judgment suits brought following the repossession and resale of a debtor's encumbered personal property. Although some of the following discussion is relevant to the defense of any creditor's suit, and some applies to representation of the debtor prior to repossession or resale, the focal point of the discussion is the low-income consumer who has lost his automobile, television or some other "hard good" and has become a defendant in a suit brought by his secured creditor for a deficiency …

The Virtues Of Nonsimulation Games, Layman E. Allen, Robert W. Allen, Joan Ross Jan 1970

The Virtues Of Nonsimulation Games, Layman E. Allen, Robert W. Allen, Joan Ross

Articles

The use of games as teaching devices is receiving attention from an increasing number of educators. Data from tests conducted with one such educational game-WFF ’N PROOF strongly indicate that this and similar games are useful, not only in teaching a particular subject (in this case symbolic logic), but also in increasing the general problem-solving ability of the student. WFF ’N PROOF is actually not one game but a series of 21 games of increasing difficulty. The first games in the series are quite simple and can be enjoyed by first graders. The final games are challenging and stimulating even …

A Touchstone For Labor Board Remedies, Theodore J. St. Antoine Jan 1968

A Touchstone For Labor Board Remedies, Theodore J. St. Antoine

Articles

Fashion dictates what lawyers argue about, and law professors write about, more than we may care to admit. In labor law, especially, the styles change with a rapidity that would impress a Paris couturier. During the past decade the spotlight has moved from union democracy to labor contract enforcement to the union organizing campaign. Today the "in" topic is National Labor Relations Board (NLRB) remedies. Yet if any subject deserves immunity from the vagaries of fashion, this is the one; for all rights acquire substance only insofar as they are backed by effective remedies. Coke said it long ago: "[W]ant …

A Language-Normalization Approach To Information Retrieval In Law, Layman E. Allen Jan 1968

A Language-Normalization Approach To Information Retrieval In Law, Layman E. Allen

Articles

An information retrieval system (as distinguished from a document retrieval system) is described for handling statute-oriented legal literature. The Normalized Sentence-Index Matrix (N-SIM) system suggested differs from more traditional retrieval systems for legal literature in three respects: (1) the categories used for classification are normalized versions of sentences from statutes, regulations, treaties, constitutions, case opinions, legal treatises, law review articles, and other documents in legal literature, (2) the classification system is hierarchial and open-ended to evolve with the literature through time, and (3) the organization of the file facilitates some analysis of the literature by computer. A sentence is expressed …

Recreational Rights And Titles To Beds On Western Lakes And Streams, Ralph W. Johnson, Russell A. Austin Jr. Jan 1967

Recreational Rights And Titles To Beds On Western Lakes And Streams, Ralph W. Johnson, Russell A. Austin Jr.

Articles

What rights do riparians, their licensees, and the public have to use the small lakes and streams of the West when the beds are privately owned? This is the question which this Article attempts to answer. However, to do this, an analysis had to be made of which lake and stream beds were privately owned. Thus, the Article covers both the questions of title to beds and rights of surface use. This Article represents the first time that an effort has been made to systematically and comprehensively survey the lake and stream surface use cases of the Western part of …

The Citizen On Trial: The New Confession Rules, Yale Kamisar Jan 1967

The Citizen On Trial: The New Confession Rules, Yale Kamisar

Articles

Commenting on why it has taken the United States so long to apply "the privilege against self-incrimination and the right to counsel to the proceedings in the stationhouse as well as to those in the courtroom" - as the Supreme Court did in Miranda v. Arizona - this author notes that, "To a large extent this is so because here, as elsewhere, there has been a wide gap between the principles to which we aspire and the practices we actually employ."

Evolving Judicial Attitudes Toward Local Government Land Use Control, Terrance Sandalow Jan 1967

Evolving Judicial Attitudes Toward Local Government Land Use Control, Terrance Sandalow

Articles

The year 1967 begins the second half-century of zoning in the United States. The first comprehensive zoning ordinance was adopted by New York City in 1916. In the fifty years that have elapsed, zoning has become, notwithstanding a growing disenchantment with it on the part of planners, the most widely employed technique of land use control in the United States. At the present time only Houston, of all the major cities in the United States, lacks a zoning ordinance. And, though I have not obtained precise figures, we are all familiar with the increasingly large per centage of small municipalities, …
