Open wide the floodgates?

Much of the initial media reaction to the recently released Plaut Report on the refugee status determination process unfortunately has given the impression that the changes proposed will in some sense give rise to "gatecrashing" by persons unwilling to comply with ordinary immigration requirements, thereby jeopardizing the ability of Canada to ensure the integrity of its borders. We are told that the adoption of the study's proposals would "encourage purported refugees to arrive here in numbers that would soon overwhelm [the proposed] procedures" (Globe and Mail editorial, June 20, 1985).

Air Carrier Technique For Row Crop Spraying Applications, Dennis G. Watson, Robert L. Wolff Sep 1985

Air Carrier Technique For Row Crop Spraying Applications, Dennis G. Watson, Robert L. Wolff

Articles

This study focuses on the problem of applying spray material to upper-plant, underside-leaf surfaces of corn and soybean plants. Aircraft and ground pressureatomizer applications of spray solution were quantified. Percent coverage values were generally less than 1 % on the sampling locations. Flat and hollow cone nozzle air carrier units were developed and evaluated for spray application to the upper-plant, bottom leaf surface. The air carrier method tested within a shroud improved spray deposition to the entire plant by 100% for corn and 234% for soybeans. Deposition to the upper-plant, bottom leaf surface was increased by 900% and 400% for …

The 'Legalization' Of The Family: Toward A Policy Of Supportive Neutrality, David L. Chambers Jun 1985

The 'Legalization' Of The Family: Toward A Policy Of Supportive Neutrality, David L. Chambers

Articles

The word "legalization" has conflicting meanings. One, intended to sound the theme of this conference, conveys the notion of government regulation permeating some area of human activity. The other-as found, for example, in the phrase "the legalization of marijuana"-is a near opposite: the process of making legal or permissible that which. was previously forbidden, taking government out of that which it had previously controlled. The recent history of government's relationship to the family amply displays both sorts of legalization, both government's intrusion and its withdrawal, and reveals a paradoxical relation between the two-that as government frees people to live their …

An Analytical View Of Recent Lending Of Credit Decisions In Washington State, Hugh D. Spitzer Jan 1985

An Analytical View Of Recent Lending Of Credit Decisions In Washington State, Hugh D. Spitzer

Articles

Sections 5 and 7 of article VIII of the Washington State Constitution, concerning gifts or loans by the state and by local governments, have been a source of confusion to the courts and frustration to the sponsors of government programs. Although some have proposed a single formula for applying the provisions, attempts to create a single rule or set of coherent rules for interpreting these problematical provisions are apt to fail. The constitutional language is complex, involving numerous elements, each of which must be present for the prohibition to apply. Rather than a single formula governing the application of these …

Unreasonable Searches And Seizures Of Papers, Eric Schnapper Jan 1985

Unreasonable Searches And Seizures Of Papers, Eric Schnapper

Articles

This article argues that the Supreme Court's original view of the history and meaning of the fourth amendment was correct: seizures of papers were condemned in eighteenth-century England without respect to the validity of any underlying warrant, and the search and seizure clause thus embodies requirements independent of the warrant clause.

Part I discusses the eighteenth-century English decisions, including Entick, and concludes that the case law of that era had two separate branches. One branch forbade general warrants and led to the adoption of the warrant clause; the other, exemplified by Entick, prohibited the seizure of certain papers …

Czm In California, Oregon, And Washington, Richard G. Hildreth, Ralph W. Johnson

Twenty years ago coastal zone protection was merely a gleam in the eyes of a few west coast visionaries. A flurry of state and federal laws in the late 1960s and into the 1970s changed this. Today, broad coastal management programs are in place in all three west coast states, with a special one for San Francisco Bay. Each program is unique, and at the same time shares significant qualities with the others. This article identifies the major attributes of these four programs and offers insights into the strengths and weaknesses of each. In comparing and contrasting the four programs, …

The speculations about its potential use, however, are ones that each legal educator will be able to test individually to determine the effectiveness of this use of microcomputers to improve legal education. The computer software that permits the innovation to be used will be available to interested persons by the time that this article is published.
