The Weakness Of Neighborhood Revitalization Planning In The Low-Income Housing Tax Credit Program: Warnings From Connecticut, Noah Kazis, Katherine M. O'Regan
The Weakness Of Neighborhood Revitalization Planning In The Low-Income Housing Tax Credit Program: Warnings From Connecticut, Noah Kazis, Katherine M. O'Regan
Articles
The Low-Income Housing Tax Credit (LIHTC) is the nation's largest program to produce and preserve subsidized housing. To ensure that LIHTC avoids harmfully concentrating poverty, entrenching segregation, or inefficiently deploying resources, federal law requires that states prioritize allocating credits to projects located in high-poverty locations that contribute to a "concerted community revitalization plan" (CCRP). In high-poverty neighborhoods, tax credit developments are meant to facilitate broader neighborhood revitalization, not only to benefit the residents of the housing itself. This paper provides new, empirical support for long-standing concerns that the CCRP process is ineffectively enforced.
Looking at each application for competitive tax …

The Right To Access Information On Land Recovery, Compensation, Assistance, And Resettlement: Case Study, City Of Can Tho, Vietnam, Hien Trung Phan, Hugh D. Spitzer
Articles
Land recovery in Vietnam is the process of compulsory transfer of land use rights from the hands of land users to the hands of the State by way of local government agencies. Land recovery frequently raises issues of compensation, assistance, and resettlement. It is vital for affected land users and the general public to have access to reports on land recovery, compensation, and resettlement. The article describes a limited survey of Vietnamese people whose land was subject to government recovery and evaluates their access to and understanding of information at each stage of the land recovery process. The study revealed …

“Social Workers By Day And Terrorists By Night?” Wounded Healers, Restorative Justice, And Ex-Prisoner Reentry, Allely Albert

Common to many post-conflict societies, former political prisoners and combatants in Northern Ireland are often portrayed as security threats rather than as potential contributors to societal peacebuilding processes. This distrust limits their ability to contribute to the transitional landscape and additionally hinders desistance processes during their reentry from prison. Drawing from the work of Maruna, LeBel, and others on “wounded healers,” this article critically examines the restorative justice work of ex-prisoners who have become involved in leadership roles within community based restorative justice. It is argued that such practitioner work can help former combatants overcome many of the challenges typically …
Silencing Litigation Through Bankruptcy, Pamela Foohey, Christopher K. Odinet
Silencing Litigation Through Bankruptcy, Pamela Foohey, Christopher K. Odinet
Articles
Bankruptcy is being used as a tool for silencing survivors and their families. When faced with claims from multiple plaintiffs related to the same wrongful conduct that can financially or operationally crush the defendant over the long term—a phenomenon we identify as onslaught litigation—defendants harness bankruptcy’s reorganization process to draw together those who allege harm and pressure them into a swift, universal settlement. In doing so, they use the bankruptcy system to deprive survivors of their voice and the public of the truth. This Article identifies this phenomenon and argues that it is time to rein in this destructive use …
Risk-Seeking Governance, Brian J. Broughman, Matthew T. Wansley
Risk-Seeking Governance, Brian J. Broughman, Matthew T. Wansley
Articles
Venture capitalists (“VCs”) are increasingly abandoning their traditional role as monitors of their portfolio companies. They are giving startup founders more equity and control and promising not to replace them with outside executives. At the same time, startups are taking unprecedented risks—defying regulators, scaling in unsustainable ways, and racking up billion-dollar losses. These trends raise doubts about the dominant model of VC behavior, which claims that VCs actively monitor startups to reduce the risk of moral hazard and adverse selection. We propose a new theory in which VCs use their role in corporate governance to persuade risk-averse founders to pursue …
Public Defenders As Gatekeepers Of Freedom, Alma Magaña
Public Defenders As Gatekeepers Of Freedom, Alma Magaña
Articles
Nearly half a million people are currently held in pretrial detention across the United States. Legal scholarship has explored many of the actors and factors contributing to the deprivation of freedom of those presumed innocent. And while the scholarship in these areas is rich, it has primarily focused on certain system actors—including judges, prosecutors, and profit-seeking sheriffs—structural concerns, such as the role race plays in who is being held in pretrial detention, or critiques of the failed promise of algorithms to deliver on bias-free bail determinations. But relatively little scholarship exists about the contributions of public defenders to this deprivation. …
Exit Engineering, Rachel Landy

How do business lawyers create value? For nearly forty years, scholars have conceptualized the business lawyer as a “transaction cost engineer” who helps contracting parties efficiently break negotiation stalemates to create more valuable deals. This theory provides meaningful insights about sophisticated corporate law practice, where outside lawyers parachute in to make one-off deals happen. However, it fails to explain the behavior of startup lawyers, who develop long-term relationships with their clients and counsel them on seemingly routine matters, well before a major transaction materializes. These lawyers are not just transaction cost engineers, they are exit engineers. This Article offers a …

A Case For Humanistic Theory, Salmoli Choudhuri, Moiz Tundawala

This article responds to a debate in Economic & Political Weekly on the state of theory in Indian academia. While earlier interventions focused on the “who” and “how” questions related to the subject and work of theory, a more fundamental question is addressed here: Why theory at all? In our age of permanent crises, the necessity to make a case for theory that can interpret the world rather than change it for the good has arisen due to the dominance of problem-solving and solution-driven approaches adopted by the social sciences.

Partnering For Climate Resilience: Exploring The Maturity Of Private-Sector Efforts In The Great Lakes Region, Lisa Greenwood, Yewande Abraham, Jennifer Schneider, Vicki Lin
Articles
Communities and businesses continue to experience the effects of climate change as global temperatures rise and extreme weather events become more frequent. In the United States (US), the public sector has traditionally been responsible for mitigating these risks; however, engaging the private sector is crucial, given industrial impacts on and vulnerability to climate change. Private-sector mitigation and adaptation efforts are critical in the Great Lakes Region due to aging infrastructure as well as its economic, environmental, and political importance in the US and Canada. This study explores private-sector resilience efforts in three Great Lakes cities to identify opportunities and trends …

The aggregated fuel cost of domestic hot water (DHW) generation in Ireland, in 2022, was €529M with associated emissions/load of 1.3MtCO2/289GWh. The shadow price of carbon monetises the negative impact of emissions, rising with time; DHW generation has an associated shadow carbon cost of €13M in 2022, rising to €42M in 2030 and €335M in 2050.
In 2020, c12%/€441M of wind was curtailed or wasted as inter alia, there was no demand at times of high wind. Meanwhile, a ‘silent crisis’ is occurring in Ireland wherein one-in-two dwellings were considered in fuel poverty in 2022. Households in …

(Un)Orthodox Jewish Women In Latin American Visual Representation, Mirna Vohnsen, Daniela Goldfine
Articles
The 2000s was a breaking point for female Jewish representation in Latin American cinema. Previously represented in stereotypical roles, Jewish women morphed into more rounded characters in the first decade of the 21st century, showing that they had become part and parcel of the social fabric in Latin America. Films such as the Brazilian Olga (Jaime Monjardim, 2004), the Chilean-Mexican El brindis (Shai Agosin, 2007) and the Argentine La cámara oscura/Camera Obscura (María Victoria Menis, 2008), which explore Jewish Latin American culture and identity, testify to the normalization of female Jewish characters. In these films, Jewish Latin American women would …

The Internal Revenue Service (IRS) collects more information on more individuals than any other government agency. The information is not only financial but personal, potentially including information about health care needs and decisions; the caregivers, disabilities, and foreign birth of children; the educational progress and felony convictions of students; and one’s religious and charitable associations. In acknowledging the vast quantity of information held by the IRS, and the necessity of taxpayers trusting tax administrators with their information, Congress provided greater protection for taxpayer information under the Internal Revenue Code (IRC) than it was provided under the Privacy Act. Congress obligated …

Soil microbial ecology in the Irish wetlands is still poorly understood, although it is crucial in introducing effective rewetting schemes to restore and conserve the Irish peatlands. As an initiative, peatlands with distinct land-use types (cutaway, raised semi-degraded, unimproved grassland and grassland) were collected from farms in the midlands to analyse various microbial populations. Peat was homogenized and serially diluted to culture on a range of specific and non-specific culture media. Culture isolation and microbial enumeration were performed. Gram staining and other microscopic observations of morphologically distinct microorganisms were performed, followed by isolation procedures. The numbers of total viable bacteria …
Graph Modeling For Openflow Switch Monitoring, Ali Malik, Ruairí De Fréin
Graph Modeling For Openflow Switch Monitoring, Ali Malik, Ruairí De Fréin
Articles
Network monitoring allows network administrators to facilitate network activities and to resolve issues in a timely fashion. Monitoring techniques in software-defined networks are either (i) active, where probing packets are sent periodically, or (ii) passive, where traffic statistics are collected from the network forwarding elements. The centralized nature of software-defined networking implies the implementation of monitoring techniques imposes additional overhead on the network controller. We propose Graph Modeling for OpenFlow Switch Monitoring (GMSM), which is a lightweight monitoring technique. GMSM constructs a flow-graph overview using two types of asynchronous OpenFlow messages: packet-in and flow-removed, which improve monitoring and decision making. …

Covid-19 Pandemic’S Impact On Online Sex Advertising And Sex Trafficking, Coxen O. Julia, Vanessa Castro, Bridgette Carr, Glen Redin
Articles
Disruptive social events such as the COVID-19 pandemic can have a significant impact on sex trafficking and the working conditions of victims, yet these effects have been little understood. This paper examines the effect of the COVID-19 pandemic on sex trafficking in the United States, based on analysis of over one million sexual service advertisements from the online platform Rubratings.com, using indicators of third-party management as potential proxies for trafficking. Our results show that there have been measurable changes in online commercial sexual service advertising, both with and without third-party management indicators, in the United States, with a significant decrease …

Reaching marginal and other migrant communities to elicit their political views and opinions is a well-known challenge. Social media has enabled a certain amount of online activism and participation, especially in societies with abundant multicultural identities. However, it can be quite challenging to isolate the voice of the migrant in English-speaking countries, especially with an abundance of content in English on social media. In this paper, we pursue a case study of Ireland’s Twitter landscape, specifically migrant and native activists. We present a methodology that can accurately ( >80% ) isolate the Irish migrant voice with as little as 25 …

Technical Report: A Framework For Confusion Mitigation In Task-Oriented Interactions, Na Li, Robert J. Ross
Articles
Confusion is a mental state that can be triggered in task-oriented interactions and which can if left unattended lead to boredom, frustration, or disengagement from the task at hand. Since previous work has demonstrated that confusion can be detected in embodied situated interactions from visual and auditory cues, in this technique report, we propose appropriate interaction structures which should be used to mitigate confusion. We motivate and describe this dialogue mechanism through an information state-style policy with examples, and also outline the approach we are taking to integrate such a meta-conversational goal alongside core task-oriented considerations in modern data driven …

No individual person is likely to be able to satisfy all of our feedback needs. Which is why I tell my students to assemble a “Feedback Board of Directors.” Focus in particular, I tell them, on recruiting people who can collectively provide what Douglas Stone and Sheila Heen of Harvard Law School identify as the three basic forms of feedback in their book “Thanks for the Feedback”:

Locating A Shadowy State In Queer, Feminist Politics, Atreyee Majumder
Articles
In this commentary, part of a book forum on Srila Roy’s (2022) book ”Changing the Subject: Feminist and Queer Politics in Neoliberal India”, I argue that the feminist and queer movement, in response to the neoliberal turn in India, is not totally separate from the Indian state formations. In fact, a shadowy state emerges in the affective life of citizens as an expression of what Timothy Mitchell would have called “state effect”.

The deep sea (below 200 m depth) is the largest carbon sink on Earth. It hosts abundant biodiversity that underpins the carbon cycle and provides provisioning, supporting, regulating and cultural ecosystem services. There is growing attention to climate-regulating ocean ecosystem services from the scientific, business and political sectors. In this essay we synthesize the unique biophysical, socioeconomic and governance characteristics of the deep sea to critically assess opportunities for deep-sea blue carbon to mitigate climate change. Deep-sea blue carbon consists of carbon fluxes and storage including carbon transferred from the atmosphere by the inorganic and organic carbon pumps to deep …

Orla O’Connor is the Director of the “National Women’s Council of Ireland” (NWCI), the leading national women’s membership organisation with over
190 member groups. She has held senior management roles in several non-governmental organisations for over 25 years. Time magazine recognised her as one of the 100 Most Influential People in 2019 for her role as Co-director of “Together for Yes”, the successful national civil society campaign that was influential in Ireland voting overwhelmingly in favour of removing the Eighth Amendment from the Constitution, a landmark referendum, which led to the legalisation of abortion in 2018. In addition to campaigning …

Race Ethics: Colorblind Formalism And Color-Coded Pragmatism In Lawyer Regulation, Anthony V. Alfieri

The recent, high-profile civil and criminal trials held in the aftermath of the George Floyd and Ahmaud Arbery murders, the Kyle Rittenhouse killings, and the Charlottesville "Unite the Right" Rally violence renew debate over race, representation, and ethics in the U.S. civil and criminal justice systems. For civil rights lawyers, prosecutors, and criminal defense attorneys, neither the progress of post-war civil rights movements and criminal justice reform campaigns nor the advance of Critical Race Theory and social movement scholarship have resolved the debate over the use of race in pretrial, trial, and appellate advocacy, and in the lawyering process more …
The Promise And Peril Of Chatgpt In Informal Rulemaking, Stephen Johnson
The Promise And Peril Of Chatgpt In Informal Rulemaking, Stephen Johnson

The dawn of e-rulemaking promised broader public participation, increased government efficiency, and higher quality decisionmaking. Moving notice and comment rulemaking online has increased the number of persons participating in the process for some rules, but not necessarily the quality of the comments they are submitting. In addition, in some cases, the transformation of the process has created new challenges for agencies by making it easier to flood agencies with duplicative and potentially fraudulent comments to which the agencies must respond. Every technological innovation holds promise for improvement of the rulemaking process, though, and artificial intelligence, including ChatGPT, is the latest …

Venture Predation, Matthew T. Wansley, Samuel N. Weinstein

Predatory pricing is a strategy firms use to suppress competition. The predator prices below its own costs to force its rivals out of the market. After they exit, the predator raises its prices to supracompetitive levels and recoups the cost of predation. The Supreme Court has described predatory pricing as “rarely tried” and “rarely successful” and has established a liability standard that is nearly impossible for plaintiffs to satisfy. We argue that one kind of company thinks predatory pricing is worth trying and at least potentially successful—venturebacked startups.
A venture predator is a startup that uses venture finance to price …
Stopping Runs In The Digital Era, Luís C. Calderón Gómez
Stopping Runs In The Digital Era, Luís C. Calderón Gómez
Articles
Bank runs, and the financial crises they catalyze and amplify, are incredibly costly-to individuals, families, society, and the economy writ large. Banking regulation has, for the most part, protected us from traditional bank runs for the last ninety years. However, as we saw in the devastating 2008 financial crisis, bank runs can still occur in lightly regulated or opaque segments of the financial sector.
The recent crypto market downturn dramatically forewarned regulators of the potential and significant risks that novel assets could pose to our financial system's stability. In particular, a novel, systemically important asset (stablecoins) revealed its vulnerability to …

Tax Reporting As Regulation Of Digital Financial Markets, Young Ran (Christine) Kim
Articles
FTX’s recent collapse highlights the overall instability that blockchain assets and digital financial markets face. While the use of blockchain technology and crypto assets is widely prevalent, the associated market is still largely unregulated, and the future of digital asset regulation is also unclear. The lack of clarity and regulation has led to public distrust and has called for more dedicated regulation of digital assets. Among those regulatory efforts, tax policy plays an important role. This Essay introduces comprehensive regulatory frameworks for blockchain-based assets that have been introduced globally and domestically, and it shows that tax reporting is the key …
