Faith In Our Fathers: Can You Believe In Fictional Priests?, Eamon Maher Jun 2015

Faith In Our Fathers: Can You Believe In Fictional Priests?, Eamon Maher

Articles

I was struck recently by an article that appeared in the online section ofthe Irish Times (November 14th. 2015). Written by a priest called Martin Boland, the piece was prompted by the publication of a novel by John Boyne, A History of Loneliness, which has as its main protagonist Fr Odran Yates, who is forced to live in an Ireland where the priest is more likely to be viewed as a paedophile or pariah than as a respected member of society. Clearly a novelist as disaffected as Boyne admits to being with the Catholic Church, would find it hard to …

Finding, Sharing And Risk Of Loss: Of Whales, Bees And Other Valuable Finds In Iceland, Denmark And Norway, William I. Miller, Helle Vogt Jun 2015

Finding, Sharing And Risk Of Loss: Of Whales, Bees And Other Valuable Finds In Iceland, Denmark And Norway, William I. Miller, Helle Vogt

Articles

The focus of the paper is twofold: the first part is about how property rights were assigned and ranked in finds, both in those items such as bees, rings and other valuables which were previously owned, and also in those things, like whales, which were unowned. We focus on Icelandic, Danish and Norwegian laws from the twelfth and thirteenth centuries, yet most of the provisions were copied into later laws and were in force up until modern times, some even current now. The second part treats the question of how risks of loss were handled, and how simple forms of …

The American Jury System: A Synthetic Overview, Richard O. Lempert Jun 2015

The American Jury System: A Synthetic Overview, Richard O. Lempert

Articles

This essay is intended to provide in brief compass a review of much that is known about the American jury system, including the jury’s historical origins, its political role, controversies over its role and structure, its performance, both absolutely and in comparison to judges and mixed tribunals, and proposals for improving the jury system. The essay is informed throughout by 50 years of research on the jury system, beginning with the 1965 publication of Kalven and Zeisel’s seminal book, The American Jury. The political importance of the jury is seen to lie more in the jury’s status as a one …

Work-Life Balance Practices Among Irish Hotel Employees:Implications For Hrm, Kathleen Farrell Jun 2015

Work-Life Balance Practices Among Irish Hotel Employees:Implications For Hrm, Kathleen Farrell

Articles

The aim of this paper is to examine work-life balance in the Irish hotel sector from an employee perspective with implications for HRM. 246 questionnaires from employees were returned which was a 22% response rate. Company benefits were not associated with numerical flexibility, but company benefits were associated with functional flexibility and work-life balance supports. This would suggest an integrated approach to human resource management (HRM), whereby some companies engage in a contemporary employee-focused approach, whereas other companies tend to be more traditional. The study advances the literature on the link between work-life balance programmes and other HRM practices such …

An Evaluation Of The Use Of Problem Based Learning And Film As A Method Of Teaching And Assessment For Social Care Students, Anne Marie Shier, David Williams

Articles

This paper presents the results of a student evaluation of Problem Based Learning (PBL) and film as a pedagogical tool that is used to help students to experience the challenges, advantages and complexities of working in a social care context. Problem Based Learning is combined with the Hollywood film “Precious” which is used as a case study. The “problem” that students are faced with is to prepare a risk assessment and care plan for their client Precious (age 16) and her son Abdul, mirroring the real world experience and challenges of social care work. This has been evaluated by qualitative …

Using Screening And Assessment Evidence Of Trauma In Child Welfare Cases, Frank E. Vandervort May 2015

Using Screening And Assessment Evidence Of Trauma In Child Welfare Cases, Frank E. Vandervort

Articles

If you are a child welfare lawyer representing children, parents, or the child welfare agency, understanding how traumatic experiences may impact your clients will help you frame your advocacy. Understanding children and their parents’ histories of exposure to potentially traumatic life events and how those events have impacted the client’s functioning—in school, in interactions with other people, and as parents—can be critical to framing your approach in the case. Evidence of the client’s trauma history and any compromised functioning that may have resulted from that trauma is critical to integrate into your advocacy.

Against Solitary Confinement: Jonah's Redemption And Our Need For Mercy, Margo Schlanger May 2015

Against Solitary Confinement: Jonah's Redemption And Our Need For Mercy, Margo Schlanger

Articles

Author’s Note: This essay is adapted from one I wrote in September 2013 to give as a d’var Torah for Yom Kippur, and published in Tablet, an online Jewish magazine. Mostly, I’ve added footnotes. As a law professor, I am far more expert at constitutional than biblical exegesis. But perhaps because the Bible and the Constitution share their status as instrumental and highly authoritative documents, my own subjective experience of developing a reading or critique of both has turned out to be remarkably similar. Both exercises require close textual reading and wide-ranging investigation of its extant interpretations; both are informed …

Jewish Games For Learning: Renewing Heritage Traditions In The Digital Age, Owen Gottlieb Apr 2015

Jewish Games For Learning: Renewing Heritage Traditions In The Digital Age, Owen Gottlieb

Articles

Rather than a discontinuity from traditional modes of learning, new explorations of digital and strategic games in Jewish learning are markedly continuous with ancient practices. An explication of the close connections between traditional modes of Jewish learning, interpretive practice, and gaming culture can help to explain how Jews of the Digital Age can adopt and are adapting modern Games for Learning practices for contemporary purposes. The chapter opens by contextualizing a notion of Jewish Games and the field of Games for Learning. Next, the chapter explains the connections between game systems and Jewish traditions. It closes with a case study …

Think Like A Businessperson: Using Business School Cases To Create Strategic Corporate Lawyers., Alicia J. Davis

Articles

For the past twenty-five years, my academic and professional pursuits have straddled the line between business and law. I majored in business administration in college and then worked as an analyst in the Corporate Finance department at a bulge bracket Wall Street firm. After completing a JD/MBA, I returned to investment banking with a focus on middle-market mergers and acquisitions (M&A) and subsequently practiced law with a focus on private equity and M&A. Finally, in 2004, I found my current home as a corporate law professor. In my courses, which include Mergers & Acquisitions, Enterprise Organization, and Investor Protection, I …

Ec – Seal Products: Seals And Sensibilities (Tbt Aspects Of The Panel And Appellate Body Reports), Donald H. Regan

Articles

The EC-Seal Products case stemmed from complaints by Canada and Norway against European Union regulations that effectively banned the importation and marketing of seal products from those countries. The EU said it had responded to European moral outrage at the killing of seals. Canada and Norway challenged the regime under various provisions of the Technical Barriers to Trade (TBT) Agreement and the GATT. This article considers TBT aspects of the Panel and Appellate Body decisions. It discusses issues such as whether there is any bright line to be drawn between legitimate and illegitimate purposes in regulation, the proper legal meaning …

Data Acquisition And Digital Instrumentation Engineering Modelling For Intelligent Learning And Recognition, Jun Qin, Lin Xu

Articles

In data acquisition and digital instrumentation fields, it is essential to understand the learning and recognition to acquire data and information of objects to be studied. In recent years, engineering modelling and simulation contribute greatly to the understanding of intelligent learning and recognition problems. The ability to learn is one of the central features of intelligence, which makes it an important concern for both cognitive psychology and artificial intelligence. In this paper, definitions and modelling aspects of learning are discussed. Fundamentals of learning and recognition and their applications are investigated and described. Illustrations are given to demonstrate the increasing applications …

Dealing With Human Weakness : Shusaku Endo's 'Silence', Eamon Maher Mar 2015

Dealing With Human Weakness : Shusaku Endo's 'Silence', Eamon Maher

Articles

Following on my recent presentation of the Catholic priest in some work by William Trevor, I have decided to follow up with a few articles for Spirituality dealing with what I consider to be some of the more insightful priestly portrayals that I have come across in world literature. For the first example, one must travel a long distance to find an author who has been dubbed the Japanese Graham Greene, Shusaku Endo (1923-1976). The novel we will be concentrating on is the writer's 1966 masterpiece, Silence.

Developing An Elite Formation Index For Comparative Elite Studies: The Schooling Of Irish And Uk Cabinet Ministers, Brendan O'Rourke, John Hogan, Paul Donnelly Feb 2015

Developing An Elite Formation Index For Comparative Elite Studies: The Schooling Of Irish And Uk Cabinet Ministers, Brendan O'Rourke, John Hogan, Paul Donnelly

Articles

Elites and their formation have become a matter of increasing public concern and research interest in recent years. The lessons from such research can be made more generalisable if a measure of elite formation could be developed that is comparable across different elite formation systems, whether they differ by elite, time or country. But, the nature of elite formation renders this a complex task. Nevertheless, in this article, by building upon measures employed in other fields such as industrial economics, indices are constructed that facilitate the comparison of elite formation systems. This is illustrated through a comparison of the schooling …

Experiences Of Computer Science Curriculum Design: A Phenomenological Study, Art Sloan, Brian Bowe

Articles

This paper presents a qualitative study of twelve computer science lecturers’ experiences of curriculum design of several degree programmes during a time of transition from year-long to semesterised courses, due to institutional policy change. The background to the study is outlined, as are the reasons for choosing the research methodology. The main findings are presented and the implications of the study described. The methodology chosen was hermeneutic phenomenology. The data were the texts of interview transcripts of the twelve participant lecturers. The experiences that emerged from analysis of the data grouped naturally in identifiable and presentable themes and these themes …

Social Services Will Not Touch Us With A Barge Pole’: Social Care Provision For Older Prisoners, Kate O'Hara, Katrina Forsyth, Jane Senior, Caroline Stevenson, Adrian Hayes, David Challis, Jenny Shaw

Articles

Older prisoners are the fastest growing subgroup in the English and Welsh prison estate. Older prisoners have high levels of health and social care needs. This mixed method study involved the distribution of a questionnaire examining the availability of health and social care services for older prisoners to all prisons housing adult males in England and Wales, followed by qualitative telephone interviews with representatives from eight prisons. Over half of establishments had some contact with external social care services but reported significant difficulties in arranging care for individuals. A professional lead for older prisoners had been identified in 81% of …

Mobile Technologies And The Incidence Of Cyberbullying In Seven European Countries: Findings From Net Children Go Mobile, Brian O'Neill, Thuy Dinh

Articles

The harmful effects of bullying and harassment on children have long been of concern to parents, educators, and policy makers. The online world presents a new environment in which vulnerable children can be victimized and a space where perpetrators find new ways to perform acts of harassment. While online bullying is often considered to be an extension of persistent offline behavior, according to EU Kids Online (2011), the most common form of bullying is in person, face-to-face. With the rise in use of mobile Internet technologies, this balance is changing. Increased levels of use and more time spent online accessed …

Not Your Mother's Will: Gender, Language, And Wills, Karen J. Sneddon Jan 2015

Not Your Mother's Will: Gender, Language, And Wills, Karen J. Sneddon

Articles

“Boys will be boys, but girls must be young ladies” is an echoing patriarchal refrain from the past. Formal equality has not produced equality in all areas, as demonstrated by the continuing wage gap. Gender bias lingers and can be identified in language. This Article focuses on Wills, one of the oldest forms of legal documents, to explore the intersection of gender and language. With conceptual antecedents in pre-history, written Wills found in Ancient Egyptian tombs embody the core characteristics of modern Wills. The past endows the drafting and implementation of Wills with a wealth of traditions and experiences. The …

Designing Work: A Study Of Collaboration And Concentration In Open-Plan Offices, John Walsh

Articles

This article looks at the design of open-plan offices, particularly in relation to the impact of spatial design on different work-modes. It examines the history of the open-plan office, looking at how the open-plan workplace has evolved. It reports the findings of a survey on office design of 150 office workers across multiple industry sectors, job types and age categories. Finally, assuming there will not be a return en masse to the traditional, space hungry, cellular office for most knowledge workers this article considers what have we learned so far, and how spaces can be designed to support different work-modes, …
